Abstract

Zakat is not merely a category of normative worship but also an aspect of mu’āmalah characterized by its adaptability. This notion is evident in the efforts of the National Zakat Agency (BAZNAS) of Kendal District to modernize zakat law, going far beyond what is stipulated in classical naṣ and fiqh. The modernization of zakat law at BAZNAS Kendal, the main focus of this article, is explored through empirical juridical research using a philosophical re-actualization approach, extensive interpretive analysis, and the theory of maqāṣidi ijtihād. The study finds that modernization is apparent in initiatives to mandate zakat from corporations as zakatable entities, with allocations for distribution in forms such as creative consumptive zakat for installing clean water facilities, creative productive zakat in the form of microfinance, and zakat for community development. Methodologically, Baznas Kendal employs the principles of maqāṣid al-shariֿ’ah, evident in its efforts to link normative zakat teachings (naṣ) with various dynamics of modern life (al-wāqi’) and considerations of social welfare as the essence of shari’a presence. Therefore, this study contributes to the reconstruction of pre-modern zakat law formulations whose conceptualization is no longer visible in the modern era into something more contextually meaningful, and it deepens the understanding of the conceptual framework for the modernization of zakat law that adheres to maqāṣid al-shariֿֿ’ah.

Abstract

Individual/family rights, when not fulfilled, will bring about ongoing threats to life safety. Eliminating wealth/property leads to the pinnacle of poverty, a lack of prosperity, and dependence on others. This study aims to examine the rights of individuals/families regarding the lack of obligation to distribute consumed wealth as a threat to their lives. It also examines the causes of this lack of obligation to distribute consumed wealth. This study relies on a qualitative approach, with the type of field research, by collecting data through in-depth interviews with key informants and conducting observations. Data sources Datuak, Ninik mamak, bundo kandung, Minangkabau indigenous people. Analysis method with qualitative description. The research results show that the lack of utilization in asset distribution indicates the emergence of a form of difficulty in fulfilling individual/family rights to sustainability and survival. There are shortages in education, health, economic capital, and so on. The existence of Rangkiang values is already feared, leading to the building being neglected and left to fall into disrepair, even though the building holds valuable value in the process of sustaining life. This paper concludes that a stable pattern of wealth consumption is associated with a person's fair attitude in balancing individual (self)/family rights and obligations in Hifzul Maal (preservation of wealth). Individual (self)/family rights are threatened when individual/family obligations in the distribution and consumption of wealth are neglected. The lack of sufficient living conditions has led to suffering due to the lack of everything needed to achieve life's activities.

Abstract

This study examines the mechanisms of price determination, profit distribution, and loss management in consignment sales transactions at Ombilin Market, Nagari Simawang. The research aims to analyze how prices are set, how profits are shared, and how losses or unsold consigned goods are handled within consignment-based trading practices at the market. The research adopts a field-based qualitative approach using a descriptive method. Data were collected from both primary and secondary sources. Primary data were obtained through observations and semi-structured interviews with traders and owners of consigned goods at Ombilin Market, while secondary data were gathered from other traders and community members with knowledge of local consignment practices. Snowball sampling was employed to identify relevant informants. Data analysis was conducted by systematically describing the empirical findings and interpreting them using relevant theoretical and legal frameworks. The findings reveal that price determination is carried out through mutual agreements between traders and consigned goods owners, taking into account prevailing market prices, operational costs, and demand conditions. Profit distribution is generally based on prior agreements, whereby traders receive approximately 30–40 percent of the total profit, while the remaining share is allocated to the owners of the consigned goods. In cases of losses arising from unsold goods, several mechanisms are applied, including returning the goods to the owners, renegotiating prices through sales to wholesalers at lower rates, sharing storage-related losses, or purchasing the goods at reduced prices upon mutual consent. When consigned goods are damaged, liability rests with the owner, provided that the trader has fulfilled the obligation to report the damage. From the perspective of Sharia economic law, the implementation of consignment agreements at Ombilin Market is consistent with the principles of wakālah bi al-ujrah. Price determination practices reflect Sharia principles of fairness and economic welfare, profit distribution corresponds to agreed-upon proportions, and loss management aligns with the concept of ḍamān in Islamic economic law.

Abstract

The life of the people of Nagari X submits zakat to create silaturrahmi to all local people in the surau. Malin distributes zakat equally to all those in the muzakki's house. The purpose of this study explains the purpose of zakat to increase silaturrahmi with relatives and neighbors in the vicinity who understand the text of the QS. Al-Taubah verse 60. As well as explaining the understanding of people who have the right to receive zakat. The research method is descriptive qualitative with a phenomenological approach in Nagari X. The data collection technique is by in-depth interviews with the community and local religious leaders. The analysis was carried out descriptively qualitatively. The research findings state that Malin submitted zakat to people who attended the zakat handover meeting. Zakat is divided based on the number of people present at the meeting. The nominal zakat is only for shopping for light things under Rp. 50,000. in field data. The conclusion of this study shows that the distribution of zakat is based on the moment of the social gathering event between the community to strengthen brotherhood, but this does not have an impact on the purpose of zakat in Islamic law, which is to make zakat recipients prosperous and improve their economy. Therefore, the method of zakat distribution in Nagari X is not in accordance with Islamic law regarding the laws of zakat and the purpose of zakat itself.

Abstract

Abstract

Control of the pawned coconut object over the damaged plants around the pawned object. The pawnbroker demands compensation for the damage to his plants around the pawned coconut tree. The purpose of this study is to examine how the control of the parties who carry out plant pawn transactions is exercised and how the legal responsibility is when damage occurs to the plants around the collateral object. This type of research is in the form of field research in the Lima Kaum Batusangkar area of Indonesia. This study is descriptive qualitative with a case study approach. Primary sources from both parties who carry out the coconut tree pawn agreement. Secondary sources from the local community. Data collection techniques through in-depth interviews and observations. Analysis techniques with qualitative descriptive analysis. Findings from the field show that the pawnbroker still has power over the land where the coconut grows and plants young plants in the form of cayenne pepper around the area, while the pawn recipient also has power over the coconut fruit that has been pawned to him. This study concludes that compensation for damaged plants cannot be justified according to Custom, because the cayenne pepper plants prevent the pawn recipient from taking the fruit, in line with the pawn recipient's power, which includes the boundaries of the coconut tree land attached to immovable objects (land). According to Islamic jurisprudence, this is a naqish (limited time) property right, only one of which is owned (material or benefit).

Abstract

There had been a debt guarantee settlement completed in the Minangkabau community. The purpose of this study was to uncover how to understand about the utilization of debt guarantees in ‘Pagang Gadai’ (pawns), as well as the position of plant ownership on land repaid in pawn transactions. The method used was qualitative with a phenomenology approach. The data source of this research was people or communities (including indigenous figures) of Minangkabau customs who were involved in pawns transactions, especially in Nagari Tabek of Pariangan district. The data collection was conducted through in-depth interviews of five research informants based on interview guidance using snowball sampling technique.  The results showed that the use of pawns can be done with several conditions: 1) obtaining permission from the owner where there is no element of exploitation and managed by pawns, and 2) mastery of old plants can be done by the recipient of the pawn after redemption is classified to the exploitation that leads to take the property of others unjustly and blatantly (‘Ghasab’ behaviors).

Abstract

This study aims to conduct an in-depth analysis of the discretion of judges at the Kotobaru Solok Religious Court in determining the amount of alimony for wives and child custody in divorce cases. This study also evaluates the driving and inhibiting factors faced by judges in exercising this discretion, by examining the alignment of their decisions with the principles of Islamic family law. The research method employed was qualitative field research. Primary data sources were obtained through direct interviews with the Panel of Judges, while secondary data were sourced from official divorce case documents at the Kotobaru Solok Religious Court. Data collection techniques included observation, interviews, and documentation, which were then analyzed using domain, taxonomic, and conventional analysis methods, and strengthened by source and time triangulation techniques to ensure data validity. The results indicate that the application of judges' discretion in determining alimony for wives after a divorce is significantly influenced by the dynamics of the parties' social and economic conditions. Judges strive to strike a balance between the husband's financial capabilities and the wife's basic needs, based on the principles of maqasid sharia, particularly in maintaining the safety of life (hifz an-nafs) and protecting property (hifz al-mal). Regarding child custody, judicial discretion is fully oriented toward the best interests of the child to ensure a healthy physical and emotional growth and development environment, in accordance with the principle of hifz an-nasl. Decisions made through this discretion aim to achieve balanced, substantial justice for all parties without disregarding Quranic principles, such as Surah At-Talaq verse 7, which emphasizes providing maintenance according to one's ability. Integrally, the practice of discretion at the Kotobaru Solok Religious Court has proven consistent in protecting the rights of vulnerable wives and children within the framework of Islamic law.

Abstract

This study aims to analyze legal protection for ex-wives due to default on post-divorce maintenance in Solok City using a local wisdom approach. The main issue raised is the weak execution of court decisions regarding iddah, mut'ah, and madliyah maintenance, and how Minangkabau customary mechanisms can address this gap. The research method used was qualitative field research. Data were collected through observation, review of decision documents, and in-depth interviews with ex-wives, Religious Court judges, and traditional leaders such as Ninik Mamak and Bundo Kanduang. The results indicate that the implementation of post-divorce maintenance in Solok City is not optimal. Many ex-wives do not file maintenance claims in order to expedite the divorce process, while existing decisions are often not executed by ex-husbands. Formal legal protection is available through instruments such as withholding of divorce certificates, but local wisdom-based protection through mediation by Ninik Mamak and the role of Bundo Kanduang has not been fully utilized. Key inhibiting factors include the ex-husband's low economic status, lack of legal awareness, and limited asset evidence during court proceedings. Conversely, the strength of formal legal structures and the customary values of "Adat Basandi Syarak, Syarak Basandi Kitabullah" are key supporting factors in strengthening women's rights after divorce in Solok City.
