Abstract

”Decentralization of protected forest management from central to district government has not yet been implemented effectively. This effectiveness depends on many factors that include policy contents and political process or discourse in the policy making process. This study aimsto: 1) analyze the discourse in policy making process of decentralization in the management of protected forests, 2) analyze the actors/networks and their interests and 3) find out policy space for future policy reform. Both quantitative and qualitative approaches were used in the study. The results show that there are three discourses in the policy-making process of decentralized management of protected forests, namely: i) democratic discourse (with story line of externality and accountability, supported by an association forum of Indonesian district government and  decentralization experts); ii) economic discourse (with story line of efficiency, supported by businessmen, Association of Indonesian Provincial Government and World Bank); and iii) democratic and economic discourses. The House of Representatives (DPR) and Ministry of Home Affairs have authorities and capacities to integrate two discourses. Redefining of externality and interdependency can be used as narratives of new policies to improve the policy of decentralized protected forest management.

Abstract

 Establishment of Forest Police Rapid Response Unit (SPORC) is the government's policy on law enforcement efforts in the field of forestry. Since its formation in 2005 it has been kown as its field implementation, while the practice of illegal logging still occurs. This study aims to reveal what the policy arguments underlying the formation, how it was implemented - especially SPORC Brigade Anoa in South Sulawesi (SPORC Anoa), and what can be recommended for the law enforcement to be more effective. The results showed that the problem is defined thus giving birth of SPORC formation policy is the deforestation is at very alarming rate, while the existing forest protection agencies have not been effective. In terms of quality, SPORC Anoa performance has not met expectations, most of the suspects were prosecuted to court are farmers. Lack of community involvement in the prevention and eradication of illegal logging, and poor relationships between central and local forestry agencies, mainly due to sharp differences about perception of forest area status. Completion of forest area status in Indonesia being important recommendations that need to be addressed. Forestry Law that is not up to date anymore, and institutions that have not been fully independent, caused low quality of case handling

Abstract

Kajian ini dilakukanuntuk mendapat pengetahuan mengenai masalah kelembagaan dan arah kebijakan rehabilitasi hutan dan lahan yang semestinya dapat diterapkan. Telah ditunjukkan oleh banyak referensi bahwa kinerja pembagunan kehutanan ditentukan oleh kapasitas kelembagaan. Dari hasil studi di dua kasus dapat ditunukan bahwa pelaksanaan program rehabilitasi hutan dan lahan, baik yang dilakukan oleh pemerintah maupun pemerinta daerah, belum disertai oleh upaya penguatan kelembagaan. Lemahnya kelembagaan terbukti oleh kegagalan implementasi kebijakan untuk mencapai tujuannya. Kesulitan pembaruankebijakan bersumber dari narasi kebijakan dan diskursus yang telah melakat dalam keyakinan para pembuat kebijakan.

Abstract

Management and development of forestry human resources is very important on attaining the objectives of forestry development towards sustainable forest management (SFM) and prosperous society. Lack of proper policy on forestry human resources management and development may degrade the quality of forest governance. Good understanding of the dynamics of power, interests, knowledge, and networks of stakeholders affecting the structure and performance of forestry human resources and it can be done by using an institutional approach to stakeholder analysis framework. This study aimed to determine the parties' interests and influences in policy-making on forestry human resource management and development. The study was conducted using snowball sampling method both in internal and external of the Ministry of Environment and Forestry. It is found that sixteen stakeholders involved in the policy-making on forestry management and human resources development, which can be divided into the groups of: subjects, key players, context setters, and crowds. The existing relationships are cooperation, complementary and conflict. It needs good understanding, clear rules and strong leadership in order to increase the optimal role of stakeholders and to determine human resource management policies and development.

Abstract

Research about Sustainable Forest Management (SFM) certification is intended to providerecommendation forpolicy implementation in addressingproblems to manage natural forests in Indonesia. Advocacy Coalition Framework (ACF) was employedto understand and explain changes when there are disagreements over the extentof policy regulatory purposes. The objective of this research is to determine the coalition of policy on SFM certification process using ACF by studying the history of related policies, beliefs of the actors and coalition. In addition, the research is alsoto formulate recommendation on the policy direction of SFM certification. This phenomenological research use discourse analysis to ensure the existence of coalition, which in this case areactors, conceptual framework, and the direction ofcoalition based on fixed parameters and external events as indicated in the ACF. The resarch found that in policy decision-making process on SFM certification in Indonesia there are two coalitions that are contradictingininterests. This political research indicates that SFM certification policy assessment tends to comply with applicable government regulations. International timber markets accepted certification of conformity assessment based on the fulfillment of standards and criteria for SFM.

Abstract

Following  the establishment  of Forest Management Units (KPHL/KPHP) by the Indonesian  Ministry of Forestry, the next step that has to be done  is the  formation and operationalization of KPHL/KPHP organization by local  governments. In reality, implementation of the respective obligation is stagnated due to a number of obstacles such as the regulatory aspects that haveless trust and difficult to be implemented by local governments. In the Institutional Analysis and Development (IAD Framework) from Elinor Ostrom, there is onecomponent, i.e. the rules-in-use concept that is possible to be applied as a tool  to analyze the relationship between the content of a certain regulation and the structure of action-situation formed due to implementationof regulation.This study aimsto test  effectiveness of  the  use  of the  concept  of  rules-in-use  to find  substantial  shortcomings  of  the  regulation  on  KPHL/KPHP formation at  provincial  level,as  a basisforimprovement. Accordingly,  analysis  was  performed  on  PP  No.6/2007  jo.  PPNo.3/2008,  Permendagri  No.61/2010  and  PP  No.41/2007by  making  analysis  of  regulation  contents and  feedback  from the implementation  process.  Based  on  the  results  of  this  study,  it  can  be  concluded  that  the  use  of  Ostrom's  rules-in-use  concept  is adequately effective to find the shortcomings of KPHL/KPHP regulation content.

Abstract

The earth atmosphere temperature is rising due to the increasing greenhouse gases. Facing the problem, the international community establishes the Climate Change Convention. One of main activities mention in that convention is to reduce deforestation and forest degradation. It has been four decades Indonesia ratified various convention relating to forest sustainability but the deforestation and forest degradation is still accelerating. This study analyzes the compatibility of the conventions on climate change in forest management in Indonesia. The research uses the narrative analysis method. Main result of the research shows that there is a discrepancy between the narrative of convention on climate change and the management of Indonesia forest. The work of the convention in Indonesia forest management requires some options related to incentives and fair access to forest uses.

Abstract

This study aims to analyze the substantial weaknesses of water utilization regulations in wildlife reserves, national parks, forest parks, nature tourism parks, and their effects on individual or organizational decision[1]making and actions. The research location is in the area of Taman Nasional Gunung Gede Pangrango (TNGGP). The analysis of this research is limited to Environment and Forestry Ministerial Regulations No. P.18/MENLHK/ SETJEN/KUM.1/4/2019, Law No. 17 of 2019, and Environment and Forestry Ministerial Regulations No. P.6/ MENLHK/SETJEN/KUM.1/1/2020. Regulatory analysis is carried out by identifying the characteristics of content of the regulations and comparing them with the conditions of water utilization in TNGGP to find out the implications of regulations on participant behavior and performance. Issues and problems are collected through interviews with participants. Furthermore, the regulations are analyzed using Ostrom's rules-in-use concept. The findin , based on the concept is that there is a discrepancy in the three regulations that all regulate water utilization permits in the conservation areas. This is mainly due to weak institutional strengthening among decision makers as well as laws and regulations made according to the interpretation of the government which often do not consider the conditions of the community.

Abstract

In forest management unit (FMU) operationalization, stakeholders are skeptical on the legitimacy of FMU policy, happening along their interaction. This interaction could encourage or inhibit the FMU policy adoption. This study goals is to analyze the FMU operationalization process and its influencing factors. Operationalization process is analyzed by analysis of qualitative descriptive based on stage of implementation and confirmation. Stakeholders interaction are analyzed by IDS method i.e. interaction between discourse/narrative, actors/networks and politics/interest. The results showed that FMU policy hasn't been fully recognized by stakeholders. Factors that affect the FMU policy operationalization are the clarity and adequacy of FMU authority, legitimacy of FMU policy and managements rights, the stakeholders support related to legality (regional policy) and action, and psychological barriers and trusts. Indicative strategies to overcome obstacles of the FMU operationalization are to establish and maintain the trust of stakeholders to support FMU operationalization bycommitment to a common goal in the FMU establishment, activity allocation suitable to the adopter needs, and participatory planning.

Abstract

Legal certainty and legitimacy of forest area can be gained through the gazettment process of forest area that starts from the designation, boundary demarcation, mapping, and ends up with the establishment. In Riau Province, these processes are stagnant, and, therefore, the legal certainty and legitimacy is difficult to achieve. What is really happenned is something that needs to be answered in this study. By using the analysis of strategy typology and descriptive qualitative analysis, this study has found that the gazettment issues of forest area consisted of three aspects, namely: designation, boundary demarcation and establishment. Social conflict has been accumulated along the gazettment process, so that the legal certainty did not lead to legitimacy. This problem happened due to: claims avoidance (PTB) to avoid failure in boundaries determination; policy narrative of the boundaries are not informed to community; inconsistency between the objective of boundary demarcation with the implementation; domination of all informed knowledge and information (BPKH); stages of gazettment were done just to fulfill administrative procedure; BPKH tasks issues; and state forest area regarded as the common pool resources (CPRs). This result proves that the improvement of government, policy in gazettment of forest area is seriously required.
