Abstract

The Malay community has engaged with various traditions, such as those of India, the Middle East, China, and even Europe. Despite that, religion, Islam, has wielded the most significant influence, particularly within the context of marriage life. The process of Muslim Malay marriages consistently adhere to Islamic values, even as these marriage processes are conducted within the framework of local customary practices. This article aims to examine the extent to which these marriage process adopt and synchronize with commonly held Islamic values. Data was gathered through observation and interviews in the Kepulauan Riau. This article reveals that these marriage processes indeed manifest values well-known within Islam. These values constitute in merisik phase symbolizing the principle of at-ta’āruf; menyampaikan hajat symbolizing al-Musyāwarah; menyampaikan belanja being a form of at-ta’āwun; ajak mengajak representing as-syirkah; berbalas pantun signifying al-mau’iẓah; and do'a selamatan embodying as-syukr. These values unequivocally represent the dominance of Islamic Law as the pivotal principles of Customary Law in Kepulauan Riau.  [Abstrak: Dalam lintasan sejarah, masyarakat Melayu telah berinteraksi dengan berbagai tradisi, misalnya India, Timur Tengah, China, dan bahkan Eropa. Terlepas dari sisi geografis di atas, Islam memiliki pengaruh yang paling signifikan, terutama dalam prosesi perkawinan. Pada tataran nilai, tahap-tahap pernikahan orang Melayu Muslim selalu menerapkan nilai-nilai Islam meskipun prosesi perkawinan itu dilaksanakan dalam bingkai acara-acara adat setempat. Artikel ini bertujuan untuk melihat sejauh mana tahap-tahap pernikahan itu mengadopsi dan singkron dengan nilai-nilai yang umum dalam Islam. Untuk mendapatkan gambaran yang tepat, kami mengumpulkan data dengan cara observasi dan wawancara di Kepulauan Riau. Artikel ini menemukan bahwa sebenarnya prosesi-prosesi tersebut merupakan manifestasi dari nilai-nilai yang selama ini jamak dikenal dalam Islam. Nilai nilai tersebut antara lain: merisik, menyimbolkan prinsip at-ta’āruf; menyampaikan hajat menyimbolkan al-Musyāwarah; menghantar belanja merupakan bentuk dari at-ta’āwun; ajak mengajak menyimbolkan as-syirkah; berbalas pantun, merupakan al-mau’iẓah; and doa selamatan merupakan as-syukr. Dengan demikian, nilai-nilai tersebut tidak ubahnya merupakan pengejewantahan dari dominasi Hukum Islam sebagai sendi Hukum Adat di Kepulauan Riau.]

Abstract

This study aims to explain that there is an integration between Islamic values and the local culture of Kampar in the balimau kasai tradition. The balimau kasai tradition is a tradition of welcoming the holy month of Ramadan by bathing with traditional herbs and gathering on the banks of the river. In this study it was found that, there are 4 (four) categories that can be integrated between Islamic values and the local culture of Kampar, namely: (1) as a form of gratitude to be met with the month of Ramadan, (2) as a form of joy and happiness with the coming of the month of Ramadan, (3) as a means of cleansing and purifying the body and spirit, (4) as a place to establish friendship, and (5) as a moment to forgive each other. Of the four categories found, it is evident that balimau kasai is a local cultural tradition, as well as a form of planting Islamic values.

Abstract

Dinamika hukum wakaf di Indonesia terus mengalami perkembangan seiring dengan meningkatnya kesadaran masyarakat terhadap potensi besar wakaf sebagai instrumen pemberdayaan ekonomi dan peningkatan kesejahteraan sosial. Namun, dalam praktiknya, pengelolaan wakaf, khususnya wakaf produktif, masih menghadapi berbagai tantangan yang kompleks. Permasalahan utama yang dihadapi meliputi aspek regulasi yang belum sepenuhnya mendukung inovasi dan fleksibilitas dalam tata kelola wakaf, rendahnya pemahaman masyarakat serta kapasitas nadzir dalam mengelola aset wakaf secara profesional dan berkelanjutan, serta keterbatasan dalam aspek pengawasan, akuntabilitas, dan transparansi. Kurangnya integrasi teknologi informasi dalam sistem manajemen wakaf juga menjadi hambatan tersendiri dalam mendorong efisiensi dan efektivitas pengelolaan aset wakaf. Penelitian ini menggunakan pendekatan yuridis-normatif dengan mengkaji berbagai regulasi yang mengatur tentang wakaf di Indonesia, termasuk Undang-Undang Nomor 41 Tahun 2004 tentang Wakaf dan regulasi turunannya. Selain itu, penelitian ini juga dilengkapi dengan studi empiris terhadap praktik-praktik pengelolaan wakaf di berbagai lembaga wakaf di Indonesia, baik yang berbasis keagamaan maupun sosial ekonomi. Hasil penelitian menunjukkan bahwa diperlukan reformasi kebijakan dan regulasi yang lebih adaptif terhadap perkembangan zaman, termasuk dalam mendukung skema wakaf produktif yang berbasis investasi dan kewirausahaan sosial. Peningkatan kapasitas nadzir melalui edukasi, pelatihan, dan sertifikasi kompetensi juga menjadi langkah strategis untuk memperkuat tata kelola lembaga wakaf.

Abstract

This study aims to analyze Islamic scholars' fatwas regarding the sale and purchase of Non-Fungible Tokens (NFTs) from a sharia economic perspective. On the one hand, NFTs offer economic opportunities through ownership of non-duplicable digital assets. On the other hand, concerns have arisen regarding the validity of transactions, the potential for speculation, and their compliance with sharia principles such as clarity of contracts, benefits (manfa'ah), and freedom from gharar (uncertainty) and maysir (speculation/gambling). This study uses a qualitative analysis method with a library research approach, specifically content analysis of fatwas, opinions of contemporary scholars, and classical and modern fiqh literature. The results show differences of opinion among Islamic scholars. Some permit NFT transactions under certain conditions, such as clear benefits and a lawful object, while others consider NFTs to carry high speculative risks and uncertainty. These differences are influenced by understandings of the substance of NFTs as contract objects and the context in which they are used. This article concludes that caution is essential in NFT transactions. Furthermore, clear regulations and guidance from sharia authorities are needed to ensure that NFT trading practices are conducted in accordance with Islamic economic principles, thus providing fair, transparent benefits, and free from prohibited practices.

Abstract

Marriage agreements play a strategic role in regulating the rights and obligations of spouses, particularly in relation to the ownership and management of property. This study aims to examine the differences in the regulation of prenuptial agreements under the Indonesian Civil Code (KUH Perdata) and the Compilation of Islamic Law (KHI), and to analyze the impact of the Constitutional Court Decision No. 69/PUU-XIII/2015 on the practice of marriage agreements in Indonesia. The research employs a normative juridical method using statutory and case study approaches, supported by literature reviews of relevant regulations, court rulings, and academic sources. The findings reveal that the Civil Code requires formal notarized agreements, while the KHI offers greater flexibility as long as the agreements align with sharia principles. The Constitutional Court’s decision broadens access to prenuptial arrangements but also brings administrative challenges and a lack of public awareness. This study highlights the importance of harmonizing national legal systems and religious norms to ensure fairer protection, particularly for women in marriage.
