Abstract

ASEAN countries are a melting pot of 617 million people with rich culture and unique skills and can only be found in this part of the world. Over the decades, this region had seen immense transformation due to the economic boom but still retained its historical identity. It is no wonder that one can see a blend of modern sophistication and traditional lifestyle existing side-by-side in ASEAN Countries today. Small Medium Enterprises (SMEs) are integral to the ASEAN Member States' economic development and growth. They vastly outnumber larger enterprises in both the number of establishments and share of the labor force they employ. The result of this hub requires active participation by multiple stakeholders, particularly the entrepreneurs. Therefore, their views are valuable to us and will be taken into consideration. It is hoped that the principles of openness, user-centricity, and stakeholder participation are upheld.

Abstract

The application of telematics applications (telecommunication, media and informatics) is one of the keys to support efforts to increase the competitiveness of the national industry. Currently, telematics is very easily accessible by entrepreneurs to improve their business competitiveness, including Micro, Small and Medium Enterprises (MSMEs). MSMEs use telematics services in the form of social media as a marketing tool to inform and offer products/services to consumers. MSME entrepreneurs choose social media for marketing to consumers online because this media is very easily accessible to both MSME actors and the general public. The purpose of this study is to examine the benefits of social media for MSME entrepreneurs and what are the implications for Law Number 11 of 2008 concerning Information and Electronic Transactions (UUITE). The research method uses a qualitative method, namely a descriptive approach to secondary data derived from literature, research journals, books, and websites that access the latest data information related to the use of social media and descriptive by utilizing secondary data derived from various literatures such as books, journals/articles and homepages to access the latest data and information related to the impact of social media in improving MSME business and its relation to the ITE Law. From the results of this study, it can be concluded that the use of social media is proven to increase sales of MSME products/goods and services and the ITE Law basically provides protection, security and data confidentiality during e-commerce transactions while also emphasizing responsibility to entrepreneurs as a result of event of failure in the function (malfunction) in the e-commerce system.

Abstract

Donation-based crowdfunding is now common in many countries in the world. It has been increasingly important, particularly during Covid-19, and is viewed as one of the strategies for addressing financial challenges in some segments of society. Government and non-governmental organizations. However, the scammer activities via crowdfunding are increasing and Malaysian laws are only regulated the Equity Crowdfunding (ECF) and Peer to Peer Financing (P2P) This paper will focus the discussion of Malaysia's legal framework for crowdfunding. The paper investigates the issues surrounding donation-based crowdfunding in Malaysia. This paper employs qualitative methodology and phenomenology as a case design. Data will be gathered from statues, journals, and other written materials. Thematic and content analysis will be used to analyse the data. This paper discovered that there are issues with donation-based crowdfunding conducted by individuals or non-governmental organizations. This paper concludes thatthere is a pressing need to regulate donation-based crowdfunding in Malaysia in order for it to achieve the donor goals and Maqasid Syariah.

Abstract

Malaysia has a dual financial system that includes both conventional banking and Islamic banking. Over time, Islamic banking has evolved to the point where it has enticed traditional banks to offer Shariah-compliant products as well. However, even though conventional banks have provided Shariah-compliant products, the Islamic bank's obligation to provide Islamic banking services remains. The goal of this article is to look at the measures in the Islamic Financial Services Act 2013 that assure Shariah-compliance security for Islamic banks. This paper also investigates the current approach of civil courts in resolving disputes. The qualitative research methodology was used in this paper. The phenomenology method was used in the research design. Data will be gathered from journals, statutes, and case law. The data will be analyzed using the content analysis method. This paper concludes that it is a heavy-duty of every Islamic bank to ensure Shariah compliance security, and the current civil court approach is that the Islamic banking agreement is still enforceable even if it does not comply with Shariah law. Islamic banking agreements that are in accordance with Shariah law or are not perfectly in accordance with Shariah law are both valid and legal

Abstract

This study analyzed a reflection on a bibliometric approach to evaluate the importance and impact of the manuscripts that have been published with the title “Law of Maritime Transportation” during the period 1998-2024. It also reveals that the area of Law of maritime documents has received increased attention and interest from academicians, researchers, and research funding institutions. The paper aims to provide a wide range of maritime fields and to offer a representation of various areas and interdisciplinarity research. Furthermore, to find out how they are connected. Bibliometric analyses were used in this study to examine dominant subfields of maritime Law, mapping and clustering the keyword. The tool provided the authors' data, year of publication, country of origin, Journal of publication, and affiliated institutions. The findings show that the manuscripts regarding the legal framework of maritime transportation documents are divided into 6 clusters. The most prominent focus is the Law of the Sea, International Law, and Law of Legislation. The legal framework was an umbrella that covered shipping, maritime transportation, documentary framework, maritime policy, and sustainable development.
