Abstract

This service was carried out with the title IPR Counseling in a Human Rights Perspective in the East Arso District, Keerom Regency. This activity was carried out because the partners did not understand IPR from a human rights perspective in order to guarantee legal certainty, so that with the expertise possessed by the service team, they could carry out legal counseling in a manner The aim is to provide a link between IPR and Human Rights as well as legal protection for creative works in the fields of science, arts and literature or capabilities in the field of technology, creative works or inventions. The method of implementing this service is carried out by means of legal education through lectures and discussions which were held on Thursday, November 23 2023, which was held in East Arso District, Keerom Regency. This activity begins with preparation and coordination, then presentation of material by providing knowledge to partners regarding the relationship between IPR and Human Rights as well as legal protection for creative works in the fields of science, art and literature or capabilities in the field of technology, copyrighted works or inventions. The output of this service is to provide understanding and knowledge to partners about the relationship between IPR and Human Rights as well as legal protection for someone's creative work and Intellectual Property Rights are rights that originate from the results of creative activities, the ability of human thought which is expressed to the general public in various ways. form, which has benefits and is useful in supporting human life. Apart from that, it also has economic value which is a real form of the ability of intellectual work, which can be in the fields of science, arts and literature as well as in the field of technology.

Abstract

Land border disputes often arise both in rural and urban areas with various problems related to customary land boundaries which can trigger clashes or conflicts between groups. Knowing the things that cause disputes in customary land boundary rights between the Awi and Afar clans and to find out the obstacles and obstacles faced in resolving customary land border disputes between the two groups. The approach used in research is empirical method, namely through field research or direct observation at research locations in order to obtain clarity about the object under study. The results of this research show that the dispute between the Awi clan (in Nafri village) and the Afar clan (in Enggros-Tobati village) occurred because the Afar clan put up a land claim flag on one of the red bridge road axles, but the Awi clan disagreed because they thought the land belonged to their group. Barriers and obstacles in resolving customary land border disputes between the Awi and Afar clans are only two factors, namely internal and external.

Abstract

To ensure legal certainty, it is important to fulfill obligations during the process of changing the name on the title certificate at the Jayapura Regency Land Office. The aim of this research is to determine the application of the principle of Accountability in the process of changing the name of a property rights certificate at the Jayapura Regency Land Office and to identify the variables that cause this process to encounter obstacles. The research approach used is normative, meaning it refers to secondary legal materials such as books, articles, written regulations and other legal documents. The findings of this research indicate that the Jayapura Regency Land Office, in accordance with the Republic of Indonesia PERKABAN, has implemented the principle of accountability fully and correctly in the process of submitting title transfers for land ownership certificates. There are 2 (two) obstacles, both internal and external, in implementing land ownership rights at the Jayapura Regency Land Office. Internal obstacles include a lack of human resources and the large volume of applications that have been submitted to the Jayapura Regency Land Office. Meanwhile there are external challenges, such as the large number of heirs and tax arrears.

Abstract

Pengabdian ini dilakukan dengan judul Penyuluhan Hukum Tentang Peran Pejabat Pembuat Akta Tanah (PPAT) Dalam Pendaftaran Hak Milik Atas Tanah Untuk Menjamin Kepastian Hukum Di Kampung Nendali Distrik Sentani Timur Kabupaten Jayapura, kegiatan yang dilakukan kepada mitra dikarenakan adanya kasus dari mitra tentang ketidakpahaman mengenai Pejabat Pembuat Akta Tanah (PPAT) dalam hal pendaftaran hak milik atas tanah untuk menjamin kepastian hukum, sehingga dengan keahlian yang dimiliki pengabdi dapat melakukan penyuluhan hukum tersebut dengan tujuan untuk memberikan pemahaman dan pengetahuan kepada mitra atas peran PPAT dalam pendaftaran hak milik atas tanah untuk menjamin kepastian hukum serta memberikan pendampingan hukum kepada mitra dalam hal pendaftaran hak milik atas tanah. Metode pelaksanaan pengabdian ini dilakukan dengan cara penyuluhan hukum melalui ceramah dan diskusi yang dilaksanakan pada hari sabtu, tanggal 27 januari 2024 yang dilaksanakan di Balai Kampung Nendali. Kegiatan ini di awali dengan persiapan dan koordinasi, kemudian pemaparan materi dengan memberikan pengetahuan kepada mitra mengenai peran PPAT dalam pendaftaran hak milik atas tanah. Adapun luaran dari pengabdian ini adalah memberikan pemahaman dan pengetahuan kepada mitra tentang peranan PPAT dalam pendaftaran hak milik atas tanah berdasarkan peraturan perundang-undangan yang berlaku dan faktor-faktor yang dialami oleh PPAT sehingga mengalami keterlambatan dalam pendaftaran hak milik atas tanah.

Abstract

Pengabdian ini dilakukan dengan judul Sosialisasi Hukum Terhadap Peraturan Menteri Agraria/KBPN Nomor 5 Tahun 1999 Tentang Pedoman Penyelesaian Masalah Hak Ulayat Masyarakat Hukum Adat Di Kelurahan Koya Barat Distrik Muara Tami Kota Jayapura, kegiatan ini dilakukan kepada mitra dikarenakan adanya kasus dari mitra tentang ketidakpahaman mengenai penyelesaian sengketa tanah ulayat berdasarkan peraturan perundang-undangan yang berlaku dan dimana para pihak yang bersengketa tidak ada yang mau mengalah atau mau menang sendiri sehingga dengan keahlian yang dimiliki pengabdi dapat melakukan penyuluhan hukum tersebut guna agar para pihak yang bersengketa dapat mengetahui tentang adanya peraturan perundang-undangan yang mengatur dalam penyelesaian masalah hak ulayat masyarakat hukum adat. Metode pelaksanaan pengabdian ini dilakukan dengan cara ceramah dan diskusi yang dilaksanakan pada hari sabtu, tanggal 20 april 2024 yang dilaksanakan di Kelurahan Koya Barat dengan memberikan pengetahuan kepada mitra tentang pedoman penyelesaian masalah hak ulayat masyarakat hukum adat. Adapun luaran dari pengabdian ini adalah memberikan pemahaman kepada mitra tentang hal-hal yang menyebabkan sengketa tanah ulayat antar kampung yang satu dengan kampung yang lain dan melakukan pendampingan hukum kepada mitra untuk penyelesaian sengketa batas tanah ulayat didalam masyarakat hukum adat berdasarkan peraturan perundang-undangan yang berlaku. Selain itu juga target luaran berikutnya pengabdi akan publikasikan kegiatan ini kedalam jurnal nasional pengabdian masyarakat.

Abstract

This paper aims to explore the essence of the excuse defense for child offenders and justice for victims. In uncovering its meaning, doctrinal research is conducted with a legislative and conceptual approach, accompanied by a teleological interpretation of legal materials. The research findings indicate that the excuse defense is granted to children under the age of 12 who commit criminal offenses not because their actions are forgiven but due to their inability to form intent or comprehend the consequences of their actions. On the other hand, victims, as the injured party, must also receive justice. The author believes that the government should reconsider the application of the excuse defense for children. The government must also be more selective in determining appropriate sanctions for children based on the nature of the crime committed. If the child's actions result in significant material or immaterial harm, restorative justice may serve as a viable option to balance the interests of both parties, restore the victim's situation, and divert the child from judicial proceedings, thereby achieving a win-win solution.

Abstract

The important role of the National Land Agency in resolving land boundary disputes in Jayapura City cannot be ignored. Many problems arise from land disputes due to the non-implementation of the Delimitation Contradictory Principle, namely the principle relating to the measurement and determination of land boundaries by the BPN. The aim is to find out the application of the Delimitation Contradictory Principle at the Jayapura City Land Office and also to find out the settlement of land disputes due to the non-applicability of the Delimitation Contradictory Principle at the Jayapura City Land Office. The method used in this research is normative and empirical law seen from the applicable laws and regulations and the reality that occurs in the field. The findings of this study indicate that the application of the Delimitation Contradictory Principle at the Jayapura City Land Office is actually according to procedure. However, there are internal problems with the old maps which have been lost and damaged, so there is often overlapping of plots of land. Apart from that, the absence of bordering parties in the field also often occurs, so that BPN must entrust the measuring drawing filling sheet. This causes the application of the Delimitation Contradictory Principle to not run properly, and land disputes cannot be resolved properly. To overcome this, BPN facilitates mediation for the disputing parties so that they do not proceed to more serious problems and even lawsuits in court. if it has not been resolved, a team is formed to deal with it and find a solution so that the problems experienced by the parties do not need to go to court and all this is carried out according to the procedures in the applicable laws and regulations.

Abstract

Corruption crimes in Indonesia are on the rise, particularly through illicit enrichment where individuals accumulate wealth outside of legitimate income. Although Indonesia has ratified the United Nations Convention Against Corruption (UNCAC), the specific issue of illicit enrichment outlined in Article 20 has yet to be implemented in national legislation. This article aims to investigate current and potential future strategies to combat such corruption.  The research is a normative study using a comparative law approach and corpus-based critical analysis to assess Indonesia's anti-corruption efforts, explore the international standards set by illicit enrichment regulations, and draw lessons from the unexplained wealth laws in the United Kingdom and Australia. This research concludes that Indonesia has ratified UNCAC, but illicit enrichment in Article 20 of UNCAC has not been regulated in the law, so the practice of corruption is still so massive. To overcome this, strategic steps are needed in the future, such as revising the corruption law to include illicit enrichment regulations, optimizing institutions through bureaucratic reform, and activating community participation. Therefore, these three steps are very important in implementing the Illicit Enrichment regulation in advancing the corruption eradication agenda in Indonesia in the future.

Abstract

This study aims to determine the process of land acquisition of the customary law community of the Ngalum tribe for development by the Regional Government of Pegunungan Bintang Regency and to determine how to resolve customary land disputes of the customary law community of the Ngalum Tribe with the Regional Government of Pegunungan Bintang Regency. The methods used in this study are normative and empirical juridical, normative juridical is an approach that refers to laws, literature, written regulations or other secondary legal materials, while empirical juridical is identifying and conceptualizing law as a real and functional social institution in a real life system. The results of this study reveal that the process of land acquisition of the Ngalum Tribe with the Regional Government of Pegunungan Bintang Regency goes through several stages of the implementation process starting from planning, preparation, implementation and submission of results. Meanwhile, there are generally 2 (two) ways to resolve customary land disputes of the Ngalum Tribe, namely through the Iwol institution and the Aplim Apom Sibilki Customary Council.
