Sovereignty of the people is placed in the context of political, legal ideals of Pancasila as stated in the preamble of the 1945 Constitution which boils down to, sovereignty, and prosperity of the people. accordance with the spirit of the precepts contained in the 4th Pancasila democracy that requires Indonesian-style democracy that is based on the notion “wisdom of deliberation representative” popular sovereignty in accordance with the ideals of Pancasila law can be seen from the construction of the founding fathers thought, that Indonesia’s democracy is a democracy that has its own characteristics, which is based on the principle of collectivism. Abstract

Correctional officers who carry out the task of fostering and securing prisoners in Law No. 12 of 1995 on the Acting Functional Correctional Law Enforcement. Functional correctional officers are law enforcement officers who carry out tasks in the field of coaching, mentoring, and security of inmates. Still away from the law enforcement, as expected due to the persistence of the constraints and challenges in matter of law, the legal apparatus, facilities and infrastructure as well as other factors that influence it. Although the legal development takes time, but the need for the law to shelter may not be delayed even prove to the demands of society is increasingly rising, and should be recognized also there are the excesses in the application and enforcement. The purpose of this thesis, namely; First, to investigate the implementation of safeguards by correctional officers against inmates in detention State Class II B Rengat according to Law No. 12 of 1995 concerning Corrections, second, to determine obstacles correctional officers in the implementation of safeguards against prisoners in a detention Class II B Rengat according to Law No. 12 of 1995 concerning Corrections, Third, To know the efforts made in the implementation of security correctional officers against inmates home state custody Class II B Rengat according to Law No. 12 of 1995 concerning Corrections.Keywords: Security-State Prison Inmates

Abstract

In the midst of tumult of democracy and trade access opening urging the Indonesian government took a bold step by signing international trade agreements both at the bilateral, regional and international levels. As we already know with Indonesia is one of the ten countries included in the ASEAN organization. According to mutual agreement, ASEAN shall establish an ASEAN Community in the late 2015's, which consists of three pillars, one of which is the pillar of the ASEAN Economic Community or. The purpose of the establishment of this AEC is that economic integration in ASEAN member countries in the field of trade liberalization in goods, services, investment, capital and labor flows in the region. To that end, formed the ASEAN Comprehensive Investment Agreement (ACIA) in order to create a more liberal investment regime and open. The purpose of this thesis namely; First, to determine the preparation of the Riau provincial government in bringing foreign investors to improve the competitiveness of SMEs in connection with the ASEAN Economic Community; Second, to determine the measures to be taken by the provincial government in connection with the preparation of the SME entrepreneurs increase the ASEAN Economic Community.From the research, there are three main things that can be inferred. First, the government's readiness Provision of Riau in bringing foreign investors to SMEs in connection with the Economic Community (AEC) in 2015 is to implement policies that have been made by the central government are associated with it. Abstract

Law enforcement officers often consider that torture is best and easiest way to be able to extract information from a suspects. In fact, we often find media reports about the violence committed by the investigator in the investigation process to get confession from someone who allegedly committing a crime.As for the purpose of writing this thesis is to determine arrangements of legal protection to suspects who experienced crimes of violence in the investigation process and criminal accountability of violence committed by investigators associated with efforts to protect the human rights of suspects.In writing this thesis, the author use the normative research methods, which in this study by a literature review. To draw a conclusion from the collected data, the authors using data analysis techniques deductive, by draw a conclusion from general to specific conclusion.The conclusion that can be derived from this research are: First, the setting about law protection of abused suspects in the investigation process does not have special regulations, so there are still many loopholes for law enforcement officials committing acts of violence in the investigation process. Second, the criminal liability of the investigator who do violence to the suspect did not go as mandated by chapter 422 of KUHP, where there are many investigators who commit acts of violence in performing its duties escape from legal responsibility. As well as ineffective oversight of the process of investigations conducted by the superior based on rules of Criminal Investigation about supervisory investigation and the need for revision of these regulations in order to optimize the process of monitoring the investigation.Keywords: Regulation - Legal Protection - Suspect

Abstract

When initiating the investigation process, the investigator must immediately fulfill the two evidences set out in Article 184 of the Criminal Procedure Code and establish the suspect in a crime and complete the file to be immediately delegated to the prosecutor. For suspects detained investigators have a time limit to settle the case while for suspects who are not detained investigators have no time limit to complete the case and may be constrained or lasted for years. This is of course detrimental to the right of the suspect to be immediately examined in court and obtain legal certainty regarding his status. The purpose of writing this thesis, namely: First, to determine the time period of determination of suspect status by the investigator. Second, to know the ideal period of time for the determination of suspect status.The type of research used is a normative legal research or can be called also the research of doctrinal law, normative legal research is a literature law research. Sources of data in this normative legal research is the data or material law of primary, secondary, and tertiary. The author in preparing and analyzing all the data and materials obtained in this study, conducted qualitatively. From the results of research problems there are two main things that can be concluded. First, the timing of the determination of suspect status by the investigator has not been clearly and completely regulated. Secondly, according to the author of the ideal period of time regarding the determination of suspect status in the investigation process, especially for the suspect who is not detained that is 90 days in accordance with the provisions in Article 88 of the Draft Law on Criminal Procedure Code. Author's suggestion, Firstly, it is necessary to amend the current Criminal Procedure Code, specifically in Article 50, concerning the time limit of the investigation process. Secondly, the Government needs to enact the New Criminal Procedure Code which has been prepared especially in Article 88 which regulates the time period for investigation process for the non-detained suspect that is 90 days to protect the rights of the suspect.Keywords : Unification Period, Investigation, Suspect, Legal Certaint

Abstract

Legal protection is a form of service that must be provided by the government to provide security to every citizen. The purpose of this thesis namely; First, to determine the implementation of the fulfillment of the right to the protection of witnesses in the stage of prosecution of corruption by the public prosecutor at the Corruption Court in the District Court Pekanbaru, second, to determine the barriers faced by the public prosecutor in the implementation of the fulfillment of the right to the protection of witnesses in stages prosecution at the Corruption Court in Pekanbaru District Court, Third, to know the efforts made by the prosecution in overcoming barriers to implementation of the fulfillment of the rights protection of witnesses in the prosecution phase at the Corruption Court in the District Court of Pekanbaru.In research there are three main things that can be inferred. First, the implementation of the fulfillment of the right to the protection of witnesses in the prosecution phase of criminal acts of corruption by the public prosecutor at the court of corruption in the District Court Pekanbaru not running optimally. Second, the barriers faced by the Prosecution in the implementation of the fulfillment of the rights of witnesses in the stage of prosecution of corruption in the corruption court in the District Court Pekanbaru is the lack of budget prosecutor, the weak performance of the Agency, and the lack of public knowledge, Third, efforts made by the Prosecutor general in overcoming obstacles to the implementation of the fulfillment of the right to the protection of witnesses is to increase the budget of the prosecutor, improving the performance of the Agency, and to increase public knowledge. Suggestions Writer, first, to the government to consider an increase in the budget cost of the prosecutor, Second, to establish the Agency representative in the region, Third, increase public knowledge about the rights of witnesses.Keywords: Protection - Witness – Corruption

Abstract

The nomination of the President under the Act must be nominated by a political party or coalition of political parties. However, the election of Regional Head, given the opportunity to nominate themselves as individuals. It certainly restrict the people who want to run for President through the individual, as if it were 1945 had arranged that every citizen has equal opportunity in government. Based on this understanding, the authors of this paper formulates two formulation of the problem, namely : first, whether the urgency of independent candidates in the general election of President and Vice President in the state system of Indonesia? second, how the efforts efforts to implement the idea of independent candidates in the general election of President and Vice President in the state system of Indonesia?The research method in this study, first, the type of research is legal normative and descriptive. Second, in this study, the data used by researchers is secondary data. Third, data collection techniques supported by three legal material, namely : primary data, secondary data and data tertiary. After the data collected then analyzed qualitatively, then draw conclusions with deductive thinking method is to analyze the problems of the general form to a special form.From the research, there are two main things that can be inferred. First , the President 's candidacy individuals refers to patterns of local elections . In the Constitutional Court Decision No. 5 / PUU - V / 2007 which discusses judicial Local Government Act, which approved the nomination of the Regional Head through individual selection. However, the opportunity is closed because of the election of President and Vice President must be nominated by a political party or coalition of political parties. This is clearly contrary to Article 28D paragraph ( 3 ) of the 1945 Constitution which says that all citizens have equal opportunities in the government. Second, this time is not considered democratic presidential election since the closure of opportunities for independent candidates, so it is necessary the holding of the fifth amendment to the articles of the 1945 Constitution and was followed by changes in legislation related to election of the President and Vice President.Keywords : Election - President and Vice President - Individual Candidates

Abstract

Corruption is an act done with the intent to provide an advantage that is not authorized by the rights of others wrongfully using his or her character to gain an advantage for himself or others. Impact of Corruption This may endanger the stability and security of societies, endanger the socio-economic development, and also political, as well as damage to democratic values and morality as slowly deeds is like to be a cultural as well as threats to the ideals of society towards a fair and prosperous. The purpose of this thesis, namely: First, to know the verdict against perpetrators of corruption in Case No. 21 / PID.SUS-TPK / 2015 / PN.PBR Case Number 26 / PID.SUS-TPK / 2015 / PN.PBR , Secondly, To know the basic legal consideration of judges in imposing criminal penalties against perpetrators of corruption in Case No. 21 / PID.SUS-TPK / 2015 / PN.PBR Case Number 26 / PID.SUS-TPK / 2015 / PN.PBR.This type of research used in the study of law is normative legal research, descriptive study, a study that aims to create a picture of the problems clearly and in detail. Source of data used secondary data consists of primary legal materials, secondary law, and tertiary legal materials. Data collection techniques in this study with a literature study method, after the data is collected and analyzed to be deduced. From the results of research and discussion can be concluded that, First, That the verdict against perpetrators of corruption in Case No. 21 / PID.SUS-TPK / 2015 / PN.PBR Case Number 26 / PID.SUS-TPK / 2015 / PN. PBR is still using the mindset of legal positivism and rarely found a judge who follows the way of thinking non-positivistic in deciding the case, wherein the case includes an extraordinary crime which negatively impact our nation and state, tend to interpret the law narrowly (textual) and still oriented judges are pragmatic. Thus, new construction mindset of judges based progressive law is needed judges in the process of deciding the corruption cases in order to become a judge idealistic as well as the realization of the purpose of law and the Law on Corruption. Second, Basic legal considerations of judges in imposing criminal penalties against perpetrators of corruption in Case No. 21 / PID.SUS-TPK / 2015 / PN.PBR Case Number 26 / PID.SUS-TPK / 2015 / PN.PBR by using juridical considerations, considerations of a non juridical and matters aggravating and mitigating matters criminal. Abstract

The term maritime countries to the Republic of Indonesia because the sea area reached 3,257,483 km2, almost two-thirds of the territory of Indonesia is an ocean. This geographical condition underlining the potential for enormous natural in the field of fisheries. Indonesia itself has implemented a regulation of fisheries policy by issuing Law No. 45 of 2009 Juncto Law Number 31 Year 2004 on Fisheries. Currently, the implementation of the management, utilization, and surveillance has not run optimally, due to rampant cases of crimes and violations of fisheries in WPPRI is not only done by Indonesian fishing vessels, but also to foreign fishing vessels. It is a challenge for law enforcement to Batam SATKER PSDKP fisheries. The purpose of this research, First, the role of SATKER Knowing PSDKP in the eradication of the fisheries in the area of fisheries management. Second, On Obstacles SATKER PSDKP in the eradication of the fisheries in the area of fisheries management. Third, to know what efforts were made by SATKER PSDKP in overcoming barriers to the eradication of the fishery. This type of research is a sociological study, where this research look at the correlation between law and society using interviews in PSDKP Base Batam and literature study. From the results of research can be concluded. The first role of SATKER PSDKP in the eradication of fishery namely monitoring, control, surveillance and enforcement including implementation of VMS, published SLO, patrolling, socialization and community development, received the report, verify fishing vessel, and conduct investigations. Second, barriers Satker PSDKP Batam related eradication of fishing among others lack of quality quantity of infrastructure, budget and human resources, the condition of the region broad oversight and erratic weather in the conduct of supervision, lack of public awareness, ineffective coordination between law enforcement fishery and the lack of participation of other countries in the fight against the crime of fisheries. Third, efforts are being made to overcome these barriers is to increase the competence and quantity of personnel and infrastructure, fostering awareness of the law for the public and coordination between law enforcement agencies and by conducting a deterrent effect did the bombing of the ship. Suggestions Author, First SATKER PSDKP Batam City needs to improve oversight and prosecution of all perpetrators of criminal acts. Second, to overcome these obstacles must take steps to improve the performance of accurate internal and coordination.
