Abstract

The problem of justice in the division of joint property after divorce has become increasingly complex in the contemporary era, along with social, economic, and legal changes. This article discusses John Rawls' theory of justice, especially the principle of justice as fairness, and its relevance in formulating joint property division policies. The purpose of this study is to examine the extent to which Rawls' theory can provide a normative framework in assessing and improving joint property division policies to be more equitable. The method used is qualitative research with a juridical-philosophical approach, through literature analysis of Rawls' works and positive legal regulations in force in several countries, including Indonesia. The research findings show that Rawls' principles of justice, especially the difference principle and the principle of equal freedom, can be used to build a joint property division system that pays attention to the balance between individual rights and protection of economically vulnerable parties. In conclusion, the formulation of joint property division policies based on Rawls' theory will encourage the creation of a legal system that is not only legalistic, but also guarantees substantive justice for both parties. Therefore, the integration of Rawlsian justice values ​​in legislation is very relevant to answer the challenges of justice in the dynamics of contemporary society.

Abstract

Effective supervision of criminal investigations is essential to ensure accountability, legal certainty, and the protection of individual rights within the criminal justice system. However, the institutional placement of the Bureau for Investigation Supervision within the Criminal Investigation Agency raises concerns regarding supervisory independence and the effective resolution of public complaints. This study examines the effectiveness of investigation supervision in handling public complaints, identifies institutional constraints on independent oversight, and develops an institutional model for strengthening investigative accountability. The research employs normative legal research through statutory, conceptual, and case approaches, supported by institutional documents, complaint data, and interviews with relevant officials and legal practitioners. The study produces three principal findings. First, substantive public complaints remained consistently high, reaching 3,488 cases in 2023, 3,782 in 2024, and 3,770 in 2025, while substantive supervisory activities represented approximately 47.5 percent, 44.5 percent, and 49.9 percent respectively, indicating a persistent gap between supervisory demand and institutional response. Second, structural dependence within the investigative hierarchy, limited authority to enforce supervisory recommendations, and inconsistent complaint resolution weaken supervisory independence and undermine legal certainty. Third, effective reform requires transforming the Bureau into an independent Investigation Supervision Division that reports directly to the Chief of the Indonesian National Police and operates through an integrated supervisory structure at national, regional, and district levels. The proposed institutional reconstruction would strengthen supervisory independence, ensure effective corrective action, improve investigative accountability, and provide greater legal certainty for individuals seeking justice.

Abstract

Corruption in Indonesia has become a complex issue, systematically, structurally, and massively damaging the governance system. As a result, the exercise of state power cannot fully focus on public interest due to the widespread influence of corrupt behavior. This situation has raised public concern over the increasing prevalence of corruption, which causes significant losses to the state. This article employs a juridical legal approach. The findings indicate that impoverishment can serve as an alternative punishment that effectively deters corrupt actors. However, efforts to eradicate corruption through the impoverishment of corruptors in Indonesia have not been optimally implemented. The legal process has not yet exerted significant pressure through the confiscation of assets obtained from corruption or the restitution of state losses resulting from such crimes. A firmer implementation is necessary so that corruptors face a real deterrent effect in accordance with applicable laws and regulations. This research is expected to assist in identifying and analyzing the current legal regulations related to the impoverishment of perpetrators of corruption crimes, particularly in the context of asset confiscation from criminal proceeds. In addition, this research aims to examine and evaluate the implementation of court decisions against perpetrators of corruption crimes concerning asset recovery or the confiscation of unlawfully acquired wealth.

Abstract

Profit sharing on agricultural land is common in rural communities in Indonesia. Profit sharing on agricultural land is generally carried out according to customary law in the form of mutual trust between landowners and cultivators. The purpose of this study is to analyze the legal culture in profit sharing on agricultural land for cultivators in Lamongan Regency and Kediri Regency. This study uses empirical legal research methods and the theory of Legal Culture. The researcher conducted field research in Lamongan Regency and Kediri Regency, East Java by conducting in-depth interviews for three months with respondents who are farmers and rice field owners who understand the Legal Culture of Farmers and Agricultural Cultivators. This study shows that agricultural land owners in Lamongan and Kediri show more profitable dominance than cultivators because of sustainable land ownership, which is a crucial production factor, while cultivators are vulnerable because they do not have land to meet their needs, even if they have land, the area is less than five hundred square meters.

Abstract

The existence of unclear information on processed food product labels, especially related to halal ingredients, raises concerns for Muslim consumers who are entitled to get products in accordance with sharia. This study aims to study and compare the regulation of the separation of halal and non-halal product places by retail businesses based on Government Regulation No. 42 of 2024 and the Dubai Food Code. The method used is a normative legal approach with comparative legal analysis of the provisions of the two regulations. The results of this study indicate that although Indonesia has a legal basis regulates the obligation to physically separate halal and non-halal product palices, its implementation is still weak due to the absence of technical guidelines and structured supervision. In contrast, Dubai has established clear operational standards. Fields findings also reinforce the conclusion that retail businesses in Indonesia have not fully implemented the obligation of separation and transparency, as seen in products. This study recommends strengthening technical regulations and supervisory mechanisms at the retail level to protect the right of Muslim consumers as a whole.

Abstract

The principle of sustainability (going concern) must create a mutual understanding of the parties in resolving business disputes, debts, and receivables. The principle of good faith in an obligatory agreement guarantees legal certainty for the parties. Failing to meet obligations in a commercial deal does not automatically lead to insolvency, since bankruptcy is viewed as a final option. This study aims to investigate how the going concern principle is applied to debtor organizations within Indonesia’s bankruptcy framework. The methodology follows a normative juridical model, relying on a statutory approach along with prescriptive analysis, and incorporates pertinent primary and secondary legal materials. The results show that there are disharmony and inconsistency of bankruptcy regulations and the Company Law related to the settlement of debtor assets and universal bankruptcy principles, so that a renewal of bankruptcy law is needed, one of which is related to the concept of going concern in bankruptcy considerations through the solvency approach of debtor entities. Creditors can file for bankruptcy if the debtor’s financial statements receive a going concern audit opinion from the auditor because it more accurately describes the company’s health condition. Therefore, the bankruptcy process must consider the going concern principle so that it can provide justice to debtors and creditors in resolving their business disputes.
