Abstract

The law of child protection is very important and determines the future of family, community, nation and state formation. If a country's child protection law is formulated, ratified, and enforced concretely in terms of substance, structure and culture applied consistently and continuously, then the position of the child both in family, community and nation will become a very strong pillar and foundation. for a country to achieve its objectives nationally independent. Improper treatment or discrimination is the duty and responsibility of guardians or other parties and their parents. Getting the right opportunity to protect and grow socially, physically, and even spiritually is absolutely given because the future leaders of the nation and the next generation will be able to fight for the nation and its ideals. Eliminating discrimination requires equality in all aspects of the field because it involves the same views and opportunities where women and men have equal access and opportunities, equality of views does not mean women must be equal to men, because women are naturally different from men. Because children are the generation and successors of the nation, the Government forms an independent institution whose task is to shade and provide protection or supervision of children who are victims of crime, namely the Indonesian Child Protection Commission (KPAI) providing data reporting and assisting these children to obtain rehabilitation or recovery related to their rights.

Abstract

Protection for children has become the responsibility of the state, and the protection provided is also the responsibility of families, teachers and the community to protect children so that they do not become victims of bullying which is increasingly widespread. Children who are victims of bullying certainly experience depression and even stress as well as feelings of fear and lack of confidence in facing the surrounding environment, and the impact also results in prolonged trauma and it is difficult to forget it, because the victim is someone who experiences suffering as a result of someone's actions or treatment other. Legal protection for children who are victims of bullying is to provide or implement their rights, such as the right to access medical services and assistance and also receive medical, as well as social and psychological services. As a result, by providing legal protection for children as victims of bullying, it can alleviate children's suffering in an effort to provide repressive protection so that children can return to experience recovery and good conditions as before in realizing true child protection.

Abstract

This study discusses that gender equality must be paired with justice and justice, between men and women must be equal and there must be no differences or contradictions. A normative study looking at it from the perspective of the following law is that submission will discuss the rights of a woman, everyone has equal rights without exception, and those rights have existed since man is in a supported reserve. Research methods using the normative juridical method by reviewing the literature and legislation, where the findings or results have met the requirements for the rights of everyone listed in the regulations of Law Number 39 of 1999, but viewed from the point of view seen sociological that in society assumes that gender equality can occur if each party considers to be responsible, their duties and roles. While the usefulness of this research provides benefits and participation of law enforcers, the community must not represent gender differences or injustice in the community, all people have the same rights, novelty in this study agrees and then gender in community life to prioritize and prioritize there will be the right to life, because that right is a very determined right granted to all people such as the right not to increase torture, get education, health, and eliminate the perception of gender inequality in any field or area of life, because everyone is the same and supports , in the field of law, and also government.

Abstract

Domestic violence is an increasingly widespread problem, and is often triggered or caused by a variety of things, but the most prominent is economic problems or primary needs. Perpetrators as people who commit violence can be reviewed why to do it, due to several factors in him, such as the environment, heredity, psychiatric disturbed so that in solving household problems is often done with high emotions and full of inappropriate words spoken to the interlocutor. While the victim as the party suffering due to the treatment given by the perpetrator must also be seen, the perception of the victim as a weak party, the victims here based on the type there are victims who really want themselves to be victims, there are victims who are truly themselves victims, exploited by the perpetrators, where violence there are various forms of physical, psychological, sexual violence and neglect of the household, this is seen when viewed from the perception of criminology and victimization. The research method used is normative juridical that is by tracing the literature and legislation relating to the problem under study. The result is that the perpetrators of domestic violence are seen from the aspect of the perpetrators' responsibilities regarding their age to be able to punish and sanction, the victims see their role when the crime is related to the loss suffered, and the settlement of the household according to the law on the elimination of violence in the household namely number 23 of 2004, namely by preventing the occurrence of criminal acts, protecting victims, providing emergency assistance, assisting the process of determining the application for protection.

Abstract

Legal protection for witnesses and victims is a crucial element in the criminal justice system, particularly in handling extraordinary crimes such as corruption, terrorism, and human trafficking. Although regulated by Law Number 31 of 2014 concerning Witness and Victim Protection, its implementation still faces various structural and normative obstacles. This study aims to analyze the effectiveness of legal protection and reconstruct an ideal protection model. The research method used is normative juridical with statutory and conceptual approaches. The results indicate that existing protection is suboptimal due to weak inter-institutional coordination, limited authority, and the lack of strengthened protection for whistleblowers and justice collaborators. Therefore, a reconstruction of the protection system based on restorative justice and institutional strengthening is necessary.

Abstract

Tindak pidana korupsi merupakan kejahatan luar biasa yang berdampak masif terhadap kerugian keuangan dan perekonomian negara. Penegakan hukum saat ini kerap dihadapkan pada dilematika ketika pelaku korupsi secara sukarela mengembalikan seluruh kerugian negara yang ditimbulkannya. Penelitian ini bertujuan untuk mengkaji pertanggungjawaban pidana dan sistem pemidanaan ditinjau dari asas kepastian hukum terhadap pelaku yang mengembalikan kerugian negara. Metode yang digunakan adalah penelitian hukum normatif dengan pendekatan perundang-undangan dan pendekatan kasus, secara khusus membedah Putusan PN Surabaya Nomor 22/Pid.Sus-TPK/2023/PN Sby dan Putusan Mahkamah Agung Nomor 1283 K/PID.SUS/2010. Hasil penelitian menunjukkan bahwa pengembalian kerugian negara dikualifikasikan sebagai perbuatan pasca-fakta (post-factum) yang secara dogmatis tidak menghapus sifat melawan hukum dan niat jahat (mens rea) pelaku berdasarkan penganutan teori dualistis. Pasal 4 UU Pemberantasan Tindak Pidana Korupsi ditegakkan secara lex stricta untuk memastikan penjatuhan pidana penjara demi efek jera. Meskipun demikian, asas kepastian hukum tetap diharmonisasikan melalui penghapusan pidana tambahan berupa Uang Pengganti guna mencegah terjadinya perampasan ganda (double recovery). Kesimpulannya, ketiadaan parameter matematis terkait besaran pengurangan pidana berdasarkan nominal dan waktu pengembalian memunculkan kekosongan norma (vacuum of norm). Kondisi ini mendesak perlunya pembentukan pedoman pemidanaan oleh Mahkamah Agung untuk mencegah disparitas putusan di masa mendatang.

Abstract

Kesadaran terhadap hukum merupakan suatu bentuk yang dari individu akan sikap dan batinnya atau dari masyarakat yang sudah menghargai serta memahami dan juga dapat menaati secara sukarela tanpa adanya paksaan dari suatu peraturan dari perundang-undangan yang ada. Dimana tujuannya untuk menciptakan akan keadilan sosial, serta ketertiban yang didorong oleh dengan adanya akan pemahaman serta pengetahuan, pemahaman dan juga kepatuhan hukum dari kesadaran nurani tumbuh dan bukan dari ketakutan, Wujud dari kesadaran hukum terkait dengan perlindungan akan anak tentunya didasarkan akan pemahaman dan pengetahuan hukum serta perilaku dan sikap yang memberikan suatu kesadaran yang tinggi akan perlindungannya karena adanya anggapan bahwa anak juga membutuhkan perlindungan dan hakiki dan menyeluruh. Penguatan dari perlindungan akan anak dimulai sejak dini dengan menumbuhkan kesadaran hukum bahwa anak berhak untuk dilindungi termasuk hak-haknya untuk mendapatkan perlindungan khusus dan bukan untuk mengalami perlakuan yang tidak manusiawi karena termasuk juga pelanggaran akan hak asasi manusia dan prinsip-prinsip dari perlindungan terhadap anak itu sendiri. Hasilnya adalah dengan tumbuhnya kesadaran hukum melalui internalisasi dari nilai-nilai bagi setiap orang tanpa adanya paksaan dari orang lain dan setidaknya dapat meminimalisir atau berkurangnya tindakan atau tindak pidana termasuk kejahatan dan pelanggaran yang dialami oleh anak dan hak dari anak akan dapat terealisasi karena mengutamakan tumbuh dan kembang anak serta mengutamakan akan kepentingan yang terbaik bagi anak dalam mencapai kesejahteraan dalam kehidupannya dimasa mendatang
