Abstract

This study aims to explain that there is an integration between Islamic values and the local culture of Kampar in the balimau kasai tradition. The balimau kasai tradition is a tradition of welcoming the holy month of Ramadan by bathing with traditional herbs and gathering on the banks of the river. In this study it was found that, there are 4 (four) categories that can be integrated between Islamic values and the local culture of Kampar, namely: (1) as a form of gratitude to be met with the month of Ramadan, (2) as a form of joy and happiness with the coming of the month of Ramadan, (3) as a means of cleansing and purifying the body and spirit, (4) as a place to establish friendship, and (5) as a moment to forgive each other. Of the four categories found, it is evident that balimau kasai is a local cultural tradition, as well as a form of planting Islamic values.

Abstract

Dinamika hukum wakaf di Indonesia terus mengalami perkembangan seiring dengan meningkatnya kesadaran masyarakat terhadap potensi besar wakaf sebagai instrumen pemberdayaan ekonomi dan peningkatan kesejahteraan sosial. Namun, dalam praktiknya, pengelolaan wakaf, khususnya wakaf produktif, masih menghadapi berbagai tantangan yang kompleks. Permasalahan utama yang dihadapi meliputi aspek regulasi yang belum sepenuhnya mendukung inovasi dan fleksibilitas dalam tata kelola wakaf, rendahnya pemahaman masyarakat serta kapasitas nadzir dalam mengelola aset wakaf secara profesional dan berkelanjutan, serta keterbatasan dalam aspek pengawasan, akuntabilitas, dan transparansi. Kurangnya integrasi teknologi informasi dalam sistem manajemen wakaf juga menjadi hambatan tersendiri dalam mendorong efisiensi dan efektivitas pengelolaan aset wakaf. Penelitian ini menggunakan pendekatan yuridis-normatif dengan mengkaji berbagai regulasi yang mengatur tentang wakaf di Indonesia, termasuk Undang-Undang Nomor 41 Tahun 2004 tentang Wakaf dan regulasi turunannya. Selain itu, penelitian ini juga dilengkapi dengan studi empiris terhadap praktik-praktik pengelolaan wakaf di berbagai lembaga wakaf di Indonesia, baik yang berbasis keagamaan maupun sosial ekonomi. Hasil penelitian menunjukkan bahwa diperlukan reformasi kebijakan dan regulasi yang lebih adaptif terhadap perkembangan zaman, termasuk dalam mendukung skema wakaf produktif yang berbasis investasi dan kewirausahaan sosial. Peningkatan kapasitas nadzir melalui edukasi, pelatihan, dan sertifikasi kompetensi juga menjadi langkah strategis untuk memperkuat tata kelola lembaga wakaf.

Abstract

This study aims to analyze Islamic scholars' fatwas regarding the sale and purchase of Non-Fungible Tokens (NFTs) from a sharia economic perspective. On the one hand, NFTs offer economic opportunities through ownership of non-duplicable digital assets. On the other hand, concerns have arisen regarding the validity of transactions, the potential for speculation, and their compliance with sharia principles such as clarity of contracts, benefits (manfa'ah), and freedom from gharar (uncertainty) and maysir (speculation/gambling). This study uses a qualitative analysis method with a library research approach, specifically content analysis of fatwas, opinions of contemporary scholars, and classical and modern fiqh literature. The results show differences of opinion among Islamic scholars. Some permit NFT transactions under certain conditions, such as clear benefits and a lawful object, while others consider NFTs to carry high speculative risks and uncertainty. These differences are influenced by understandings of the substance of NFTs as contract objects and the context in which they are used. This article concludes that caution is essential in NFT transactions. Furthermore, clear regulations and guidance from sharia authorities are needed to ensure that NFT trading practices are conducted in accordance with Islamic economic principles, thus providing fair, transparent benefits, and free from prohibited practices.

Abstract

Program kerja unggulan bidang ekonomi ini dilaksanakan dengan fokus pada panen dan distribusi jeruk sunkist sebagai upaya pengenalan produk pra pemasaran. Kegiatan ini dilatarbelakangi oleh potensi jeruk sunkist sebagai komoditas bernilai ekonomi tinggi yang belum optimal dalam strategi pemasaran di masyarakat. Tujuan utama program adalah memperkenalkan kualitas produk secara langsung kepada konsumen sekaligus memberikan pengalaman praktis bagi masyarakat dalam tahapan pra pemasaran. Metode kegiatan meliputi pemanenan, pengemasan sederhana, hingga distribusi jeruk sunkist ke sejumlah titik sasaran. Hasil yang diperoleh menunjukkan adanya respon positif dari masyarakat terhadap kualitas jeruk, serta memberikan gambaran strategi awal pemasaran produk hortikultura berbasis lokal. Pelaksanaan program kerja ini menggunakan pendekatan pengabdian masyarakat yaitu Asset Based Community Development (ABCD), berhasil mendorong partisipasi masyarakat dalam pengembangan produk hortikultura lokal. Dengan demikian, kegiatan ini menjadi langkah awal dalam membangun kesadaran pasar dan mendukung pengembangan ekonomi berbasis hasil pertanian

Abstract

Nahdlatul Ulama is a major Islamic organization in Indonesia. In deciding a law, Nahdlatul Ulama has a forum called the Lembaga Bahtsul Masa'il (LBM). This paper examines the developments in the determination of Islamic law by the Lembaga Bahtsul Masa'il. The method used is a qualitative research method with a normative approach. While the data sources used are secondary data sources with data processing and analysis in five stages, namely editing, grouping, verification, analysis, and drawing conclusions. The results obtained are that the Lembaga Bahtsul Masa'il in establishing a law is always developing. As a forum for determining NU's Islamic law, the Lembaga Bahtsul Masa'il not only always discusses fiqh issues, but also discusses other issues outside of fiqh, namely modern issues regarding state policies and legislation that are in direct contact with the interests and welfare of the community, such as the issue of protection of religious communities through laws; Implementation of Religious Education in Schools (Improved PP No. 55 of 2007); Organizing cheap and quality regional head elections; Natural Resources (SDA) for the welfare of the people; Shortening the waiting period for prospective pilgrims and managing Hajj finances; Protection of Indonesian Migrant Workers and Marriage Registration for Indonesian Muslim Migrant Workers abroad; and Improving the management of BPJS Kesehatan.

Abstract

Islamic Civil Law plays a significant role in regulating social, economic, and religious relations in Indonesia. In the context of rapid social transformation, the application of Islamic civil law within Indonesia’s pluralistic society requires critical examination from both juridical and philosophical perspectives. One of the main challenges lies in ensuring that Islamic civil law remains responsive to dynamic social change while preserving its foundational religious and moral principles. Accordingly, this study aims to analyze the relevance of Islamic civil law in addressing social change in Indonesia and to examine its application through juridical and philosophical approaches. This research employs a qualitative library-based method with normative analysis, drawing on legal literature, scholarly books, academic journals, and other relevant sources related to Islamic civil law and social change in Indonesia. The findings indicate that Islamic civil law remains highly relevant in responding to social change, particularly in the regulation of family relations, economic activities, and social interactions. From a juridical perspective, Islamic civil law demonstrates adaptability in accommodating evolving societal conditions. Philosophically, it maintains a balance between adherence to religious values and responsiveness to contemporary social needs. This combination of juridical flexibility and philosophical consistency is essential to sustaining the effectiveness and relevance of Islamic civil law within Indonesia’s continually evolving social context.

Abstract

The Constitutional Court Decision No. 69/PUU-XII/2015 marked a significant legal reform in Indonesia’s marriage law by amending Article 29 of Law No. 1 of 1974 concerning Marriage, which previously restricted the making of prenuptial agreements to before or at the time of marriage. Following this decision, spouses are now permitted to create or amend marital agreements during the course of their marriage. This study aims to examine the normative implications of this ruling, particularly in relation to the protection and management of joint marital property. Using a normative juridical method with statutory and conceptual approaches, this research analyzes how the decision reshapes the legal framework governing marital property arrangements and enhances the protection of individual and joint ownership rights within marriage. The findings reveal that the Constitutional Court’s interpretation expands the legal meaning of marital agreements, providing greater flexibility and legal certainty for married couples in managing their assets. Nevertheless, challenges remain in its practical implementation, particularly concerning the registration process, the recognition of third-party rights, and the potential emergence of legal uncertainty if not properly regulated. Therefore, additional technical and procedural guidelines are necessary to ensure that the objectives of fairness, legal certainty, and protection of property rights can be effectively realized in accordance with the spirit of the Constitutional Court’s decision.

Abstract

Abstract: Religious Courts have a strategic role in resolving Islamic civil disputes in Indonesia, especially in family, inheritance, and sharia economic cases. This article analyzes the role of Religious Courts through contemporary decisions that show adaptation to legal developments and social dynamics. In divorce disputes, the latest decisions consider aspects of gender justice and child protection. In inheritance cases, several decisions provide more flexible interpretations for the sake of social justice. Meanwhile, in sharia economic disputes, Religious Courts increasingly consider the principle of contractual justice. The results of the analysis show that Religious Courts not only play a role as enforcers of Islamic law, but also as institutions that adjust decisions to developments in society. Abstract

Marriage agreements play a strategic role in regulating the rights and obligations of spouses, particularly in relation to the ownership and management of property. This study aims to examine the differences in the regulation of prenuptial agreements under the Indonesian Civil Code (KUH Perdata) and the Compilation of Islamic Law (KHI), and to analyze the impact of the Constitutional Court Decision No. 69/PUU-XIII/2015 on the practice of marriage agreements in Indonesia. The research employs a normative juridical method using statutory and case study approaches, supported by literature reviews of relevant regulations, court rulings, and academic sources. The findings reveal that the Civil Code requires formal notarized agreements, while the KHI offers greater flexibility as long as the agreements align with sharia principles. The Constitutional Court’s decision broadens access to prenuptial arrangements but also brings administrative challenges and a lack of public awareness. This study highlights the importance of harmonizing national legal systems and religious norms to ensure fairer protection, particularly for women in marriage.

Abstract

This study aims to analyze the relevance of the ta’zir concept in Islamic criminal law as a more humanistic alternative to the modern criminal justice system. The research method used is a library research with a descriptive qualitative approach through an analysis of literature, classical fiqh jinayah books, and relevant academic journals. The results show that the ta’zir concept offers high flexibility and emphasizes moral and educational aspects for offenders, contrasting with the retributive nature of modern punishment systems. Ta’zir allows judges to impose penalties based on the offender’s intent, degree of guilt, and public benefit. The discussion reveals that the implementation of ta’zir values could strengthen the national legal system by promoting substantive justice rooted in humanitarian and Pancasila values. In conclusion, integrating ta’zir principles into the modern criminal justice system can be a strategic step toward a more ethical, fair, and socially beneficial legal framework.
