Abstract

Tujuan penelitian menganalisis efektifitas pelaksanaan serta faktor penyebab yang memengaruhi penyelesaian tindak pidana dengan pendekatan keadilan Restorative Justice yang dilakukan oleh Kejaksaan Negeri Bone. Penelitian yang digunakan adalah penelitian hukum empiris. Hasil penelitian menujukan bahwa (1). Belum efektifinya pelaksanaan Restorative Justice yang dilakukan oleh Kejaksaan Negeri Bone, dikarenakan lemahnya landasan norma yang digunakan mengalami disharmonisasi norma serta kekosongan norma. (2). Faktor penyebab yang memengaruhi pelaksanaan penyelesaian tindak pidana dengan pendekatan keadilan restorative (Restorative Justice) di Kejaksaan Negeri Bone, terletak pada faktor hukum dan struktur hukum. Pada faktor struktur hukum SDM Kejaksaan yang kurang mumpuni dalam menerapkan konsep Restorative Justice serta jalur koordinasi antar aparat penegak hukum yang tidak tidak memiliki organisasi tata kerja dalam penanganan Restorative Justice di wilayah hukum Kejaksaan Negeri Bone. The research objective is to analyze the effectiveness of implementation and the causal factors that influence the resolution of criminal acts using the Restorative Justice justice approach by the Bone District Prosecutor's Office. The research used is empirical legal research. The research results show that (1). The implementation of Restorative Justice by the Bone District Prosecutor's Office has not been effective, due to the weak basis of the norms used, experiencing norm disharmony and the absence of norms. (2). The causal factors that influence the implementation of resolving criminal acts using a restorative justice approach at the Bone District Prosecutor's Office lie in legal factors and legal structures. The legal structure factor is that the Prosecutor's Human Resources are less capable of implementing the concept of Restorative Justice as well as coordination channels between law enforcement officials who do not have a work procedure organization in handling Restorative Justice in the jurisdiction of the Bone District Prosecutor's Office

Abstract

Tujuan penelitian menganalisis efektivitas fungsi Jaksa penuntut umum dalam menentukan status tersangka pada perkara tindak pidana korupsi di Kejaksaan Negeri Tana Toraja, dan menganalisis Faktor apakah yang mempengaruhi fungsi Jaksa penuntut umum dalam menentukan status tersangka pada perkara tindak pidana korupsi di Kejaksaan Negeri Tana Toraja. Penelitian ini, jika dilihat tipenya maka penelitian ini adalah penelitian hukum empiris. Hasil penelitian ini menunjukan bahwa: Berdasarkan penelitian yang telah di lakukan bahwa fungsi Jaksa penuntut umum dalam menentukan status tersangka pada perkara tindak pidana korupsi di Kejaksaan Negeri Tana Toraja Masih Kurang Efektif karena terdapat beberapa kendala dalam sistem penerapannya. Kendala-kendala tersebut diantaranya Tersangka mangkir panggilan, Sakit, Tidak cukup 2 alat bukti, surat perhitungan kerugian tidak lengkap, meninggal dunia. 2. Faktor-faktor yang mempengaruhi fungsi Jaksa penuntut umum dalam menentukan status tersangka pada perkara tindak pidana korupsi di Kejaksaan Negeri Tana Toraja adalah Faktor Hukum, Faktor Penegak Hukum, Faktor Sarana atau fasilitas, Faktor Budaya dan Faktor Masyarakat. The research objective is to analyze the effectiveness of the function of the public prosecutor in determining suspect status in corruption cases at the Tana Toraja District Prosecutor's Office and to analyze what factors influence the function of the public prosecutor in determining suspect status in corruption cases at the Tana Toraja District Prosecutor's Office. If you look at the type, this research is empirical legal research. The results of this research show that: Based on research that has been conducted, the function of the public prosecutor in determining suspect status in corruption cases at the Tana Toraja District Prosecutor's Office is still less effective because there are several obstacles in the implementation system. Abstract

Tujuan penelitian menganalisis efektivitas penerapan restorative justice yang diberlakukan oleh Kejaksaan Negeri Kep. Selayar terhadap tindak pidana pencurian. Penelitian ini, jika dilihat tipenya maka penelitian ini adalah penelitian hukum empiris dan dilakukan di Wilayah Hukum Kabupaten Kepulauan Selayar tepatnya di Kejaksaan Negeri Kepulauan Selayar. Hasil penelitian ini menunjukan bahwa: Berdasarkan penelitian yang telah di lakukan bahwa Penerapan Restorative Justice di Kejaksaan Negeri Kepulauan Selaya kurang efektif karena Terdapat beberapa faktor yang mempengaruhi Efektivitas penerapan Restorative Justice terhadap tindak pidana pencurian yaitu Faktor Hukum, Faktor Penegak Hukum, Faktor Sarana atau fasiitas, Faktor Masyarakat, Faktor Budaya., Terdapat beberapa faktor-faktor yang mempengaruhi penerapan restorative justice di Kejaksaan Negeri Kepu Selayar diantaranya Pemahaman masyarakat tentang tujuan Restorative Justice masih kurang, Restorative Justice hanya diatur oleh peraturan Jaksa Agung dan Intervensi keluarga dan pihak ketiga. Tujuan penelitian menganalisis fungsi penuntutan jaksa dalam menyelesaikan kasus pencabulan anak dibawah umur, dan Untuk mengetahui. Dalam penelitian ini, penulis menggunakan penelitian hukum normatif yuridis dengan pendekatan kualitatif. Fungsi Penuntutan Jaksa Dalam Menyelesaikan Kasus Pencabulan Anak Dibawah Umur adalah di Kejaksaan Negeri Pinrang sudah optimal, Jaksa Penuntut Umum dalam menjalankan wewenang dan tugasnya berpegang pada pasal Pasal 1 ayat 6 KUHAP Jo Undang-Undang Nomor 11 Tahun 2021 Perubahan atas Undang-Undang Nomor 16 Tahun 2004 tentang Kejaksaan Republik Indonesia dalam hal ini JPU menerapkan asas dalam hal ini dalam KUHP akan mengesampingkan hal-hal yang mempunyai sifat-sifat yang umum dan hanya terfokus kepada hukum yang mengatur sifat yang khusus yaitu yang disebut dengan Lex Specialis Derogat Legi Generalis, dan Fungsi penuntutan jaksa dalam kasus pencabulan anak di bawah umur dipengaruhi oleh berbagai faktor antara lain: Faktor Bukti, Kondisi Korban, Profesionalisme Jaksa, Serta Faktor Kerja Sama Antar Lembaga. The research objective is to analyze the prosecution function of prosecutors in resolving cases of sexual abuse of minors and to find out. The author uses normative juridical legal research with a qualitative approach in this research. The Prosecutor's Prosecution Function in Resolving Child Abuse Cases at the Pinrang District Prosecutor's Office is optimal, the Public Prosecutor in carrying out his authority and duties adheres to Article 1 paragraph 6 of the Criminal Procedure Code in conjunction with Law Number 11 of 2021 Amendment to Law Number 16 of 2021 2004 concerning the Prosecutor's Office of the Republic of Indonesia, in this case, the Prosecutor applies the principle that in this case, the Criminal Code will ignore matters that have general characteristics and only focus on the law that regulates special characteristics, namely what is called the Lex Specialis Derogat Legi Generalis, and the prosecutor's prosecutorial function in cases of molestation of minors is influenced by various factors, including Evidence Factors, Victim Conditions, Prosecutor Professionalism, and Inter-Agency Cooperation Factors.

Abstract

This study aims to gain an in-depth understanding of how the Mamuju Regency House of Representatives carries out its oversight function and its accountability mechanisms over Regional Budget utilization in the Mamuju Regency. The study employs a normative legal research method with a statute approach. The collected legal materials are then analyzed qualitatively to describe the issues and address the research objectives. The results of this study indicate that the oversight function of the Mamuju Regency House of Representatives is an integral element of good local governance. This function is crucial in ensuring the accountability and transparency of Regional Budget utilization as a vital instrument for regional development. The optimization of the Mamuju Regency House of Representatives’s oversight function, including the exercise of the rights of interpellation, inquiry, and expressing opinions, is a determining factor in preventing corruption and guaranteeing the effectiveness of Regional Budget utilization. The accountability mechanisms for Regional Budget management encompass coherent and systematic stages, including the democratic and participatory formulation and enactment of the Regional Budget, the closely monitored implementation by the Mamuju Regency House of Representatives, and the submission of accountability reports and audit reports that present comprehensive evaluations. Therefore, it is recommended that the supporting elements of the Mamuju Regency House of Representatives enhance synergy and coordination in carrying out the oversight function. The Audit Board is expected to improve the quality of audits and expand the scope of audits over Regional Budget utilization. The Regency Government should enhance transparency and accountability in Regional Budget management. Public participation in overseeing Regional Budget utilization must also be enhanced through various mechanisms that facilitate public engagement.

Abstract

Tujuan penelitian menganalisis implementasi pelaksanaan prinsip penerapan asas ultimum remedium terhadap pelaku tindak pidana di bidang cukai hasil tembakau di kantor pengawasan dan pelayanan bea dan cukai tipe madya pabean b makassar. Penelitian ini menggunakan metode penelitian empiris. Hasil penelitian bahwa Penerapan prinsip asas ultimum remedium dalam penanganan tindak pidana cukai hasil tembakau harus dilakukan dengan pendekatan yang bijaksana, memprioritaskan pencegahan dan pemulihan daripada langsung menghukum. Efektifitas pelaksanaan ultimum remedium terhadap pelaku tindak pidana di bidang cukai hasil tembakau dalam penerapannya dianggap telah cukup efektif memberikan dampak secara materil dan moril kepada pelaku pelanggaran, karena kerugian negara yang ditimbulkan lansung dibayarkan ke negara sebesar tiga kali lipat dari nilai cukainya, dapt mengurangi jumlah kasus yang disidik dan dibawa ke Pengadilan, mengurangi biaya penegakan hukum, mengurangi over kapasitas lapas dan mengurangi dampak sosial terhadap pelaku tidak harus mengalami stigmastisasi sebagai terpidana. The research objective is to analyze the implementation of applying the principle of ultimum remedium to perpetrators of criminal acts in the field of excise on tobacco products in the Makassar Customs and Excise Service and customs service middle type B Makassar office. This research uses empirical research methods. The research results show that applying the principle of ultimum remedium in handling tobacco excise crimes must be carried out wisely, prioritizing prevention and recovery rather than direct punishment. The effectiveness of the implementation of ultimum remedium against perpetrators of criminal acts in the field of excise on tobacco products in its implementation is considered to have been quite effective in having a material and moral impact on perpetrators of violations because the state losses incurred are directly paid to the state at three times the value of the excise, able to reduce the number of cases. who are investigated and brought to court, reducing law enforcement costs, reducing prison overcapacity and reducing the social impact on perpetrators who do not have to experience stigmatization as convicts.

Abstract

Tujuan penelitian menganalisis penegakan hukum terhadap pelaku usaha yang mengedarkan kosmetik ilegal; (2) Untuk mengetahui, menganalisis serta mengidentifikasi faktor-faktor yang mempengaruhi penegakan hukum terhadap pelaku usaha yang mengedarkan kosmetik ilegal. Penelitian ini menggunakan data primer melalui wawancara sebanyak 1 Orang Terpidana dan 11 Orang anggota Unit 3 Tipiter Satreskrim Kepolisian Resort Kota Besar Makassar wawancara dilakukan di bulan November 2024. Data dianalisis secara deskriptif dan kualitatif. Hasil penelitian ini menunjukkan bahwa : (1) Penegakan hukum terhadap pelaku usaha yang mengedarkan kosmetik ilegal dilakukan dengan upaya represif dan upaya preventif oleh Kepolisian Resort Kota Besar Makassar . (2) Beberapa faktor yang mempengaruhi penegakan hukum yaitu faktor substansi hukum, faktor penegak hukum, faktor sarana dan prasarana. Rekomendasi penelitian : (1) Terkhusus pelaku usaha diharapkan agar dalam membuat suatu usaha tidak sekedar menjual produk tersebut yang termasuk dalam kategori berbahaya atau tidak mempunyai izin edar tetapi juga harus mempertimbangkan efek yang terjadi setelah pemakaian khususnya kosmetik. The research objective is to analyze the law enforcement against business actors who distribute illegal cosmetics; (2) To find out, analyze and identify factors that influence law enforcement against business actors who distribute illegal cosmetics. This research uses primary data through interviews with 1 convict and 11 members of Unit 3 Tipiter Satreskrim Makassar Resort Police, interviews conducted in November 2024. The data was analyzed descriptively and qualitatively. The results of this research show that: (1) Law enforcement against business actors who distribute illegal cosmetics is carried out with repressive and preventive efforts by the Makassar City Resort Police. (2) Several factors influence law enforcement, namely legal substance factors, law enforcement factors, facilities and infrastructure factors. Research recommendations: (1) In particular, business actors are expected to not only sell products which are categorized as dangerous or do not have a distribution permit but also to consider the effects that occur after use, especially cosmetics.

Tujuan penelitian menganalisis efektivitas kompetensi penyidik terhadap tindak pidana korupsi di Kepolisian Resor Kota Mamuju, dan 2). Untuk mengetahui. Tipe penelitian ini adalah yuridis empiris, data yang diperoleh penulis dari studi dokumen maupun wawancara dengan pihak yang berkepentingan dalam hal ini pihak Kepolisian Resor Kota Mamuju, kemudian dilakukan analisis kuantitatif. Hasil Penelitian penulis mendapatkan bahwa: 1). Efektivitas kompetensi penyidik terhadap tindak pidana korupsi di Kepolisian Resor Kota Mamuju, kurang berjalan secara efektif. Hal ini dikarenakan minimnya kompetensi penyidik dalam memahami nilai kerugian keuangan negara. 2). Faktor yang mempengaruhi efektivitas kompetensi penyidik terhadap tindak pidana korupsi di Kepolisian Resor Kota Mamuju dipengaruhi oleh berbagai aspek seperti: substansi hukum, struktur hukum, sarana, dan budaya hukum. Substansi hukum, khususnya Undang-Undang Pemberantasan Tindak Pidana Korupsi, memberikan kewenangan kepada penyidik untuk melakukan penyidikan. The research objective is to analyze the effectiveness of investigators' competence in criminal acts of corruption in the Mamuju City Police Department, and 2). To know. This type of research is empirical juridical, with data obtained by the author from document studies and interviews with interested parties, in this case, the Mamuju City Police, then carried out quantitative analysis. The author's research results found that: 1). The effectiveness of the competency of investigators regarding criminal acts of corruption at the Mamuju City Police Department is not working effectively. This is due to the investigators' lack of competence in understanding the value of state financial losses. 2). Factors that influence the effectiveness of investigators' competence in criminal acts of corruption in the Mamuju City Police are influenced by various aspects such as legal substance, legal structure, facilities and legal culture. Legal substance, especially the Corruption Eradication Law, gives investigators the authority to conduct investigations.

Abstract

Tujuan penelitian menganalisis urgensi penyitaan aset pelaku tindak pidana korupsi dalam penegakan hukum di wilayah hukum Kepolisian Daerah Sulawesi Selatan. Jenis penelitian yang digunakan dalam penulisan ini adalah penelitian hukum empiris. Penelitian ini menggunakan data primer melalui wawancara sebanyak 1 Orang Anggota PPATK dan 10 Orang anggota Unit 3 Tipidkor. Data dianalisis secara deskriptif dan kualitatif. Hasil penelitian ini menunjukkan bahwa : (1) Urgensi penyitaan aset pelaku tindak pidana korupsi dalam penegakan hukum di wilayah hukum Kepolisian Daerah Sulawesi Selatan yaitu untuk kepentingan proses hukum dan kepentingan pengembalian kerugian keuangan negara. (2) Beberapa faktor yang mempengaruhi penegakan hukum yaitu faktor keterbatasan penyidik kepada pihak Bank dan faktor perhitungan transaksi keuangan oleh Pusat Pelaporan dan Analisis Transaksi Keuangan (PPATK) relatif lama. The research objective is to analyze the urgency of confiscating the assets of perpetrators of criminal acts of corruption in law enforcement in the jurisdiction of the South Sulawesi Regional Police. The type of research used in this writing is empirical legal research. This research uses primary data through interviews with 1 PPATK member and 10 members of Unit 3 Tipidkor. Data was analyzed descriptively and qualitatively. The results of this research show that: (1) The urgency of confiscating the assets of perpetrators of criminal acts of corruption in law enforcement in the jurisdiction of the South Sulawesi Regional Police is for the benefit of the legal process and the interest of recovering state financial losses. (2) Several factors influence law enforcement, namely the limited number of investigators at the Bank and the relatively long time it takes to calculate financial transactions by the Financial Transaction Reports and Analysis Center (PPATK).

Abstract

Tujuan penelitian menganalisis Eksistensi Kepala Desa dalam terwujudnya peralihan hak atas tanah di Kabupaten Mamuju. Penelitian ini menggunakan pendekatan yuridis empiris, bersifat deskriptif analitis. Hasil penelitian ini menunjukkan bahwa eksistensi kewenangan kepala desa dalam terwujudnya peralihan hak atas tanah dikabupaten mamuju sesuai dengan Peraturan Pemerintah No 72 tahun 2005 tentang Desa dan berdasarkan Peraturan pemerintah No 24 tahun 1997 tentang Pendaftaran Tanah bahwa kepala desa sama sekali tidak berhak untuk mengurus peralihan hak atas tanah baik yang belum bersertifikat maupun untuk tanah yang sudah bersertifikat. Peran Kepala Desa dalam bidang pertanahan yaitu hal-hal yang berkaitan dengan peralihan hak. karena jual beli, hibah dan penyertaan modal berupa bidang tanah kedalam satu Perusahaan. Syarat utama untuk mendaftarkan peralihan hak alias balik nama ini adalah akta yang dibuat oleh PPAT. Kemudian ada 2 faktor yang mempengaruhi yaitu: Faktor dari kurangnya kesadaran masyarakat akan peraturan pertanahan dan Faktor dari Kepala Desa yang belum memahami mengenai aturan dibidang pertanahan. The research objective is to analyze the existence of the Village Head in realizing the transfer of land rights in Mamuju Regency. This research uses an empirical juridical approach, descriptive-analytical. The results of this research indicate that the existence of the village head's authority in realizing the transfer of land rights in Mamuju Regency is by Government Regulation No. 72 of 2005 concerning Villages and based on Government Regulation No. 24 of 1997 concerning Land Registration that the village head has no right to manage the transfer of land rights. land, both uncertified and land that has been certified. The role of the Village Head in the land sector is matters relating to the transfer of rights. due to buying and selling, grants and capital participation in the form of land plots into one company. The main requirement for registering the transfer of rights, aka change of name, is a deed made by PPAT. Then there are 2 influencing factors, namely: the factor of the lack of public awareness of land regulations and the factor of the Village Head who does not yet understand the regulations in the land sector.
