Abstract

The purpose of this research is to find out the concept of criminal law renewal to place restorative justice as ultimum remedium in certain crimes with a prison sentence of under five years. This type of normative legal research with the type of legal synchronization. Collecting data on normative legal research uses data collection techniques from a literature study. In drawing conclusions the author uses the deductive thinking method, namely a way of thinking that draws conclusions from a general statement or argument into a specific statement. the results of research and discussion can be concluded. First; The restorative justice approach to criminal acts with the threat of imprisonment for under five years finds its footing in the basic philosophy of Pancasila, namely in accordance with the 4th precept of Pancasila "Deliberation to reach consensus". Currently, restorative justice has been regulated in various regulations/policies. The contents of this internal policy show that there is no uniformity in understanding and boundaries of criminal acts that can be resolved through restorative justice and does not create an Integrated Criminal Justice System. and the imposition of criminal sanctions on perpetrators.

Abstract

This community service initiative investigates the pressing need to implement a Village Regulation concerning the Neighborhood Security System (SISKAMLING) in Koto Mesjid Village, addressing emerging  security challenges such as reduced community engagement, heightened environmental risks, and the lak of uniform security protocols. The primary aim is to bolster community awareness and ensure organized governance for maintaining public safety at the village level.The approach employed integrades field observations, stakeholder interviews, community workshops, and participatory discussions to collaboratively identify current challenges and establish regulatory requirements. The findings reveal that the community is in strong favor of creating a formal SISKAMLING regulation, acknowledging that well-defined guidelines, roles, and operational standards are crucial for enhancing coordination, accountability, and the sustainability of security efforts. This initiative improves the village’s preparedness in preventing disturbances, promotes  shared responsibility, and strengthens local resilience trhough a legal framework that meets community needs.

Abstract

Penelitian ini mengkaji tanggung jawab pemerintah dalam mencegah kerusakan hutan yang dilakukan oleh perusahaan pemegang izin Hutan Tanaman Industri (HTI), dengan studi kasus pada PT. Perawang Sukses Perkasa Industri (PSPI) di Kampar, Riau. Latar belakang penelitian muncul dari maraknya praktik pembalakan liar dan perambahan hutan di dalam kawasan konsesi PSPI, meskipun telah tersedia berbagai perangkat hukum yang mewajibkan perusahaan dan pemerintah untuk melakukan perlindungan hutan secara optimal. Kondisi ini menunjukkan adanya kesenjangan antara regulasi yang berlaku dan realitas pelaksanaan di lapangan. Penelitian ini menggunakan metode hukum sosiologis, dengan pengumpulan data primer melalui wawancara bersama pejabat pemerintah, aparat dinas kehutanan, serta perwakilan perusahaan. Selain itu, data sekunder diperoleh dari peraturan perundang-undangan, buku, jurnal, dan dokumen resmi lainnya. Seluruh data dianalisis secara kualitatif dengan pendekatan deskriptif-analitis untuk menggambarkan dan menilai efektivitas tanggung jawab pemerintah dalam pengawasan kehutanan. Hasil penelitian menunjukkan bahwa tanggung jawab pemerintah dalam perlindungan hutan belum berjalan secara efektif. Faktor-faktor utama yang mempengaruhi antara lain keterbatasan sumber daya manusia, lemahnya koordinasi antarinstansi, serta kurang optimalnya kegiatan pemantauan di lapangan. Di sisi lain, evaluasi pemerintah terhadap kepatuhan perusahaan juga masih lemah, terlihat dari jarangnya verifikasi terhadap laporan perusahaan serta ketidaktegasan dalam penerapan sanksi. Penelitian ini menyimpulkan bahwa pencegahan kerusakan hutan membutuhkan pengawasan yang lebih kuat, penegakan sanksi yang konsisten, serta peningkatan kerja sama antara pemerintah, perusahaan, dan masyarakat.

Abstract

Penyengat Village has been designated as a Traditional Village by the Siak Regency Government. The determination carries juridical implications in the form of the necessity of implementing village government based on the customary government system. However, efforts to restore the long-running village government system to the previously abandoned customary government system face various normative and sociological challenges. This study aims to analyze the formulation of the Customary Village policy by the Siak Regency Government and examine the readiness of Penyengat Village as the Original Customary Village of Anak Rawa Penyengat in organizing the government affairs of the Customary Village in Sungai Apit District, Siak Regency. This study uses a normative legal approach supported by empirical data to obtain a comprehensive picture of the implementation of Customary Village policies. The results of the study show that Kampung Penyengat is not fully ready to implement the Traditional Village government. The main obstacles faced include the unresolved boundaries of the village area, community heterogeneity, limited public understanding of the customary government system that has been in effect, low participation of the younger generation, and the lack of optimal socialization of Customary Village policies. In addition, the traditional government system of Kampung Penyengat has different characteristics from the Siak Malay customs, so it requires a deeper arrangement and understanding. Therefore, strategic steps are needed from local governments and indigenous peoples to strengthen institutional aspects, policy socialization, and revitalization of customary values as the basis for the implementation of the Traditional Village government.

Abstract

Penggunaan fasilitas komputer dan melakukan kejahatan pada sistem atau jaringan komputer dianggap sebagai kejahatan siber. Pada tahun 2021, Indonesia mencatat sekitar 1,6 miliar serangan siber. Pemerintah Indonesia memiliki perlu untuk meratifikasi Convention on Cybercrime dan perlu mengembangkan kolaborasi internasional dalam penegakan hukum khususnya pada kejahatan carding. Tujuan dari penelitian ini adalah untuk mengetahui bentuk pencegahan yang dilakukan Indonesia dalam mengambil langkah-langkah proaktif untuk memerangi dan mencegah kejahatan carding. Penelitian ini menggunakan metode penelitian hukum normatif, atau sering disebut juga sebagai penelitian hukum doktrinal, yang mengacu pada sumber-sumber hukum primer, sekunder, dan tersier sebagai sumber data sekunder. Penelitian yuridis normatif ini melihat bagaimana hukum di Indonesia tentang kejahatan siber, khususnya yang berkaitan dengan kejahatan carding, selaras dengan konvensi kejahatan siber. Hasil penelitian menunjukkan langkah yang dilakukan Indonesia adalah dengan ratifikasi Convention on Cybercrime untuk memperkuat kerangka hukum internasional dalam menangani kejahatan siber lintas negara dan pembaruan undang-undang, khususnya terkait cybercrime. Sehingga dengan adanya regulasi yang lebih komprehensif tersebut, penegakan hukum di Indonesia akan lebih efektif dalam mengatasi kasus carding dan mencegah kerugian finansial serta kerusakan reputasi yang dapat ditimbulkan dari kejahatan siber.

Abstract

Dispute Settlement Body (DSB) as a dispute settlement body of the World Trade Organization (WTO) in the trade dispute between Indonesia and the European Union in the case of nickel ore export restrictions loaded by the Indonesian Government through domestic policies. Thus, on 22 November 2019 the European Union officially sued Indonesia to the WTO with violations of Article X, Article XI and could not be justified by Article XI Paragraph (2) point (a) of GATT 1994 and Article XX point (d) of GATT 1994, and the European Union claimed that Article III Paragraph (1) point (b) of the Agreement on Subsidies and Countervailing Measures (SCM) was not consistent. In the end, the Panel granted the EU's lawsuit against Indonesia through the Final Report of the Panel DS592 by recommending Indonesia to cancel the nickel ore export ban policy. The research method in this case uses a normative legal approach. Normative law in this research has two legal sources, namely primary and secondary legal sources. Primary legal sources refer to Dispute Settlement Body Decision Number DS592, the 1994 GATT Agreement, Minister of Energy and Mineral Resources Regulation No. 1 of 2014, and Minister of Energy and Mineral Resources Regulation No. 11 of 2019. Then, secondary legal sources refer to a book by Huala Adolf entitled International Trade Law and a book by Serlika Aprika and Rio Adhitya entitled International Trade Law. The results of this study indicate that the DSB decision through the Final Report of the Panel number DES592 does not have binding legal force for the Indonesian state and will not have any legal consequences on Indonesia's legal sovereignty. Because the decision is considered to have experienced errors in terms of interpreting Indonesia's nickel ore export ban policy in relation to the applicable rules in the GATT 1994. Thus, Indonesia demands that the WTO form an Appealate Body to appeal the DSB decision
