Abstract

This article discusses the legal status of a child born from an embryo transfer from a woman who donors the egg to another woman who provide the womb. From Islamic law perspective, a child born from embryo transfer to another woman's womb belongs to the mother who gave birth to her, even though the egg is not from her. This then impacts on the inheritance status whereby the child can inherit from the mother who gave his/her birth, and vice versa. Meanwhile, positive law regards the child is the legal heirs of the parent who have the seed because they are the legal parent of the child pursuant to the agreement that has been agreed by the parties

Abstract

The canon of interpretation in Islamic jurisprudence (al-qawa`id al-fiqhiyah) is like a bridge for an Islamic Jurist (faqih) to find a common thread in analyzing and deciding the extent of the legal problems. It also serves as the meeting point of the Islamic-jurisprudence-related issues. This is what makes an Islamic Jurist wiser and more sensible in applying fiqh at different times and places. When they provide an interpretation on a similar case, they take into account the situation and condition, as well as different customs. At the level of actualization, al-Qawa'id al-Khams can be applied to almost all of the discussion in the discourse of Islamic jurisprudence. The five rules of fiqh are always used as the base and backrest each Islamic Jurists in providing answers and solutions to various problems of life since the classical time to present.

Abstract

The phenomenon of marriage via the Internet is a matter that should be reviewed and commented upon by the experts of Islamic family law in Indonesia. Practice ceremony remotely using this technology media has never even met the previous era. Practice ceremony at the time of the Prophet and the righteous Salaf simply implies permissibility tawkil method, ie, if the contract understudy contract actors (both guardian and groom) was unable to do so. Problems in marriage are done via the internet. On the use of internet facility (on-line), we can see the other person exactly like the original and the same words spoken by what diucaapkannya according to the time when he was talking. This certainly will not reduce the validity of a marriage contract terms as described above, for granted consent and can be done with a clear and done at one time and future wife, guardians and witnesses could see the presence of the husband candidates via the Internet (on-line). There is a difference of opinion in the use of the word sahnnya assemblies on a contract requirement. Jumhurul scholars interpret the word "assembly" is the "time and circumstances or continuous". While some scholars argue that the word "assembly" that means "place", For some scholars, the contract may be performed at different times and places only on probate issues.
