Abstract

Guardianship in the marriage contract is one of the key elements in Islamic marriage law and serves as a main differentiator between the views of various scholarly schools of thought (madhhabs). The presence of a guardian (wali) is seen as a form of protection for women in a sacred contract that has significant implications for marital life. This article examines the views of the four major Islamic legal schools—Hanafi, Maliki, Shafi’i, and Hanbali—on the legal status of the wali in marriage, including the form and conditions of guardianship, as well as the legal consequences if a marriage contract is conducted without a wali. Using a literature review methodology on classical and contemporary texts, this study finds a significant difference between the Hanafi madhhab, which allows adult women to marry without a wali, and the other madhhabs, which require the presence of a wali for the validity of the marriage contract. These differences arise not only from divergent legal reasoning but also from differing views on women's autonomy and the concept of protection in Islamic law. This study highlights the importance of understanding madhhab differences as a rich source of Islamic legal heritage, as well as the urgency of ijtihad in responding to contemporary social and legal needs.

Abstract

This study aims to examine the axiology of the Independent Curriculum as an orientation for the development of Islamic Religious Education (PAI) at MAN 2 Kota Bima. The Independent Curriculum offers a flexible learning approach that focuses on strengthening character, so it has great potential in strengthening the relevance of Islamic religious education in madrasahs. With a qualitative approach and case study design, this study involved the head of the madrasah, PAI teachers, and students as participants. Data collection techniques were carried out through in-depth interviews, participatory observation, and documentation. The results of the study indicate that the implementation of the Independent Curriculum at MAN 2 Kota Bima contributed significantly to the formation of student character through the integration of spiritual, moral, and social values ​​in PAI learning. From an axiological perspective, the values ​​of honesty, discipline, and tolerance are important foundations that are instilled contextually. However, challenges remain, such as limited human resources, lack of intensive training for teachers, and the need to adapt to changes in the learning paradigm. These findings emphasize the importance of strengthening the capacity of educators and systemic support so that the Independent Curriculum truly functions as a vehicle for fostering students' religious and social character holistically. This research is expected to provide academic and practical contributions in the development of a more transformative Islamic religious education curriculum in various madrasas in Indonesia.

Abstract

The Massuro Baca tradition is one of the cultural practices of the Makassar Bugis community which is still preserved to this day and has a close relationship with Islamic values. This study aims to analyze the values of Islamic education contained in the Massuro Baca tradition in the Tamarambu Environment, Bontoa Village, Mandai District, Maros Regency. This research uses a descriptive qualitative approach with field research methods. Data collection was carried out through observation, in-depth interviews, and document analysis. Data analysis was carried out through the stages of data reduction, data presentation, and conclusion drawn, and its validity was tested through triangulation techniques. The results of the study show that the Massuro Baca tradition contains Islamic educational values which include the values of faith, worship, and morals. These values are reflected in the practice of prayer, tawassul, almsgiving, gratitude, sima'an Al-Qur'an, friendship, and helping. These findings confirm that the Massuro Baca tradition functions as a non-formal Islamic educational medium that plays a role in shaping religious character, strengthening social solidarity, and maintaining harmony between Islamic teachings and local wisdom of the community.
