Abstract

Penelitian ini bertujuan untuk merumuskan konsep model pengelolaan hutan desa berbasis desa adat di desa Selat, kabupaten Buleleng. Metode pendekatan yang digunakan dalam perumusan konsep model pengelolaan hutan desa berbasis desa adat yaitu metode dengan aspek perancangan dan aspek sumber daya alam, sedangkan metoda pendekatan untuk warga masyarakat/krama desa dalam kegiatan pelestarian hutan yaitu keterlibatan langsung sebagai pengelola BUM Desa dalam menjaga terjadinya kerusakan hutan desa. Hasil penelitian ini menunjukkan bahwa a) konsep penyempurnaan terhadap Awig-awig Desa Pakraman Pandan Banten Selat menjadi sangat penting untuk dilakukan penyesuaian sejalan dengan perkembangan keberadaan warga masyarakat/krama desa di sekitar kawasan hutan desa. Sebagai antisipasi awal terhadap semakin merebaknya adanya pengerusakan terhadap hutan oleh warga masyarakat/krama desa diperlukan pengaturan semakin tegas dengan cakupan pengaturan lebih luas melalui pararem. b) Konsep pemberdayaan ini dilakukan terhadap keberadaan pecalang jagawana dalam menjaga keamanan dan pelestraian hutan desa. Mengingat tantangan terhadap perilaku warga masyarakat/krama desa akan semakin banyak. Dipandang perlu untuk penambahan (kuantitas) tenaga pecalang jagawana, agar mampu mengcover cakupan luas hutan. Termasuk peningkatan sarana dan prasarana pendukung dalam rangka pengamanan hutan. c) Konsep Rehabilitasi ini dilakukan dalam upaya tetap terjaganya kelestarian hutan. Sehingga program/kegiatan yang dilaksanakan BUM Desa Pandan Harum melakukan rehabilitasi hutan dengan penanaman pohon secara berkelanjutan.

Abstract

Potensi masyarakat lokal dapat dijadikan nilai tambah dalam mengembangkan desa Wisata. Pulau jawa yang jaman kerajaan Majapahit agama Hindu sebagai agama kerajaan, maka kini masih menyisakan warisan budaya yang dapat meperkuat ketahanan sosial-budaya sekaligus apabila didisain menjadi ketahanan ekonomi lokal. Contoh riil pura Bukit Amerta yang terletak di Desa Karangduro kecamatan Tegal Sara memiliki nilai tambah potensi sumber mata air yang digunakan sebagai sumber Tirta (air suci) dan sumber air baku bagi masyarakat di Desa Karangdoro Banyuwangi. Pura Bukit Amerta menjadi daya Tarik wisata bagi masyarakat Karangduro untuk mendulang nilai tambah dari kegiatan eko wisata spiritual. Hal ini, menjadi tujuan Pengabdian untuk mengetahui permasalahan mitra yaitu: 1) Persoalan penggunaan air untuk kepentingan Tirta (sembahyang) terpenuhi, namun untuk kepentingan rumah tangga masih memerlukan solusi; 2) Pura sebagai subyek hukum belum memiliki serfikat hak milik sebagai bukti eksistensi pura dalam aspek yuridis; 3) Pura sebagai pusat kebudayaan dan sekaligus sebagai nilai tambah dalam ekonomi kerakyatan berbasis lokal. Metode yang digunakan dalam Bentuk pemberdayaan Masyarakat dalam mewujudkan pendampingan, FGD dan menemukan inti persoalan yang sebenarnya. Desa Wisata spiritual, dengan metode Persoalan hukum sangan komplek, dapat menemukan persoalan yang tersembunyi dalam kasus subyek hukum pura yang belum disertifikatkan. Menginventarisasi persoalan dan memecah persoalan yang timbul akibat Pura sebagai pusat kebudayaan dan pengembangan ekonomi kreatif dalam pengelolaan pura sebagai respons masyarakat di sekitarnya. Target luaran yang akan dicapai adalah publikasi jurnal Nasional/ atau proseding ISBN Nasional, publikasi mass media, video kegiatan pengadian.

Abstract

The formulation of customary law norms for marriage and inheritance needs to be constructed through Awig-Awig (customary law) formulation to ensure legal certainty in strengthening Balinese customary law. The Awig-Awig formulation is a form of codification of Balinese customary law, which regulates traditional village members and their various activities, Parhyangan (temple) as a forum for village members to connect with Ida Sang Hyang Widi Wasa (God Almighty) and at the same time as a means of preserving Balinese culture, Palemahan (land) as a manifestation of the territory and at the same time as an area that becomes the foundation of the source of life and a foothold in living life until death in a harmonious relationship. In the development of the life of village members, which are always in process, it is necessary to confirm the arrangement through Awig-Awig formulation, such as in the field of membership of village members with their rights and obligations, marriage, inheritance with the intention of being enforced consistently and dynamically according to appropriate values ​​in a society that is always developing.

Abstract

The global expansion of tourism carries social, cultural, and economic significance, necessitating effective management. Legal regulations are instrumental in ensuring justice and societal welfare, encompassing human rights fulfillment for tourists, encompassing quality service, safety, and comfort. This requires collaborative synergy between the government, tourism service providers, local communities, and tourists themselves. Empirical research is employed in this study, amalgamating sociological and legal approaches. Primary data is supported by secondary literature. The research explores legalities surrounding supervision and law enforcement, inadequacies in preventing illegal travel ageny (biro perjalan wisata/BPW), law enforcement strategies against such entities, and governmental efforts for tourist legal protection and sustainable tourism realization. Findings affirm that effective regulation, involving stakeholders' responsibility, is vital for justice in the tourism sector. However, challenges persist in effectively preventing illegal travel agencies despite governmental efforts, resulting in discrepancies between issued permits and operational travel agencies. Law enforcement mechanisms primarily leverage Bali Regional Regulation Number 10 of 2020, especially targeting illegal online operations. To ensure tourist protection and Bali's sustainable tourism, governmental persuasion and prevention strategies are pivotal. The study proposes a policy merger and a travel agency permit moratorium to legalize tourism actors, fostering job creation and societal welfare while preserving sustainable tourism in Bali.

Abstract

Legal Politics and social changes in Bali Tourism Tourism Villages have provided Balinese people, especially Indigenous Balinese, to develop cultural tourism. The majesty of Balinese Hindu cultural values is not only recognized by the Republic of Indonesia, even the world recognizes it by providing protection for Balinese Hindu cultural and cultural values such as Balinese irrigation (subak). Therefore, legal protection for the people of Bali, especially tourism villages in Bali which are based on Hinduism, local traditions, customs and Balinese culture, is important and very relevant for research. The purpose of this research is to find out a new value for the concept of cultural tourism in managing tourism villages in Bali. The value of local wisdom in tourism management if the state and indigenous peoples in Bali are unable to provide protection, then the sustainability of cultural tourism will be threatened. Traditional villages in Bali have the potential to develop culture-based tourism. For this reason, this paper examines the potential for rural tourism (ecotourism) in various regencies in Bali, especially Badung, Tabanan, Bangli regencies, then legal politics related to cultural tourism will be the focus of this writing. The research method used is empirical legal research, with legal anthropology and legal sociology approaches. The research results show that legal politics towards tourism villages can be realized in the form of legislation, Bali Province Regional Regulations, Regency/City Regional Regulations and/or Regent Regulations and others. Cultural tourism arrangements are contained in the Regional Regulation of the Province of Bali Number 5 of 2020 concerning cultural tourism standards. The impact of the implementation of the regional regulations mentioned above, there has been a social change in the management of culture-based tourism villages in each traditional village in Bali. In this case, it is managed by the Institution, namely Traditional village-owned enterprise (referred to as BUPDA) as an instrument for the welfare of the Balinese indigenous people in managing Cultural Tourism. If necessary, traditional villages can work together with (private) investors using BOT agreements to strengthen cultural tourism

Abstract

Indonesia as a rule-of-law country has statutory regulations, relating to criminal sanctions and sentencing. In addition, some laws apply throughout the area called Customary Law, including in Bali. Perpetrators of the destruction of goods as well as religious blasphemy can be punished with the general criminal code or, in comparison with the Applicable Customary Law. This research examines 2 things: 1) How is the existence of the Hindu religious community in carrying out its obligations and legal protection for Hindu religious people in terms of Human Rights? and 2) What is the application of legal sanctions in the event of the revocation of the penjor for Hindus in the Taro Kelod Village area, Gianyar Regency? The method used in this research is Empirical Research. The purpose of this research is to emphasize the study of the protection of penjor removal victims in Taro Kelod Village, Gianyar. With the results of the study showing that a person deliberately destroys goods together and harms someone, it is possible to be subject to Article 170 paragraph (1) and Article 156A letter A concerning religious blasphemy, because the penjor being revoked is a sacred symbol and has religious meaning for Hindus.

Abstract

Publikasi ini bertujuan membahas diskursus politik hukum dalam mempertahankan desa adat di Bali. Sebagai hasil penelitian kualitatif, pengumpulan data dilakukan melalui studi dokumen, observasi parsisipasi daan wawancara mendalam dengan 10 informan kunci yang memahami topik penelitian. Data yang diperoleh dianalisis dengan menerapkan teori secara eklektif, yakni teori sistem hukum Lawrence M. Friedman, teori kuasa/pengetahuan Michel Foucault dan teori praktik sosial Bourdeau. Hasil penelitian menunjukan bahwa upaya mempertahankan desa adat di Bali, telah terapkan politik hukum yang diwarnai perdebatan (diskursus) yang muncul di era orde baru, era reformasi dan era pasca reformasi. Pada era orde baru, diberlakukan Peraturan Daerah (Perda) Provinsi Bali Nomor 6 tahun 1986 untuk mempertahankan desa adat Bali sekaligus menentang UU Nomor 5 thuan 1979 penyeragaman bentuk desa. Pada era reformasi diberlakukan Perda Provinsi Bali Nomor 3 tahun 2001 tentang desa pakraman yang kemudian diperbaruhi menjadi Perda Provinsi Bali Nomor 3 tahun 2003 tentang desa pakraman. Aroma tuntutan reformasi begitu kuat dalam kedua produk hukum (Perda Nomor 3/2001 dan Perda Nomor 3/2003) ini. Disamping memperkuat sistem keamanan desa adat dengan mengakui eksistensi pecalang, Perda Provinsi Bali Nomor 3/2001 mengganti proses pemilihan bendesa dari sistem musyawarah ke sestem voting serta mengganti Majelis Pembian Desa Adat menjadi Majelis Desa Pakraman. Selanjutnya dalam Perda Provinsi Bali Nomor 3 tahun 2003 istilah pakraman digugat, karena hal ini tidak menguntungkan baghi krama Bali. Selanjutnya pada era Pasca Reformasi, politik hukum dalam mempertahakan desa adat di Bali kembali diperbarui dengan dikeluarkannya Perda Provinsi Bali Nomor 4 tahun 2019 tentang Desa adat di Bali. Beberapa substansi penting dalam produk hukum ini, antara lain: mengembalikan sebutan desa pakraman menjadi desa adat, kembali ke sistem musyawarah dalam pemilihan bendesa, serta kedudukan Desa adat disejajarkan dengan desa dinas yang diperkuat dengan pemberian alokasi APBD untuk desa adat. Politik hukum yang menjamin kesinambungan eksistensi Desa adat di Bali perlu terus dipertahankan.

Abstract

Incidents of accidents during risky climbs have been reported in Bali, and yet to date there are no specific legal regulations regarding mountaineering tourism in the region. Mountaineering tourism is a type of tourism with a high risk, making it very important to implement legal regulations that can provide protection to tourists in any undesirable situation. This research aims to evaluate the legal protection of tourists according to Law No. 10/2009 on Tourism as well as the liability of mountain climbing tourism business actors to those who have experienced losses. This is a qualitative research which adopted normative and conceptual approach. The research findings indicate that there is a necessity for additional regulations as stated in the Governor Regulation of Bali No. 52/2021 concerning Regulations for the Implementation of Regional Regulation No. 5/2020 concerning Standards for the Implementation of Balinese Cultural Tourism. In accordance with Article 1366 of the Civil Code, businesses or managers of the mountain climbing tourist attractions in Bali are obliged to be responsible in the case of accidents that have caused significant losses to tourists. The liability of business actors can also refer to Article 7 of Law No. 8/1999 on Consumer Protection. In addition, the liability of business actors as managers of tourist attractions is also referred to Article 26 of Law No. 10/2009 concerning Tourism and Article 6 No. 3 of Bali Province Regional Regulation No. 5/2020 concerning Standards for the Implementation of Balinese Cultural Tourism.

Abstract

Tourism in Indonesia is experiencing rapid development, bringing both positive and negative impacts. However, with the rapid growth of tourism in Bali, the problem of unlicensed tour guides, or illegal guides, has emerged, which is detrimental to the quality of service and image of tourism. This research aims to analyze the local government's supervisory function towards illegal tour guides and examine the enforcement of legal sanctions against foreign tour guides based on relevant regulations. The researchers intend to further explore legal issues related to the authority of the Bali Provincial Government in enforcing the law against foreign tours without a license, focusing on the synchronization of rules between national and regional regulations to create better legal certainty. The results of this research show that the local governments in the Balinese province have the authority to enforce the law, and the local authorities in the province have a responsibility to ensure the integrity of the tourism sector. The research results also show that there is a need to improve the capacity of law enforcers in order to ensure optimal law enforcement, protect the tourism industry, and support the sustainable development of Bali tourism.

Abstract

BKSDA Bali faces problems in the development of natural tourism in Taman Wisata Alam Gunung Batur Bukit Payang (TWA GBBP), namely the business of providing natural tourism facilities (hot springs) without permission by Batur Customary Village. The hot spring has been managed since 1986 and developed into Batur Natural Hot Spring in 2007. The issues discussed in this study are: (1) How is the licensing process for the use of conservation forest areas in the development of natural tourism in Taman Wisata Alam Gunung Batur Bukit Payang? (2) What is the model of community-based natural tourism development in Taman Wisata Alam Gunung Batur Bukit Payang? The methods used in this study are a type of empirical legal research, using the approach of legislation, the historical juridical approach and the legal sociology approach. Based on the results of the analysis, it can be concluded that the process of licensing the utilization of the area in TWA GBBP is based on: (1) Inventory of regional potential, (2) Arrangement of the area into the management block, set on February 11, 2016, (3) The design of natural tourism sites on the utilization block, set on June 4, 2018, (4) The preparation of the management plan (RPJP) of KPHK Kintamani was set for April 15, 2019. Taman Wisata Alam Gunung Batur Bukit Payang is eligible for natural tourism business licensing in the form of IUPJWA / PB-PJWA and IUPSWA / PB-PSWA. There are three models of community-based natural tourism development in Taman Wisata Alam Gunung Batur Bukit Payang, namely: (1) Hot Spring Tourism (Batur Natural Hot Spring) developed by Batur Customary Village and accommodated through cooperation with PT. Tanaya Pesona Batur through IUPSWA commitment, (2) Camping Tourism developed by Pokdarwis Ampupu Kembar, (3) Mount Batur Climbing Tour developed by FP3GB through the provision of IUPJWA.
