Abstract

This study discusses legal protection for customer data security in internet banking systems in Indonesia, especially after the enactment of various related laws and regulations. The purpose of this study is to analyze how legal protection is applied and the legal measures that can be taken by customers if their data is not protected. The research method used is normative legal research with a qualitative approach, through data collection from secondary sources such as laws, legal literature, and official documents. The final findings show that although legal protection has improved with the existence of relevant laws, there are still challenges in its implementation. Customers have the right to file complaints and legal claims in the event of a data breach, which includes complaint procedures with banks and the Financial Services Authority. Compliance with regulations and the principles of legal justice are essential to maintaining public trust in the banking sector.

Abstract

Consumer protection plays a crucial role in the insurance industry due to the complex, long-term, and trust-based nature of insurance products. Consumers are often in a vulnerable position because of limited access to information and a lack of understanding of policy terms, which increases the risk of losses, especially during claim settlement processes. This study aims to analyze the factors that influence the importance of consumer protection in Indonesia’s insurance sector and to examine the role of the Financial Services Authority (OJK) as the regulatory and supervisory body in financial services. The findings indicate that low financial literacy, information asymmetry, and the dominance of standard contracts are key factors that underscore the need for consumer protection. Meanwhile, OJK plays a strategic role through regulation, supervision, dispute resolution, and financial education for consumers. This study concludes that the effectiveness of consumer protection in the insurance sector depends largely on the synergy between strong regulations, consistent supervision, and improved public awareness of consumer rights.

Abstract

The active role of advocates in peace efforts is stated in the Indonesian Advocate Code of Ethics (KEAI). This is the role that the author wants to emphasize in the contribution of advocates in the urgency of implementing mediation in criminal cases. With the active involvement of advocates, the peace process which previously only took place in the mediation room can now expand outside the mediation room, through interactions carried out by each legal representative. This article uses normative and qualitative juridical research methods on previous data about lawyers, as well as the results of observations and insights obtained by the author while carrying out internship activities at a law office. The results of this research found that the role of advocates is also important as a catalyst for peace between victims and perpetrators of criminal acts. Advocates act as mediators whose aim is to reach an agreement on compensation for the victim as well as an apology from the perpetrator to the victim as well as a form of accountability from the perpetrator to the victim. If there is peace through agreed mediation, the legal process can be stopped if the reporter (victim) has withdrawn his report to the police (article 75 of the Criminal Code). Ordinary offenses cannot stop the court process. However, in practice, if this occurs during the court process, the agreement between the perpetrator and the victim or the defendant and the victim witness will be a consideration for the judge in mitigating when handing down a decision.

Abstract

Maraknya pelanggaran yang dilakukan oleh kurator dalam, pemberasan harta pailit yang menimbulkan pertanyaan dikalangan masyarakat sejauh mana pertanggung jawaban pidana yang diberikan kepada kurator dalam menjalankan tugas dan tanggung jawabnya. Sebagai dasar analisis, penelitian ini menyoroti Melalui Keputusan Mahkamah Agung Nomor 277 K/Pid/2024, dilakukan analisis terhadap peran dan kewajiban kurator dalam pengelolaan serta penyelesaian aset pailit. Penelithan yang bertujuan untuk menganalisis bagaimana sebenarnya penerapan pemidanaan kepada para kurator yang berbuat pelanggaran dalam pengurusan dan pemberesan harta pailit serta bagaimana proses pengembaliannya kepada para kreditur dan juga debitur. Dalam upaya menghimpun dan mengintegrasikan seluruh data, penulis menerapkan metode yuridis normatif dengan pendekatan perundang-undangan serta pendekatan konseptual. Dalam hasil penelitian menunjukkan bahwa pelangaran yang dilakukan oleh kurator dapat menimbulkan tanggung jawab pidana apabila terbukti adanya unsur kesengajaan yang mengakubatkan kerugian dalam pengurusan harta pailit. Penerapan pemidanaan ini dapat menjadi jalan keluar agar para kurator dalam menyelesaikan tugas pengurusannya dapat berjalan dengan baik tanpa adanya penyimpangan pada saat menjalankan tugas dan tanggung jawabnya.

Abstract

Consumer disputes hold significant importance in Indonesia due to the large number of business actors, which necessitates the establishment of the Consumer Dispute Settlement Agency (BPSK) as stipulated in Law Number 8 of 1999 on Consumer Protection. This study examines the relevant legal provisions and their alignment with the BPSK Decision No. 006/SPut/IX/2025/BPSK.Mdn, covering both fundamental regulations and consumer protection aspects. Using a normative juridical approach and referring to primary, secondary, and tertiary legal materials, the research findings indicate that BPSK operates in accordance with existing legal frameworks and upholds the principles of justice, legal certainty, and balance between consumers and business actors. Consequently, the implementation of the law and its decisions are consistent with the foundational principles of the Consumer Dispute Settlement Agency.

Abstract

Remittances generated by migrant workers, particularly those from Indonesia, play a significant role in supporting the economic stability of households and national economies. However, the magnitude of these contributions contrasts sharply with the limited legal and social protection available to migrant workers. This research examines the key factors underlying the persistent impasse in migrant worker protection policies within ASEAN and explores potential strategies for improvement through a comparative assessment of the European Union experience. Using normative juridical methods that combine conceptual, regulatory, and comparative analyses, the study evaluates ASEAN legal instruments and compares them with the European Union framework for protecting migrant workers. The analysis identifies three main causes of policy stagnation in ASEAN. First, the region lacks binding obligations that require member states to adopt uniform minimum standards. Second, existing enforcement mechanisms are weak and do not ensure consistent implementation. Third, member states resist the establishment of supranational authority, limiting opportunities for stronger regional governance. Despite these challenges, functional adaptation through the selective adoption of European Union practices offers viable options, including harmonizing minimum standards, establishing regional complaint procedures, and facilitating the portability of social rights. The research concludes that a gradual and priority based approach, especially for high risk sectors, can enhance migrant worker protection while remaining consistent with the principles of the ASEAN Way.

Abstract

Penelitian ini membahas bagaimana masyarakat hukum adat diakui dalam sistem hukum di Indonesia, dengan fokus pada perbandingan antara komunitas adat yang sudah mendapatkan Surat Keputusan (SK) pengakuan dan yang belum. Menurut UUD 1945, Pasal 18B ayat (2) dan Pasal 28I ayat (3), negara seharusnya mengakui keberadaan masyarakat hukum adat, tetapi dalam praktiknya, pengakuan ini masih terbatas hanya pada aspek administratif. Penelitian ini menggunakan pendekatan yang kualitatif dengan metode studi kasus dan komparatif di Kabupaten Tapanuli Utara, di mana terdapat Desa Simaradangiang (yang sudah memiliki SK) dan Dusun Hopong (yang belum memiliki SK). Data dikumpulkan melalui pengamatan, wawancara, dan analisis dokumen hukum. Hasilnya menunjukkan bahwa keberadaan SK memberikan pengakuan hukum, perlindungan atas hak ulayat, dan kesempatan bagi masyarakat untuk ikut dalam kebijakan publik. Namun, komunitas yang tidak memiliki SK sering kali mengalami ketidakpastian hukum dan rentan terhadap konflik pertanahan. Berdasarkan teori pengakuan (Honneth) dan pluralisme hukum (Griffiths), pengakuan terhadap masyarakat adat seharusnya lebih dari sekadar bentuk resmi, tetapi harus memiliki makna yang mendalam. Penting untuk mengesahkan Rancangan Undang-Undang Masyarakat Adat untuk memperkuat perlindungan atas hak kolektif dan mencapai keadilan sosial dalam sistem hukum nasional yang beragam.

Abstract

This article discusses the application of Intellectual Property Rights (IPR), especially patent protection, to the results of processing haminjon sap into perfume products as a form of innovation based on local wisdom. Haminjon sap, a non-timber forest product typical of North Sumatra, has high economic potential if processed into value-added products, such as perfume. However, the protection of this innovation still faces various legal and practical obstacles. Based on Law Number 13 of 2016 concerning Patents, every invention that meets the elements of novelty, inventive steps, and can be applied in industry is entitled to legal protection. However, the implementation of this protection in the small business sector is still limited due to low IPR literacy, minimal access to information, and relatively high patent registration costs for small businesses. This condition causes many small business actors to not understand the importance of exclusive rights to their inventions, thereby risking losing ownership rights and the economic value of the results of their innovations. Therefore, efforts are needed to increase legal awareness, technical assistance, and affirmative policies from the government to facilitate access to patent protection for local products such as perfume made from haminjon sap, so that they can compete sustainably in the national and international markets.

Abstract

The palm oil industry is a strategic sector for the Indonesian economy, but in practice it often faces various problems, particularly related to licensing, which triggers conflicts. In response, the government passed the Job Creation Law, which introduced the Online Single Submission Risk-Based Approach (OSS-RBA) system to simplify regulations and accelerate the licensing process. This study aims to conduct a legal business analysis of the implementation of the Job Creation Law and its impact on licensing disputes in the palm oil industry following the implementation of OSS-RBA. Using a legal research approach, the analysis focuses on the gap between legal norms and their implementation in practice. The results of the study show that although the OSS-RBA is normatively intended to provide legal certainty and efficiency, in reality, the implementation of this system has actually led to new licensing disputes. The main problems identified include a lack of data synchronization between the central and regional governments, inadequate facilities and infrastructure, and insufficient human resources. Furthermore, this system is considered to weaken environmental control instruments and minimize public participation, as evidenced in cases where the participation of indigenous peoples is merely symbolic. This creates a gap between the administrative legitimacy obtained through the system and the socio-legal reality in the field. It is concluded that the effectiveness of the Job Creation Law in resolving disputes is highly dependent on strong implementation support. Therefore, comprehensive institutional reform is needed, including strengthening data interoperability across agencies, establishing a unified oversight body, and harmonizing central-regional regulations. This reform must be grounded in the spirit of achieving substantial justice that balances economic rights with social and environmental responsibilities, not merely procedural efficiency.

Abstract

This study examines whether paralegal efforts are effective in defending and protecting the human rights of indigenous communities, including their rights to land, natural resources, and cultural identity as recognised by national and international law. This study also examines how the livelihoods of these indigenous communities are preserved from generation to generation, ensuring their survival, through clear regulations guaranteeing customary land ownership, or decrees (SK) recognised by the government. Once a region obtains a decision, either at the district or provincial level, it will receive clear legal certainty regarding customary land ownership. Paralegals play a crucial role as a bridge between indigenous communities and the formal legal system, particularly in advocacy, legal assistance, and raising awareness of community rights. This study aims to analyse the forms of efforts and regulations that govern the role of paralegals in protecting the rights of indigenous communities. The research method used is a judicial normative approach with a regulatory approach and qualitative analysis of various regulations. Therefore, strengthening regulations and policies is necessary to expand the strategic role of paralegals in ensuring effective and sustainable protection of the rights of indigenous peoples.
