Abstract

In Islam, reason is put on the most honor place and make it as one of the valuable means to realize the exixtance of God. It is inevitable that some of the Islamic teachings are mobilizing sense, opening mind, and opening human reason, body and soul. Islam does not like the people who do not use their minds, the people whose minds are bound by beliefs and isms that are not based on a correct basis. The independence of thinking can reinforce and strengthen the faith, humility 'and awareness of the greatness of Allah. Independence of thinking is quite important. Because without it, there would be no innovation and creativity. After 68 years of Indonesian’s independence politically, independence of thinking is something that needs to be realized. Without freedom of thinking and social justice, the so called independence is just imaging. Independence of thinking is a golden bridge towards a common welfare. Independence of thinking and freedom of expression are the right of every citizen to express their thoughts orally and in a written form freely in accordance with the provisions of the legislation in force.

Abstract

Abstract; this paper highlights democracy in the history of the constitution of the Republic of Indonesia. In the history of the nation, from independence to now, there are three kinds of democracy that once applied in the constitutional life of Indonesia, namely the liberal democracy, the guided democracy, and the Pancasila democracy. The liberal democracy leads to a failure of the Constituent establishing Undang-Undang Dasar 1945 as a replacement of Undang-Undang Dasar Sementara 1950. The Guided Democracy is under the reign of the old order and the Pancasila democracy is under the rule of the new order. Although the initial concept for the period intended as an implementation of the fourth principle of Pancasila, but the power was ultimately centralized on the hand of President. A failure of the old and the new order to uphold the values of democracy cause a reformation. In this reformation era, the values of democracy are expected to be enforced. Abstract

This article discusses the role of the Village Consultative Body in carrying out its duties and functions in Wanar village, Pucuk District, Lamongan Regency, East Java from the perspective of fiqh siyasa. This research is field and qualitative research. Data were collected through observation, interviews and documentation, which was then analyzed deductively. The results of this study concluded that the function and role of the Village Consultative Body of Wanar Village, Pucuk District, Lamongan Regency, had been carried out well. 2 factors affect the performance of BPD Wanar, namely: supporting and blocking factors. The supporting factor is the support from the village community and the village government is a good partner with BPD. The inhibiting factors are the salary of BPD members is still minimal, facilities and infrastructure are inadequate, funding is lacking, the human resources of BPD members are less qualified, and there is rejection by some communities of decisions/policies made by the village head. From the perspective of fiqh siyasah, the role and function of BPD are equated with ahl al-hall wa al-' aqd and the Hisbah institution. In performing its functions, BPD's performance is by the rules of " tasharruf al-imam ala al- raiyyah manuth bi al- mashlahah " (The imam's actions toward his people must be linked to the benefit of the people).
