Abstract

Criminal acts are a significant concern for the surrounding community and require swift and appropriate handling to overcome them. The crime of human trafficking is a form of denial of the fundamental human status as a legal subject. It also results in cases of humanism that certainly degrade the dignity of humans as social beings. Indonesian law has a complex framework in protecting children from all forms of exploitation and crime, including the Crime of Human Trafficking (TPPO). Within the Indonesian legal system, there are various regulations designed to protect children's rights and provide protection against crimes that threaten their safety. This study uses a normative legal method with a statute approach, a fact approach, and a case approach. Based on the problem in this study, which discusses the Implementation of Legislation in the Protection of Child Victims of Trafficking, the Judge's Consideration in Imposing Sentences in Decision Number 98/Pid.Sus/2020/PN.Kot. Further analysis is needed to understand the judge's considerations and the application of the principle of justice in the decision.

Abstract

The palm oil industry is a strategic sector for the Indonesian economy, but in practice it often faces various problems, particularly related to licensing, which triggers conflicts. In response, the government passed the Job Creation Law, which introduced the Online Single Submission Risk-Based Approach (OSS-RBA) system to simplify regulations and accelerate the licensing process. This study aims to conduct a legal business analysis of the implementation of the Job Creation Law and its impact on licensing disputes in the palm oil industry following the implementation of OSS-RBA. Using a legal research approach, the analysis focuses on the gap between legal norms and their implementation in practice. The results of the study show that although the OSS-RBA is normatively intended to provide legal certainty and efficiency, in reality, the implementation of this system has actually led to new licensing disputes. The main problems identified include a lack of data synchronization between the central and regional governments, inadequate facilities and infrastructure, and insufficient human resources. Furthermore, this system is considered to weaken environmental control instruments and minimize public participation, as evidenced in cases where the participation of indigenous peoples is merely symbolic. This creates a gap between the administrative legitimacy obtained through the system and the socio-legal reality in the field. It is concluded that the effectiveness of the Job Creation Law in resolving disputes is highly dependent on strong implementation support. Therefore, comprehensive institutional reform is needed, including strengthening data interoperability across agencies, establishing a unified oversight body, and harmonizing central-regional regulations. This reform must be grounded in the spirit of achieving substantial justice that balances economic rights with social and environmental responsibilities, not merely procedural efficiency.

Abstract

The expansion of oil palm plantations in Indonesia over the past two decades has significantly contributed to national economic growth, particularly in terms of foreign exchange earnings and employment. However, many plantations have been established within forest areas without valid forestry permits, creating overlapping land tenure and complex legal issues. In this research, the term forest occupation refers to the factual condition in which business actors have settled and cultivated forest areas. The inconsistency between legal maps (de jure) and field realities (de facto) has placed thousands of oil palm plantation actors, both individuals and corporations, in a “grey area” of law. To address this issue, the government enacted Law No. 6 of 2023 (Job Creation Law), which introduced Articles 110A and 110B as administrative mechanisms for legalization and fines. However, the issuance of Presidential Regulation No. 5 of 2025 introduced a new approach through the establishment of the Forest Area Enforcement Task Force (Satgas PKH) involving the military, police, and the Attorney General’s Office, with powers to evict land and impose criminal sanctions—later supported by Ministerial Decree No. 36 of 2025. This policy is considered to violate the constitutional rights of business actors and disregard the principle of lex superior derogat legi inferiori, which holds that lower regulations must not contradict higher laws. This study employs both normative and empirical legal approaches to analyze the normative conflict between regulations. The findings highlight that resolving forest occupation disputes by oil palm enterprises must prioritize the principles of legality, substantive justice, reinforcement of due process of law, and transparency through the One Map Policy to ensure legal certainty and protection for bona fide business actors.

Abstract

Artikel ini membahas perbandingan hukum penanaman modal asing di Indonesia dan Vietnam. Fokus utama penelitian ini adalah menganalisis bagaimana ketentuan hukum di Vietnam lebih mendukung penanam modal asing dibandingkan dengan ketentuan di Indonesia. Dengan menggunakan teori perbandingan hukum, penelitian ini bertujuan untuk mengidentifikasi persamaan dan perbedaan dalam hukum penanaman modal asing antara kedua negara. Objek penelitian difokuskan pada struktur sistem hukum dan ketentuan yang berlaku. Metode penelitian yang digunakan bersifat deskriptif dengan pendekatan perbandingan hukum mikro. Data yang dikumpulkan berupa data sekunder, dan analisis dilakukan secara kualitatif. Hasil penelitian menunjukkan bahwa Undang-Undang Penanaman Modal No. 25 Tahun 2007 (UUPM) di Indonesia dan UU Penanaman Modal No. 67/2014/QH13 di Vietnam memiliki persamaan dalam memberikan perlindungan hukum kepada investor asing serta manfaat bagi kesejahteraan rakyat. Namun, kedua undang-undang tersebut berbeda dalam beberapa aspek, seperti ruang lingkup aplikasi, jenis badan usaha, pengaturan tenaga kerja, bidang usaha investasi, dan institusi penanaman modal. Berdasarkan perbandingan ini, disarankan agar Indonesia melakukan pembaruan hukum penanaman modal untuk menciptakan sistem yang lebih terintegrasi, mempermudah proses perizinan, dan mendukung perusahaan asing yang ingin berinvestasi.

Abstract

Penelitian ini bertujuan untuk menganalisis perbandingan hukum e-commerce antara Indonesia, yang menggunakan sistem civil law, dan Amerika Serikat, yang menggunakan sistem common law. Perbedaan pendekatan hukum ini mempengaruhi perlindungan konsumen di kedua negara, khususnya dalam menghadapi tantangan transaksi digital. Di Indonesia, kerangka hukum e-commerce didasarkan pada Undang-Undang Informasi dan Transaksi Elektronik (UU ITE), Undang-Undang Perlindungan Konsumen, serta Kitab Undang-Undang Hukum Perdata (KUHPer). Peraturan ini mencakup hak dan kewajiban konsumen serta pelaku usaha dalam transaksi digital, tetapi implementasinya masih menghadapi kendala, seperti kesadaran hukum konsumen yang rendah dan lemahnya pengawasan hukum. Sebaliknya, Amerika Serikat mengatur perlindungan konsumen dalam e-commerce melalui Federal Trade Commission Act (FTC Act) dan Consumer Product Safety Act (CPSA). FTC diberikan otoritas untuk menindak pelanggaran hukum oleh pelaku usaha, termasuk penipuan dan kelalaian yang merugikan konsumen. CPSA juga memperkuat perlindungan konsumen dengan mengatur standar keamanan produk serta memberikan kewenangan kepada Consumer Product Safety Commission (CPSC) untuk melarang peredaran produk yang berisiko. Perbandingan ini menunjukkan bahwa regulasi di Amerika Serikat lebih terpadu dan tegas dalam menindak pelanggaran dan menjaga keamanan konsumen. Di sisi lain, Indonesia perlu meningkatkan efektivitas perlindungan hukum e-commerce, terutama dalam pengawasan dan kesadaran konsumen, serta memperbaiki mekanisme pengaduan. Penelitian ini merekomendasikan peningkatan kerangka hukum e-commerce di Indonesia agar lebih komprehensif dan mampu menyesuaikan diri dengan kemajuan teknologi.

Abstract

Cross-border e-commerce (CBEC) semakin berkembang melalui teknologi untuk melakukan transaksi jual beli secara internasional. Perkembangan CBEC muncul untuk memberikan solusi terbaik, seperti kemudahan perdagangan, untuk menjangkau konsumen di berbagai negara. Penelitian ini bertujuan untuk mengetahui CBEC, ketentuan yang mengatur CBEC dalam melindungi pelaku usaha dan konsumen, penerapan CBEC, dan pengaruh CBEC di Indonesia terhadap usaha mikro (UMKM) untuk memperluas dan mengembangkan sektor perekonomian secara global melalui teknologi.

Abstract

Pemanasan global dan emisi gas rumah kaca merupakan isu global yang terus menjadi perhatian, terutama karena berdampak terhadap lingkungan dan aktivitas makhluk hidup. Aktivitas manusia seperti pembakaran hukun dan aktivitas industri menjadi penyebab utama dalam hal ini. Teknologi Carbon Capture and Storage (CCS) muncul sebagai solusi yang signifikan untuk mengurangi emisi karbon. Dalam upaya memahami dan mengevaluasi kebijakan CCS, penting untuk melakukan studi literatur yang komprehensif. Studi ini melibatkan pengumpulan berbagai sumber hukum, laporan pemerintah dan penelitian akademis yang relavan seperti jurnal dan buku. Sumber-sumber hukum memberikan kerangka yang mengatur penerapan regulasi dan teknologi CCS. Setelah mengumpulkan dan menganalisis literatur yang ada, langkah selanjutnya adalah melakukan analisis perbandingan. Dalam tahap ini, metode analisis kualitatif digunakan untuk membandingkan regulasi dan penerapan CCS di dua negara baik Indonesia dan Singapura. Dalam penerapan dan regulasi CCS terdapat perbedaan signifikan antara Indonesia dan  Singapura sebagai konteks penulisan ini. Singapura menunjukkan kemajuan yang lebih cepat dalam penerapan CCS berkat regulasi yang lebih jelas dan dukungan finansial yang kuat. Indonesia perlu memperkuat kerangka hukum dan meningkatkan investasi untuk memaksimalkan potensi CCS.

Abstract

In this day and age, many people are in dire need there is land. Many people also use this land as a future investment front. Because land prices rise every year. This one investmentIt is also closely related to buying and selling land. Definition of buying and selling land according to customary law is an act of transfer of rights, which is cash, real and bright. The nature of cash means Cash, is the transfer of rights by the sellertogether with payment by the buyer and immediately the rights are availableswitch. One of the legal acts of transferring ownership rights to land is bybuying and selling land. In the current practice of buying and selling land, this is expectedthere is legal certainty that can guarantee the continuation of these activitiesthrough the reverse of the name of the land title certificate. Reverse the name of the land title certificate What is done by buying and selling is a legal act of transferring rights other things, except that transfer of rights through auction can only be registered if proven by a deed made by the authorized PPAT. Objective The expected writing in this research is: To analyze the process of changing the name of a title certificate when buying and selling land; To analyze legal consequences if you do not change your name in the buying and selling process land, to analyze the legal measures that can be taken against the perpetrators use of land certificates. This research uses normative research methods, with a focus on collecting data as primary, secondary or tertiary data. Technique Data collection includes data analysis, which ensures proper interpretation of the data systematic, clear, and accurate to provide meaningful insights. Results This research is the Implementation of Transfer of Names of Ownership Certificates in Buying and Selling Land carried out by the Deli Serdang Land Office against the certificate Land ownership rights are legally impaired due to ownership certificates previously had been involved in buying and selling with other people. Abstract

Living law is an inseparable part of the Indonesian criminal law system. However, in perspective of legality principle, living law causing pros and cons. The idea of regulating the living law in Indonesian, as the basis for criminal prosecution, for unregulated act is still debated. The issue that will be analysed in this article is how to apply living law/adat law as a basis for prosecuting criminals related to the existence of legality principle and, how to measure the enforcement of living law in criminal process. Based on the analysis using the principle of legality, it can be concluded that living law, as basis for prosecution, is contrary to principle of legality and protection of human rights. The enactment of living law can potentially create legal uncertainty and abuse of power by the government. Law enforcement against living law is also difficult to implement, because it is tied to the four indicators. Therefore, the living law provision better not be placed as part of general principles in the Indonesian Penal Code Bill. Keywords: Code Bill: Legality principle; Living law.

Abstract

Sea transportation is an important component in international trade, which plays an important role in the distribution of goods. However, there are losses greater than the losses caused by the transportation itself, such as shortages, damages, and loss of goods, which can arise during the process of unloading at the port carried out by the freight forwarding company by sea. This study aims to examine the limitation of responsibility in the legal relationship between freight forwarding companies, carriers, and sea transportation expedition companies in the context of sea transportation activities. Using a normative legal research methodology, this research relies on sources of legal materials, including laws and regulations and court decisions/rulings, using a legislative approach and a case approach. The results of this study show that, first, the limitations on the responsibility of the expedition party are regulated in Article 87 of the Commercial Code, as well as the limitations on the responsibility of the carrier regulated in Article 40 and Article 41 of Law Number 17 of 2008, and the responsibility of the sea freight expedition company in terms of providing facilities, licensing, supervision, and the implementation of order of sea transportation activities, as stipulated in Cassation Decision Number 2665 K/Pdt/2022 which corroborates the decision of the first judge in case Number 728/Pdt.G.2016/PN.Mdn, has been appropriate and fulfills the legal objectives that provide certainty, justice, and usefulness.
