Abstract

This research is motivated by issues concerning the authority of the Corruption Eradication Commission (KPK) in handling corruption cases involving both civilian and military jurisdictions, commonly referred to as connectivity cases. The main issues examined are: (a) what is the position and authority of the KPK in handling corruption cases according to the procedural law of connectivity ; and (b) what ratio decidendi and its legal implications of Constitutional Court Decision Number 87/PUU-XXI/2023 on the KPK's authority in handling connectivity corruption cases. The research aims to provide an understanding of the mechanisms for handling connectivity cases, also known as connectivity trials, according to positive law. This includes provisions within Law No. 8 of 1981 concerning the Criminal Procedure Code (KUHAP), Law No. 31 of 1997 concerning Military Courts, Law No. 30 of 2002 concerning the Corruption Eradication Commission (KPK), and Law No. 31 of 1999 concerning the Eradication of Criminal Acts of Corruption (as amended by Law No. 20 of 2001). Furthermore, the research seeks to clarify the position and authority of the KPK following Constitutional Court Decision No. 87/PUU-XXI/2023. Additionally, the research intends to identify the challenges faced by the KPK in handling connectivity cases, such as procedural differences between jurisdictions (civilian and military courts) and institutional coordination. Finally, the research aims to formulate recommendations to enhance the effectiveness of the KPK's authority in handling connectivity corruption cases. The type of legal research employed in this study is normative legal research, utilizing a statute approach, case study approach, and conceptual approach. The research findings indicate that the KPK's position in connectivity cases is not explicitly regulated within the law governing connectivity procedures. However, the KPK, as an investigative institution within the general court system, implicitly possesses the authority to handle connectivity corruption cases based on Article 89 Paragraph (2) of the Criminal Procedure Code (KUHAP) and Article 198 Paragraph (2) of the Military Justice Law. The legal implications of Constitutional Court Decision No. 87/PUU-XXI/2023 affirm that the KPK is authorized to coordinate and control the investigation, inquiry, and prosecution of connectivity corruption cases where law enforcement was initiated or discovered by the KPK.

Abstract

Indoor air quality is an important factor affecting human comfort, health, and productivity, especially in enclosed spaces with high usage intensity, where temperature and humidity serve as primary indicators of environmental conditions. This study aims to design and implement a real-time Internet of Things (IoT)-based temperature and humidity monitoring system using a DHT11 sensor and an ESP32 microcontroller integrated with the ThingSpeak cloud platform. The system is designed to collect environmental data, transmit it via a Wi-Fi network, and display the monitoring results in graphical form through a web dashboard. The research method includes hardware and software design, system implementation, and performance testing under normal indoor environmental conditions. The testing results indicate that the system is capable of displaying temperature and humidity data in real time with stable readings and deviations within the sensor’s tolerance limits, allowing consistent monitoring without significant interruptions. Practically, the system has potential applications in classrooms, offices, laboratories, and public facilities as a remote environmental monitoring solution. Furthermore, the system can be further developed by utilizing sensors with higher accuracy and incorporating additional air quality parameters to enhance its functionality and reliability.

Abstract

The increasingly dynamic development of education raises various challenges, one of which is the problem of bullying in schools. Character education is a solution that is considered effective for overcoming this problem, especially if it is integrated into the Independent Curriculum. This research aims to analyze the effect of integrating character education in the Merdeka Curriculum on reducing bullying cases at SDIT Kasih Ibu. This research uses a quantitative design with a quasi-experimental approach, where data is collected through observation, interviews and surveys with students and teachers. The data analysis techniques used are descriptive and inferential statistics to measure changes that occur before and after implementing the character education program. The research results show that the integration of character education has succeeded in reducing the number of bullying in the school from 20% to 5%, especially physical and verbal bullying. The implication of this research is the importance of implementing character education systematically in the school curriculum to create a safer learning environment and support students' social-emotional development. Apart from that, increasing teacher capacity in implementing character education needs attention so that the success of this program can be maintained. This research contributes to the development of educational policies that are more holistic and have a positive impact on the school environment.

Abstract

This study aims to analyze corruption in the implementation of government procurement of goods and services based on Presidential Regulation No. 16 of 2018 concerning Government Procurement of Goods and Services as amended by Presidential Regulation No. 12 of 2021. The method used is normative juridical with a regulatory and conceptual approach. The study outlines the provisions of Presidential Regulations 16/2018 and 12/2021, as well as the anti-corruption regulations in Law No. 31 of 1999 in conjunction with Law No. 20 of 2001, supported by studies of court decisions and the latest scientific literature. The results of the study indicate that although the second Presidential Regulation emphasizes the principles of transparency, accountability, and the use of an e-procurement system, corrupt practices—such as collusion in auction winners, specification manipulation, and price markups—remain rife. Weak internal oversight, overlapping authority, and lax administrative sanctions are driving factors for irregularities. In response, the study recommends: (1) strengthening the independence and capacity of procurement oversight bodies, (2) simplifying and real-time auditing of the e-procurement system, (3) sharpening administrative and criminal sanctions in the Presidential Decree, and (4) an integrity training program for procurement officials. Implementation of these recommendations is expected to increase the effectiveness of preventing and prosecuting corruption in government procurement of goods and services.

Abstract

This study examines public financial accountability and distributive justice in international space exploration from a normative legal perspective. Despite the rapid expansion of space activities and the increasing allocation of public funds, international space law remains primarily focused on technical responsibility and liability, while lacking binding norms on fiscal transparency, public financial reporting, and accountability. This normative gap raises concerns regarding the equitable governance of outer space as a global common. Employing normative legal research, this study analyzes key international space law instruments, particularly the Outer Space Treaty (1967) and related conventions, together with Indonesia’s national legal framework under Law No. 21 of 2013 on Space Activities. Statutory, conceptual, and comparative approaches are used to assess the adequacy of existing legal norms. The findings reveal an international fiscal accountability gap that undermines the operationalization of the principle of the province of all mankind and contributes to structural inequality in space exploration. At the national level, Indonesia’s space law framework is largely declarative and insufficiently integrated with public finance regulation. This study concludes that normative reform is required to strengthen fiscal transparency, accountability, and distributive justice in space governance.

Abstract

Pertumbuhan pesat industri teknologi finansial berbasis Peer-to-Peer (P2P) lending di Indonesia diiringi dengan meningkatnya risiko gagal bayar yang menimbulkan kerugian bagi pemberi dana (lender). Berbagai kasus pada platform berizin Otoritas Jasa Keuangan menunjukkan masih lemahnya perlindungan hukum lender, terutama pencantuman klausula eksonerasi dalam perjanjian baku. Tujuan penelitian ini adalah untuk mengevaluasi efektivitas pertanggungjawaban hukum penyelenggara pembiayaan P2P setelah POJK 40/2024 diberlakukan. Penelitian ini akan menggunakan metode yuridis normatif dengan pendekatan perundang-undangan dan konseptual. Hasil penelitian menunjukkan bahwa POJK 40/2024 menggeser paradigma tanggung jawab penyelenggara dari perantara pasif menjadi pengelola risiko aktif, sehingga kelalaian dalam credit scoring dan manajemen risiko dapat dikualifikasikan sebagai perbuatan melawan hukum, bukan sekadar risiko bisnis lender. Klausula pengalihan tanggung jawab kepada lender bertentangan dengan Undang-Undang Perlindungan Konsumen dan batal demi hukum. Namun, pemulihan kerugian lender masih belum efektif karena penegakan hukum yang dominan bersifat administratif, sehingga diperlukan penguatan pertanggungjawaban hukum dan pengembangan mekanisme perlindungan yang lebih efektif dalam ekosistem ekonomi digital.

Abstract

Artikel ini menganalisis dan membandingkan kedudukan hukum laporan akuntan publik dalam jasa investigasi sebagai bagian dari pembuktian tindak pidana korupsi di Indonesia dan Malaysia. Fokus utama berada pada (i) jalur penerimaan (admissibility) laporan investigatif dalam sistem pembuktian, (ii) bobot pembuktian (weight) laporan melalui mekanisme pengujian di persidangan, serta (iii) desain kelembagaan yang memengaruhi penggunaan laporan tersebut, khususnya pada pembuktian unsur kerugian keuangan negara. Penelitian ini menggunakan metode yuridis normatif dengan pendekatan perundang-undangan, konseptual, dan perbandingan hukum, melalui studi kepustakaan atas peraturan, doktrin, dan sumber hukum relevan. Hasil kajian menunjukkan bahwa di Indonesia laporan jasa investigasi akuntan publik tidak berdiri sebagai alat bukti mandiri, melainkan harus dikonstruksikan ke dalam kategori alat bukti KUHAP, terutama sebagai keterangan ahli dan/atau surat, sehingga kekuatan pembuktiannya bersifat derivatif dan sangat bergantung pada strategi pembuktian serta penilaian hakim. Di sisi lain, pada konteks pembuktian kerugian negara, terjadi tarik-menarik normatif-institusional antara ruang yang diberikan Penjelasan Pasal 32 UU Tipikor dengan kecenderungan penguncian otoritas pemeriksaan melalui Penjelasan Pasal 603 KUHP (berlaku 2 Januari 2026), yang berdampak pada kepastian hukum penggunaan laporan investigatif pihak non-negara. Sebaliknya, Malaysia memberikan pengakuan lebih eksplisit terhadap expert evidence melalui Evidence Act 1950 serta menormalisasi keterujian bukti ahli melalui kombinasi laporan dan testimoni, diperkuat oleh etika profesi dan pedoman prosedural penyusunan expert report. Temuan ini mengindikasikan perlunya penguatan kerangka pembuktian di Indonesia agar pemanfaatan laporan investigasi akuntan publik lebih akuntabel dan konsisten, tanpa mengurangi prinsip fair trial dan tata kelola pembuktian kerugian negara

Abstract

Revolusi ekonomi digital telah menantang arsitektur pajak internasional tradisional yang bergantung pada kehadiran fisik (nexus). Perusahaan multinasional Over-The-Top (OTT) meraup laba signifikan di negara pasar seperti Indonesia tanpa memiliki Badan Usaha Tetap (BUT) fisik, menciptakan kekosongan hukum dan ketidakadilan pajak. Pemerintah Indonesia merespons dengan konsep Significant Economic Presence (SEP) dalam UU Harmonisasi Peraturan Perpajakan (UU HPP), namun implementasinya ditangguhkan demi menunggu konsensus global Pilar Satu BEPS 2.0. Penelitian ini bertujuan menganalisis kepastian hukum alokasi hak pemajakan serta harmonisasi Pilar Satu ke dalam hukum nasional. Penelitian ini menggunakan metode yuridis-normatif dengan pendekatan perundang-undangan, konseptual, dan komparatif. Hasil penelitian menunjukkan bahwa kekosongan hukum saat ini menciptakan ketidakpastian. Adopsi Pilar Satu (Amount A) menawarkan solusi yang lebih adil berbasis market nexus dibandingkan SEP unilateral, namun memerlukan harmonisasi hukum yang cermat melalui ratifikasi Multilateral Convention (MLC) untuk menjamin kesesuaian dengan Konstitusi dan UU PPh Indonesia.

Abstract

Fasilitas Kawasan Berikat merupakan instrumen insentif fiskal yang bertujuan mendorong pertumbuhan industri berorientasi ekspor dan meningkatkan daya saing investasi di Indonesia. Pemberlakuan Undang-Undang Nomor 6 Tahun 2023 tentang Penetapan Peraturan Pemerintah Pengganti Undang-Undang Nomor 2 Tahun 2022 tentang Cipta Kerja menjadi Undang-Undang membawa restrukturisasi pengaturan di bidang kepabeanan dan perpajakan yang turut memengaruhi tata kelola Kawasan Berikat. Meskipun kerangka regulasi tersebut secara normatif dirancang untuk menyederhanakan perizinan dan memperkuat pengawasan, dalam praktiknya masih terdapat peluang penghindaran pajak dalam pemanfaatan fasilitas tersebut. Penelitian ini menganalisis: (1) pengaturan hukum fasilitas Kawasan Berikat berdasarkan UU No. 6 Tahun 2023 dan peraturan perundang-undangan terkait, serta (2) efektivitas penerapan Ketentuan Anti-Penghindaran Pajak Umum (General Anti-Avoidance Rule/GAAR) dalam menutup peluang penghindaran pajak yang timbul akibat hambatan regulatif dan kelembagaan. Dengan menggunakan metode penelitian hukum normatif melalui pendekatan perundang-undangan dan analitis, penelitian ini menunjukkan bahwa meskipun pengaturan hukum telah tersusun secara komprehensif, fragmentasi antara rezim kepabeanan dan perpajakan, tumpang tindih kewenangan pengawasan, serta keterbatasan integrasi sistem administrasi mengurangi efektivitas korektif GAAR. Oleh karena itu, harmonisasi regulasi dan penguatan koordinasi antarinstansi menjadi prasyarat utama untuk mewujudkan kepastian hukum dan keadilan fiskal dalam sistem Kawasan Berikat.

Abstract

This study designed an indoor environmental condition monitoring system based on IoT using the ESP32 microcontroller and DHT11 sensor, specifically tested to handle extreme temperature fluctuations in Indonesia's tropical climate. The system aims to proactively prevent mold growth on walls by providing early detection of condensation risks and dew points. Temperature and humidity data are periodically transmitted via Wi-Fi and stored in the Firebase Realtime Database for long-term trend analysis. Test results showed that the temperature sensor had an average error of 2.1% with a data transmission success rate of 98%. The implementation of this system offers direct benefits to residents by maintaining air quality and respiratory health through a significant reduction in mold frequency. Furthermore, the web dashboard visualization assists users in taking measurable preventive actions, such as more efficient ventilation management, thereby preserving the structural integrity of the building over the long term.
