Abstract

Tindak pidana pencabulan terhadap anak yang dilakukan oleh tenaga pendidik merupakan pelanggaran berat yang mencederai nilai pendidikan dan hak anak. Penelitian ini dimaksudkan untuk mengkaji secara mendalam penerapan sanksi pidana terhadap tenaga pendidik yang melakukan tindak pencabulan terhadap anak, ditinjau dari perspektif hukum positif yang berlaku di Indonesia serta dalam perspektif hukum pidana Islam. Metode yang digunakan adalah deskriptif-analitis melalui studi kepustakaan dengan pendekatan kualitatif. Dalam hukum positif, sanksi diatur dalam Pasal 82 (1) UU No. 17 Tahun 2016 jo Pasal 15 (1) huruf (b) UU No. 12 Tahun 2022, yang memberikan pemberatan sanksi kepada tenaga pendidik. Dalam hukum Islam, perbuatan ini dikategorikan sebagai jarimah ta’zir dengan ketentuan hukuman yang ditetapkan oleh hakim berdasarkan pertimbangan moral dan sosial. Hasil kajian menunjukkan bahwa kedua sistem hukum sama-sama menekankan perlindungan terhadap anak dan memberikan sanksi tegas kepada pelaku, terutama bila dilakukan oleh pihak yang memiliki kuasa dan kepercayaan.

Abstract

The self-declare halal certification introduced under BPJPH Decree No. 146 of 2025 has opened new opportunities for micro and small enterprises (MSEs), particularly meat-based culinary businesses that face the most complex halal critical points. Indonesia, with over 65 million MSMEs, still struggles with limited halal literacy, challenges in verifying critical ingredients, and incomplete Halal Product Assurance System (SJPH) documentation. This community engagement project was conducted with a single SME, Dapur Mamih in East Bandung, aiming to strengthen SJPH understanding, improve ingredient traceability, ensure proper documentation, and build the capacity to input applications through the Sihalal platform until the halal certificate was issued. Using a Participatory Action Research (PAR) approach, the program involved field observation, interviews, intensive mentoring, and document verification over one month (August 2025). The pre- and post-test questionnaires revealed clear improvements: halal literacy increased from 35% to 75%, ingredient record-keeping from 40% to 68%, and document validation from 30% to 85%. The SME responded positively, demonstrating behavioral changes in ingredient selection, consistency in record-keeping, and successful submission of data through Sihalal, which led to halal certification of seven culinary menus by BPJPH. These results confirm that participatory mentoring not only enhances declarative knowledge but also develops technical skills, thereby achieving the program’s goal of preparing SMEs for halal self-declare certification. ABSTRAKSertifikasi halal self-declare melalui Keputusan Kepala BPJPH No. 146 Tahun 2025 membuka peluang besar bagi usaha mikro dan kecil (UMK), khususnya kuliner berbahan daging yang memiliki titik kritis paling kompleks. Indonesia dengan lebih dari 65 juta UMKM masih menghadapi tantangan literasi halal yang rendah, keterbatasan verifikasi bahan, dan ketidaktertiban dokumen Sistem Jaminan Produk Halal (SJPH). Kegiatan pengabdian ini dilakukan pada satu UMK, yaitu Dapur Mamih di Bandung Timur, dengan tujuan meningkatkan pemahaman SJPH, keterlacakan bahan, kelengkapan dokumen, serta kemampuan menginput data ajuan pada aplikasi Sihalal hingga terbit sertifikat halal. Pendekatan Participatory Action Research (PAR) diterapkan melalui observasi, wawancara, pendampingan intensif, dan verifikasi dokumen selama satu bulan (Agustus 2025). Hasil kuisioner pre-test dan post-test menunjukkan peningkatan: literasi halal naik dari 35% menjadi 75%, pencatatan bahan dari 40% menjadi 68%, dan validasi dokumen dari 30% menjadi 85%. Respon pelaku usaha positif, ditandai dengan perubahan perilaku dalam pemilihan bahan, keteraturan pencatatan, serta keberhasilan menginput data ke Sihalal hingga tujuh menu kuliner memperoleh sertifikat halal BPJPH. Dengan demikian, pendampingan partisipatif berbasis PAR tidak hanya meningkatkan pengetahuan deklaratif, tetapi juga membangun keterampilan teknis, sehingga tujuan pengabdian tercapai dalam memperkuat kesiapan UMK menghadapi sertifikasi halal self-declare.

Abstract

This study addresses the issue of sanctions against perpetrators of the crime of possession of protected wildlife, focusing on the analysis of Denpasar District Court Decision No. 809/Pid.Sus/2024/PN.Dps. The main problem in this study is the judge's legal considerations in issuing an acquittal for the defendant, as well as how Islamic criminal law examines the case. This research differs from previous studies by integrating positive criminal law and Islamic criminal law perspectives simultaneously. This study uses a normative juridical method with statutory, conceptual, analytical, and case study approaches. The results indicate that the judge considered the defendant's legal ignorance, lack of malicious intent (mens rea), and lack of outreach from relevant agencies. From an Islamic legal perspective, the defendant's actions are categorized as ta'zir crimes, for which sanctions are entirely left to the judge's discretion. This study demonstrates the importance of a substantive justice approach in environmental law enforcement that is not solely based on formal legality but also considers the social context and moral values

Abstract

Legal provisions regarding Regional Regulations and the process of their formation are the basis for the Taqnin process of jinayat law. To understand the mechanisms of criminal law, there are several principles that must be considered in making the Aceh Jinayat Law Qanun. All leaders in the Aceh region showed the process of preparing the Qanun from start to finish. In the Taqnin process in Aceh, the Al-Qur'an and Hadith are the main sources and should not be ignored. Apart from that, the initial plan for the process must be based on the Al-Qur'an and Hadith. Because public legal awareness really determines the success of jinayat law legislation, there are several obstacles in implementing the Aceh Qanun because civil society proposes testing the Qanun, and several organizations even carry out judicial reviews.

Abstract

Carok is a cultural tradition in Madura, involving a fight or duel using a cerulit knife to restore one's pride and honor that has been trampled on by others. This tradition involves abuse and murder, and the perpetrators are not punished because there is a customary agreement. This is not in accordance with Islamic law and positive law. In Islamic Criminal Law, carok is categorized as a qishash-diyat crime. Meanwhile, according to Indonesian positive law, carok is a criminal act of murder as regulated in Articles 338-340 of the Criminal Code. This study aims to analyze the tradition of carok from the perspective of positive law and Islamic criminal law, including examining the sanctions for perpetrators of carok, the elements and stages of carok, and the customary agreements involved. This study uses a descriptive analysis method with a normative juridical approach. The type of data used in this research is qualitative, using secondary data sources with library research data collection techniques and deductive data analysis techniques. The results of this study show that the tradition of carok violates Positive Law and Islamic Criminal Law. In Islamic Criminal Law, perpetrators are subject to qishash-diyat, and in Positive Law, carok is a criminal act and violates the law. Therefore, carok as a tradition needs to be re-examined.

Abstract

Aceh's Qanun, as a legal product of Special Autonomy under Law No. 11/2006, occupies a unique and paradoxical position within Indonesia's national legal framework. Formally, it is hierarchically equivalent to a Provincial Regulation (Perda), yet its substantive authority transcends the limits of ordinary regional autonomy, venturing into domains traditionally reserved for uniform national law—most prominently with the establishment of Islamic criminal law through Qanun Jinayat. This creates a systemic legal dualism where citizens, particularly Muslims, are subject to two concurrent criminal regimes: the national Criminal Code (KUHP) and the Jinayat provisions. Its legislative process reflects this complexity, functioning as a multi-level political arena involving intense negotiations among the Aceh DPRD, the Governor, the Aceh Sharia Court (for syariah-based Qanuns), and the Central Government via the Ministry of Home Affairs' evaluation. This ex-ante control mechanism often prioritizes political and administrative considerations over deep juridical review. While Qanun Jinayat attracts significant scholarly and public attention for its controversial nature, the majority of Qanuns actually govern more technical, secular fields like spatial planning and public services. These face different but equally critical challenges, including regulatory overlaps and weak drafting quality, highlighting a gap between the symbolic prominence of syariah and the practical needs of governance. A fundamental flaw in the system is the weak ex-post control; mechanisms for judicial review are unclear and systematic evaluations of a Qanun's implementation and impact are virtually absent. Consequently, many Qanuns exist and are enforced in a state of persistent legal uncertainty, undermining the very rule of law and equal protection that the legal system aims to guarantee, ultimately posing a continuous challenge to national legal integration

Abstract

Graduates of the Islamic Criminal Law (HPI) Study Program at UIN Sunan Gunung Djati Bandung face challenges related to the suitability of their academic competencies with the demands of the world of work. This study aims to assess the distribution of alumni, the relevance of the curriculum, and the relationship between academic experience and career achievements. The methods used are purposive sampling with an online questionnaire and a sequential explanatory mixed method approach. The results show that the majority of HPI graduates have careers in education, public administration, and da'wah, while their involvement in the formal legal sector is limited; academic abilities support professionalism, but professional networks need to be strengthened. The novelty of this study lies in the integration of alumni distribution analysis with curriculum relevance evaluation, providing practical contributions to the development of learning strategies, internships, and alumni networks so that graduates are more adaptive and ready to face professional demands. Keywords : competence, islamic criminal law study program, opportunities

Abstract

Abstract The application of qishash punishment in Islamic criminal law is often debated because it is considered to be contrary to Article 5 of the Universal Declaration of Human Rights (UDHR), which rejects all forms of cruel, inhuman, and degrading punishment. This accusation is certainly misleading because it views qishash only from a symbolic-artificial perspective. The purpose of this study is to interpret Article 5 of the UDHR, analyze the concept of qishash punishment in fiqh jinayah, and critique Article 5 of the UDHR in relation to the application of qishash punishment. This study uses qualitative research with a normative juridical method through a statute approach, conceptual approach, and comparative approach through library research on primary and secondary legal sources, which are then critically analyzed. The results of this study are able to criticize Article 5 of the UDHR with two main arguments, namely, first, qishash is not a cruel, inhuman, and degrading punishment; second, there is caution in the application of qishash punishment through various critical theories and logic (evotivism theory, deconstruction theory, logical fallacy, cultural relativism theory, critical human rights theory, and postcolonial theory). The novelty of this research lies in its attempt to critique the human rights perspective on the application of qishash punishment by offering a maqashid al-syari'ah qishash approach, namely qishash as a mechanism for protecting the right to life (hifz al-nafs) as well as a form of substantive and proportional justice. The academic contributions of this research include enriching the study of Islamic criminal law with an integrative perspective, offering a critical analysis of the interpretation of Article 5 of the UDHR, and providing normative references for the development of a more contextual national criminal law.

Abstract

Penelitian ini dilatarbelakangi oleh maraknya praktik peredaran minuman keras (miras) dan prostitusi yang menimbulkan degradasi moral serta keresahan sosial di masyarakat. Pemerintah daerah kemudian merespons fenomena ini melalui pembentukan Peraturan Daerah (Perda) tentang pelarangan miras dan prostitusi. Kajian ini bertujuan untuk menganalisis korelasi antara penegakan Perda Miras dan Prostitusi dengan teori Maqāṣid al-Syarī‘ah, khususnya dalam konteks menjaga lima tujuan utama syariat (hifz al-dīn, al-nafs, al-‘aql, al-nasl, dan al-māl). Penelitian ini menggunakan metode kualitatif dengan pendekatan normatif-yuridis dan studi kepustakaan, dengan menelaah peraturan daerah, literatur fiqh jinayah, dan konsep maqasid. Hasil penelitian menunjukkan bahwa penegakan perda tersebut sejalan dengan prinsip maqasid, karena bertujuan menjaga akal dan keturunan masyarakat dari kerusakan moral dan sosial yang disebabkan oleh konsumsi miras dan praktik prostitusi. Selain itu, perda ini juga berfungsi sebagai instrumen tazir modern dalam bingkai siyasah syar‘iyyah, yakni kebijakan pemerintah yang bertujuan mewujudkan kemaslahatan publik. Kebaruan penelitian ini terletak pada upaya mengintegrasikan regulasi daerah kontemporer dengan teori hukum Islam klasik. Kontribusinya diharapkan dapat memperkuat paradigma harmonisasi antara hukum positif dan hukum Islam dalam pembangunan moral dan sosial masyarakat.

Abstract

This research aims to analyze the legitimacy and position of the justice collaborator within the Indonesian criminal justice system and to assess its compatibility with the principles of Islamic criminal law. The method used in this research is a normative juridical approach with statutory and conceptual approaches. The research data were obtained through a literature study of primary legal materials in the form of legislation, the Supreme Court Circular Letter Number 4 of 2011, as well as Islamic legal sources such as the Qur’an, Hadith, and literature on fiqh jinayah. The results of the study indicate that the regulation of justice collaborators in Indonesian positive law provides legal protection and recognition in the form of sentence reductions for perpetrators who cooperate in revealing crimes. From the perspective of Islamic criminal law, this concept can, in principle, be accepted through the approach of tahfif al-‘uqubah (mitigation of punishment), taubat nasuha (sincere repentance), and considerations of public benefit (maslahah mursalah). This research finds a point of convergence between national law and Islamic law, particularly in efforts to realize substantive justice and the protection of public interests.
