Abstract

The dense population and growing economic needs are leading humanity toward a new way of life. One of the fundamental needs of every person is the need for a place to live and reside. The exploitation of state-owned land, whether in cities or the wilderness, has become inevitable. State land, which should be managed by the government and used for the welfare of society, is often seized and used for personal interests. Dr. Syauqi Ibrahim Allam, a grand mufti at the Egyptian fatwa institution, stated in his book Fiqh al-Wathan wa al-Muwathonah that using state land without permission is forbidden (haram) and is considered gasab (unlawful usurpation). He also urged those involved in such acts to vacate and return the land to its rightful authority. How did he determine the legal basis for his fatwa? What are the implications for Indonesia? This article reviews Dr. Syauqi Ibrahim Allam's perspective on the illegal use of state land, a practice now common in Indonesia, as a moral and ethical compass. To analyze this, the author employs descriptive analysis within the framework of qualitative research methodology.The findings indicate that Dr. Syauqi Ibrahim Allam's fatwa is well-grounded in religious texts and is also supported by the views of Ahlus Sunnah scholars from the four major schools (madhabs), with a particular alignment to the Hanafi school, which strictly requires permission from the leader (imam) for the use of state land. He equates the illegal use of state land to the gasab of private properties. This fatwa is crucial for public understanding, given the numerous issues arising from land disputes with the government.

Abstract

This study examines the impact of workcation programs, digital entrepreneurship, and local policy strengthening on the success of sustainable tourism in Bali, Indonesia. Utilizing a quantitative research approach, data was collected from a sample of 150 community members using a Likert scale (1-5). The analysis was conducted using Structural Equation Modeling with Partial Least Squares (SEM-PLS 3). The results reveal that workcation programs, digital entrepreneurship, and local policy strengthening all have significant positive effects on the success of sustainable tourism in Bali. Furthermore, workcation programs and local policy strengthening positively influence digital entrepreneurship, creating a synergistic effect. These findings highlight the importance of a multi-faceted approach to fostering sustainable tourism through the integration of workcation initiatives, digital business innovation, and supportive policies. The study provides valuable insights for policymakers and tourism stakeholders looking to enhance sustainable tourism practices in Bali.

Abstract

Artikel ini mengkaji pentingnya pendidikan tinggi sebagai bagian dari aktualisasi fitrah manusia dalam perspektif Islam yang wasathiyah dengan pendekatan multidisipliner sejarah, filsafat, dan sosial keagamaan. Penelitian ini dilatarbelakangi oleh masih kuatnya pandangan patriarkis dan deterministik dalam masyarakat pesisir Pantura yang menganggap pendidikan tinggi, terutama bagi perempuan, sebagai hal yang kurang esensial. Melalui pendekatan kualitatif studi pustaka dan analisis teks, penelitian ini menemukan bahwa pendidikan tinggi bukan hanya sarana untuk mencetak tenaga profesional, tetapi juga merupakan jalan kodrati bagi manusia untuk mengembangkan potensi akal, spiritual, dan sosialnya. Temuan menunjukkan bahwa konsep fitrah, ikhtiar, dan takdir dalam Islam justru mendorong manusia untuk terus belajar, termasuk hingga ke jenjang pendidikan tinggi. Integrasi teori pendidikan klasik nativisme, empirisme, dan konvergensi dengan prinsip-prinsip Islam menghasilkan kerangka pemikiran baru tentang urgensi pendidikan tinggi dalam membangun masyarakat yang berdaya dan berkeadaban. Implikasi dari studi ini memberikan dorongan untuk mendesain kurikulum dan kebijakan pendidikan yang inklusif serta kontekstual terhadap realitas sosial-ekonomi kawasan pesisir. Penelitian ini menyarankan pentingnya keterlibatan negara, pesantren, dan keluarga dalam menyadarkan masyarakat akan nilai strategis pendidikan tinggi sebagai jalan fitrah yang berkelanjutan.

Abstract

The moral decline in the modern era presents a serious challenge to Islamic education, particularly in shaping strong spiritual character towards Allah SWT. Qur’anic verse QS. Al-Baqarah:186 conveys the message of divine closeness that holds deep relevance for moral development. This study aims to analyze the verse using Emilio Betti’s hermeneutic approach to uncover the moral education dimension from historical, linguistic, and contextual perspectives. The research applies a qualitative-descriptive method through textual and philosophical-hermeneutic analysis. The findings reveal that the verse contains not only theological meaning but also universal ethical messages such as spiritual optimism and slot thailand obedience to divine commands. Through Betti’s approach, the study finds that the objective meaning structure of the verse is both transhistorical and contextual. This research offers a synthesis between classical Qur’anic exegesis and modern hermeneutics, contributing practical insights for developing Islamic moral education curricula that are integrative and responsive to contemporary moral challenges.

Abstract

Purpose – This study aims to evaluate the implementation of the Structural Analytic Synthetic (SAS) method in teaching beginning reading within the context of 21st-century skills, particularly during online learning environments prompted by the COVID-19 pandemic. It examines the extent to which first-grade teachers effectively apply the SAS method and align their instructional practices with the demands of modern literacy education.Methodology – This study employed a quantitative descriptive research design using a survey method. This research aims to analyze the extent to which teachers apply the Structural Analytic Synthetic (SAS) method in beginning reading instruction within the framework of 21st-century learning, particularly during the implementation of online learning in response to the COVID-19 pandemic. A total of 35 respondents were selected through a probability sampling technique, specifically using simple random sampling, and the sample size was determined based on the Krejcie and Morgan table at a 95% confidence level. The data collection techniques used in this study were questionnaires, structured interviews, and documentation.Findings – The findings of this study indicate that the implementation of the Structural Analytic Synthetic (SAS) method in teaching beginning reading during online learning has been generally successful, particularly in the context of 21st-century education. Teachers demonstrated a good level of mastery in applying the SAS method, as evidenced by consistent improvements in each observed session and positive responses from parents. The integration of 21st-century competencies—such as critical thinking, creativity, communication, and collaboration—was evident in teachers' instructional practices despite the challenges posed by the sudden transition to online learning during the COVID-19 pandemic.Contribution – This study contributes to improving early reading skills in first-grade students and offers a classroom strategy to enhance student reading comprehension outcomes.

Abstract

The objective of this thesis is: 1) To analyze the position and rights of creditors who reject the peace proposal in the PKPU process based on the applicable laws and regulations in Indonesia. 2) To analyze the form of legal protection and its implementation for creditors who reject the peace proposal in the PKPU process. The research method used is normative research, where the researcher connects the study with the prevailing laws and regulations. The results of this thesis research are: 1) That creditors have different legal positions in the PKPU process, especially the secured creditors who hold a special position because they retain the right to execute the collateral object and are still protected even if they reject the composition plan proposal that approved by the majority of creditors. The law also ensures that the secured creditors' property rights are not nullified by the decision of the majority of creditors. Therefore, the PKPU legal system in Indonesia has accommodated legal protection for creditors who reject the composition plan proposal during the PKPU process. 2) UUK-PKPU provides legal protection instruments for secured creditors who reject the composition plan proposal, through Article 281 paragraph (2) which grants the right to compensation, and Article 286, which states that the secured creditors who reject the composition plan proposal are not bound by the ratified composition plan proposal. These two articles aim is to ensure that the rights of secured creditors are protected during the PKPU process. However, in practice, the implementation of these provisions still shows inconsistencies, as seen in the cases of PT Adhi Persada Properti vs. PT Bank Jtrust Indonesia;as well as the case of PT K88 vs. its’ Secured Creditors. This phenomenon caused by the judges' lack of understanding, as they only refer to Article 281 paragraph (2) and disregard the Article 286 UUK-PKPU, whereas these two articles must be applied together to provide comprehensive legal protection for secured creditors who reject the composition plan proposal in the PKPU process. Therefore, the researcher argues that improvements are needed in the provisions that protecting the secured creditors who reject the composition plan proposal in PKPU, by clarifying the compensation mechanism and ensuring the close relations between Article 281 paragraph (2) and Article 286 UUK-PKPU. Additionally, there should be an enhancement for judges' understanding of applying both articles through training and special guidance from the Supreme Court to avoid the legal uncertainties and misinterpretation in judicial decisions.

Abstract

This study aims to analyze the impact of the Tax Court's decision on the dispute over the return of operating costs (cost recovery) in the Oil and Gas Production Sharing Contract between the Indonesian Government and the Oil and Gas Contractor. The method used in this study is normative legal research by focusing on the analysis of written legal norms such as the Oil and Gas Law, Income Tax Law, Oil and Gas Production Sharing Contracts, and Tax Court Decisions. The research approach used is the statute approach and the case study approach. The results of the study indicate that the Production Sharing Contract has regulated the cost recovery guidelines that can be returned by the Oil and Gas Contractor in connection with upstream oil and gas business activities in Indonesia, so that taxpayers are entitled to the burden of the cost recovery costs. The implementation of cost recovery burdens in tax reporting by Upstream Oil and Gas Companies is in accordance with the Production Sharing Contract, the principle of legal certainty and the principle of uniformity in the upstream oil and gas industry. To improve legal certainty and avoid negative impacts on upstream oil and gas investment in Indonesia, recommendations can be made for solutions to revise and harmonize regulations, improve tax authorities' knowledge of upstream oil and gas business patterns, and create more detailed technical guidelines for the implementation of cost recovery to provide legal certainty for Oil and Gas Contractors

Abstract

This study examines the adaptation of Muhammadiyah's da'wah strategies to modern technological advancements, with a focus on engaging Generation Z, who are known for their tech-savviness. The research aims to identify effective methods for delivering religious messages to this demographic through digital platforms. Utilizing a library research method, analytical data were gathered from a variety of sources, including books, academic journals, research papers, and other relevant literature. The study found that Muhammadiyah's digital da'wah model is sufficiently flexible to integrate contemporary technological tools, ensuring continuous and effective religious communication. Specific findings highlight the importance of using social media, video content, and interactive online platforms to engage Generation Z. Additionally, the research underscores the need for da'i (preachers) to be well-versed in digital communication, possess deep knowledge of religious content, and create engaging, relevant material.This adaptive approach not only addresses technological advancements but ensures that the da'wah message is impactful and resonates with Generation Z. The practical implications of this study suggest that digital da'wah can significantly enhance the reach and effectiveness of religious communication in the modern age. In conclusion, Muhammadiyah's use of digital da'wah demonstrates its capacity to evolve and remain relevant, particularly in communicating with a tech-oriented audience like Generation Z.

Abstract

This thesis aims to: 1) Analyze and examine the legal basis of the Commercial Court in deciding Suspension of Debt Payment Obligation (PKPU) cases involving debtors still engaged in civil disputes in the District Court. 2) Analyze and examine the legal certainty for debtors whose PKPU is granted, particularly regarding agreements still subject to civil disputes outside the PKPU process. This study employs normative legal research, connecting the research with prevailing laws and regulations. The findings of this thesis are: 1) The judicial considerations in Decision No. 45/Pdt.Sus-PKPU/2023/PN Niaga Mdn embrace the principle of simple proof despite the complexity of debts involved in civil disputes. This decision demonstrates that, unlike bankruptcy, PKPU aims for swift debt restructuring and peaceful settlement. This is reflected in the judge's rejection of in personam disqualification and absolute competence exceptions, alongside the affirmation of the "Lex Specialis Derogat Lex Generalis" principle. The core of the judge's consideration involves a flexible interpretation of "simply proven debt" (Article 8 paragraph (4) of the Bankruptcy Law), accepting complex contractual debts through implied admission, and utilizing final and binding court decisions as strong evidence. The legal implications of this ruling include setting aside detailed civil disputes for the sake of PKPU speed and strengthening creditor protection, thereby establishing a pro-restructuring precedent, despite potentially creating future conflicts of norms or overlapping jurisdictions. In this case, the Commercial Court functions as a "gateway" to debt restructuring, rather than a forum for in-depth substantive dispute resolution. 2) PKPU Decision No. 45/Pdt.Sus-PKPU/2023/PN Niaga Mdn provides pragmatic legal certainty for debtors amidst civil disputes, emphasizing the objective of expedited debt restructuring as opposed to bankruptcy liquidation. The Commercial Court consistently rejects formal exceptions and upholds its absolute jurisdiction based on the "Lex Specialis Derogat Lex Generalis" principle. The essence of the decision lies in a flexible interpretation of "simply proven debt" (Article 8 paragraph (4) of the Bankruptcy Law), accepting complex debts from valid agreements through implied admission, and recognizing final and binding court decisions as strong evidence. This indicates that the Commercial Court sidesteps detailed civil disputes for procedural efficiency. Consequently, this ruling strengthens creditor protection and fosters a pro-restructuring precedent, although it might lead to potential conflicts of norms if underlying disputes are decided differently in the future. The role of the Administrator and Supervisory Judge is crucial in ensuring procedural fairness. Overall, the Commercial Court serves as a "gateway" for restructuring, rather than an in-depth substantive dispute resolution forum.
