Abstract

Adapun tujuan dalam penelitian ini yaitu untuk mengetahui peran Dewan Pengupahan Nasional (Depenas) pasca berlakunya UU No. 6 Tahun 2023. Metode penelitian ini bersifat yuridis normatif karena penelitian ingin mempelajari ius constitutum diranah ketenagakerjaan Indonesia. Selain itu, penelitian menggunakan pendekatan yuridis empiris berdasarkan UU No. 6 Tahun 2023. Menurut penelitian, Depenas diberi wewenang baru dalam PP No. 51 Tahun 2023 untuk menentukan upah minimum dan skala upah di tingkat provinsi, kabupaten, dan kota. Menurut analisis penelitian, Depenas tidak mempunyai wewenang untuk menentukan nilai alfa untuk setiap daerah karena nilai alfa telah ditetapkan oleh pemerintah pusat pada skala 0,10–0,30 dan menurut penelitian ini sudah tidak berlandaskan pada asas keadilan hukum dan membuat suatu konflik di masyarakat khususnya bagi pekerja/buruh. Dalam PP No. 51 Tahun 2023, Depenas diberi wewenang baru untuk menentukan upah minimum dan skala upah di tingkat perusahaan provinsi, kabupaten, dan kota serta pemerintah membuat kebijakan untuk menciptakan wilayah baru melalui pemekaran, yang mencakup pembentukan Ibu Kota Nusantara (IKN). Untuk memenuhi kebutuhan wilayah yang belum menetapkan upah minimum dan yang belum memilikinya, pemerintah membuat peraturan perundang-undangan yang berfungsi sebagai dasar untuk perhitungan, penetapan, dan penerapan upah minimum.

Abstract

Pelaksanaan eksekusi jaminan fidusia yang dilakukan kreditur melalui jasa debt collector kadangkala menimbulkan masalah baru antara kreditur dengan debitur. Maka kepolisian memberikan solusi berupa pengamanan eksekusi jaminan fidusia, karena Kepolisian Negara Republik Indonesia merupakan alat negara yang bertugas dan berfungsi untuk memelihara keamanan dan ketertiban masyarakat, penegakan hukum, perlindungan, pengayoman, dan pelayanan kepada masyarakat. Tujuan dari penelitian ini adalah untuk mengetahui bagaimana upaya kepolisian dalam mengamankan pelaksanaan jaminan fidusia berdasarkan peraturan kepala Kepolisian Republik Indonesia Nomor 8 Tahun 2011 tentang Pengamanan Eksekusi Fidusia. Metode penelitian yang digunakan adalah metode penelitian kualitatif dengan pendekatan yuridis normatif dan menggunakan analisis data metode serta penalaran hukum. Hasil penelitian ini menunjukkan bahwa upaya kepolisian terhadap pengamanan eksekusi jaminan fidusia pada dasarnya dilakukan pada saat pengambilan benda objek jaminan fidusia dari pemberi fidusia yang telah lalai dan tidak mau menyerahkan benda secara sukarela.

Abstract

The legal culture of society in Indonesia assumes that providing sanctions or punishment for perpetrators of crimes until they are sent to detention is the easiest method and provides satisfaction for the victim. Crime itself is a social control institution that is linked to and always reflects the values and structure of society, so that it is a symbolic reaffirmation of violations of the collective conscience. In the view of researchers, restorative justice and human rights are one unit because it is law that embodies human rights values. We must ensure that the orientation regarding corrections must of course be in line with the conceptual change in the goals of corrections from the concept of retribution towards the concept of rehabilitation.

Abstract

Billboards are promotional media designed to introduce or market goods, services, or individuals to the wider public. In Karawang Regency, the number of billboard installations increases annually in line with regional development, yet this growth is not accompanied by adequate supervision and law enforcement. Irregularities in billboard placement potentially disrupt urban aesthetics and violate existing regulations. The Karawang Regency Government regulates this matter through Regent Regulation Number 308 of 2023 as an implementation of Regional Regulation Number 3 of 2019 on Billboard Licensing. This study aims to identify the causes of weak law enforcement and the obstacles faced in billboard supervision. The research applies a socio-legal approach by examining the normative provisions in Regent Regulation Number 308 of 2023 and analyzing their implementation in practice. The findings indicate a lack of inter-agency coordination and limited socialization to the public and business actors. Therefore, strengthening inter-agency synergy, budget allocation, and legal education for the community is required to achieve orderly and compliant billboard management.

Abstract

Cosmetics are used primarily for women for various purposes such as to make an attractive appearance. One of them is the HN Cream product, which is still a serious problem, which includes products that are not as safe as consumer expectations. As a result of using these products, it causes financial losses and also skin diseases including skin peeling, acne breakouts, and others. This is not in accordance with Law no. 8 of 1999 regarding Consumer Protection. The main problem that the author raises in this study is how the process of applying legal protection to consumers of facial whitening cosmetics Cream HN in online buying and selling transactions according to Law no. 8 of 1999 concerning Consumer Protection and how are the factors inhibiting the implementation of consumer protection for Cream HN cosmetics in online buying and selling transactions. His method applies an empirical juridical approach, and is carried out directly to the place that is the object of his research. Researchers also obtained data through the interview process. His research was obtained from the results of selling Cream HN online. The approach uses a primary approach, which is in the form of data obtained from field studies. The result is that to provide legal protection guarantees regarding consumers, business actors when selling online must be based on Law no. 8 of 1999 regarding consumer protection.

Abstract

Capital punishment is a compelling and expansive type of discipline, and the discussion about the upsides and downsides of the death penalty go on today. The question of whether the death penalty should be retained in the Criminal Code or abolished in the justice system is inseparable from Indonesia's reform of criminal law, particularly through the creation of the Criminal Code. Despite the fact that its nature differs from that outlined in the Criminal Code, Indonesia will continue to use the death penalty, as evidenced by the Criminal Code Bill, which contains the death penalty. The purpose of this research is to identify the current legal formulation of death penalty policies in Indonesian criminal law and to examine the desired future legal formulation of death penalty policies in Indonesia. This study utilizes a subjective technique with a legitimate and administrative methodology as well as unmistakable scientific exploration details. According to the findings of this study, the death penalty is still regulated by Indonesian law as the primary form of punishment, resulting in disagreements between pro- and anti-death penalty groups. In the new version of Indonesian criminal law, change in death penalty policy, originally a principal punishment to become an alternative punishment . In the future, the death penalty will be a tangible expression of human rights that is in line with national and international perspectives.

Abstract

The motivation behind this composing is to specify the execution of Article 64 of Unofficial law (PP) Number 35 of 2021 Concerning Explicit Time Work Arrangements, Reevaluating, Working Time/Hours and Rest, and End of Business, as well as methodology for execution in light of Unofficial law 35 of 2021 concerning Time Arrangements. Explicitly re-appropriating, working time/hours and rest periods, as well as end of business connected with Unofficial law in Lieu of Regulation (Perppu) Number 2 of 2022 concerning Position Creation. In this review, the creators utilize a standardizing juridical methodology as a technique for approach. The end is that Administration Guideline (PP) Number 35 of 2021 concerning Work Arrangements for Explicit Periods, Re-appropriating, Working Hours and Breaks, and End of Business, which corrects Regulation Number 13 of 2003 concerning Labor makes regulations for laborers. The legitimate outcome is that the temporary guidelines are not directed, which makes managers randomly utilize laborers with PKWT status for over 5 years with no juridical results.

Abstract

Overclaim occurs when business actors convey excessive or factual information in product promotions, thus misleading consumers and violating the principles of transparency and honesty in trade. In the skincare industry on e-commerce platforms, this practice is increasingly widespread along with high market competition. Consumers are often disadvantaged because they do not have adequate ability to verify the truth of product claims. This study aims to examine the form of legal protection provided to consumers, as well as to examine the responsibilities of business actors based on the provisions of Law Number 8 of 1999 concerning Consumer Protection. The method used is qualitative with a normative legal approach, which focuses on literature studies and analysis of relevant laws and regulations. The findings in this study indicate the need to strengthen the legal protection system, both preventively through advertising monitoring mechanisms, and repressively through the application of strict legal sanctions. The active involvement of e-commerce platforms is also key to creating effective consumer protection in the digital space.

Abstract

On the basis of Pancasila's mandate and the 1945 Constitution, numerous economic activities were carried out during the period of national economic development to achieve a just and prosperous society. Leasing is one type of business activity that can be carried out in the financial and non-financial sectors to help the economy grow. A lease is an agreement between the lessor and the lessee to rent a particular kind of capital goods that the lessee chooses. In point of fact, numerous breakthroughs are regarded as in violation of the leasing party's agreements. Where this is known as over credit (obligation move) under the hands or without the information on the important gatherings, in particular renting. The issue lies in the connection between Law Number 42 of 1999 concerning Fiduciary Guarantees and the implementation of over credit (debt transfer) in car leasing agreements as well as the factors that prevent it. The exploration technique utilizes an observational juridical methodology, as per the creators, as the creators make sense of that the presence of these occasions requires a comprehension for the general population about the lawful component of over credit (move of obligation) in credit, particularly for vehicle vehicles. Based on these issues, scientists need to thoroughly analyze the component of over credit (obligation move) in renting (renting) related with Regulation Number 42 of 1999 concerning Trustee Assurances.

Abstract

Bankruptcy results in a general confiscation of all assets of the bankrupt debtor (budel bankrulit). An important phase in the bankruptcy process is the insolvency stage. Based on the explanation of Article 57 paragraph 1 of the Bankruptcy Law and PKPU, what is meant by insolvency is the state of inability to pay, this is in line with the Central Jakarta Commercial Court Decision Number: 44 / PDT. SUS. PAILIT/20 20/PN. TRADE. JKT. PST. That PT. Pazia Retailindo was declared bankrupt. Application for bankruptcy filed by PT. Dana Kaya through its Directors, namely Sri Dewi Endang Mumpuni and Ambar Bawono on October 20, 2020, was represented by the appointed legal representative, namely PARLIN SIHOMBING, S.E., S.IP., S.H. Advocate at the Law Firm BELASSANDRO TORUAN &; PARTNERS. The problem raised in this study is the condition of Insolvency of PT. Pazia Retailindo before the bankruptcy decision , and what underlies the judge's consideration in the bankruptcy decision Number: 44 / Pdt.Sus.Pailit / 20 20 / Pn.Niaga.Jkt.Pst which refers to Law Number 37 of 2004. This research uses a Normative Juridical approach. The result of this study is that the legal considerations used by the panel of judges in deciding the bankruptcy case of PT. Pazia Retailindo complies with Law Number 37 of 2004 concerning Bankruptcy and PKPU, namely the fulfillment of all elements contained in Article 2 Paragraph 1 and Article 8 Paragraph 4 of the Bankruptcy Law and PKPU.
