Abstract

The post-covid-19 pandemic in Indonesia has had a major social impact on society in the form of unemployment and divorce. The problem is whether the government can be held accountable for its policies in the context of overcoming the COVID-19 pandemic which has caused many social impacts on the society. The is study aimed to determine the government's responsibility for increasing social community such as increasing layoffs (PHK) and divorce in the society during the pandemic. The research methodology applied empirical methods. The results were based on the theory of government action, which is an action taken by state administrators in carrying out government duties that cause disputes between the people and the government. In Indonesia, the responsibilities of the government have not been regulated, and in practice, the society is still neglected. Society has surrendered to the consequences of the PPKM policy during the COVID-19 pandemic. Even if there are people who will file a civil lawsuit against the government. This lawsuit against government officials in the civil sector in Indonesia is based on the unlawful acts of the government as regulated in Article 1365 of the Civil Code.  The responsibilities of the Government other than in the field of civil law is in the field of state administrative law.

Abstract

In 2020 Walls Indonesia re-launched their legendary product, "Viennetta" Ice Cream which was famous in the 90s. but this is misused by bad people who are not responsible for their own interests. They took advantage of the public's enthusiasm for the return of the legendary product from Walls Indonesia, namely Viennetta Ice Cream by hoarding these items and selling them at a higher price. The regulations regarding consumer protection against hoarding of goods have received protection from the Ministry of Trade in the Regulation of the Minister of Trade Number 20/M-DAG/PER/3/2017 concerning Registration of Business Actors in the Distribution of Staple Needs, but unfortunately this regulation only applies to basic goods. Therefore, this study aims to educate consumers in order to know their rights as consumers and so that the government can re-discuss regulations regarding stockpiling of goods so that they can be expanded not only to basic necessities by using the juridical normative research method and using a statutory approach, the authors get the results of this research that consumers can still get legal protection against the scarcity of a non-basic item by using the Trade Law, the Consumer Protection Law, and the Business Competition Law..

Abstract

Pemberian konsesi oleh pemerintah kepada investor telah menimbulkan banyak konflik pertanahan antara investor-investor pemegang izin, lisensi ataupun konsesi dan masyarakat hukum adat. Data konflik yang telah dicatat oleh Komisi Nasional Hak Asasi Manusia, Aliansi Masyarakat Adat Nusantara maupun Sawit Watch telah mencapai 500-800 kasus konflik tanah antara investor-investor tersebut dan masyarakat hukum adat. Tehadap konflik-konflik tersebut Mahkamah Konstitusi Indonesia kemudian telah mengeluarkan putusan yaitu dalam Putusan Mahkamah Konstitusi No. 35/PUU-X/2012 yang memutuskan bahwa eksistensi hutan adat tidak lagi masuk sebagai bagian dari hutan negara. Artinya Pemerintah harus mengakui eksistensi tanah adat bukan merupakan tanah negara. Menjadi pertanyaan adalah bagaimana kebijakan pemerintah dalam memberikan izin konsesi kepada para investor yang akan mengelola sumber-sumber daya alam dan mineral di atas tanah adat dengan tetap menghargai hukum adat setempat. Penelitian penulisan konseptual ini adalah normatif yuridis dengan pendekatan teori yang dilakukan oleh Lon L. Fuller, yang menyatakan bahwa hukum tertulis yang tidak didasarkan pada hukum adat yang telah mengalami saringan, tidak akan mempunyai basis sosial yang kuat dan menjadi hukum yang tidak efektif serta mengakibatkan merosotnya wibawa hukum. Hasil kajian ini diharapkan pemerintah yang diberikan Hak Menguasai Negara dapat melakukan kewenangannya sesuai konstitusi khususnya dalam membuat kebijakan pemberian konsesi pemanfaatan sumber daya alam di atas tanah adat kepada investor, tanpa menimbulkan konflik hukum dengan Masyarakat Hukum Adat.

Abstract

Anak adalah sebagai makluk Tuhan Yang Maha Esa dan sebagai makluk sosial, menurut Undang-Undang Nomor 35 Tahun 2014 Tentang Perlindungan Anak, perlindungan anak sejak di dalam kandungan sampai dengan dilahirkan hingga umur 18 tahun mempunyai hak untuk dapat itu dari orangtua itu sendiri, keluarga, masyarakat dan bangsa maupun negara. Setiap manusia tidak diperbolehkan merampas hak atas untuk memperoleh perlindungan diantaranya dalam hak untuk kehidupan, hak dalam kemerdekaan, hak untuk memperoleh pendidikan dan hak bermain. Maka tidak boleh sampai terjadinya diskriminasi terhadap anak, faktor penyebab terjadinya diskriminasi terhadap anak di bawah umur, dan untuk menjelaskan upaya yang dilakukan untuk mengatasi diskriminasi terhadap anak sebagai akibat kurangnya perhatian terhadap anak. Apalagi jika anak telah dilahirkan dari orangtuanya maka anak tersebut sudah mempunyai hak untuk kehidupan dan hak untuk merdeka yang merupakan hak yang mendasar dan juga kebabasan mendasar tidak dapat dilenyapkan dan dihilangkan, anak juga harus selalu dilindungi dengan diberikan kebebasan untuk hidup dan hak untuk kemerdekaannya, karena hak asasi anak tersebut merupakan bagian dari hak asasi manusia yang mendapatkan jaminan dan perlindungan hukum, baik hukum internasional maupun hukum nasional. Maka Undang-Undang Nomor 35 Tahun 2014 tentang Perlindungan Anak perlu disosialisasikn kepada masyarakat demi anak tersebut. Oleh sebab itu menyarankan melakukan perlindungan terhadap hukum bagi anak seperti melakukan kepatuhan dan kesadaran hukum, lingkungan sosial serta sosialisasi pemberlakuan tentang ketentuan UU yang mengatur tentang perlindungan anak tersebut.

Abstract

In 2016, Indonesia is a country that has agreed to the contents of the Paris Agreement. The contents of the Paris Agreement have been ratified into Indonesian law number 16 of 2016. The Indonesian government is targeting to achieve Net Zero Emissions by 2060. This study aims to achieve Net Zero Emissions by 2060, the Indonesian government is committed to reducing emissions by 29% (without conditions) or 41% (conditional) in 2030, which can be achieved by encouraging the use of new and renewable energy (EBT) by 23% by 2025. This study uses normative juridical methods to review policies and improve regulations for the Net Zero Emissions program by obtaining existing literature, theories, concepts, principles, and rules related to the legal perspective. Appropriate and consistent energy policies, including a long-term strategy to increase the use of new and renewable energy, are needed to achieve emission reduction targets. Policies made by the Indonesian government should reduce fossil fuels, develop environmentally friendly technologies and start increasing the use of new and renewable energy. It is very important to strengthen carbon emission reduction policies by considering all aspects to achieve the goal of 2060 without carbon emissions

Abstract

This study was conducted to analyze the Business Competition Supervisory Commission's consideration of re-tendering as a vertical conspiracy, as well as to examine arrangements for the application of re-tendering that provide legal certainty for project owners and tender participants. This research uses qualitative normative methods involving steps such as statutory studies, case studies, and conceptual approaches. This research uses a statutory approach to examine related regulations, a case approach to analyze decisions related to tender conspiracy, and a conceptual approach to understand relevant legal ideas and concepts. The results showed that the Business Competition Supervisory Commission (KPPU) concluded that there was a tender conspiracy in the process of canceling and re-running the tender by PT Jakarta Propertindo (Perseroda). Where PT Jakarta Propertindo (Perseroda) is a company officially assigned by the Provincial Government of DKI Jakarta to plan, build, manage, and maintain the Jakarta Arts Center Taman Ismail Marzuki. The Commission Panel found that the Reported Party I, which canceled the tender without a valid reason and could not be accounted for, deliberately did so to facilitate the Reported Party II and the Reported Party III to win the tender. Changes in the assessment procedures, especially in the experience aspect of the technical assessment, proved the intent of the Procurement Team to increase the technical scores of the Reported Party II and the Reported Party III. Thus, it confirms the role of KPPU in prohibiting vertical conspiracy and re-tendering in the practice of goods and services procurement, which provides legal certainty for project owners and tender participants

Abstract

Infrastruktur jalan tol yang dibangun baik oleh pemerintah atau swasta memiliki ruang milik jalan (Rumija) yang dapat dimanfaatkan sebagai tempat usaha yang diatur dalam Peraturan Pemerintah Nomor 15 Tahun 2005 tentang Jalan Tol dan Peraturan Menteri Pekerjaan Umum Nomor: 20/PRT/M/2010. Selain itu, para pelaku usaha UMKM juga melakukan pemanfaatan Ruang milik jalan yang berada di bawah Jalan Layang Tol (Elevated Toll Road). Rumija di bawah elevated toll road tersebut masih terdapat kekosongan hukum. Metode penelitian adalah yuridis normatif dengan didukung wawancara dari pelaku usaha UMKM, pejabat daerah dan operator jalan tol. Objek penelitian adalah Ruang milik jalan di bawah jalan tol milik PT. CW. Hasil temuan dan kesimpulan penelitian bahwa perjanjian yang dilakukan oleh UKM kepada RT/RW setempat Batal Demi Hukum karena tidak semua Ruang milik jalan dapat dimanfaatkan sebagai tempat usaha kecuali ada izin dari Direktorat Bina Marga Kementerian PUPR. Untuk pemberdayaan UMKM maka pemerintah perlu mengkaji pemberian izin (konsesi) pemanfaatan Rumija khususnya yang berada di bawah jalan tol.Toll road infrastructure built either by the government or the private sector has road-owned space (Rumija) which can be used as a place of business which is regulated in Government Regulation Number 15 of 2005 concerning Toll Roads and Regulation of the Minister of Public Works Number: 20/PRT/M/2010. In addition, MSME business actors also use Rumija which is under the Elevated Toll Road. Rumija, under the elevated toll road, there is still a legal vacuum. The research method is normative juridical supported by interviews from MSME business actors, regional officials and toll road operators. The object of research is Rumija under the toll road owned by PT. CW. The findings and conclusions of the study are that the agreement made by SMEs to the local RT/RW is null and void because not all Rumija can be used as a place of business unless there is a permit from the Directorate of Highways of the Ministry of PUPR. For the empowerment of MSMEs, the government needs to review the granting of permits (concessions) for the use of Rumija, especially those under toll roads

Abstract

Penelitian ini mengkaji tentang perlindungan hukum pemegang saham non pengendali atas kebijakan perseroan terbatas. Penelitian ini bertujuan untuk menganalisis dasar pertimbangan hakim dalam putusan Mahkamah Agung Nomor: 217 PK/Pdt/2014 atas keputusan Rapat Umum Pemegang Saham Perseroan Terbatas (RUPS) terhadap pemegang saham non pengendali, serta menganalisis perlindungan hukum bagi pemegang saham non pengendali dalam Perseroan Terbatas. Metode penelitian yang diterapkan pada penelitian ini ialah yuridis normatif. Hasil penelitian ini menjelaskan bahwa perlu pengaturan perlindungan hukum bagi pemegang saham non pengendali dalam Undang-Undang perseroan yang dapat diimplemetasikan dalam akta pendirian perseroan serta menekankan pentingnya perlindungan hukum bagi pemegang saham non pengendali dalam mencegah tindakan yang bisa merugikan mereka. Selain itu menyoroti pentingnya implementasi prinsip-prinsip Good Corporate Governance (GCG) untuk melindungi pemegang saham non pengendali. Dalam konteks ini, transparansi dan keadilan menjadi prinsip utama yang harus diterapkan dalam hubungan antara perusahaan dan pemegang saham non pengendali.

Abstract

The research's background is based on the Decision of the Indramayu District Court, which canceled the deed of sale and purchase of land and buildings between the Koperasi Simpan Pinjam Sejahtera Bersama and PT Asuransi Bumi Asih Jaya because it contains elements of Actio Pauliana. Therefore, this study aims to (i) examine the application of the Actio Pauliana principle as a form of legal protection for creditors due to the transfer of bankruptcy objects; (ii) discover the legal protection framework for buyers with good intentions who were canceled due to a third-party lawsuit; (iii) and discover the legal consequences of canceling the sale and purchase of bankruptcy objects for buyers with good intentions. Using descriptive analysis, this normative juridical research results: 1) The use of the Actio Pauliana principle by the judges as legal protection for creditors due to the transfer of bankruptcy object is correct. 2) However, the Judges did not consider the legal protection given to land/building buyers with good intentions; and (3) The Judges had considered the Buyer's negligence in fulfilling Article 1491 of the Civil Code to determine the failure of proving the good faith of the Buyer.

Abstract

This research analyzes the impact of Indonesian Supreme Court Decision No. 141/Pdt.Sus- PKPU/2020 on the execution of personal guarantees (borgtocht) in bankruptcy proceedings. This decision is significant as it has the potential to alter the practice of borgtocht execution and affect legal certainty for both creditors and debtors. The research employs a normative method with a statutory approach and case studies. Legal sources include legislation, legal literature, and relevant court decisions. The findings indicate that the Supreme Court decision provides clarity regarding the position of borgtocht in bankruptcy, yet also raises some legal uncertainties. This research offers recommendations for legal improvements regarding borgtocht execution to ensure legal certainty and fairness for all parties involved..
