Abstract

Auction in motorcycle arisan are organized by a business entity without interference from the government with the aim of selling goods, namely motorcycles. Motorcycle arisan adopts an auction system to be used as the determination of the winner of the arisan. This study aims to determine the implementation of auction at motorcycle arisan in terms of the regulation of the minister of finance regarding auction implementation guidelines. The data used was obtained through literature studies related to the issue. This type of research is normative legal research using a legal approach and a conceptual approach. In this study, it can be concluded that the auction carried out at the motorcycle arisan is actually used only for business purposes for the arisan organizers, where the auction team is formed independently by the arisan organizers without an Auction Official. Judging from the purposes of motorcycle arisan which is the sale of motorcycles with an auction system, then it is included in the category of voluntary auctions where the implementation stage is regulated in the ministerial regulation, so that business entities as the organizers of motorcycle arisan with an auction system must carried out auction activities to be adjusted to the voluntary auction procedures that have been regulated in laws and regulations.

Abstract

Rapid technological advances have had a great impact on many aspects of human life, one of which is the economy. Judging from the all-digital era that has spread almost to all corners of the world, in this all-digital era bitcoin has emerged which is used as a digital medium of exchange. Bitcoin is a cryptocurrency that appeared precisely in 2009 by someone under the pseudonym Satoshi Nakamoto. The method used in this study is normative law research, by analyzing library materials and secondary data to collect information about regulations and literature that are considered relevant to the research topic. As a result, there are regulations that regulate the provisions of currency as a legal instrument of payment in Indonesia, namely in Law Number 7 of 2011 concerning the Rupiah Currency, so that only the rupiah currency can be used as a means of payment, due to this legal vacuum raises many question marks regarding the position of the use of the bitcoin currency, considering that this will lead to the aspect of legal protection that will be given to bitcoin users. If at one point there is a loss arising from the use of bitcoin, with the absence of specific regulations that regulate bitcoin, it means that the use of bitcoin cannot be said to be safe considering that its position has not been regulated by the government

Abstract

This study aims to analyse the criminal law regulations regarding the handling of illegal broadcasting actions in paid football shows and to assess the legal status of providers of illegal broadcasting services based on criminal law provisions. The research employs a normative legal method by examining the application of positive legal norms. It consists of normative legal research that utilizes secondary data collection and analysis, as well as empirical legal research that involves obtaining and analysing primary data through interviews with relevant sources. The findings are then analysed qualitatively and systematically organized. The results of the study indicate that (1) the criminal law regulations for addressing illegal broadcasting actions in paid football shows are established in various legislative provisions, including Law No. 28 of 2014 on Copyright, Law No. 19 of 2016 on Amendments to Law No. 11 of 2008 on Information and Electronic Transactions, and the principles found in Law No. 32 of 2002 on Broadcasting. Despite these regulations, numerous violations still occur. (2) The legal status of organizers of illegal broadcasts who engage in watching/providing/distributing illegal broadcasts violates the applicable regulations. This situation arises because subscription fees charged by Mola TV, the license holder, are still considered expensive, even though the public is generally aware of the relevant legal provisions concerning activities related to watching/providing/distributing illegal broadcasts.
