Abstract

Kerusakan hutan mengalami peningkatan luas kerusakan setiap tahun di Indonesia. Setidaknya, sekitar 857.756 hektare. Terdiri dari 630.451 hektar lahan mineral dan 227.304 hektar lahan gambut. Angka ini meningkat 160% dibandingkan sebelumnya yang luasnya sekitar 328.724 hektar. Situasi ini akan berdampak pada lingkungan secara keseluruhan, termasuk perubahan iklim pada kenaikan suhu udara. Pemerintah sudah banyak mengkampanyekan larangan kebakaran hutan dan illegal logging, namun kebakaran hutan dan illegal logging masih saja terjadi, sehingga perlu mengintensifkan instrumen lain. Yakni dengan memanfaatkan peran masyarakat adat, mereka memiliki banyak kebijakan lokal yang dapat dimunculkan dan dijadikan salah satu kebijakan nasional dalam rangka pencegahan terjadinya tindak pidana pembakaran hutan dan illegal logging. Metode penulisan makalah ini adalah penelitian non doktrinal, dengan wawancara mendalam kepada tokoh masyarakat adat, kemudian hasil wawancara mendalam dianalisis untuk dijadikan rekomendasi temuan penelitian. Hasilnya adalah model penegakan hukum di masyarakat adat, dalam praktiknya sejalan dengan konsep hukum pidana administrasi. Konsep hukum ini menekankan pada prinsip penegakan hukum yang tidak berorientasi pidana sebagai pilihan utama. Masyarakat adat mengutamakan upaya pencegahan berupa larangan perusakan hutan, kemudian pembatasan mengambil kayu hutan, dan kewajiban menanam kembali pohon.

Abstract

One of the criminal acts that frequently occurs in society is giving false testimony under oath, which is punishable by imprisonment; however, in practice, judges may impose a suspended sentence. This study aims to analyze the judge’s considerations in imposing a suspended sentence on perpetrators of giving false testimony under oath and its conformity with the objectives of punishment. The research employed normative legal research with statutory and conceptual approaches. The data used were secondary data obtained through library research and analyzed descriptively and qualitatively. The findings show that in Decision Number 1353/Pid.B/2017/PN.Tjk and 23/Pid/2018/PT.Tjk, the juridical consideration of the judges was based on the fact that the defendant was proven to have violated Article 242 paragraph (1) of the Indonesian Criminal Code. The philosophical consideration was directed at efforts to rehabilitate the defendant so that he would not repeat the offense, while the sociological consideration involved taking into account both mitigating and aggravating factors. The imposition of the suspended sentence was deemed consistent with the objectives of punishment, particularly given the defendant’s advanced age (68 years) and in line with the relative theory, which emphasizes punishment as a means of learning rather than mere retribution.

Abstract

The current Indonesian criminal law, although it has used the restorative justice method, has not been able to resolve the core of the problem and has not restored balance in society, so the settlement of criminal acts is not complete to the community, the victim and the victim's family. The importance of criminal law policies for the settlement of criminal cases through the integration of Angkon Muakhi law is to realise justice, benefit, balance, and kinship in criminal law enforcement. This research method uses the combined theory paradigm and mixed legal system to generate new ideas in settling criminal cases. This research is normative juridical and empirical juridical research with a socio-legal approach. In-depth interviews were carried out in primary data collection; sources were determined by the snowball method, while secondary data collection was carried out using a literature study. The findings of this study indicate that the enforcement of criminal law at this time still does not involve the community. There are still the rights of victims' families and communities that have not been restored; even though restorative justice has been resolved, it still leaves disputes, seeds of conflict and grudges both from the victim, the victim's family and the surrounding community. Prison sentences are still prioritised in light cases and negligence, both in the investigation process, prosecutors' demands, and the judge's decision. The importance of resolving criminal cases through integrating the customary law values of Angkon Muakhi, which can resolve cases, conflicts, hostilities and disputes between perpetrators, victims and the community.

Abstract

This study aims to analyze the legal review of legal protection for consumers related to the circulation of drugs that do not have a distribution permit in Indonesia. The research method used in this study is the normative legal research method. The main data source in this study is a secondary legal source, consisting of laws and regulations governing the circulation of drugs. The results of this study indicate that legal protection for consumers related to the circulation of drugs without a distribution permit in Indonesia has been strictly regulated in various regulations. Law Number 8 of 1999 concerning Consumer Protection, Law Number 36 of 2009 concerning Health, and Regulation of the Head of BPOM Number 26 of 2017 provide a strong legal basis to ensure that drug products circulating in the market are safe and have obtained a valid distribution permit from BPOM. This aims to protect consumer rights so that they are not exposed to health risks caused by drugs that are not guaranteed to be safe. However, a major challenge faced is the high number of illegal drugs circulating, both on the black market and online platforms that are difficult to monitor. In addition, the lack of awareness from consumers also exacerbates this problem. Suboptimal supervision is also another challenge in this legal protection. The lack of utilization of technology in supervision is also a significant obstacle. Although there are regulations and supervisory authority from BPOM and pharmaceutical personnel, the distribution of drugs without a distribution permit remains a complex problem

Abstract

Children as part of the younger generation are the successors of the ideals of the nation's struggle and human resources in national development. In order to realize quality Indonesian human resources who are able to lead and maintain the unity and integrity of the nation within the framework of the Unitary State of the Republic of Indonesia based on Pancasila and the 1945 Constitution, continuous development is needed for the sake of survival, growth and physical, mental and social development and protection from all possibilities that will endanger them and the nation in the future. In various ways, these development and protection efforts are faced with problems and challenges in society and sometimes behavioral deviations are found among children, even more than that there are children who commit unlawful acts without knowing their social and economic status. The massive act of bullying has certain consequences for the victims. Bullying in some cases has its own implications towards acts that are included as criminal acts. This study aims to understand the regulation of bullying in Indonesian criminal law and criminal law policies in cases of bullying and juvenile delinquency in Indonesia. The approach method used in this Community Service is through the lecture method in delivering the material, then at the end of the event a question and answer session is held. With this question and answer method, the public is given the opportunity to ask questions according to the theme or relevant questions. The benefit of holding this activity is to create better legal awareness in society so that every member of society realizes and appreciates the importance of the role of criminal law in overcoming bullying and juvenile delinquency.

Abstract

Indonesia menempati posisi ke-5 tertinggi balita stunting setelah India. Lampung Selatan ditetapkan sebagai “kabupaten/kota prioritas intervensi penurunan stunting tahun 2020” oleh Kementerian Perencanaan dan Pembangunan Nasional. Tujuan dari kegiatan pengabdian ini adalah mengedukasi pasangan usia subur (PUS) dari keluarga berisiko stunting untuk dapat melakukan pencegahan stunting, khususnya pencegahan yang dapat dilakukan dalam keluarga di Desa Negara Ratu, Kecamatan Natar Lampung Selatan. Pencegahan dalam keluarga yang dimaksud adalah pencegahan infeksi dan peningkatan asupan gizi bayi balita, terutama dengan makanan berprotein tinggi dan sayuran, seperti telur dan daunkelor. Kegiatan yang diikuti oleh 30 orang peserta ini dilaksanakan dengan 2 metode, yaitu ceramah-tanya jawab dan pelatihan keterampilan dalam kelompok-kelompok kecil tentang zat gizi makanan menggunakan food model. Evaluasi peningkatan pengetahuan dengan pretest dan posttest menggunakan 20 pertanyaan pilihan ganda dan diuji dengan dependent t test menunjukkan adanya peningkatan pengetahuan secara signifikan, p<0,05. Kegiatan ini juga melatih peserta membuat makanan murah berbahan dasar telur untuk lauk pendamping nasi. Praktik keterampilan dilakukan peserta di rumah masing-masing menggunakan bahan makanan yang telah dibagikan.Kata kunci: edukasi, keluarga berisiko, PUS, stunting

Abstract

Latar belakang: Menurut World Health Organisation, empat penyakit kronis terbesar dengan biaya perawatan tertinggi adalah penyakit kardiovaskular seperti hipertensi, diabetes mellitus, penyakit paru obstruktif kronis serta keganasan (WHO, 2015). Pekon Kiluan Negeri memiliki pola penyakit tidak menular yang terjadi yaitu penyakit tekanan darah tinggi (Hipertensi), kencing manis (Diabetes Mellitus) dan penyakit jantung. Penyakit hipertensi dan diabetes mellitus tipe 2berada dalam peringkat 10 besar penyakit terbanyak yang  berkunjung  ke  UPT  Puskesmas  Ranap kelumbayan. Tujuan : Memberdayakan masyarakat Pekon Kiluan memahami, mampu melakukan dan termotivasi melakukan pencegahanpenyakit kronis dengan metode POSBINDU PLUS sesuai dengan kapasitas masing-masing di lingkungan desa, dan menjadi pelaku aktif dalam program tersebut. Metode : Kegiatan ini dilakukan dengan strategi  Community empowerment dengan metode POSBINDU PLUS (POS Pembinaaan Terpadu untuk penyakit tidak menular, prediksi, dengan prediksi Diabetes dan Hipertensi yaitu 1) promosi kesehatan dengan media poster di tempat yang strategis di pekon yaitu pasar, tempat ibadah, jalan masuk ke desa, 2) melatih kader Posbindu untuk memprediksi risiko menderita penyakit kronis dengan Diabetes RiskCalculator. 3) pencegahan penyakit dengan mengidentifikasi kelompok berisiko, serta memprediksi potensi timbulnya penyakit kronis pada kelompok berisiko. Sasaran kegiatan ini adalah 1) kader Posbindu, 2) masyarakat pekon terutama dari  kelompok berisiko penyakit kronis, yaitu usia di atas 35 tahun. Abstract

This research addresses the deficiencies in the scholarly exploration of constitutional law in relation to elitist populism within the legislative framework of Indonesia. The article examines the tendency of elitist populism in Indonesian legislative practice and advocates the idea of curbing it by constitutional law. Elitist populism, in the context of this article, refers to a political approach in which leaders claim to represent the common people, while simultaneously engaging in elitist practices. This study uses a normative juridical research method using statutory and conceptual approaches, and analyzes controversial cases with significant legislation impact. The research findings show that elitist populism in legislative practice is manifested in rapid legislation, and the consolidation of power that minimizes participation fails to reflect public aspirations. To limit these tendencies, constitutional law arrangements in institutional design, supervisory mechanisms, as well as spaces for public participation and awareness, need to be stronger. Therefore, it is recommended to strengthen the institutional rules of the constitutional court, revitalize the supervisory function of the house of representatives, encourage lawmaker’s consistency in the application of meaningful participation, and build public awareness.

Abstract

Illegal, Unreported, and Unregulated (IUU) Fishing remains a significant challenge for Indonesia, posing threats to its marine resources, economic stability, and national sovereignty. This study examines the enforcement of sanctions against fisheries violations in Indonesia from an international legal perspective. It explores how Indonesia aligns its regulatory framework with global legal instruments, such as the United Nations Convention on the Law of the Sea (UNCLOS), the Port State Measures Agreement (PSMA), and regional agreements within ASEAN. The research identifies key challenges, including legal inconsistencies, enforcement limitations, and jurisdictional complexities, which hinder the effective prosecution of fisheries crimes. It also analyzes obstacles in implementing stricter sanctions, particularly in cases involving foreign fishing vessels operating illegally in Indonesian waters. The study also assesses Indonesia’s current legal reforms and proposes policy recommendations to enhance compliance with international norms. Strengthening cooperation with neighboring countries, improving monitoring and surveillance systems, and reforming legal mechanisms are crucial steps toward ensuring more effective sanctions. By integrating international legal standards into domestic policies, Indonesia can enhance its ability to combat fisheries violations while fostering sustainable marine resource management.
