Abstract

The franchising is one of the business activities that support the economy. Therefore, in this study, this study analyzes the implementation of the franchise agreement clauses between franchisees and franchisees and knows the legal protection for Hockey Clean Shoes in case of default by the franchisee. This research uses empirical methods using document studies and field studies and data analysis using descriptive qualitative. The results show that the Hoki Clean Shoes franchise agreement has met the minimum clauses that must exist in the franchise agreement as stipulated in Government Regulation Number 42 of 2007 concerning Franchising and has fulfilled the principles of the agreement and is applicable in Indonesia. The obstacles faced by Hockey Clean Shoes so far are related to franchises because this is in the service sector so the turnover obtained by the franchisee every month is difficult for us to know because the financial management we do is different from the facts in the field. Franchise cooperation agreements like this are also vulnerable to default.

Abstract

Penelitian hukum ini merupakan kajian tindak pengabdian di Desa Adat Penglipuran sebagai desa wisata yang fokus pada pemberdayaan masyarakat melalui analisis Perjanjian Kerja Sama (PKS) dengan Pemerintah Kabupaten Bangli. Kajian menyoroti dampak ekonomi dari pembagian hasil pungutan (bruto) sebesar 60% untuk desa dan 40% untuk kabupaten, tingkat kesadaran hukum masyarakat adat saat proses perjanjian, peran tenaga ahli melalui Focus Group Discussion (FGD) dalam pendampingan, serta potensi verifikasi usaha wisata berbasis adat. Metode yang digunakan adalah kualitatif deskriptif dengan pengumpulan data melalui wawancara, FGD, dan telaah dokumen PKS. Hasil menunjukkan bahwa porsi pembagian saat ini berpotensi mengurangi kemandirian finansial desa, sehingga perlu direvisi menjadi 80–90% untuk desa. Kesadaran hukum prajuru dan warga masih terbatas, sehingga perlu penguatan literasi hukum. Selain itu, potensi ekonomi tambahan dari pengelolaan homestay, penyewaan pakaian adat, serta warung tradisional yang menjual pakaian, pernak-pernik, makanan, dan minuman khas desa menjadi sumber pendapatan penting bagi masyarakat. Penelitian merekomendasikan revisi PKS, peningkatan kapasitas hukum masyarakat adat, dan diversifikasi usaha pariwisata berbasis budaya sebagai strategi pemberdayaan masyarakat Desa Wisata Penglipuran.

Abstract

This study examines the legal protection of temples in Bali as both sacred areas and tourist destinations. Temples hold profound ontological, epistemological, and axiological significance as spiritual centers, cultural heritage, and symbols of Balinese identity. However, the rapid growth of tourism has created tensions between sacred values and economic interests, leading to commodification and violations of customary norms. The research employs normative legal methods to analyze existing frameworks, including Law No. 10 of 2009 on Tourism, Law No. 32 of 2009 on Environmental Protection and Management, Bali Provincial Regulation No. 5 of 2020 on Cultural Tourism, and the Decree of the Central Council of Hindu Dharma Indonesia (PHDI). Findings reveal that while these instruments provide a foundation, they remain insufficient in addressing the dualism of authority between state law and customary law. Theories of legal pluralism and living law highlight the coexistence of state regulations and traditional village norms, emphasizing the need for harmonization. The study concludes that temple protection must integrate formal legal frameworks with local wisdom, ensuring sustainable tourism that respects sanctity, cultural identity, and community participation. This approach strengthens Bali’s position as both a global tourist destination and a center of spiritual civilization.
