Abstract

ABSTRAK Mengembangkan hukum yang hidup di dalam masyarakat Indonesia (hukum adat), sesunguhnya merupakan keniscayaan, karena hukum adat yang dimiliki bangsa Indonesia sejatinya adalah nilai-nilai yang berasal dari masyarakat Indonesia itu sendiri. Secara khusus tentang hukum pidana adat, memiliki prinsip yang sama. Hukum pidana adat di Indonesia menganut doktrin bahwa tindak pidana adat merupakan hal yang dapat menganggu keseimbangan masyarakat adat, dan terhadap tindakan atau perbuatan delik yang mengganggu keseimbangan masyarakat adat sanksi yang diberikan pada umumnya dilakukan oleh para petugas adat. Akan tetapi hingga saat ini belum ada penerapan secara nyata dalam penegakan hukum di Indonesia. Dengan metode normatif meliputi aturan dan doktrin-doktrin tentang penerapan hukum pidana adat di Indonesia, dapat disimpulkan bahwa memikirkan kembali kebijakan penangulangan kejahatan dengan hukum pidana, berarti dapat diartikan sebagai upaya untuk melakukan perbaikan terhadap kebijakan hukum pidana yang berlaku saat ini. Bila dikaitkan dengan pernyataan bahwa hukum pidana warisan kolonial merupakan sesuatu yang tidak berakar pada nilai-nilai moral dan budaya Indonesia, maka perbaikan/pembaharuan yang perlu dilakukan terhadap kebijakan hukum pidana Indonesia saat ini adalah dengan memperhatikan dan memasukkan unsur-unsur nilai-nilai moral dan budaya Indonesia, sehingga mengembangkan hukum pidana adat Indonesia merupakan langkah nyata menghargai nilai-nilai bangsa Indonesia, dengan tetap memperhatikan perkembangan global. Kata kunci: adat; hukum; pengakuan; pidana.  ABSTRACT Developing a law that lives in Indonesian society (adat law), actually is a necessity, because the adat law owned by the Indonesian nation is actually values originating from the Indonesian community itself. Specifically about criminal adat law, has the same principle, which lives and develops from the identity of the Indonesian nation itself. Criminal adat law in Indonesia adheres to the doctrine that customary crimes are things that can disrupt the balance of indigenous peoples, and against delict actions or actions that disrupt the balance of indigenous peoples sanctions are generally carried out by customary officers. However, until now there has been no real implementation in law enforcement in Indonesia. This study uses normative methods and the results is rethinking crime prevention policies with criminal law, means that it can be interpreted as an effort to make improvements to current criminal law policies. If it is associated with the statement that the colonial law is an inheritance that is not rooted in the moral values and culture of Indonesia, then the improvement/renewal that needs to be done towards the current Indonesian criminal law policy is to pay attention to and incorporate elements of moral values and Indonesian culture, so that developing Indonesia's  criminal adat law is a real step to respect the values of the Indonesian people, while still paying attention to global developments.Keywords: adat; criminal; law; recognition.

Abstract

The death penalty in Indonesia is still maintained to combat crime within the Indonesian criminal law reform. Although many states have it removed, Indonesia would have the sole discretion to keep it. Despite the opposition, the death penalty application still has a juridical and sociological basis, so it is still legal to be maintained. Indonesia itself has overshadowed the death penalty with a form of legality according to international law so that the position of Indonesia that still maintain the death penalty cannot be blamed. Moreover, sociologically, Indonesian people still accept those who commit an offence who may have profound implications that could lead to the death penalty. This issue is what became the basis for lawmakers in Indonesia to keep it. This research uses the doctrinal method toexamine various regulations regarding capital punishment and non-doctrinal to understand the community's situation related to the existence of capital punishment in Indonesia. The death penalty is a more effective deterrent and therefore prevents crime better. With the death penalty, others were about to commit a similar crime is expected not to commit the crime. The death penalty is more effectively immobilizing offenders. Perpetrators, in principle, still manage to have the desire to commit the crime again after release. The death penalty for perpetrators of crimes is not a violation of human rights, but rather to respect human rights itself, namely for victims of crime. The setting and the application of the death penalty in Indonesia until now is still needed. They are considering that there are still many crimes that undermine humanity's values or the crimes that harm the State and crackdown on corruption in society.

Abstract

Omnibus law is a law in which it discusses and contains more than one discussion theme or topic. The omnibus law became the attention of the Indonesian people after the enactment of Law no. 11 of 2020 concerning Job Creation. Even before the law was passed, it had been rejected by the community. This is because people think the law will harm the small people, one of which is PKWT employees and will actually benefit the elite. Then what is the actual status of the omnibus law in Indonesia, considering that the technique has not been regulated in Law no. 12 of 2011 concerning the Establishment of Legislation which was changed to Law no. 15 of 2019. And what is the status of PKWT after the omnibus law regarding the work copyright law. In this study, the author uses a normative juridical research method. The results obtained in this study can be concluded that the application of omnibus law in Indonesia may be applied, but it would be better if before the enactment of the omnibus law, the legal basis was first made, considering that our country is a state of law. The omnibus law is also not the only way out in solving regulatory problems in Indonesia. This is because Indonesia's problems are not only about overlapping regulations, but there are many things that are not sufficiently resolved through the omnibus law. Then regarding PKWT there are five important points that must be considered with the existence of the Job Creation Act, namely the employee's tenure, contract extension, probationary period, compensation money and the form of a written agreement.

Abstract

Akan tetapi hingga saat ini belum ada penerapan secara nyata dalam penegakan hukum di Indonesia. Dengan metode normatif meliputi aturan dan doktrin-doktrin tentang penerapan hukum pidana adat di Indonesia, dapat disimpulkan bahwa memikirkan kembali kebijakan penangulangan kejahatan dengan hukum pidana, berarti dapat diartikan sebagai upaya untuk melakukan perbaikan terhadap kebijakan hukum pidana yang berlaku saat ini. Bila dikaitkan dengan pernyataan bahwa hukum pidana warisan kolonial merupakan sesuatu yang tidak berakar pada nilai -nilai moral dan budaya Indonesia, maka perbaikan/pembaharuan yang perlu dilakukan terhadap kebijakan hukum pidana Indonesia saat ini adalah dengan memperhatikan dan memasukkan unsur -unsur nilai -nilai moral dan budaya Indonesia, sehingga mengembangkan hukum pidana adat Indonesia merupakan langkah nyata menghargai nilai-nilai bangsa Indonesia, dengan tetap memperhatikan perkembangan global . Abstract

ABSTRAKKerusakan hutan mengalami peningkatan luas kerusakan setiap tahun di Indonesia. Setidaknya, sekitar 857.756 hektare. Terdiri dari 630.451 hektar lahan mineral dan 227.304 hektar lahan gambut. Angka ini meningkat 160% dibandingkan sebelumnya yang luasnya sekitar 328.724 hektar. Situasi ini akan berdampak pada lingkungan secara keseluruhan, termasuk perubahan iklim pada kenaikan suhu udara. Pemerintah sudah banyak mengkampanyekan larangan kebakaran hutan dan illegal logging, namun kebakaran hutan dan illegal logging masih saja terjadi, sehingga perlu mengintensifkan instrumen lain. Yakni dengan memanfaatkan peran masyarakat adat, mereka memiliki banyak kebijakan lokal yang dapat dimunculkan dan dijadikan salah satu kebijakan nasional dalam rangka pencegahan terjadinya tindak pidana pembakaran hutan dan illegal logging. Metode penulisan makalah ini adalah penelitian non doktrinal, dengan wawancara mendalam kepada tokoh masyarakat adat, kemudian hasil wawanca-ra mendalam dianalisis untuk dijadikan rekomendasi temuan penelitian. Hasilnya adalah model penegakan hukum di masyarakat adat, dalam praktiknya sejalan dengan konsep hukum pidana administrasi. Konsep hukum ini menekankan pada prinsip penegakan hukum yang tidak berorientasi pidana sebagai pilihan utama. Masyarakat adat mengutamakan upaya pencegahan berupa larangan perusakan hutan, kemudian pembatasan mengambil kayu hutan, dan kewajiban menanam kembali pohon.Kata kunci: perusakan hutan; masyarakat adat; lampung; penebangan liar. ABSTRACT The area of Forest damage has increased every year in Indonesia. At least, about 857,756 hectares. It consists of 630,451 hectares of mineral land and 227,304 hectares of peat land. This figure is an increase of 160% compared to the previous area of about 328,724 hectares. This situation will have an impact on the environment, including climate change and the increase in air temperature. The government has made many campaigns for the prohibition of forest fires and illegal logging, but forest fires and illegal logging still occur, need to intensify other instruments, by taking advantage of the role of indigenous peoples, they have many local policies that can be brought up and used as one of the national policies in the context of preventing the occurrence of criminal acts of forest burning and illegal logging. The problem is what is the role of indigenous peoples in preventing forest fires and illegal logging? The method of writing this paper is non-doctrinal research, with in-depth interviews with indigenous community leaders, then the results of in-depth interviews are analyzed to be used as recommendations for research findings.The result is a model of law enforcement in indigenous people, which in practice is in line with the concept of administrative criminal law. This legal concept emphasizes the principle of law enforcement that is not criminally oriented as the main choice. Indigenous people prioritize prevention of forest destruction, then restrictions on taking forest wood, and the obligation to replant trees. Keywords forest destruction; traditional community; lampung; illegal logging.

Abstract

Criminal acts committed by children should be placed in LPKA as referred to in the law on juvenile justice, however the judge in this decision prefers to place the child in the development of a boarding school, of course in this case the judge has his own considerations. This paper will examine the basic legal considerations of judges in imposing criminal guidance on children who are criminal offenders of theft with weighting, the suitability of decision Number: 8/Pid.Sus-Anak/2016/PN.Kot with the demands of the Public Prosecutor, and the mechanism for implementing the verdict. Number: 8/Pid.Sus-Anak/2016/PN.Kot. The research method used in this research uses a normative approach, namely normative research which is carried out by examining the laws and basic theories. As for the results of the research, it was found that the basis for judges' legal considerations in making decisions against children, that in the trial the judge saw the two children who committed the crime not because of the crime factor but because the dominant factor of juvenile delinquency and also the two children could still be mentally corrected by giving opportunity for both children will certainly provide protection for their rights. The judge's decision was not in accordance with the prosecutor's demands where there were differences, namely: first, the judge did not agree with the method of imposing penalties that put children in LPKA; second, the judge's freedom to impose sanctions is also a factor in the incompatibility between the prosecutor's demands and the judge's decision; third, the impact of the harm caused by the two children was not too big. The mechanism for implementing the Decision Number:8/Pid.Sus-Anak/2016/Pn.Kot where the judge handed down the punishment of coaching in the institution to the two defendants in the form of an obligation to participate in a coaching program at the Islamic Boarding School, so that the guidance method followed the guidance method in the pesantren. Based on the results of the research conducted, it is recommended that the Public Prosecutor pay more attention to aspects of benefit in imposing criminal sanctions on children. In addition, the judge's future considerations should reflect justice and progressive steps.

Abstract

Dalam perkembangannya, penegakan hukum pidana telah banyak mengalami perubahan-perubahan yang signifikan.  Untuk memenuhi kebutuhan perkembangan tersebut, dalam rancangan perubahan KUHP (konsep KUHP baru) banyak hal yang mengalami perubahan, penambahan ataupun juga aturan berupa pengakuan yang mengembalikan hukum pada jati dirinya, yakni tertulis dan tidak tertulis. Salah satu bentuk pembaharuan yang ada dalam konsep KUHP baru adalah pengaturan tentang mediasi pidana, yang merupakan bentuk dari penyelesaian sengketa pidana di luar proses formal seperti yang biasa dilakukan. Penyelesaian sengketa diluar proses tentunya akan membuka ruang bagi hidupnya nilai-nilai yang ada dalam masyarakat Permasalahannya adalah belum ada pengaturan bagi mediasi dalam bidang hukum pidana di dalam hukum positif di Indonesia saat ini. Kemudian sejauh mana peluang dapat terimplementasikannya mediasi dalam bidang hukum pidana ini  di dalam masyarakat Indonesia. Mengingat di Indonesia berkembang nilai-nilai yang hidup dan menjadi acuan bagi masyarakat dalam menyelesaikan  persoalan yang dihadapinya, maka dalam Rancangan KUHP baru Indonesia sudah dimasukan untuk dijadikan hukum positif, aturan mengenai penyelesaian sengketa di luar proses. Tentunya dengan berkembangnya nilai-nilai yang hidup di masyarakat Indonesia, maka sudah barang tentu mediasi pidana merupakan  salah satu alternatif yang dapat berkembang dengan baik, karena sejalan dengan appa yang diinginkan oleh masyarakat.

Abstract

Illegal levies are the designation of all forms of levies that are unofficial, which have no legal basis, so the act of levies is referred to as illegal levies. One of the criminal acts of corruption that occurs in people's lives is illegal fees. An example of a criminal case of illegal fees is the case in Decision Number: 46/Pid.Sus-TPK/2018/PN.Tjk in that case the defendant  was acquitted. Judging from the judge's decision that acquitted the defendant, the authors conducted research on the identification of illegal fees as a criminal act of corruption and what was the basis for the considerations of the Panel of Judges in passing an acquittal in cases of criminal acts of corruption based on Decision Number: 46/Pid.Sus-TPK/2018/ PN. Tjk. The problem with this research is the identification of extortion as a criminal act of corruption. and what are the basic considerations of the Panel of Judges in passing an acquittal in a corruption case based on Decision Number: 46/ Pid.Sus -TPK/2018/PN. Tjk The research method used is normative juridical research method, sources of primary and secondary legal materials. From this study it can be concluded that illegal fees can be categorized as a criminal act of corruption, this action is regulated in Article 12 letter e of Law Number 31 of 1999 which has been amended and added to Law Number 20 of 2001 concerning Eradication of Corruption Crimes. That the basis for the judge's considerations in deciding that the corruption case was free of Decision Number: 46/Pid.Sus-TPK/2018/PN.Tjk Defendant did not meet the elements of "benefiting oneself or others" and the element of "receiving gifts or promises" as charged in the Alternative indictment by the Public Prosecutor, so that the defendant is not legally and convincingly proven guilty of committing a criminal act of corruption.

Abstract

A child in conflict with the law, who is then sentenced and placed in the Special Child Development Institution (LPKA), has the right to receive supervision, assistance, training, guidance and the right to education in accordance with the mandate and provisions of the relevant law. This research discusses the application of Guaranteed Educational Rights for Correctional Students (Andikpas) in Class II LPKA Bandar Lampung with the legal issue behind this research is that there are several LPKAs in Indonesia that have not paid attention to the right to education for Andikpas. Based on these legal issues, the problem in this research is related to the application of education rights guarantees in the sentencing of Andikpas at LPKA Class II Bandar Lampung and what are the inhibiting factors for implementing education rights guarantees in the sentencing of Andikpas in LPKA Class II Bandar Lampung. This research uses normative legal research methods which are supported by empirical research. Sources of primary data collection were carried out through field studies by conducting interviews with LPKA structural officials, LPKA employees, Andikpas representatives, and lecturers in the Criminal Law section of the Faculty of Law, University of Lampung. Secondary data collection is done by literature study. The data that has been obtained by the author is then analyzed qualitatively. The results of the research carried out show that the implementation of the Education Rights Guarantee at LPKA Class II Bandar Lampung for Andikpas has been implemented, but not yet fully implemented properly. The forms of education available include formal and non-formal education. For formal education, there are Package A (SD), SMP, and SMA equivalency education programs that work independently with the Dwi Mulya Foundation. Non-formal education can be said to be a skills and training activity in which Andikpas are fostered and trained in their skills through various activities prepared by LPKA on a regular basis. In carrying out the implementation of education, of course, they are faced with various kinds of obstacles, including legal factors, namely there are no specific technicalities in legislation that show how to apply education to Andikpas. Law Enforcement Factors, namely there are still deficiencies in quality and quantity in coaching officers. Factors of Facilities and Infrastructure, which are still classified as limited and not sufficient enough. Community factors, regarding the negative stigma against Andikpas who have returned to social life. And Cultural Factors, cultivate laziness from within Andikpas in carrying out educational obligations. In this way, LPKA strives fully, whatever becomes an obstacle in implementing the implementation of education and the Head of LPKA Class II Bandar Lampung hopes that the education and coaching that has been held can develop the potential of children so that when they return to social life they are still educated and can play an active and responsible role.

Abstract

ABSTRACT: Press is an institution that has a strong influence on the forming of public opinion and efficacy of spreading information. Therefore, it is really strategic if press is empowered to spread positive information for public. However, in many cases crime of press in the Act Number 40, 1999regarding Press is not imposed by the reason of lex specialist. This article is going to answer the juridical problem in enforcing law regarding press. It shows that the act has not fulfilled the criteria as the act with lex specialist as it has no qualification of a crime as KUHP states it as KUHP is the main rule of crime regulation. Thus, in terms of trial involving press, judges persist to impose KUHP is correct. it is recommended that the act of Press as lex specialist should be revised on the Act by fulfilling the requirements that are proper to KUHP as the main source of criminal law for other laws.  Juridical Matters on The Act Number 40, 1999 on Press
