Abstract

The property sector is the backbone of development in Indonesia, thus property ownership greatly influences developers and impacts 174 other related industries and millions of Indonesian residents. The mismatch between housing advertisements and reality often disappoints consumers due to the breach of promises by housing developers. These breaches can include delays in construction, poor building quality, unfulfilled promised facilities, and even cases where developers misappropriate large sums of money from consumers. Such disparities between advertisements and reality have serious implications for consumer trust in existing developers. A satisfactory resolution to disputes, achieved through a win-win solution, is the desire and hope of all parties involved, as it brings numerous benefits and helps maintain harmonious relationships that have been established, or even allows for mutually beneficial future relationships. From a legal perspective, a just, beneficial, and legally certain dispute resolution is the hope and aspiration of all parties involved in the dispute. H.A. Mukti Arto, quoting Yahya Harahap, suggests that, in principle, the disputing parties seek a resolution that is fast, fair, and inexpensive, which serves as a general principle in dispute resolution.

Abstract

Penelitian ini menggarisbawahi peran penting dari sertifikat aktif dan surat kapal untuk kegiatan laut yang legal, sesuai dengan Undang-Undang Nomor 17 Tahun 2008. Undang-undang ini mengamanatkan surat persetujuan berlayar yang dikeluarkan oleh Syahbandar. Sejalan dengan ISM Code dan Konvensi SOLAS, yang memprioritaskan keselamatan kapal dan perlindungan lingkungan laut, studi ini memiliki dua tujuan utama. Pertama, untuk menganalisis faktor- faktor dan hambatan yang mempengaruhi Kebijakan Perpanjangan Sertifikat Kapal di Kantor Kesyahbandaran dan Otoritas Pelabuhan Kelas IV Pangkal Balam. Kedua, mengkaji implementasi kebijakan tersebut di Kantor Kesyahbandaran dan Otoritas Pelabuhan Kelas IV Pangkal Balam. Menggunakan metode kualitatif dengan pendekatan yuridis normatif, hasil penelitian menunjukkan adanya faktor pendukung seperti unsur internal dan eksternal, serta faktor penghambat seperti sumber daya manusia yang kurang memadai dan penggunaan sertifikat sementara. Kesimpulannya menekankan perlunya upaya optimalisasi oleh Kantor Kesyahbandaran dan Otoritas Pelabuhan Kelas IV Pangkal Balam untuk meningkatkan implementasi kebijakan tersebut, dengan mempertimbangkan faktor-faktor yang telah diidentifikasi yang mempengaruhi kegiatan operasional kapal.

Abstract

Perjanjian kerjasama antara pangkalan gas LPG 3 Kg dengan PT. Yasri Panutan Sejahtera sebagai agen LPG 3 Kg Pertamina mengatur hak dan kewajiban yang mengikat kedua belah pihak. Terkadang, dalam pelaksanaan hak dan kewajiban ini, ada kasus kegagalan atau ketidakpenuhan kewajiban yang telah disepakati, yang disebut sebagai wanprestasi. Dalam artikel ini, permasalahan yang diteliti adalah: 1) Jenis wanprestasi apa yang terjadi dalam perjanjian kerjasama antara pangkalan gas LPG 3 Kg dan PT. Yasri Panutan Sejahtera sebagai agen LPG 3 Kg Pertamina, dan 2) Bagaimana cara menyelesaikan kasus wanprestasi dalam perjanjian tersebut. Penelitian ini menggunakan metode hukum normatif. Hasilnya menunjukkan bahwa pangkalan gas LPG 3 Kg melakukan wanprestasi dalam perjanjian tersebut. Ada beberapa jenis wanprestasi yang terjadi, salah satunya adalah menjual gas LPG 3 Kg di atas Harga Eceran Tertinggi (HET) yang telah ditetapkan. Akibat hukum dari wanprestasi ini adalah sanksi berupa penangguhan distribusi gas LPG 3 Kg selama 2 minggu. Hasil penelitian menyimpulkan bahwa perjanjian ini mengandung ketidakseimbangan dalam hak dan kewajiban, ada berbagai jenis wanprestasi, serta konsekuensi hukum dari wanprestasi tersebut. Penyelesaian sengketa wanprestasi biasanya melalui musyawarah yang dimediasi oleh Pertamina, advokat, atau pihak hukum.

Abstract

Development is an important sector to achieve the goals of developing countries like Indonesia. In its development, development continues to be planned every year to support the development of the Indonesian economy. Procurement activities of goods and services in the development process often give rise to negative implications in very complicated legal issues. A conspiracy is an unlawful act by officials implementing goods and service procurement activities between procurement officials and providers of goods and services to play cheating and not in accordance with the objectives, principles, policies, and ethics of government procurement of goods and services. The formulation of the problem in this research is 1) how to find out legal protection for PT. Putri Mahakam Lestari, who had been named the winner of the tender, was unable to carry out the work, even though the Medan PTUN and Medan District Court had strengthened PT. Putri Mahakam Lestari as the tender winner; 2) what is the state's responsibility for unlawful acts committed by government officials, which have been decided by the Medan State Administrative Court Number 4/P/FP/2020/PTUN-MDN and the Medan District Court Number 465/Pdt.G/2020/PN Mdn. This research uses normative juridical research with a descriptive approach through legislation and a case approach. From the research results it was found that in accordance with Article 53 paragraphs (1) and (2) of Law no. 30 of 2014 concerning Government Administration, PT. Putri Mahakam Lestari as the winner of the tender should receive a Letter of Appointment as Provider of Goods/Services (SPPBJ) and carry out the contract based on Government Goods/Services Procurement Policy Institute Regulation No. 9 of 2018 concerning Guidelines for Implementing Procurement of Goods/Services through Providers for Determining Winners and Regulation of the Minister of Public Works No. 07 of 2019 concerning Standards and Guidelines for Procurement of Construction Services through Providers, Preparatory Meeting for the Appointment of Providers, Article 91 paragraph (1) regarding the construction of the Estuary Ferry Port phase III. Then, as a state responsibility, it must be in accordance with the regulations regarding sanctions in the procurement of government goods and services regulated in Articles 78 - 82 of Presidential Regulation Number 16 of 2018 concerning Procurement of Government Goods/Services in conjunction with Presidential Decree No. 12 of 2021 concerning Government Procurement of Goods/Services including allegations of conspiracy and attempts to abuse the authority of UKPBJ, PPK and KPA provide: 1) the sanction of being aborted in the election; 2) sanctions for disbursement of collateral; 3) Blacklist Sanctions; 4) compensation sanctions; 5) fine sanctions; 6) sanctions for temporary suspension in the E-purchasing transaction system; and/or 7) sanctions for reducing the provider's inclusion in the electronic catalog. ASN/Government Officials in Procurement/Election Working Group/Procurement Agents who are proven to be involved in conspiracy may be subject to sanctions based on Law Number 5 of 2014 concerning State Civil Apparatus and Law Number 20 of 2001 concerning Amendments to Law Number 31 of 2014. concerning the Eradication of Corruption Crimes.

Abstract

Abstrak: Penggunaan perjanjian nominee dapat menjadi strategi yang umum untuk melindungi kepentingan atau menyembunyikan identitas investor. Namun, dalam praktiknya, keabsahan perjanjian nominee ini sering dipertanyakan, terutama dalam perspektif hukum perdata. Analisis terhadap keabsahan perjanjian nominee dalam perspektif hukum perdata menunjukkan bahwa penggunaannya dalam konteks penanaman modal memerlukan pertimbangan yang cermat terhadap prinsip-prinsip hukum perdata yang mendasarinya, serta dampaknya terhadap transparansi, kepastian hukum, dan perlindungan pihak-pihak yang terlibat. Oleh karena itu, dalam mempertimbangkan penggunaan perjanjian nominee, penting untuk mendapatkan nasihat hukum yang kompeten dan mempertimbangkan implikasi hukumnya secara menyeluruh. Metode yang diterapkan dalam penelitian hukum ini adalah metode penelitian yuridis normatif, yang bertitik tolak pada penelitian analisis subtansi peraturan perundang-undangan, buku-buku, jurnal dan makalah. Adapun teknik pengumpulan data yang diharapkan penulis ialah melalui studi kepustakaan. Kesimpulan dari penelitian ini, pertama menurut Kitab Undang-Undang Hukum Perdata (KUHPerdata), perjanjian nominee tidak sah. Kedua, perjanjian nominee termasuk dalam perjanjian innominaat yang telah digunakan secara luas dalam praktik. Kata Kunci: Hukum Perdata, Perjanjian Nominee, Penanaman Modal Abstract: Nominee agreements can be a common strategy to protect investors' interests or hide their identities. However, in practice, the validity of these nominee agreements is often questioned, especially from a civil law perspective. An analysis of the validity of nominee agreements from a civil law perspective reveals that their use in the context of investment necessitates careful consideration of the underlying civil law principles, as well as their impact on transparency, legal certainty, and the protection of the parties involved. Therefore, when considering the use of nominee agreements, it is important to obtain competent legal advice and thoroughly consider its legal implications. The normative juridical research method is used in this legal research, which focuses on analyzing the substance of laws and regulations, books, journals, and papers. The author expects data collection to be done through library research. The conclusion of this research is that, first, according to the Civil Code (KUHPerdata), nominee agreements are not valid. Abstract

Implementing the free market in the ASEAN region is one way to grow an advanced economy. Entrepreneurs must be able to compete in this free market era, including small businesses in Indonesia. Small businesses in Indonesia have an essential role in social welfare and economic development in Indonesia. Therefore, the presence of small businesses must be protected because small businesses are absorption of labor. For this reason, a problem must be answered: how to provide legal protection for small businesses in Indonesia's free market era. Meanwhile, the research method used in this study is a normative legal research method, namely library law research conducted by examining library materials or mere secondary data. This research resulted in a conclusion that legal protection is essential to be provided by the government for MSMEs in Indonesia so that there is legal certainty in guaranteeing the activities of small business actors; several Laws and Invitations have been issued which regulate them among others, the MSME Law, and Law No. 7 of 1994 concerning the Agreement Establishing the World Trade Organization.

Abstract

Penyelesaian sengketa perjanjian Kredit Pemilikan Rumah (KPR) melalui Badan Penyelesaian Sengketa Konsumen (BPSK) menjadi isu penting dalam sistem perlindungan konsumen di Indonesia. Banyak konsumen yang merasa dirugikan oleh pelaku usaha dalam perjanjian KPR, yang sering kali melibatkan inkonsistensi dalam pemenuhan kewajiban dan hak-hak yang tidak terlindungi dengan baik. Penelitian ini bertujuan untuk menganalisis dasar hukum dalam penyelesaian sengketa KPR melalui BPSK dan memahami pertimbangan hakim dalam membatalkan putusan BPSK melalui Putusan Mahkamah Agung Nomor: 163K/Pdt.Sus-BPSK/2017. Metode yang digunakan adalah penelitian yuridis normatif dengan pendekatan deskriptif, yang mengkaji peraturan perundang-undangan dan studi kasus terkait sengketa KPR. Hasil penelitian menunjukkan bahwa meskipun Undang-Undang Perlindungan Konsumen memberikan kewenangan kepada BPSK untuk menyelesaikan sengketa, praktik di lapangan menunjukkan adanya inkonsistensi dalam penerapan hukum yang menyebabkan putusan BPSK dapat dibatalkan oleh Mahkamah Agung. Implikasi penelitian ini diharapkan dapat memberikan pemahaman yang lebih mendalam mengenai mekanisme penyelesaian sengketa KPR, serta memberikan masukan bagi penguatan perlindungan konsumen dan penyempurnaan regulasi terkait penyelesaian sengketa di luar pengadilan.

Abstract

Based on this background, there are several main problems in this writing, namely how legal protection for bank customers in the event of skimming crimes and how dispute resolution efforts can be made by bank customers in the event of skimming crimes. The legal theories used are the theory of legal protection from John Austin and the theory of justice from John Rawls. The research method is juridical normative and the data collection tools used are document or literature studies and interviews. The results of the existing research are Legal protection for bank customers in the event of skimming crimes consists of two types, namely indirect legal protection and direct legal protection. Next about dispute resolution. Dispute resolution that can be done by bank customers in the event of skimming crimes can be taken through non-litigation channels and through litigation channels. Dispute resolution through non-litigation channels, where banks are responsible for the refund of customer funds lost due to skimming by mediating for simple, cheap and fast dispute resolution. Meanwhile, if the customer is not satisfied with the compensation due to skimming, the customer can resolve the dispute through the court.

Abstract

The digital revolution has changed various aspects of life, including the trade sector. The development of information & communication technology (ICT) gave birth to renewable business models, such as e-transactions in buying and selling. However, online transaction activities in purchasing and vending also present various challenges, one of which is related to legal certainty for MSME business actors. This research aims to identify legal certainty problems MSME business actors face in online purchasing and vending. The method used in the study is a normative juridical approach that examines legislation. Data was collected through literature studies related to regulations when carrying out online buying and selling transactions, the rights of MSME business actors, and dispute resolution mechanisms. The data analysis method employed in this study is a qualitative analysis using deductive approaches. The research results show that legal clarity for MSME business actors involved in the online buying and selling process in the digitalization era is important in ensuring that trade transactions carried out via digital platforms occur with transparency, security, and by applicable legal Wprovisions. The law governing online purchasing and vending is based on principles stipulated in Article 34(1) of the 1945 Constitution. It is embodied in Legislation No. 20 of 2008 regarding Micro, Small, and Medium Enterprises (MSMEs). This regulation is the basis for all legal regulations governing MSMEs to provide adequate protection for MSME actors.

Abstract

Law Number 33 of 2014 concerning Halal Product Assurance (JPH Law) aims to protect consumers and increase the competitive ability of Indonesian halal products in the world market, which is included in the aspects listed in the JPH Law, namely the obligation for business actors to obtain halal certificates for goods that business actors produce and trade. The focus of the study aims to evaluate the extent of legal effectiveness in the application of halal product assurance certification by MSME business actors. The research method used is qualitative with techniques in collecting data, namely literature studies. After the data is collected, data analysis is carried out which includes the stages of data simplification, data presentation and conclusion making. The conclusion of the study explains that the effectiveness of the law in implementing halal product assurance certification for MSME business actors is still at a low level. Several obstacles were identified, such as lack of knowledge about the JPH Law and the halal certification process, the relatively expensive cost of halal certification, the halal certification process which is considered complicated and convoluted and lack of assistance and socialization from the government.
