Abstract

Karangtanjung Village is a village with an area of 380 Ha/m² in the Lemahabang District, Karawang Regency, with the main livelihood being agriculture.. The problem of difficulty in finding work due to the shift in the paradigm of society from agrarian to industrial areas creates inequality, thus potentially causing poverty which leads to crime problems so that it is necessary to conduct research on this phenomenon which is a concern of the Sustainable Development Goals program. Based on this, the identification of the problems raised in this study is what are the factors causing the many crimes that occur in Karawang Regency in relation to the theory of Cultural Deviance? and how are crime prevention efforts to build human resources to realize the Sustainable Development Goals program in Karangtanjung Village? This study uses a qualitative method with an empirical juridical approach. The conclusion of the researcher is that the factors causing the many crimes that occur in Karawang Regency are related to the Cultural Deviance theory, due to the increasing number of residents who do not have prospects (hopes) due to the poor social integration process which gives rise to social inequalities (potential economic sources that are still controlled by a handful of parties) and efforts that can be made to build human resources in order to realize the Sustainable Development Goals program in Karangtanjung Village are by instilling a mindset in the workforce to become entrepreneurs by utilizing the potential of the Micro, Small and Medium Enterprises (MSMEs) sector under the guidance of Village-Owned Enterprises (BUMDes) in Karangtanjung Village.

Abstract

Pariwisata merupakan sektor utama yang memberikan kontribusi signifikan terhadap perekonomian Bali. Namun, tingginya kunjungan wisatawan, membawa juga dampak negatif, salah satunya tindak pidana narkotika. Penelitian ini bertujuan untuk menganalisis dampak negatif kunjungan wisatawan ke Bali, khususnya terkait tindak pidana narkotika, serta meninjau upaya penegakan hukum. Metode penelitian yang digunakan adalah penelitian yuridis-empiris dengan pendekatan kualitatif, yang mengkombinasikan kajian normatif terhadap UU No. 35 Tahun 2009 tentang Narkotika dengan data empiris dari BPS Provinsi Bali dan BNN Provinsi Bali. Hasil penelitian menunjukkan bahwa kunjungan wisatawan memiliki korelasi dengan meningkatnya risiko peredaran gelap narkotika di Bali. Faktor penyebabnya antara lain lemahnya pengawasan pada titik kedatangan wisatawan, gaya hidup bebas yang diadopsi sebagian wisatawan, dan adanya jaringan peredaran narkotika internasional yang memanfaatkan destinasi pariwisata sebagai jalur distribusi. Penegakan hukum terhadap tindak pidana narkotika di Bali masih menghadapi berbagai tantangan, seperti keterbatasan koordinasi antarinstansi, kesulitan pembuktian dalam kasus yang melibatkan warga negara asing, dan keterbatasan teknologi. Dengan demikian, pemerintah perlu melakukan revisi terhadap UU terkait narkotika yang lebih cenderung pada pemulihan korban dan disertai dengan kontribusi seluruh pihak pemerintah baik itu dalam skala nasional maupun internasional.

Abstract

Tindak pidana narkotika merupakan salah satu bentuk kejahatan yang memiliki dampak luas terhadap ketahanan sosial, kesehatan masyarakat, serta stabilitas keamanan nasional. Penyalahgunaan narkotika tidak hanya menimbulkan korban individu, tetapi juga mendorong berkembangnya jaringan peredaran gelap yang bersifat terorganisir dan transnasional. Dalam kondisi demikian, kebijakan hukum pidana menjadi instrumen penting untuk menanggulangi kejahatan narkotika melalui perumusan norma pidana, penegakan hukum, serta kebijakan pemidanaan yang seimbang antara efek jera dan rehabilitasi. Penelitian ini menggunakan metode yuridis normatif dengan pendekatan perundang-undangan dan pendekatan konseptual. Data penelitian bersumber dari bahan hukum primer berupa Undang-Undang Nomor 35 Tahun 2009 tentang Narkotika, KUHP, KUHAP, serta peraturan terkait, dan bahan hukum sekunder berupa literatur hukum pidana dan kebijakan kriminal. Analisis dilakukan secara kualitatif yuridis. Hasil penelitian menunjukkan bahwa kebijakan hukum pidana narkotika di Indonesia masih didominasi pendekatan represif dengan pidana penjara, sementara pendekatan rehabilitatif bagi penyalahguna belum sepenuhnya berjalan efektif. Hambatan yang muncul meliputi overkapasitas lembaga pemasyarakatan, ketidaktepatan klasifikasi antara pengguna dan pengedar, serta belum optimalnya pelaksanaan rehabilitasi. Oleh karena itu, diperlukan pembaharuan kebijakan hukum pidana yang menekankan diferensiasi penanganan antara pecandu sebagai korban dan pengedar sebagai pelaku, serta memperkuat rehabilitasi dan pemulihan sosial demi efektivitas penanggulangan narkotika.

Abstract

Corruption offences in Indonesia not only cause financial losses to the state, but also undermine public trust in the legal system. In the law enforcement process, money obtained through corruption is often used as key evidence to uncover the flow of funds and prove the element of state losses. This study aims to analyse the designation of money as evidence in corruption cases through a normative legal approach by examining legislation, legal doctrine, and judicial practice in Indonesia. The results of the study show that the determination of money as evidence has a strategic role in proving the elements of unlawful acts and strengthening the construction of the public prosecutor's indictment. However, there are still problems related to seizure procedures, evidence management, and the return of state losses that are not yet optimal. The lack of synchronisation between the provisions in the Criminal Procedure Code, the Corruption Eradication Law, and practices in the field also hinders the effectiveness of law enforcement. Therefore, regulatory harmonisation and increased professionalism among law enforcement officials are needed so that the management of money as evidence can provide legal certainty, justice, and benefits in the eradication of corruption in Indonesia.

Abstract

Criminal law reform through the 2023 Criminal Code shows a paradigm shift in criminal punishment in Indonesia from a retributive approach to a more humanistic and benefit-oriented approach. This study aims to evaluate the application of the principle of *hedonic calculus* as a utilitarian instrument in the standardization of punishment, namely assessing legal policies based on their ability to maximize happiness and minimize suffering through indicators such as intensity, duration, certainty, and extent of impact (Bentham, 1789). Using descriptive methods and a qualitative approach through literature studies and analysis of the 2023 Criminal Code, the results of the study show that sentencing standards have accommodated a utility orientation through alternative punishments, an emphasis on offender rehabilitation, and attention to the social impact of sentencing. This approach has the potential to improve crime prevention and social reintegration, but it still faces challenges in maintaining a balance between social utility, the protection of individual rights, and a sense of justice for victims. Therefore, its implementation must be carried out proportionally while upholding human rights and substantive justice.

Abstract

The evolution of legal theory from classical to modern periods reveals significant shifts in how law is understood and conceptualized. While earlier legal theories were strongly shaped by philosophical and political thought, modern legal theory is largely developed within frameworks constructed by legal scholars themselves. Legal positivism, particularly Hans Kelsen’s Pure Theory of Law, argues that law must be separated from non-juridical elements such as social, political, historical, and ethical factors. Nevertheless, in the Indonesian context, law cannot be viewed solely through textual norms. Its effectiveness depends on legal culture, law enforcement performance, and supporting infrastructure. This complexity demonstrates the limitations of a purely positivistic approach when applied to a multidimensional legal system. Therefore, the ongoing development of legal philosophy shows that law cannot be confined to statutory texts alone, but must be understood as a living social institution influenced by broader external factors.
