State-Owned Enterprises (SOEs) has a role to improve the nation's economy is very central, in the implementation of SOEs are excluded to monopolize market share based on the Act based on article 33 Paragraph (2) of the 1945 Act basically can be excluded in certain sectors with the welfare of the people, however, in practice, monopolistic practices are often found that are not in accordance with the stipulated regulations. Aviation companies under the auspices of SOEs are necessary considering that the aviation sector is very much needed by the community. This journal examines business competition in BUMN monopolies. This study aims to understand the concept of monopoly carried out by SOEs in the aviation sector and efforts to overcome it. The method used in this research is a normative juridical approach which in the main data processing uses secondary data, namely data obtained from literature reviews. The approach used in solving problems is per se illegal. A good corporate government can be a reference for KPPU in determining the limits of activities in monopoly carried out by SOEs. The type of research carried out in this research is legal research (legal reseacht), namely research that examines the formulation of the problems contained in the research by examining the relevant regulations that apply. The post-covid-19 pandemic in Indonesia has had a major social impact on society in the form of unemployment and divorce. The problem is whether the government can be held accountable for its policies in the context of overcoming the COVID-19 pandemic which has caused many social impacts on the society. The is study aimed to determine the government's responsibility for increasing social community such as increasing layoffs (PHK) and divorce in the society during the pandemic. The research methodology applied empirical methods. The results were based on the theory of government action, which is an action taken by state administrators in carrying out government duties that cause disputes between the people and the government. In Indonesia, the responsibilities of the government have not been regulated, and in practice, the society is still neglected. Society has surrendered to the consequences of the PPKM policy during the COVID-19 pandemic. Even if there are people who will file a civil lawsuit against the government. This lawsuit against government officials in the civil sector in Indonesia is based on the unlawful acts of the government as regulated in Article 1365 of the Civil Code. The responsibilities of the Government other than in the field of civil law is in the field of state administrative law.

In 2020 Walls Indonesia re-launched their legendary product, "Viennetta" Ice Cream which was famous in the 90s. but this is misused by bad people who are not responsible for their own interests. They took advantage of the public's enthusiasm for the return of the legendary product from Walls Indonesia, namely Viennetta Ice Cream by hoarding these items and selling them at a higher price. The regulations regarding consumer protection against hoarding of goods have received protection from the Ministry of Trade in the Regulation of the Minister of Trade Number 20/M-DAG/PER/3/2017 concerning Registration of Business Actors in the Distribution of Staple Needs, but unfortunately this regulation only applies to basic goods. Therefore, this study aims to educate consumers in order to know their rights as consumers and so that the government can re-discuss regulations regarding stockpiling of goods so that they can be expanded not only to basic necessities by using the juridical normative research method and using a statutory approach, the authors get the results of this research that consumers can still get legal protection against the scarcity of a non-basic item by using the Trade Law, the Consumer Protection Law, and the Business Competition Law..

Pemberian konsesi oleh pemerintah kepada investor telah menimbulkan banyak konflik pertanahan antara investor-investor pemegang izin, lisensi ataupun konsesi dan masyarakat hukum adat. Data konflik yang telah dicatat oleh Komisi Nasional Hak Asasi Manusia, Aliansi Masyarakat Adat Nusantara maupun Sawit Watch telah mencapai 500-800 kasus konflik tanah antara investor-investor tersebut dan masyarakat hukum adat. Tehadap konflik-konflik tersebut Mahkamah Konstitusi Indonesia kemudian telah mengeluarkan putusan yaitu dalam Putusan Mahkamah Konstitusi No. 35/PUU-X/2012 yang memutuskan bahwa eksistensi hutan adat tidak lagi masuk sebagai bagian dari hutan negara. Artinya Pemerintah harus mengakui eksistensi tanah adat bukan merupakan tanah negara. Menjadi pertanyaan adalah bagaimana kebijakan pemerintah dalam memberikan izin konsesi kepada para investor yang akan mengelola sumber-sumber daya alam dan mineral di atas tanah adat dengan tetap menghargai hukum adat setempat. Penelitian penulisan konseptual ini adalah normatif yuridis dengan pendekatan teori yang dilakukan oleh Lon L. Fuller, yang menyatakan bahwa hukum tertulis yang tidak didasarkan pada hukum adat yang telah mengalami saringan, tidak akan mempunyai basis sosial yang kuat dan menjadi hukum yang tidak efektif serta mengakibatkan merosotnya wibawa hukum. Hasil kajian ini diharapkan pemerintah yang diberikan Hak Menguasai Negara dapat melakukan kewenangannya sesuai konstitusi khususnya dalam membuat kebijakan pemberian konsesi pemanfaatan sumber daya alam di atas tanah adat kepada investor, tanpa menimbulkan konflik hukum dengan Masyarakat Hukum Adat.

Anak adalah sebagai makluk Tuhan Yang Maha Esa dan sebagai makluk sosial, menurut Undang-Undang Nomor 35 Tahun 2014 Tentang Perlindungan Anak, perlindungan anak sejak di dalam kandungan sampai dengan dilahirkan hingga umur 18 tahun mempunyai hak untuk dapat itu dari orangtua itu sendiri, keluarga, masyarakat dan bangsa maupun negara. Setiap manusia tidak diperbolehkan merampas hak atas untuk memperoleh perlindungan diantaranya dalam hak untuk kehidupan, hak dalam kemerdekaan, hak untuk memperoleh pendidikan dan hak bermain. Maka tidak boleh sampai terjadinya diskriminasi terhadap anak, faktor penyebab terjadinya diskriminasi terhadap anak di bawah umur, dan untuk menjelaskan upaya yang dilakukan untuk mengatasi diskriminasi terhadap anak sebagai akibat kurangnya perhatian terhadap anak. Apalagi jika anak telah dilahirkan dari orangtuanya maka anak tersebut sudah mempunyai hak untuk kehidupan dan hak untuk merdeka yang merupakan hak yang mendasar dan juga kebabasan mendasar tidak dapat dilenyapkan dan dihilangkan, anak juga harus selalu dilindungi dengan diberikan kebebasan untuk hidup dan hak untuk kemerdekaannya, karena hak asasi anak tersebut merupakan bagian dari hak asasi manusia yang mendapatkan jaminan dan perlindungan hukum, baik hukum internasional maupun hukum nasional. Maka Undang-Undang Nomor 35 Tahun 2014 tentang Perlindungan Anak perlu disosialisasikn kepada masyarakat demi anak tersebut. Oleh sebab itu menyarankan melakukan perlindungan terhadap hukum bagi anak seperti melakukan kepatuhan dan kesadaran hukum, lingkungan sosial serta sosialisasi pemberlakuan tentang ketentuan UU yang mengatur tentang perlindungan anak tersebut.

In 2016, Indonesia is a country that has agreed to the contents of the Paris Agreement. The contents of the Paris Agreement have been ratified into Indonesian law number 16 of 2016. The Indonesian government is targeting to achieve Net Zero Emissions by 2060. This study aims to achieve Net Zero Emissions by 2060, the Indonesian government is committed to reducing emissions by 29% (without conditions) or 41% (conditional) in 2030, which can be achieved by encouraging the use of new and renewable energy (EBT) by 23% by 2025. This study uses normative juridical methods to review policies and improve regulations for the Net Zero Emissions program by obtaining existing literature, theories, concepts, principles, and rules related to the legal perspective. Appropriate and consistent energy policies, including a long-term strategy to increase the use of new and renewable energy, are needed to achieve emission reduction targets. Policies made by the Indonesian government should reduce fossil fuels, develop environmentally friendly technologies and start increasing the use of new and renewable energy. It is very important to strengthen carbon emission reduction policies by considering all aspects to achieve the goal of 2060 without carbon emissions

Tujuan dari Penelitian ini untuk mengkaji pentingnya sebuah jaminan terhadap risiko kerugian atas kebijakan Grace Period atau penundaan pembayaran sewa guna yang diberikan oleh Lembaga Manajemen Aset Negara kepada Mitra Kerjasama apabila terdapat Mitra yang tidak dapat melanjutkan biaya tarif sewa ketika masa Garce Period tersebut berakhir. Rentang waktu masa Grace Period sendiri diberikan minimal selama 3 bulan untuk masa sewa 1 (satu) tahun dan maksimal selama 18 (delapan belas) bulan untuk masa sewa 10 (sepuluh) tahun . Untuk itu product guarantee diperlukan dalam kebijakan ini untuk pemanfaatan aset sewa guna agar di kemudian hari Lembaga Manajemen Aset Negara tidak mengalami kerugian dari kebijakan tersebut. Penelitian ini merupakan penelitian yuridis normatif, dimana dalam penelitian ini menggunakaan data kepustakaan yang diperoleh dengan cara menelitii sumber pustaka atau sumber sekunder belaka dan Teknik wawancara sebagai sumber fakta dari hasil penelitian untuk menjawab permasalahan hukum yang terjadi. Penelitian ini mengkaji jaminan surety bond sebagai product guarantee yang dapat diberikan oleh Mitra Sewa sebagai komitmennya dalam memenuhi kontrak perjanjian sewa guna aset atas Grace Period yang diberikan oleh Lembaga Manajamen Aset Negara. Hasil penelitian ini menunjukkan bahwa jaminan surety bond dapat dijadikan product guarantee atas kebijakan Grace Period dalam perjanjian aset sewa guna kelolaan Lembaga Manajemen Aset Negara karena tidak memberatkan biaya modal awal Mitra dalam pelaksanaan konstruksinya. The purpose of this article is to examine the importance of a guarantee against the risk of loss on the Grace Period policy or the postponement of lease payments provided by Lembaga Manajemen Aset Negara to their Collaboration Partners if there are Partners who cannot continue to charge rental rates when the Garce Period ends. The Grace Period itself is given a minimum of 3 (three) months for a 1 (one) year rental period and a maximum of 18 (eighteen) months for a 10 (ten) year rental period. Then, product guarantee is needed in this policy for the utilization of leased assets so that in the future Lembaga Aset Negara does not experience losses from this policy. This research is a normative juridical research, in which this study uses bibliographical data obtained by examining literary sources or mere secondary sources and interview techniques as a source of facts from research results to answer legal problems that occur. This research examines the surety bond guarantee as a product guarantee that can be provided by the Colaboration Partner as a commitment to fulfill the asset lease agreement contract for the Grace Period provided by Lembaga Manajemen Aset Negara. The results of this study indicate that surety bonds can be used as a product guarantee for the Grace Period Grace Period in the lease asset agreement managed by Lembaga Manajemen Aset Negara because it does not burden the partner's initial capital costs in carrying out its construction.

The Customary Law Community (Masyarakat Hukum Adat, MHA) as part of the Customary Law System is recognized for its existence and its implementation in the National Land Law (Hukum Tanah Nasional, HTN). In the Explanation of the Basic Agrarian Law (UUPA) it is stated that the function of Customary Law as the main source in the development of HTN, although such recognition is accompanied by conditions as long as in reality they still exist and in accordance with national and state interests. This paper analyses and examines the problems of MHA in the concept of regional representative council. The problem on this paper come up from various problems concerning to ulayat land and its conflict between indigenous people and government. The research emphasized that the main problem is the inequality of perception between the Executive, Judiciary and Legislative institutions in the consistency of compensation payments resulting in the re-claim of Tanah Ulayat (Adat), there is no basis for a multi-dimensional approach (anthropology, sociology and others besides the juridical approach). This means that the formal juridical approach alone does not achieve effective results. The question is whether the constitutional MHA can have representation in the Regional Representative Council (DPD) and what forms of democracy are appropriate and can channel the aspirations of the MHA.

Penulisan ini bertujuan untuk mengetahui implikasi hukum terkait kedudukan hak upah pekerja sebagai hak yang didahulukan dalam konteks kepailitan perusahaan menurut Undang-Undang Cipta Kerja. Penelitian ini menggunakan metode pendekatan hukum normatif dengan mengandalkan data sekunder dari berbagai sumber untuk membantu menjawab permasalahan penelitian. Undang-Undang Nomor 6 Tahun 2023 telah merubah ketentuan secara signifikan, terutama dalam bidang ketenagakerjaan, dengan memberikan hak mendahulu kepada pekerja dalam menerima hak upah mereka saat perusahaan diumumkan pailit, sesuai dengan Pasal 95. Namun, UU Kepailitan masih mempertahankan hak mendahulu bagi kreditur separatis dalam proses penyelesaian harta debitur yang mengalami pailit. Hal ini menciptakan ketidakselarasan antara UU Nomor 37 Tahun 2004 tentang Kepailitan dan Penundaan Kewajiban Pembayaran Utang (PKPU) dengan UU Nomor 6 Tahun 2023, sehingga terjadi disharmoni peraturan dalam hirarki peraturan. Konflik antara ketentuan-ketentuan dalam kedua undang-undang tersebut menggambarkan inkonsistensi dalam substansi peraturan, di mana satu peraturan memiliki cakupan yang lebih umum dibandingkan dengan peraturan lainnya, meskipun kedua peraturan tersebut memiliki hierarki yang sama. This article analyzes the legal implications of workers' wage rights during company bankruptcy, as mandated by the Job Creation Law. The research adopts a normative legal approach, utilizing secondary data from various sources to investigate the issue. According to Article 95 of Law Number 6 of 2023, workers have priority rights to their wages in the event of a company's bankruptcy. However, the Bankruptcy Law still grants priority rights to separatist creditors when settling a debtor's assets. This creates a conflict between the two laws, resulting in inconsistency within the regulatory hierarchy. The conflicting provisions illustrate the differing scopes of the two laws, despite sharing the same hierarchy.

Tujuan dilakukannya penelitian ini untuk mengetahui pertimbangan hakim atas addendum perjanjian sewa menyewa dan pengelolaan pabrik pascapailit sebagai actio pauliana dan bentuk tanggung jawab sekutu Persekutuan Komanditer (CV) dalam penyelesaian kepailitan atas pembatalan addendum perjanjian sewa menyewa dan pengelolaan pabrik. Penelitian ini menggunakan metode penelitian normatif dengan pendekatan undang-undang, konseptual, dan kasus. Hasil penelitian menunjukkan bahwa berdasarkan pertimbangan hakim, addendum perjanjian yang dilakukan pascapailit ini dapat dibatalkan melalui actio pauliana karena bukan suatu kewajiban bagi debitor dan merugikan kreditor, sehingga pembatalan perjanjian dan addendum dapat dilakukan dengan putusan pengadilan untuk menghindari kerugian bagi kreditor atas debitor yang pailit. Pihak kedua yang dirugikan dalam addendum dapat dijadikan kreditor untuk mendapatkan pemenuhan haknya yang dijanjikan dalam addendum oleh CV. Kesimpulan penelitian adalah dalam pemenuhan utang CV, sekutu aktif bertanggung jawab secara tanggung renteng hingga melibatkan harta pribadinya, sementara itu sekutu pasif hanya bertanggung jawab sebatas modal disetorkan jika tidak turut melakukan kepengurusan CV. The purpose of this research is to determine the judge’s consideration of the post-bankruptcy addendum of lease agreement and factory management as actio pauliana and the responsibilities of CV partners in bankruptcy regarding to the cancellation of addendum. This research uses normative method with statute, conceptual, and case approach. This research shows that based on judge’s consideration, the addendum of the agreement that made post-bankruptcy could be canceled through actio pauliana, because it is not an obligation for the debtor and is detrimental to creditors, so the cancellation of the agreements and addendum can be done by court to avoid losses for the creditors in bankruptcy. The second party who suffers losses in the addendum could become a creditor to obtain the fulfillment of their rights as promised in the addendum by CV partners. In fulfilling CV debts, active partners are jointly and severally responsible to their personal assets, while passive partners are only responsible for the capital contributed to the CV if they do not take any parts in managing the CV with active partners.
