Abstract

This research examines the influence of religious groups on LGBT policies in Thailand and Indonesia from a human rights perspective, focusing on the differences in policy implementation influenced by religious values in the two countries. This research uses a qualitative approach with descriptive-analytical methods. Data was collected through a literature study that included academic journals, legal documents, and international organization reports. The results show that in Thailand, Buddhism's emphasis on tolerance has led to relatively inclusive policies towards the LGBT community, although structural discrimination remains in some aspects. In contrast, in Indonesia, the influence of conservative Islamic groups is dominant, resulting in more restrictive policies towards the LGBT community, with significant social and political pressure. The research also found that human rights principles have not been fully integrated into LGBT policies in either country, although Thailand tends to be more open to change. As such, this research contributes to understanding the dynamics between social norms, conservative religious values, and human rights principles and the implications for LGBT-related policy formation in two countries with very different cultural backgrounds.

Abstract

This paper analyzes the results of court decisions on the application of jurimetric formulations in the division of joint property as an effort of justice. Jurimetry can be used as an option when the division of joint property regulated in the Compilation of Islamic Law does not guarantee justice to the parties. Jurimetry emphasizes the division of joint property based on the implementation of the obligations and responsibilities of each party while bound by marriage, so that the use of jurimetry will provide a greater sense of justice. The focus of this article is how the jurimetry formulation of court decisions in cases of division of joint property and its relevance to the principles of justice. This article is a literature research with a normative approach. The source of data in writing this article is court decisions regarding joint property. The result is that the application of jurimetry in the division of joint property can provide more justice for the parties. Parties who do not carry out their obligations in full will have their rights to joint property reduced in accordance with their actions. Conversely, parties who carry out their obligations in full will get rights in accordance with their actions. If both parties carry out their obligations in full, then both are entitled to the same amount of joint property. The recommendation of the results of this writing is that the judge can use this jurimetric formulation as a consideration in handling joint property disputes. Keyword: Jurimetry, Joint Property, Justice and Legal Reform

Abstract

Politik sektarianisme di Lebanon telah menjadi faktor penting dalam pembentukan dan perkembangan sistem politik negara ini, yang tercermin dalam pembagian kekuasaan berdasarkan identitas agama dan etnis. Penelitian ini bertujuan untuk menganalisis dampak sektarianisme terhadap kepentingan nasional Lebanon, dengan menyoroti bagaimana sistem politik Lebanon yang berlandaskan pada prinsip-prinsip sektarian mempengaruhi stabilitas internal dan hubungan luar negeri negara tersebut. Dalam kajian ini, menggunakan teori sektarianisme dan kepentingan nasional untuk memahami bagaimana pembagian kekuasaan yang didasarkan pada denominasi agama (Maronit, Sunni, Syi’ah, dan lainnya) mempengaruhi pembuatan kebijakan dalam negeri serta strategi luar negeri Lebanon. Penelitian ini menunjukkan bahwa meskipun sistem sektarian memberi ruang bagi inklusivitas politik, ia juga menciptakan ketegangan antar kelompok, yang pada gilirannya memperburuk stabilitas politik dan sosial negara. Selain itu, intervensi aktor eksternal, seperti Saudi Arabia dan Iran, memperburuk persaingan politik domestik dan memperburuk dampaknya terhadap kepentingan nasional Lebanon. Dengan demikian, sistem politik sektarian di Lebanon tidak hanya berimplikasi pada kebijakan domestik, tetapi juga membentuk dinamika politik regional dan internasional yang semakin kompleks.Sectarian politics in Lebanon has played a pivotal role in shaping and developing the country’s political system, as reflected in the power-sharing arrangement based on religious and ethnic identities. This study aims to analyze the impact of sectarianism on Lebanon's national interests, highlighting how the sectarian-based political system influences internal stability and the country’s foreign relations. Utilizing theories of sectarianism and national interest, this research examines how the power distribution along religious denominations (Maronite, Sunni, Shia, and others) affects domestic policymaking and Lebanon’s foreign policy strategies. The findings indicate that while the sectarian system allows for political inclusivity, it also generates inter-group tensions, exacerbating the nation’s political and social instability. Furthermore, external interventions by actors such as Saudi Arabia and Iran have intensified domestic political rivalries, compounding their adverse effects on Lebanon’s national interests. Thus, Lebanon's sectarian political system not only impacts domestic policies but also shapes increasingly complex regional and international political dynamics.

Abstract

Penelitian ini bertujuan untuk menganalisis implementasi Proyek Rethinking Plastics (2019-2022) di Kota Tegal dalam konteks pengelolaan sampah plastik laut dan kontribusinya terhadap pengembangan Ilmu pemerintahan dan Politik. Metode yang digunakan adalah pendekatan kualitatif dengan desain studi kasus, melibatkan Dinas Kelautan & Perikanan Pelabuhan Perikanan Nusantara Tegalsari, Forum Anak Tegal Bahari (Fantri), dan pelaku usaha pengelolaan sampah di wilayah pesisir. Data dikumpulkan melalui analisis dokumen dan dianalisis menggunakan metode process tracing. Hasil penelitian menunjukkan bahwa meskipun proyek berhasil menurunkan persentase sampah plastik secara signifikan pada puncak intervensi, penurunan tersebut tidak sepenuhnya dapat dikaitkan dengan proyek karena keterbatasan cakupan wilayah dan durasi pelaksanaan. Kebijakan lokal seperti pembatasan plastik sekali pakai dan peningkatan kapasitas TPS turut berperan penting. Penelitian ini menekankan pentingnya kolaborasi lintas sektor dan integrasi kebijakan lokal dengan inisiatif bilateral untuk keberlanjutan pengelolaan sampah plastik. Rekomendasi mencakup pembentukan forum koordinasi, pengembangan skema insentif, perluasan edukasi inklusif, serta penguatan ekonomi sirkular melalui dukungan anggaran dan pelatihan teknis. Kontribusi penelitian ini terletak pada pemahaman tentang dinamika kerja sama pemerintahan lokal dan aktor non-negara dalam pengelolaan lingkungan yang berkelanjutan.

Abstract

Educational diplomacy has become an important element in international relations, especially in the era of globalization and technological revolution. This research aims to explore the role of United Arab Emirates (UAE) soft power in education diplomacy in Indonesia, particularly in the context of technology transfer and innovation. Using a descriptive-analytical qualitative approach, this research examines the dynamics of bilateral relations between the UAE and Indonesia, through technology-based education initiatives, such as the Alef Education platform. The results show that the United Arab Emirates has utilized various tools in education diplomacy, including technology transfer in Indonesia through Alef Education, proven to improve accessibility and quality of learning in Indonesia. However, the research also found challenges, including cultural differences, regulatory barriers, and limited technology-based education infrastructure, as well as program synergies with the national curriculum to support the sustainability of these programs. This research provides a deep insight into how the UAE's education diplomacy becomes a strategic tool in strengthening bilateral relations and creating long-term impact for Indonesia's education sector. The implications of this research can help identify opportunities for further cooperation in the field of education technology and innovation

Abstract

Unregistered polygamous marriages (poligami siri) often give rise to complex legal issues, particularly regarding the protection and rights of children. The disharmony between positive legal norms and social realities creates legal disparities that result in uncertainty over the legal status of children born from such marriages. This situation leads to a central legal inquiry: How can the formulation of legal norms be directed to ensure the protection of children’s rights in the context of unregistered polygamous marriages? This study aims to analyze these legal gaps through a philosophical approach, emphasizing the principles of justice and child welfare. Using a qualitative method through literature review, this paper reflects on the values of substantive justice that should underpin legal formulation and implementation. The findings indicate that the existing legal framework does not fully guarantee the protection of children's rights in the context of unregistered polygamy. Therefore, a reformulation of legal norms is necessary one that is more responsive to social realities and aligned with justice and welfare principles as the philosophical foundation of law.

Abstract

The discourse on human rights in the Muslim world continues to generate significant debate, particularly regarding the interplay between Islamic principles and universal human rights standards. This study explores the implementation of human rights in Muslim-majority countries by examining two essential approaches: the essentialist perspective, which views Islamic teachings as inherently compatible with human rights, and the socio-historical perspective, which emphasizes the contextual interpretation of Islamic values in contemporary settings. The research aims to analyze how these differing approaches influence the realization of human rights in the Muslim world. Using qualitative methods, including literature review and content analysis of key Islamic texts, legal frameworks, and case studies from various Muslim countries, the study identifies patterns and challenges in harmonizing Islamic doctrines with global human rights norms. The findings reveal that while the essentialist approach promotes a timeless and unchanging view of human rights within Islam, the socio-historical perspective offers flexibility, allowing for reinterpretation in response to evolving societal needs. The study concludes that a balanced integration of both approaches is essential for fostering a comprehensive and culturally relevant human rights framework in the Muslim world, emphasizing the importance of dialogue, contextual understanding, and legal reforms.

Abstract

The rapid development of Artificial Intelligence (AI) and telemedicine has transformed healthcare delivery by improving efficiency, accessibility, and patient reach. Nevertheless, these innovations raise significant legal challenges, particularly regarding medical malpractice, diagnostic accuracy, doctor–patient communication, and the protection of sensitive medical data. This study aims to examine the potential risks of medical malpractice arising from the use of AI and telemedicine and to evaluate their broader legal implications for patient safety and healthcare quality. The research employs a literature review and case law analysis, focusing on health regulations governing the integration of AI and telemedicine in medical practice. Using a descriptive and comparative approach, this study explores dimensions of legal responsibility, including the liability of healthcare providers, technology developers, and medical professionals. The findings indicate that errors in AI-based medical diagnosis may generate liability due to algorithmic failures, while telemedicine creates legal concerns in communication that affect clinical accuracy. In addition, patient data protection remains a critical issue due to risks of data breaches. The study concludes that comprehensive regulations are urgently needed to ensure data security, establish mechanisms for monitoring AI algorithms, and provide adequate training and certification for medical professionals in utilizing these technologies.

Abstract

Cybercrime is becoming a very serious threat to Indonesia's national security. The pervasive nature of cyberattacks raises questions about the effectiveness of current regulatory measures. This research aims to analyze how the government addresses security challenges in cyberspace in a sustainable manner. A descriptive qualitative method was used to evaluate the impact of cybercrime in Indonesia and its relationship with highly interrelated regulations. The results show that the threat of cybercrime and cyber-terrorism, in both physical and digital forms, has increased alarmingly in recent years. The impact of universal access to all relevant information has several consequences, including the spread of false information and the development of cybercrime networks. Significant measures are needed to disrupt the cyber terrorism industry to create a safe environment in Indonesia. The success of regulatory measures in Indonesia relies on a holistic approach involving the active participation of the government, society, and the private sector.

Abstract

The trilateral conflict involving Iran, Israel, and the United States represents one of the most persistent and complex geopolitical tensions in the Middle East. Rooted in ideological opposition, strategic competition, and concerns over nuclear proliferation, this conflict has had far-reaching implications for regional stability and the credibility of international legal norms. Each actor, Iran, Israel, and the United States has engaged in actions that reflect differing perceptions of threat and power projection, often justified through contested interpretations of self-defense and sovereignty. This study raises a central question: to what extent do the actions of Iran, Israel, and the United States in their ongoing conflict reflect compliance with or violations of the core principles of international law, particularly those relating to state sovereignty, non-intervention, and the lawful use of force? The objective of this research is to analyze how the legal justifications and strategic behaviors of the three actors align with or undermine international legal norms. Employing a qualitative, descriptive-analytical method, the study draws on official documents, United Nations reports, and scholarly literature to assess relevant events, such as targeted killings, cross-border airstrikes, and proxy warfare. The findings suggest that all three states have frequently invoked self-defense in ways that stretch or sidestep legal boundaries, contributing to a pattern of norm erosion and legal ambiguity. In conclusion, this conflict illustrates a broader legitimacy crisis in international law and underscores the need for stronger, more consistent multilateral mechanisms to uphold legal accountability in global security affairs.
