Abstract

In bankruptcy practice, not all bankrupt assets can be immediately liquidated, because Law Number 37 of 2004 opens opportunities for debtors who are still economically prospective to continue their business (going concern ). The purpose of going concern  is to maintain asset value, maximize debt payments, and reduce socio-economic impacts, with judge supervision and creditor approval. However, there is still a legal vacuum regarding the protection of curator service Fees for additional risks and workloads. The formulation of the research problem is: how is the legal regulation of the implementation of going concern  in bankruptcy, and how is the legal protection for curators related to Fees/service Fees in carrying out the process of continuing the debtor's business (going concern ) in bankruptcy. The theory used is Satjipto Rahardjo's legal protection and M. Hadi Shubhan's bankruptcy theory. The method used in this research is a normative juridical research, namely library legal research or secondary data with primary, secondary, and tertiary legal materials as sources. The research approach used is a legislative approach, a conceptual approach, and legal material collection techniques are carried out by identifying and inventorying positive legal regulations, literature books, journals, and other legal material sources. The legal material analysis technique is carried out using grammatical legal interpretation, systematic interpretation, teleological interpretation, and functional interpretation. The results of the study indicate that legal protection for curators in going concern  cases is inadequate. Clear legal regulations are needed regarding the mechanism for implementing going concern  cases, including the regulation of compensation for curators in carrying out going concern  cases. It is recommended that Law Number 37 of 2004 be revised, as well as the Regulation of the Minister of Law concerning Guidelines for the Amount of Remuneration for Curators and Administrators, and that intensive training related to the implementation of going concern  cases be conducted by the Ministry of Law of the Republic of Indonesia to improve the capacity of curators in managerial, financial, and business governance aspects

Abstract

This study aims to analyze the dynamics and effectiveness of bankruptcy law in Indonesia and Thailand through a comparative law approach. Thailand regulates bankruptcy through the Bankruptcy Act B.E. 2483 (1940) and its amendments, while Indonesia uses Law Number 37 of 2004 on Bankruptcy and Suspension of Debt Payment Obligations. The study focuses on the legal framework, procedural mechanisms, the role of judicial institutions, and creditor protection. The analysis results show that Thailand implements a centralized system through the Central Bankruptcy Court, which features specialized judges, a concise procedure, and the role of an official receiver as a state official in debt liquidation and reorganization. In contrast, Indonesia has a more open access to filing for bankruptcy for various parties. Still, it faces obstacles such as long resolution times, differing interpretations among courts, and issues with the cost and independence of curators. From the perspective of creditor protection, Thailand is more prominent because it provides legal certainty and encourages restructuring. At the same time, a liquidation pattern still dominates Indonesia due to the weak implementation of the PKPU mechanism. Therefore, it can be concluded that the Thai system is more effective in the aspects of efficiency, consistency, and business continuity. At the same time, Indonesia excels in access openness but faces challenges in the practical resolution of the bankruptcy process.

Abstract

This paper presents a systematic literature review (SLR) of 120 academic documents sourced from the Scopus database, which analyses the efficiency of crop watering systems utilizing Internet of Things (IoT) technology controlled via Google Assistant. The review explores key advances in IoT-based irrigation systems, highlighting how real-time data from sensors and voice-controlled automation improve water efficiency and user experience. The findings reveal that IoT systems can reduce water wastage by 25-30%, optimise plant health, and offer convenience through voice commands. However, challenges such as connectivity issues, high implementation costs, and system maintenance complexity also need to be addressed. This paper discusses potential future research directions, including scalability, AI integration, and cost-effective solutions to expand the adoption of these technologies in agriculture and horticulture.

Abstract

The process of foreclosure under Indonesian law generally requires a debt acknowledgment deed as valid evidence of legal relationship between debtor and creditor. However, current practices show that warning letters are sometimes used as an alternative to the debt acknowledgment deed in some foreclosure cases. The issue raised in this study concerns the validity of using Warning Letter as substitution for Debt Acknowledgment Deed in the execution auction process of collateral rights in Indonesia. The Debt Acknowledgment Deed holds an important position in Indonesian law as a valid legal instrument that facilitates the execution against debtors who fail to repay their debts. Meanwhile, the Warning Letter is often used as an initial step in debt collection, but it does not carry the same legal force as the Debt Acknowledgment Deed. The purpose of this writing is to analyze the validity of using the Warning Letter as a substitute for the Debt Acknowledgment Deed in the execution auction procedure of collateral rights. The method used in this research is normative approach by analyzing the applicable regulations, jurisprudence, and relevant legal doctrines. The results of this research show that, although the Warning Letter plays an important role in the early stages of debt collection, it cannot replace the legal status of the Debt Acknowledgment Deed in the execution auction of collateral rights. Therefore, further regulation is needed regarding the use of the Warning Letter in the execution auction process of collateral rights to provide legal certainty for both parties, creditors and debtors.
