Abstract

Inmates who served the punishment in prison are often considered to have no rights of any kind. They are often treated in inhumane because they are considered to have committed a crime so that their actions must be in the prison. The rules regarding correctional system in force at the moment is Act No. 12 Year 1995 about a Correctional one of the conditions governing the rights of an Inmate that where there is a requirement of the Ordinance as well as in the implementation of those rights.Based on the foregoing formulated problems: 1) how is the implementation of the Rights of prison inmates get Parole in State Custody Homes class IIA Kerobokan?. 2) what are the obstacles that arise in the implementation of the grant of the rights of Convicts get Parole in State Custody Homes IIA Kerobokan?. Type of this research is the empirical research by reviewing the provisions of normative and use case study for non doktrinial. This research is predicated on research field, research libraries. This research was conducted at the home of State Prisoners Class IIA Kerobokan. Data research results, both primary data secondary data as well as processed and analyzed qualitatively. The implementation of the rights of prison inmates get parole is donebased on Regulation of the Minister of Justice and human rights Indonesian Republic No. D. 01. At 04.10 Year 2007. Barriers in the implementation of the grant of the rights of convicts get parole, Parole proposing Procedures are too complicated and take a long time to get a decision.

Abstract

Correctional Center is an institution to carry out the guidance of correctional clients and correctional clients in question is someone who is under the guidance of BAPAS especially the Child Clients. Many children are subject to criminal acts. The child is the subject of a criminal offense if the offender is a child. To be able to do guidance, a correctional system is needed in accordance with Law No. 12 of 1995 concerning Correctional Services. Formulation of the problem in this study, 1. What is the position of Penitentiary in Law Number 12 of 1995? 2. What is the role of Denpasar Class I Penitentiary (BAPAS) against children who commit crimes? This study uses empirical research methods, using conceptual approaches and approaches that emphasize direct research at the Class I Denpasar Penitentiary (BAPAS), reviewing primary and secondary data sources and using data collection techniques with interviews and literature review, analysis of the data in the form of qualitative and quantitative. BAPAS in its position, namely as one of the sub-systems of the criminal justice system. BAPAS outside the penitentiary is located as a Technical Implementation Unit which is directly responsible to the Ministry of Law and Human Rights. Broadly speaking, the position of BAPAS is tasked with guiding residents of the prison in accordance with applicable rules. BAPAS services make a community research report for the purposes of investigation, prosecution and trial in Child cases both inside and outside the trial and provide assistance, guidance and supervision. BAPAS inhibiting factors in conducting guidance on correctional clients are the lack of a number of community mentors and training, facilities, children's clients who are not required to report to BAPAS, and the lack of cooperation between BAPAS and the family.

Abstract

Lembaga Pemasyarakatan merupakan salah satu lembaga yang menegakkan hukum dalam hal pembinaan yang dilakukan terhadap para narapidana dimana segala jenis aturan yang dilakukan di dalam Lembaga Pemasyarakatan diatur dalam Undang-Undang Nomor 12 Tahun 1995 tentang pemasyarakatan. Adapun rumusan masalah yang penulis kemukakan yaitu, (1) Bagaimana proses pembinaan narapidana lanjut usia di Lapas Kelas IIA Denpasar menurut UU No.12 Tahun 1995 Tentang Pemasyarakatan. (2) Apakah upaya penyelesaian terhadap kendala yang dihadapi dalam melakukan pembinaan pada narapidana lanjut usia di Lapas Kelas IIA Denpasar. Penelitian ini menggunakan metode empiris dengan mengumpulkan data melalui wawancara di lapangan. Penelitian ini dilakukan di Lembaga Pemasyarakatan Kelas II A Denpasar yang terletak di daerah Kerobokan Kabupaten Badung. Hasil penelitian di lapangan didapat bahwa di Lembaga Pemasyarakatan yang menampung 1684 narapidana dengan klasifikasi 7 orang narapidana anak, 1663 orang narapidana dewasa serta 14 orang narapidana lansia ini telah memberikan perlakuan khusus kepada narapidana yang sudah lanjut usia karena para narapidana yang sudah lanjut usia tidak memiliki kemampuan yang cukup untuk melakukan segala kegiatan pembinaan yang seharusnya dilakukan, namun tidak ada peraturan khusus yang mengatur secara detail terkait hal tersebut. Memberikan perlakuan khusus dan membentuk aturan mengenai tata cara pembinaan terhadap narapidana yang sudah lanjut usia merupakan langkah yang wajib dilakukan agar terciptanya proses pembinaan terhadap para narapidana lanjut usia yang sesuai dengan kondisi narapidana lanjut usia itu sendiri.

Abstract

HAM dalam setiap insan masyarakat yang terdapat ataupun terselubung dalam daerah pertambangan, seiring berjalannya proyek tersebut menyebabkan adanya permasalahan-permasalahan yang cukup signifikan akibatnya kurang memaksimalkan SDA di daerah tersebut dan perlu adanya pemenuhan ataupun perlindungan. Dampak-dampak yang membuat risih masyarakat sehingga terjadinya konflik dengan operasi tambang dan perlu adanya penyempurnaan keselarasan didalamnya. Adapun rumusan masalah dalam jurnal ini adalah bagaimana pengaturan perizinan pertambangan di indonesia? dan Bagaimana perlindungan hukum terhadap masyarakat di daerah pertambangan?. Penelitian ini menggunakan tipe hukum normatif dengan pendekatan konseptual dan peraturan perundang-undangan. Pengaturan Perizinan Pertambangan di Indonesia yakni suatu konteks kesepakatan yang harus dilakukan dalam sebelum berjalannya proyek tambang tersebut, seperti halnya izin dalam pertambangan yang terutama meliputi segala bentuk, sistematis, cara/ pemikiran, pengolahan serta program proyek tersebut. Bentuk perlindungan hukum yang bersifat preventif yaitu pemerintah memberikan hak terhadap masyarakat di sekitar tambang dalam upayanya menyelaraskan pengelolaan ataupun pemanfaatan konten-konten SDA yakni mineral dan juga batubara, dengan demikian masyarakat dan perusahan pertambangan dapat bekerjasama dan saling mengawasi. Sedangkan bentuk perlindungan hukum bersifat represif adalah pemberi izin usaha pertambangan mewajibkan bila pertambangan terjadi pada tanah ulayat masyarakat hukum adat.

Abstract

Sanksi pidana terhadap tindak pidana mengedarkan sediaan farmasi kosmetika tanpa izin edar, penelitian ini bertujuan karena semakin maraknya peredaran kosmetika yang tidak mempunyai izin edar namun tetap banyak diminati dan digunakan oleh masyarakat. Penelitian ini memiliki dua rumusan masalah yang akan dibahas yaitu, pertama bagaimanakah pengaturan mengedarkan kosmetika di pasaran yang tidak memiliki izin edar? Dan yang kedua bagaimanakah sanksi pidana terhadap para pelaku yang mengedarkan kosmetika yang tidak memiliki izin edar? Penelitian ini menggunakan metode hukum normatif. Berdasarkan dari hasil penelitian ini bahwa penulis mengkaji melalui analisis kasus menggunakan Putusan Pengadilan Negeri Gianyar Nomor Perkara 132/Pid.Sus/2018/PN Gin. Penelitian ini menggunakan pendekatan Perundang-undangan dengan menelaah semua undang-undang yang berhubungan dengan kasus ini, Konseptual yaitu dengan menggabungkan pendapat para ahli sehingga menjadi argumentasi hukum penulis, dan pendekatan kasus yaitu dengan menggunakan putusan pengadilan. Hasil penelitian ini menunjukan bahwa peran dinas kesehatan Republik Indonesia lebih tegas dalam memberikan standard kesehatan dan kemanfaatan bagi produsen-produsen kosmetik agar tidak lagi ada produsen kosmetik yang curang dan tidak bertanggung jawab dengan menggunakan bahan berbahaya dalam pembuatan kosmetiknya. Pengenaan sanksi pidana terhadap tindak pidana mengedarkan sediaan farmasi kosmetika yang tidak memiliki izin edar sebagaimana diatur dalam UU 36 Tahun 2009 Tentang Kesehatan diatur dalam Pasal 197-201. Dalam kasus penelitian ini Majelis Hakim mempertimbangkan dengan Pasal 197 dengan hukuman penjara maksimal 15 (lima belas) tahun dan denda maksimal 1.500.000.000 (satu milyar lima ratus juta rupiah). Tetapi terdakwa disini hanya dijatuhkan pidana penjara selama 8 (delapan) bulan dan denda sejumlah Rp 2.000.000,- (dua juta rupiah) dengan ketentuan apabila denda tersebut tidak dibayar maka akan diganti dengan pidana kurungan selama 2 (dua) bulan. Peran dinas kesehatan republik Indonesia lebih tegas dalam memberikan standar kesehatan dan kemanfaatan agar tidak lagi ada produsen kosmetik curang dan tidak bertanggung jawab.

Abstract

Abstract—This is a consumer protection guarantee which should be by the consumer over any food products purchased from manufacturers or businessmen. For businessmen who just always worried about how to gain that much without thinking of the interests of consumers. It can be posed some problems that would constitute the subject of this research, the problem namely: 1) how form of liability in case of loss on consumers due to consume products in parcels. 2) how does the dispute resolution mechanism that creates consumer losses resulting from consuming products in parcels. This presentation method using empirical legal research, sociological issues in IE approach using an approach based on the provisions of the law and legal developments on a periodic basis. Liability in the event of the occurrence of harm on consumers due to consume products in parcel is a party – the party that made a mistake and led to losses. Parties – parties that are manufacturer, businessmen and parcel delivery service. Sanctions according to the civil code, namely compensation or administrative sanction and according to the criminal law, namely criminal confinement 5 years in prison. Consumers are dispute resolution mechanism gives rise to loss due to consume products in gifts can be made in litigation or non litigation. In trade parcels expected all parties to know about their respective responsibilities so that would not be incurred losses against consumers who consume parcels.

Abstract

Abstract—Pretrial is the authority of the District Court about examining, deciding whether or not the arrest or detention is valid, whether or not the termination of the investigation or termination of the prosecution is legal, and the request for compensation or rehabilitation. The Constitutional Court has determined that new pretrial objects include the validity of the determination of suspects, searches and seizures. This research was conducted, namely to examine the challenges of the Court's decision Number 21 / PID.PRAP / 2017 / PN.DPS regarding the determination of the status of suspects in suspected corruption, while the problem is (1) on the basis of consideration of the judge who canceled the suspect's status? (2) What are the legal consequences of the pretrial decision? In this study, the author uses a normative legal research method and a statutory approach that uses a conceptual approach. The source of legal material is the primary legal material in the form of KUHAP, Law No. 20 of 2001, and Law No.48 of 2009, and secondary legal materials are literature and legal journals that have to do with problems, then analyzed qualitatively and presented in the form of analytical descriptive. The status of the suspect must be based on sufficient initial evidence or preliminary evidence, the provisions clearly stipulated by the Criminal Procedure Code. Determination of suspects in criminal acts of corruption must be proven by the existence of real state financial losses that have existed or arisen meaning, official audits issued by the BPK as a basis or reference to prove the existence of state financial losses (SEMA Number 4 in 2016). Proof and consideration see the absence or absence of sufficient initial evidence, it is not impossible due to the legal determination of the status of the suspect is not valid.

Abstract

With existence of law expected by state Indonesia become peaceful state and can prevent the happening of crime. Its function criminal law arrange life of society to be can create orderliness of public. These time often met by various crime case conducted by recidivist, where the recidivist don’t discourage to penalization which he have against the punismentin prison previously. Research problems of this study are (1) How arrangement of law to recidivist according to positive law in Indonesia? ( 2) How base consideration of judge in breaking a recidivist? This research use approach of normatif that is with method approach of legislation, conceptual, and approach of case. Result indicate that: ( 1) Arrangement of law to recidivist according to Indonesian positive law is pursuant to section 486 Criminal code which enter in certain type of crimes, in section 486 Criminal code arrange about maximum crime from some criminal of which can added by 1/3 one-third because conducting repetition of or deed of recidive. ( 2) Base consideration of judge in breaking a recidivist that is in the balance punish Assembly Judge of Tabanan constitution its decision regarding have proven of validly and assure mistake of defendant of Section assertion 362 Criminal code have precisely and correctness. But regarding dropped crime penalization to defendant according to writer don’t in agreement with the decision because of existence of dimness of norm and also not yet fulfilled sense of justice and rule of law which where judge ought to add 1/3 one-third from maximum crime threat of fundamental because defendant a recidivist.

Abstract

Law violations continue to increase every year, even children become lawbreakers. Children as the next generation must be protected. Because Indonesia is a State of Law. Then the Law on Legal Aid provides legal protection for the poor. The problems of this study are 1) what is the role of LBH APIK BALI in dealing with ABH? 2) What is the effectiveness of the APIK BALI LBH in handling ABH? The research method used in this paper is empirical, namely primary data sourced from research in the field and secondary data sourced from library research in the form of legal materials. The results of the study can be concluded that: 1) LBH APIK BALI in dealing with ABH by providing assistance to children in the Litigation and Non Litigation circles. 2) LBH APIK BALI in handling ABH has not been effective, but it is in accordance with the SPPA Law. The importance of cooperation, lobbying with the government to protect ABH so that the rights of the ABH regarding the provision of legal assistance in the LBH APIK BALI are fulfilled.Keywords: Role, Legal Aid Institution, Child Criminal Justice System

Abstract

The survival of a society is guaranteed by marriage, which there is a legal heir. The existence of legal heirs in Indonesia is still not currently legal, as well as unification of Bali from a district with other counties could not be equated the inheritance system. Bali has a fatherly line that ispatrilinial, which causes only the descendants of the kapurusa's status as heir in the family. Then with the decision of the Supreme Pesamuhan III which describes possible female heir or heirs. Formulation of the difficulty in this study is how the situation of women in Bali in Bali where the inheritance in the family embraced the system patrinial and how the position of women of Bali after the promulgation of the decision of the Supreme Pesamuhan III MUDP. The type of research used in this study is normative legal research. Thus the legal heirs in Bali customs, women cannot inherit because she is not capable in undertaking its obligations, whether liability caring for parents or an obligation in customary and ayahan temples. Whereas after the Supreme Pesamuhan III MUDP Bali said women can fully inheriting like male although in that women marrying out but he had to keep running its obligations.
