Abstract

This study aims to analyze the implementation of spatial planning regulations in the development of tourism accommodations and law enforcement against spatial planning violations in the Bingin Beach area, Badung Regency. The rapid development of tourism in the area has encouraged the construction of various facilities such as villas, hotels, and restaurants, some of which are located in coastal areas and do not fully comply with spatial planning and licensing regulations. This study uses empirical legal research methods with a legislative approach, case approach, and legal sociology approach. Data was obtained through observation, interviews, and document studies, then analyzed qualitatively. The results show that the implementation of spatial planning regulations in Bingin Beach has not been optimal because there are still tourism accommodation buildings that violate zoning and coastal boundary line regulations. This condition is influenced by weak supervision, rapid tourism development, and lack of compliance with licensing procedures. Law enforcement is carried out by the local government through the imposition of administrative sanctions and efforts to control buildings that do not comply with spatial planning. This law enforcement aims to maintain order in the use of space and protect the sustainability of the coastal environment.

Abstract

Indonesian bureaucracy are in flux. Bureaucracy also can not be separated from the process of political activity. In political activity, the government bureaucracy often use a dual role. On the one hand, the bureaucratic administration role, and on the other hand, can play the role of practical politics, if not set out clearly in law. Government bureaucracy has a role congenital defects, namely as 'official royal disease'. Congenital defect in question is the existence of an opinion that the leadership of the bureaucracy felt it would add prestige, prestigious ruling if she has a lot of staff numbers, although no analysis of whether the number of staff able to work or not. Bureaucratic reform is needed to improve the condition. Reform of the bureaucracy is putting bureaucracy as a public servant with a laid back bureaucracy as an institution of public servants and entrepreneurial system. Bureaucratic positions should be filled by those professional and competence. In addition, the need for strengthening supervision of conspiracy between political institutions and the bureaucratic institutions. Bureaucracy as implementers of government activity to public administration practices with three components, namely the government / state, private, people, still require the presence of additional components, namely a moral component. This component is required to maintain the bureaucratic and political conspiracy.Moreover, the moral components necessary to implement a system of bureaucratic cultural behavior of Pancasila that the smooth running of the state administration, the breath, the style and behavior of Pancasila.Keywords : Bureaucracy reformation, Pancasila Bureaucracy , Public service.

Abstract

The dynamics of the Pecalang’s role in the Traditional Village of Tuban has experienced multifunctional roles after the splendor of the tourism activities happened in the village. As a tourism area that is supported by Ngurah Rai International Airport and heterogeneous and multicultural population, this traditional village requires an arrangement of the socialreligious institution of Pecalang, the Village Security Forces that are in synergy with the Civil Defense (Hansip). The problems that arose in this research were 1). How the form of the Pecalang in supporting the tourism activities in the traditional village of Tuban was?; 2). How the implications of the Pecalang’s involvement in supporting the tourism activities in the village was? The method of approach with the type of the qualitative research, that is, the analysis of field data collection with consideration of the nature and scope of the research problems is in the characteristic of multidisciplinary. Based on the results of the research, it can be described that the multifunctional role of the Pecalang is empirically in synergy with the Security Forces of the traditional village (Hansip). The Pecalang and the Security Forces of the village altogether form a single integrated post to maintain the security, tranquility, and the orderliness at the traditional village of Tuban. The role of the Pecalang in the tourism of a pluralistic community is at the beginning in the domain of “religion,” custom, and culture, then flows to the domain of “state”/security and to the social-economic function of tourism activities. In the real juridical, the formation of Pecalang and the Security Forces of the village was just written in the village role “Penyacah” when the traditional village followed village a contest of traditional villages in the level of Badung Regency in 2016. At that time, there was a mistake to put the role of the Security Forces of the village and the Pecalang. The role of the village Security Forces and the Pecalang should be not in the role of “Penyacah, but in the role of “Nyeje” or “Ngele”/ the released role. Abstract

Balinese unmarried women still do not get legal protection in the rights of inheritance. This is because the Hindu community in Bali adheres to the Patrilinial family system that only men are entitled to receive inheritance. In the development of the main assembly of Pakraman village, Bali (MUDP) has taken the initiative to grant the rights of inheritance to women with their parents' property. From the fact, then the research problems are formulated as (1) How the position of unmarried Balinese women in the customary village of Abianbase? (2) How to implement the birthright of unmarried Bali women in the customary village of Abianbase. The research method used is empirical-juridical research implemented by researching the reality in Abianbase customary village and the Supreme Pasamuhan Decree of MUDP III. The data types used are the primary data and the secondary data. Finally it was concluded that the position of unmarried women equals the women’s position on the customary law of Bali. The unmarried woman cannot have a birthright except the right to take advantages of their parents’ inheritance as the cost of living with other heirs. The implementation is, in the traditional village Abianbase after the decree of the main assembly of Pakraman village about the results of Pasamuhan Agung III MUDP Bali, there’ a need for a relatively longer time because it concerns the tradition that has been ingrained in society life.
