Abstract

Supervision of public service performed by internal and external supervisory. according to article 35 item 2 of Act No. 25 of 2009 on Public Service can be done through oversight by the Ombudsman of the Republic of Indonesia in accordance with the legislation. The Ombudsman of the Republic of Indonesias Riau Province Representative tasked to oversee the implementation of public service in the province of Riau. In this case the effectiveness of the Ombudsman of theRepublic of Indonesia Riau Provincial Legislative need to be assessed in order to realize the objectives of supervision. But in terms of performing the duties and functions of its Ombudsman of the Republic of Indonesia Representative Riau province there are still some obstacles include the lack of human resources, lack of funds, supporting facilities still need to be added in order to support the execution of their duties and functions, as well as the existence of the existence of the Ombudsman of the Republic of Indonesia Representatives of the province of Riau still less among the people. this is what causes his old settlement process and also menghambatan public reports of its operation in the field of prevention.From the research, it can be concluded there are still some tasks Ombudsman of the Republic of Indonesia Representative Riau province that still has not run equally effective, this is due to his existing barriers include the lack of human resources, limited funds, a lack of facilities to support the performance of the Ombudsman of the Republic of Indonesia Representative Riau province, there is still a lack of existence of the existence of the Ombudsman of the Republic of Indonesia Representative Riau Province. Abstract

Corruption is sub-ordination to the public interest for personal goals that include violations of norms, onus, and general well-being, accompanied with secrecy, betrayal, deception, and unconcerned about suffering of the communities. Tax crime is an act that violates the laws which give rise to state loses tax revenue which the person is threatened with criminal penalties. Corruption is lex specialist derogat legi generali so that corruption cases should be examined based on the laws of corruption. Tax crime is lex specialist systematic, so tax crime case must be examined and decided upon by the tax laws. A tax levied by the Civil Service but not paid to the state treasury is more specific crime of corruption. Legal certainty is required to define more precise rules to be applied uniformly.Application of the Article 3 of Law Number 31 of 1999 on Corruption Act as amended by Act Number 20 of 2001 on the Amendment Act Number 31 of 1999 on Corruption Eradication in the decision No. 02/Pid.Sus-TPK/2015/PN.Mdn at the Corruption Court on Medan District Court is not appropriate for violating the principle of lex specialist systematic, and tax crime can be qualified as criminal acts of corruption as defined in Article 3 of Law Number 31 of 1999 on Corruption Act as amended by Act Number 20 of 2001 on the Amendment of Act Number 31 of 1999 on the Eradication of Corruption.

Abstract

Filing pretrial more than one time in criminal procedural law into research background, the Criminal Procedure Code as the basis for litigation pretrial does not explain the filing of pre-trial more than once, the Criminal Procedure Code only mmemunginkan someone to file pretrial without restrictions or ideal concept of filing pretrial more than one time. Pretrial filing more than one time to make the law enforcement process protracted and legal certainty are not implemented. This type of research can be classified in this type of normative legal research, which examines the general principles of law and perbandinganhukumterhadap a legal event. To draw conclusions from the data collected, the authors used data analysis techniques deductive, that is by drawing conclusions that are special. From the research problem there are two things that can be inferred. First, pretrial filing more than one still accepted by the judge even though no rules were discussed. Second, the concept of pretrial ideal is the appointment of special judges, registration and inspection of pretrial matters should be attended by the suspect in question. Suggestions Writer, first, it is recommended that immediately made arrangements firmly on pretrial which can only be done once the by revisions to the Criminal Procedure Code, or at least the Supreme Court issued PERMA (Rules of the Supreme Court) on a pre-trial can only be done one kali.Kedua, is expected in the future pretrial case investigation is conducted by a special judge, the parties filed a lawsuit petition shall be attended by the suspect in question, the case investigation pretrial attended by the suspect to the interests of the suspect can be proved at trial. Abstract

Position the House of Representatives (DPRD), which is referred to as the local legislative body by the public, it is not so. Parliament is one of the elements of the regional administration together with the Regional Head, so that Parliament is a partner of the Regional Head, located parallel to the regional head. Parliament only perform the function of legislation in the area by establishing rules and regulations along the regional level Regional Head, as the regional regulation. The purpose of this study is to determine how exactly the position of Parliament in the regional administration together with the head of the region, as well as how to do with the implementation of the concept of the Unitary Republic of Indonesia (NKRI). This study was included in the normative legal research is the study of law with a review of the legal materials in the form of legislation and study books or library materials available. While the nature of this research is descriptive research is research that provides a clear and detailed picture of the problems studied. The data used is primary data that materials are binding law, as well as secondary data derived from primary legal materials, secondary and tertiary. Data was collected by the method of literature review. The result of this study is that the position of the Council is a partner in running the Regional Head of the regional administration. Indeed, the legislative power is in the realm of the center instead of on the local level, in Parliament ought to be regular penenrapannya position themselves as partners in helping both the Regional Heads in making regulations or the regional administration. Efforts are expected in order to Act No. 23 of 2014 may be revised or amended by the Act which tebaru, so that the absence of any reinterpretation of the Local Government Act.Keywords: Position - Parliament

Abstract

This research method is a sociological study. That is reviewing the state of the existing problems in the field associated with the legal aspects that prevail in society. Abstract

In the case of the settlement of criminal cases there are arrangements that do not provide legal certainty that leads to multiple interpretations leading to misappropriation. In the case of the formulation of a criminal case becomes one of confusion among law enforcers in particular the separation of the file of the case or Splitsing. Separation of a case file or Splitsing is regulated in Article 142 of the Criminal Procedure Code, namely "In the case of the public prosecutor receiving a case file containing several crimes committed by several suspects not included in Article 141 of the Criminal Procedure Code, the prosecutor may prosecute each Defendants separately. "The arrangement of the split file or Splitsing has not supported the evidentiary system within the criminal justice system. Splitsing arrangements are not strict and do not provide legal certainty so as to cause adverse impacts in particular law enforcement in the case of the compilation of criminal case files of perpetrators of criminal acts for subsequent prosecution. The purpose of this thesis writing is: First, to know whether the arrangement of split file or splitsing case has supported the principle of proof in the criminal justice system, Secondly, to find out the ideal arrangement of split case file or splitsing in the judicial system. This type of research is normative legal research or can be called also research doctrinal law. From the research results of the problem there are two main points that are concluded, First, the arrangement of the separation of the file of the case or the explicit Splitsing is to provide legal certainty in law enforcement and support the evidentiary system in the criminal justice system. Abstract

Reconsideration is a remedy that can be taken by the convict in a case of law against a decision of a court that has permanent legal force in the judicial system in Indonesia . Reconsideration categorized as an extraordinary legal remedy because it has the privilege, meaning that it can be used to reopen a court decision which has had permanent legal force. Thus the institution Reconsideration is a remedy that is used to retract or reject the judge's decision has had permanent legal force. Mary Jane Veloso a drug kingpin arrested for carrying 2.6 kg of heroin in Yogyakarta, on March 25, 2015 Mary Jane file a judicial review through the Sleman District Court but was rejected. However, the Review that Mary Jane make a schedule execution pending death. Then, Mary Jane file a Reconsideration second, but immediately rejected. The reason for rejection of the Supreme Court because it does not find new Novum.This type of research is classified in normative law research using the method of assessment literature or documentary study, the author quotes from books, literature, or book support, which has links with the problems to be studied. The data used primary legal materials, secondary law and tertiary legal materials.From the research problem there are five things that can be inferred. Abstract

A political party as an organization's political base has important roles in the democratic system and determines the direction of the passage of a state. In other words, political parties act as a regulator or managing conflict (conflict management), the party serves as a means interest aggregation (aggregation of interest) which distribute variety of different interests through institutional channels of party politics. However, it is not uncommon in the diversity it has given issues to inter-party or even just an internal party elite in the party itself. Problems between the party elite in the party's internal impact on the presence of two or more groups, and ultimately led to the dualism management.In the event of a dispute in the party court internal party as a mandate of Law No. 2 of 2011 jo Law No. 2 of 2008 on Political Parties should be able to perform its role as a cutter conflict like that contained in Article 32 paragraph (5) Law Act No. 2 of 2011. Countries should be able create the party court as an party institution of free and independent in carrying out the task to examine and decide the party's internal disputes. Excluding the settlement by the party court, the legislation also mandates the party conflict resolution mechanisms through the courts. However, in order to create the internal party mechanisms to resolve disputes through the court quickly and which do not overlap the decision that ultimately disrupt the principle of legal certainty required large-scale court reform that ultimately deemed the chaotic situation the party dispute on only one court roof. On the other side also needs to do a judicial review of Law No. 2 of 2011 on Political Parties.
