Abstract

This research is aimed to find and introduce a new idea on the state administration, which has implications on the international treaty ratification procedure followed by Indonesia and additional authorizations of the Constitutional Court of the Republic of Indonesia. The judicial preview in this research is an international treaty examination procedure by the Constitutional Court before an international treaty is transformed into a law, i.e. such international treaty is a Bill. The judicial preview shall have different terms in each country, such as Review ex ante, abstract review, judicial review. This procedure is applied when an international treaty has not been validated as a country’s national law. The benefits of a judicial preview shall be a solution to connect an ambiguity between the state administrative law and international law. The judicial preview is also the inter-state institutions real check and balance on the international treaty. Out of benchmarking results of four countries following the monism doctrine, i.e. Russia, Germany, France, and Italty and two countries following the dualism doctrine, i.e. Hungary and Ecuador, several additional authorizations of the Constitutional Court shall be summarized, i.e. via the Amendment of 1945 Constitution of the Republic of Indonesia and/or regulations via laws. If both manners are not possible, the Constitutional Court may apply the judicial preview as a state administrative practice. An international treaty draft, which has passed through the judicial preview, may not be submitted to the Constitutional Court to be performed a judicial review, unless 5 (five) year-period has passed since the bill is enacted as a law.

Abstract

This research aims to analyze and to describe the relation between the Constitutional Court of the Republic of Indonesia (CC) with the People Representatives’ Council and the President of the Republic of Indonesia as legislators by looking on implementation of CC’s decision through the legislation in the period 2004-2015. Using doctrinal research, it can be seen how the constitutional mandate in the CC’s decision are implemented by the legislator through the legislation. The results are: (a) legal opinions of the CC’s decision have a binding power; (b) a constitutional mandate in the legal opinion is intended as guidance for the legislators regarding what the 1945 Constitution requires; (c) directives to the legislator in the legal opinions should be implemented because it is the implementation of the principle of checks and balances according to the 1945 Constitution, (d) implementation of the CC’s decisions through legislation does not have standard mechanism and does not become the priority of legislation, and (e) relation between the CC with the legislators can not be categorized in black and white in cooperative or confrontative, but shows ups and downs between cooperative and confrontative relations. Cooperative relations are realized when the constitutional mandate is formulated strongly so it is implemented by the legislator as the formula. Relationships tend to be cooperative in the implementation of the constitutional mandate of the decision, but not a priority of legislation. Meanwhile, the confrontative relations is seen from the constitutional mandate of the CC decisions which are not implemented.

Abstract

After the Reformation, several responsive laws were enacted, including Law Number 30 Year 2014 on Government Administration. The Government Administration Act is the legal basis for the government in carrying out governmental measures that provide legal protection for citizens for theactions of unlawful bodies / government officials. In the context of legal protection for the people through juridical control by the State Administrative Court, since the enactment of the Administrative Administration Law the competence that became the object of dispute in the State Administrative Court is wider, ie not only the Administrative Decision of the State, but also includes Government Action, Positive fictions, and testing of judgments of elements of abuse of authority. However, the extension of the competence of the State Administrative Court under the Government Administration Act has not been followed by the amendment of the State Administrative Justice Law, so in some cases there is an antinomy between the two laws. Such antinomies are aboutunderstanding the Decision of State Administration as well as about the enforcement of fictitious or negative fictitious lawsuits / requests. In the case of the subject of dispute, the provisions in the State Administrative Justice Act and the Administrative Law are relatively the same, in which thePlaintiff is a Civil Legal Entity, the Defendant is the State Administrative Agency / Officer, and the Intervention Party is a Civil Law Person . However, in the Government Administration Act there is a special case in the form of examination of the element of abuse of authority, where the Applicant isthe State Administration Officers / Officers. Against the antinomy and disharmonization between the State Administrative Justice Act as the formal law and the Government Administration Law as the material law, this paper seeks to conduct legal studies with the approach of legislation andconceptual approach, which is intended to realize harmonization and synchronization Between the two laws and regulations, so that the legal protection for the people will be realized through better handling of State Administration dispute in the State Administrative Court.

Abstract

The criminal act of terrorism is a crime against humanity, human civilization and constitute a serious threat to the integrity and sovereignty of a nation. In fact, terrorism can be a threat to a state security and sovereignty as well as world peace.It is argued that one of the main causes of criminal acts of terrorism is radicalization. Thus, this paper seeks to analyze the casual link between radicalization and terrorism. This paper determines to what extent does the radicalization affected the criminal acts of terrorism. This research uses a juridical normative method by analyzing legal instruments relating to terrorism and seeks to analyze the reason behind the provided rules.This paper submitted that while radicalization affected terrorism, de-radicalization is urgent in responding to terrorism. This paper also proposes how de-radicalization works in preventing terrorism.

Abstract

Hydrothermal activity in Kluwih, Tulakan Pacitan area East Java indicated by rock alteration zone, sulphide mineralization, and quatz vein NNE-SSW, NNW-SSE trend. Mineralization deposited at least in 6 stages, yaitu : 1st stage, pre mineralization deposited quatz (320°C), 2nd stage, deposited quartz + pyrite (290°C), 3rd stage, deposited quartz + pyrite + chalcopyrite + bornite ± galena ± sphalerite (260°C), 4th stage, deposited quartz + pyrite + cahalcopyrite + Tetrahedrite + bornite ± galena (220°C), 5th stage, deposited quartz + pyrite (200°C), and 6th stage or supergen stage, deposited secondary mineral (covellite, malachite, azurite) <100 °C. The hydrothermal system was able in Kluwih Pacitan and surrounding area interpreted as epithermal low suphidation system, or base metal horizon to precious metal horizon. Hydrothermal process initially by propilitic alteration and deposited of sulphides and quartz vein, then argilic alteration overprint both. Finally, surface erosion outcropted those deposits at surface.Key words : hydrothermal, mineralization, sulphide ore, Pacitan

Abstract

Bombana gold mineralization occurs within metamorphic rocks hosted environment, and it's not yet reported having connection with magmatisme/volcanisme. Therefore most ore mineral deposits have to be related with volcanisme bearing metallic mineralization. The aim of this study is to explain the character and types of gold deposit using petrography, mineragraphy, fluid inclusions, AAS, and geochemistry methods.Bombana area formed by orogenic activities which is composed by metamorphic rocks mainly consists by greenschist facies and ultra mafic rocks. Petrographically rocks called as garnet glaukofane amphibol schist, peridotite, serpentinite, sandstone meta, limestone meta, andesite meta, and altered rocks. While based on major elements composition, their parent rocks has ultrabasic-acidic rocks composition, formed peridotite to andesite.Gold mineralization of Bombana area indicates an epithermal-mesothermal type, which is exhibited by hydrothermal evidences such as crosscut veins after foliation and alteration at vicinity of quartz/calcite veins. These indicate that mineralization resulted by hydrothermally process and formed after metamorphism. Ore minerals consisted of gold, pyrite, chalcopyrite, goethite, lepidocrocite and cinabar and commonly associated with quartz veins as mineralized fluids suggested as low salinity (0,18-1,78)% NaCl equivalent and water rich mineralized fluid, at (210-350)ºC temperatur ranges.Keywords: Bombana, volcanic rocks, epithermal, metamorphism

Abstract

AbstractThis study aims to describe how the Group Investigation technique affects the class dynamic learning of English Speaking practice and how the Group Investigation technique affects the students’ cooperative learning in English Speaking practice by Year-10 students of SMA Negeri 3 Pontianak in Academic Year 2013/2014. This study is a case study. The subject in this study is the students of class 10F which consist of 35 students. This research uses observation, interview, and documentation technique. Data is analyzed using a formula to find out the percentage of class dynamic learning. The result of analysis shows the percentage of class dynamic learning 77.97% with criteria good learning. This result indicates that group investigation technique affect the students’ English speaking practice which is shown from the students’ positive response on every aspect being observed during the learning process. The result of interview indicates that Group investigation makes students work cooperatively in group and they can build a new relationship with people who culture and tradition are different from them Key Words: Group Investigation, Speaking Skill, Cooperative Learning

Abstract

AbstractThe objectives of this study are to investigate sorts of error on subject-verb agreement encountered in theses, the error frequency of subject-verb agreement, and the causes of errors of subject-verb agreement. Written language production is the major requirement of a thesis writing. However, sentence types necessarily become the starting points of determination to the correct subject-verb agreement. The research applied a descriptive method with qualitative approach. The data of this research were collected from the corpus of 6 theses submitted to English Language Study Program in Academic Year 2017/2018. The data were manually sorted out by separating subject-verb agreement errors from other types of error. The result showed that there are 6 major forms of subject-verb agreement which comprised 170 errors. Of 6 forms, “3rd singular subject” was the most frequent encountered in theses. In contrast, “double subject” was the least frequent error form. The errors were caused by “interlingual errors” and “intralingual errors”. Keywords: Errors, Subject-verb Agreement, Theses

Abstract

AbstractThe result of the research showed that students could comprehend narrative text with good comprehension. The problem of the research  was  students got difficulty to find out the meaning of the words, got less information during learning process because they were not active in reading the narrative text and its generic structure. Reading narrative text helped the students in finding the information about the story. The teacher explained the generic structure of narrative text to studying. The student sharing the information in the second group helped them in comprehending a narrative text. This research found out that there was an improvement of students reading comprehension in narrative text  for each cycle by Implementing One Stray Technique in teaching reading comprehension and students’ score improvements was better.Keywords: Reading Comprehension, Narrative Text, One Stray Strategy.
