Abstract

This research aims to find out and analyze related to (1) the basis for granting surnames to women from other tribes according to customary law; (2) Procedures for granting surnames to non-Toba Batak women due to inter-ethnic marriages in Buleleng Regency. This research is empirical legal research that uses observation, interviews and document studies. The legal materials used in this research are primary, secondary and tertiary legal materials which are useful for drawing conclusions relevant to the problems in this research. The results of the research show that (1) The basis for granting surnames to women and men from other tribes according to customary law is that there is a plural life of citizens today, the flexibility of Batak customary law, the existence of traditional community views based on customary law regarding ethnic differences, the influence inheritance in customary law, and changing an individual's position based on customary law (2) The procedure for granting surnames to non-Batak Toba women according to traditional experts/traditional elders in Singaraja is with the Mangain traditional ceremony and before the Mangain is carried out, approval and participation from the Tulang Party is required. and/or Amangboru.

Abstract

Children are the most beautiful gift given by God Almighty who will play an important role in the future of the Indonesian nation. However, currently a big obstacle in the development of the younger generation is the large number of criminal cases of sexual violence. Cases continue to increase and punishment for perpetrators of sexual violence has not had a deterrent effect, making it difficult to hope to reduce the level of sexual violence. Using normative legal research methods as well as Statute approach, Case Approach, and, Conceptual Approach to examine the considerations of judges' decisions in imposing criminal sanctions on perpetrators of sexual violence against children. The aim of this research is to determine the basis for the judge's considerations in providing protection to children as victims of criminal acts of sexual violence in rape cases in case decision Number 4/Pid.Sus/PN Sgr. The type of research used is normative legal research with descriptive research characteristics. Implementation of the judge's authority as regulated in Law no. 48 of 2009 concerning Judicial Power, article 5 paragraph (2), does not yet provide a clear description of the phrase "experienced in the legal field", in this case it gives rise to vague norms and has the potential to impose sanctions on perpetrators of sexual violence against children that are not optimal.

Abstract

This research aims to (1) analyze and examine the form of dispensation for the use of helmets for motorbike riders and passengers based on the Decree of the Governor of the Regional Head of Level I Bali Number 217 of 1986 Article 4 Paragraph (1) and Paragraph (2) with Article 106 Paragraph (8) of the Law -Law Number 22 of 2009 concerning Road Traffic and Transportation, (2) analyzes the regulations on the use of helmets in terms of traditional clothing which is more appropriate to use in the Decree of the Governor of the Head of the Level I Region of Bali Number 217 of 1986 Prodi Ilmu Hukum 1 Article 4 Paragraph (1) and Paragraph (2) With Article 106 Paragraph (8) of Law Number 22 of 2009 concerning Road Traffic and Transportation. The type of research used in this research is normative juridical research which aims to identify forms of norm conflict that occur between the two laws and regulations. Using a statutory approach and a conceptual approach. The sources of legal materials used are primary legal materials, secondary legal materials and tertiary legal materials. The legal material collection technique used is through document study techniques. The legal material analysis technique used is a vertical synchronization analysis technique. The results of this research show (1) The form of dispensation for the use of helmets for motorbike riders and passengers based on the Decree of the Governor of the Regional Head of Level I Bali, namely when there is a head injury, use traditional clothing within a radius of 10 Km with a maximum speed of 40 Km per hour, (2) Regulations The more appropriate use of a helmet when wearing traditional clothing is Law Number 22 of 2009 concerning Road Traffic and Transportation because it is a law that is at a higher level than the Decree of the Governor of the Level I Regional Head of Bali.

Abstract

The phenomenon of patriarchal culture is still frequently encountered in the midst of community life. This is due to the societal belief that men are prioritized because they are the heirs of lineage. In this case, the author attempts to examine a legal case at the Singaraja District Court concerning alimony and undivided shared property. In the final decision, a larger proportion of the shared property is obtained by the male party due.to.the.absence of a prenuptial agreement that.regulates.the terms of marital property division. The purpose of this research is to analyze court decisions and understand how judges consider dividing shared property without a prenuptial agreement based on the Civil Code, Law Number 16 of 2019 regarding changes to Law Number 1 of 1974 concerning Marriage. Additionally, it aims to encourage society to be more mindful of creating prenuptial agreements before marriage to ensure the interests of both parties are accommodated. The research methodology employed in this study is a normative juridical approach, utilizing three types of approaches: case analysis, legal provisions, and conceptual analysis.

Abstract

Tujuan penelitian ini adalah : (1) untuk mengetahui pentingnya Pendidikan Karakter diberikan kepada peserta didik; (2) untuk mengetahui relevansi Pendidikan Karakter dalam mengembangakan sikap tanggung jawab sosial bagi peserta didik; dan (3) untuk mengetahui internalisasi Pendidikan Karakter dalam memperkaya khasanah pengetahuan peserta didik dalam rangka menumbuhkan sikap positif mengisi kemerdekaan. Metode penelitian, Penelitian ini menggunakan model penelitian dan pengembangan Pendidikan (Educational Research and Development). Proses pengembangan dan validasi produk pendidikan dalam penelitian ini adalah berupa pengembangan model pembelajaran nasionalisme berbasi local genius.Penelitian pada tahap Define dan design ini dilakukan pada setting penelitian: pendidik, sekolah, siswa dan perpustakaan. Tahapdevelopment, yaitu uji coba terbatas sesuai dengan desainnya akan dilakukan di SD Negeri 2 Datah dan SD Negeri 6 Tianyar dengan menggunakan setting kelas-kelas dalam pembelajaran PKn. Kelas-kelas mata pelajaran PKn yang dilibatkan pada tahap develompment dipilih secara purpossive (bertujuan) sesuai fokus penelitian. Penentuan sampel penelitian pada uji coba dilakukan secara random sampling. Hasil: Pendidikan Karakter diberikan kepada peserta didik, relevansinya berpengaruh terhadap sikap tanggung jawab sosial siswa.

Abstract

The purpose of this study was to examine the nature of regional government authority over regional tourism management business cooperation agreements and the legal consequences of regional tourism management business cooperation agreements in increasing Regional Original Income. This study uses normative legal research methods with statutory and conceptual approaches. The results of the study show that the regional government's authority in the field of tourism is in principle one of the implementation of the government's choice of affairs which is the authority of the Regency/City Regional Government, this is based on the provisions of Article 12 paragraph (3) letter b of Law no. 23 of 2014 concerning Regional Government, but specifically the authority of the Regency Government in the field of tourism is regulated in the provisions of Article 30 of Law no. 10 of 2009 concerning Tourism. The regulation of regional tourism business licensing has legal consequences for local governments to carry out tourism business licensing as a preventive juridical effort as an administrative instrument in the tourism business in increasing Regional Original Income.

Abstract

This article analyzes the legal challenges of illegal online lending practices from the perspective of business ethics and the government's role in supporting financial technology. Online lending offers convenience in obtaining funds through quick and easy processes. The research employs a constructivist paradigm and a descriptive-analytical method, with the theory of justice in business as a reference. One major issue is the rise of illegal online lending. The Financial Services Authority (OJK) recorded that from January 2018 to April 2019, 947 illegal peer-to-peer lending fintech entities were blocked. The study results highlight two key points: first, the legal challenges of illegal online lending involve issues related to legal entity structure, licensing, legality, and legal protection for parties involved. From a business ethics perspective, legal online lending must maintain trust, which significantly impacts a company's reputation. However, illegal lending can lead to criminal activities such as fraud and money laundering. Second, the government's role in business development includes improving the national legal system and regulations that cover funding, taxation, consumer protection, education, cybersecurity, and the management of online lending practices.

Abstract

This research aims to determine the constitutional rights of citizens through constitutional complaints based on the authority of the Constitutional Court from the perspective of Constitutional Law. Types of normative juridical research with a statutory, conceptual, and case approach. The data sources used are primary, secondary and tertiary legal materials. The research results show that constitutional complaints as the authority of the Constitutional Court have become an urgent need to be enforced in the Unitary State of the Republic of Indonesia. The authority for constitutional complaints to the Constitutional Court is eliminated, the legal implication of which is to create protection for the human rights of Indonesian citizens from actions by government officials or individuals who injure citizens' human rights and recognition of the Constitution. The Court as an institution has the authority to submit constitutional complaints to the Constitutional Court. Authorised institution. Guardian of the Constitution. The Constitutional Court protects the constitutional rights of citizens if their constitutional rights are violated by the provisions of the law so that the law is then declared to be contrary to the Constitution. The possibility of violations of citizens' constitutional rights does not only occur through normative provisions in law. There are many ways and opportunities for citizens' constitutional rights violations, whether by the authorities or other parties. This is where we learn the importance of the Constitutional Complaints mechanism at the Constitutional Court.

Abstract

This study examines the implementation of the Manak Salah tradition in Padang Bulia Customary Village from the perspectives of legal certainty and human rights protection. Manak Salah is a customary practice associated with the birth of opposite-sex twins, which in Balinese Hindu cosmology is considered a sacred event that may disrupt the balance between the sekala and niskala realms, thereby requiring purification rituals. Although the contemporary practice of this tradition has become more humane and no longer involves social exclusion, its regulation remains unwritten and has not been formally codified in the village’s Awig-awig (customary law). This condition creates the risk of multiple interpretations, legal uncertainty, and insufficient protection of the rights of children and affected families. This research employs an empirical juridical method with a qualitative approach, using interviews with customary leaders, field observations, and document analysis of statutory regulations and customary legal sources. The findings reveal that the absence of written norms causes the implementation of Manak Salah to rely heavily on the discretion of customary authorities, leading to potential inconsistency and normative vulnerability. This study emphasizes the urgency of codifying the Manak Salah tradition into the Awig-awig as a form of customary law reform aimed at ensuring legal certainty, strengthening institutional accountability within customary villages, and harmonizing customary law with Bali Provincial Regulation No. 4 of 2019 and fundamental human rights principles.

Abstract

This study aims to analyze the role and optimization strategies of Pecalang Segara in monitoring fishing activities that contribute to coral reef ecosystem degradation in the Traditional Village of Pemuteran, North Bali. Pecalang Segara is a customary security institution that holds social legitimacy and customary authority in maintaining order within coastal areas. This research applies an empirical legal approach using a qualitative descriptive method. Data were collected through field observations, interviews with customary leaders and coastal communities, and a literature review of environmental laws and related regulations. The findings indicate that Pecalang Segara plays a strategic role in supervising fishing activities based on local wisdom, particularly in preventing destructive fishing practices that damage coral reefs. However, the effectiveness of this role remains limited due to insufficient technical capacity, low environmental legal awareness, and weak integration between customary law and formal legal systems. The study highlights the importance of strengthening Pecalang Segara through environmental education, regulatory-based monitoring training, and institutional coordination with local government authorities. The integration of customary law and national environmental law is expected to establish a sustainable community-based marine monitoring model capable of effectively protecting coral reef ecosystems and supporting environmental governance in coastal areas.
