Abstract

Some actions of the management of the foundation have even led to criminal actions. For example,letting the owner of an orphanage violate children in an orphanage, knowing the owner of an orphanagefoundation has committed a crime of violence but does not prevent it, is negligent in carrying outstewardship duties as it is so that the victim dies. So far, very little punishment has been carried out on themanagement of the foundation, even though the sentence is clearly condemned because the management ofthe foundation is one of the legal subjects. The absence of punishment against the foundation's managementwas the background of this research. In accordance with the description above, the authors are interested inconducting research under the title Criminal Liability Against Administrators of the Tunas BangsaOrphanage Foundation Against the Crime of Child Violence according to Law Number 35 of 2014concerning the Protection of Children in the Legal Territory of Pekanbaru City. This thesis aims to find outwhether or not administrators of the nation's orphanage foundations can be held accountable or not if thereis a criminal act in the nation's foster home foundation and to find out how the nation's foster careinstitutions are convicted so that the orphanage foundation administrators can be convicted.The type of research used in writing this law is empirical sociological legal research, namely themethod or method used in legal research conducted by examining existing library materials by looking atevents or facts that occur in the social environment. The nature of this research is descriptive. This studyuses primary data, namely data that the author gets / gets through respondents (field) that are in accordancewith the problem and secondary data, namely data that has been prepared.From the results of the problem research there are two things that can be concluded, firstly, themanagement of the foundation can be criminal if there is a crime that causes casualties because themanagement is an important organ in the foundation. Second, the punishment of the management of thefoundation can be carried out in accordance with the Foundation Law and the Child Protection Act.Keywords: Accountability, Foundation Management.

Abstract

The Civil Service Police Unit is a regional government tool in providing peace and public orderand enforcing regional regulations. In addition, the civil service police unit can also carry out publicwelfare and provide the best service to the public, the civil service police unit requires certain powers to actaccording to their own initiatives and policies, especially in urgent circumstances and where there are norelevant regulations.This study is a sociological juridical research that is a type of research to see the effectiveness ofthe law in the field in accordance with the reality of life in society. This research was conducted at thePekanbaru City Police Department on the grounds that there were still many members of the Satpol PP whocommitted violent crimes against the street vendor. While the population and sample are parties related tothe problems examined in this study, the data sources used, primary data, secondary data, and tertiary data.The technique of collecting data in this study was by interviews, questionnaires and literature review.From the results of the research the authors concluded, first the application of criminal sanctionsto members of the civil service police unit who committed violations where the apparatus only gavesanctions in the form of reprimand, and in this case the sanctions given by the apparatus were certainly noteffective and not in accordance there is. Second. Sanctions that should or ideally be given to members of thecivil service police unit who commit a crime of violence are in accordance with Article 351 of the CriminalCode concerning Persecution, namely imprisonment and criminal penalties and Discipline Sanctions givenby the agency of the Civil Service Police.Keywords: Application of Sanctions - Civil Service Police - Violent Crimes.

Abstract

Indonesia is a developing country, in a developing country the fulfillment of economic needs and motor vehicle facilities, especially cars, is very important for its people. With the higher needs, the higher the risk of crime. The crime of embezzlement of rental cars has happened a lot in people's lives. The embezzlement was carried out by the perpetrators to fulfill the necessities of life, with many car rental fraud embezzlement now it is necessary to consider quick action by the investigators regarding the background and mode of the fraud of the rental car embezzlement as well as how criminal liability against the embezzler of the rental car embezzlement that causes the occurrence of the acts embezzlement.The type of legal research used by the author is the type of sociological research, which is field research to see the effectiveness of law. According to Soejono Soekanto that in sociological legal research can see the correlation between law and society so that it can reveal the effectiveness of the law in society and identify unwritten laws that apply to the community. This research is based on descriptive research, which is a study that aims to describe the situation or phenomenon that occurs as clearly as possible. In this case what will be described is the rule of law, the crime of embezzlement of four-wheeled vehicles, obstacles encountered in the Pekanbaru City Police Department.The conclusion is that fraud is caused by economic factors that force a person to commit a crime. To get the defendant's money, he bought a car which the defendant pawned to get the amount of money the defendant used for his daily needs. After the elements of a criminal offense have been fulfilled, the perpetrators of these crimes must be sentenced. The embezzlement crime is regulated in article 372 of the Criminal Code which carries a maximum sentence of 4 years in prison.Keywords: Investigation – Embezzlement.

Abstract

Investigation of the efforts made by investigators seeking information and gather evidence that he explained crime. As for the criminal acts that often occur in the community that violence or persecution, the presence of such actions certainly abuse victims take legal steps by making a police report. In the passage of the investigation process is often the case for peace between the victim and reported. In this case the investigation of criminal offenses related to maltreatment by Civil Service Police Unit against demonstrators associated with the peace made by the parties in the resort city of Pekanbaru police. The purpose of this thesis, namely: First, the Crime Investigation persecution conducted by Civil Service Police Unit Against Protesters, Second, Crime Persecution Peace Process conducted by Civil Service Police Unit Against Protesters Can Be The Reason For Termination of Investigation Process.This type of research can be classified in this type of sociological juridical research because in this study the authors directly conduct research on the locations or places studied in order to provide a complete and clear picture of the issues examined. This research was conducted at the City Police Pekanbaru, while the sample population is a whole party with regard to the issues examined in this study, the data source diginakan, primary data, secondary data and tertiary data collection techniques in research in the observation , interviews and a literature review.From the research, there are two fundamental rights problem that can be inferred. First, Investigation Crime of Torture conducted by Civil Service Police Unit Against Protesters, that the criminal acts of persecution carried out by the Civil Service Police Unit has memenuhui element of the sentence, but in terms of the passage of the investigation, Warrant Commencement of Investigation (SPDP) was never delivered to the public prosecutor (prosecutor). As Article 109 of the Criminal Procedure Code since the start of the investigation the investigator must give written notification of the commencement of the investigation. Second, the Peace Process Crime persecution conducted by Civil Service Police Unit Against Protesters Can Be The Reason For Termination Process of Investigation, while the peace process made by the victim and reported, in line with the Letter of the Chief of Police No. Pol: B / 3022 / XII / 2009 / SDEOPS, dated December 14, 2009 on Alternative Dispute Case Handling Through Resolusion (ADR). Selanjtnya for legal certainty investigation process carried his case to terminate the investigation. Abstract

This article discusses the local government policies with respect to Malay culture in Siak, one of the regencies in Riau Province. It is based on the fact that Malay culture is inseparable part of Siak. Historically speaking, Malay culture has been there since the early formation of the Siak Kingdom in 1723 AD. Having and promoting itself with a slogan “The Truly Malay,” Siak is proud of standing upon Malay culture. The reflection of Malay culture as well as its traditions is established in day-to-day lives witnessed in its language and clothing. Aiming at preserving the culture, the local government has made a policy in the form of Regional Regulations on Malay Language and Culture. However, as will be demonstrated through a normative approach, the implementation of the Regional Regulation is still constrained due to the absence of a Regent Regulation which is hoped to function as an implementing regulation. Addressing such a problem has to be integrated into various policies in the form of a District Head Regulation.

Abstract

After the enactment of Law Number 6 of 2014 concerning Villages on 15 January 2014, the Republic of Indonesia now has laws specifically regulating the administration of village governance. A very important part is the arrangement of village regulations. Village regulations are set by the village head after obtaining approval with the Village Consultative Body. In the process of establishing village regulations, community participation is needed, so that the output of village regulations can fulfil aspects of local community needs that are conveyed through the Village Consultative Body. The aspirations of the local community in the form of input and contribution ideas are more effective, because community complaints and opinions are taken into consideration in decision making. Related to this matter, the formulation of the problem in this study is how is community participation in the process of establishing Village Regulations in Koto Masjid Village, District XIII, Koto Kampar, Kampar Regency? There are still very many village organizers (Village Heads and Village Consultative Bodies) and village communities who do not yet have the knowledge and expertise in the field of legislation. This has the potential to affect the success of the implementation of the Law on Villages, and even does not rule out the possibility of creating legal chaos, among others, the occurrence of conflicts and overlapping laws and regulations. So that in the future knowledge of the establishment of legislation is needed which is able to encourage people to participate in the formation of village regulations, realize Village Regulations that are aspirational, responsive, obedient, harmonious and harmonious vertically and horizontally in the framework of developing national legal systems based on The 1945 Constitution of the Republic of Indonesia, and produced a Draft Law and Regulations that could be accounted for philosophically, juridically and sociologically. Knowledge can be obtained through legal counselling, especially legal counselling related to community participation in the process of establishing village regulations in Koto Masjid Village, District XIII Koto Kampar, Kampar District.

Abstract

AbstractMoney laundering criminal acts are referred to as follow-up crimes and follow-up actions, money laundering is a follow-up action that is continued or an original crime (predicate crime) while the follow-up perpetrator of the findings of a large fund that appears to be clean or lawful, using sophisticated, creative and complex methods The purpose of deciding on this Test is, namely; First, the Current Criminal Law Policy Can Overcome Money Laundering in Indonesia, Secondly, Constraints that back down in the Criminal Law Policy in overcoming Money Laundering in Indonesia. This type of research can be classified in the type of Normative Law research. Data collection in this study uses library research methods (library research) or documentary studies. From the results of the study there are two main things that can be concluded. First, criminal law policy in the renewal of criminal law in the field of money laundering crimes that focuses on the policy formulation of criminal acts, criminal liability, and criminal sanctions In other words, renewal of criminal law requires the existence of research and thinking on a central problem and very fundamental and strategic in formulated in a statutory regulation. Second, Constraints in dealing with money laundering crimes in addition to the Constraints of the Financial Transaction Analysis Center (PPATK), Banking constraints, Police Investigator Constraints and lack of coordination between other law enforcement officers in carrying out money laundering and government efforts to overcome obstacles - these obstacles. In carrying out their respective roles synergies between these institutions are needed to prevent and eradicate money laundering crimes that apply effectively, Suggestion the author, first, It is expected that in money laundering regulations, the government is expected to be more assertive in formulating criminal acts, criminal liability, sanctions or penalties so that money laundering criminals feel more afraid, this is to reduce future money laundering crimes, Secondly, It is hoped that banks will implement a single Idenity number system so that banks can obtain the identity of service users and avoid fake identity users to use with the aim of conducting money laundering. Keywords: Legal Policy, Eradication, Crime, Money Laundering AbstrakTindak pidana pencucian uang disebut sebagai tindak lanjut kejahatan dan tindak lanjut, pencucian uang adalah tindak lanjut yang dilanjutkan atau merupakan kejahatan asal (predicate crime) sedangkan pelaku tindak lanjut atas temuan dana besar yang tampaknya bersih atau halal, menggunakan metode canggih, kreatif, dan kompleks. Tujuan penentuan Tes ini adalah, yaitu; Pertama, Kebijakan Hukum Pidana Saat Ini Dapat Mengatasi Pencucian Uang di Indonesia, Kedua, Kendala yang mundur dalam Kebijakan Hukum Pidana dalam mengatasi Pencucian Uang di Indonesia. Jenis penelitian ini dapat diklasifikasikan dalam jenis penelitian Hukum Normatif. Pengumpulan data dalam penelitian ini menggunakan metode penelitian kepustakaan (library research) atau studi dokumenter. Dari hasil penelitian ada dua hal utama yang dapat disimpulkan. Pertama, kebijakan hukum pidana dalam pembaharuan hukum pidana di bidang kejahatan pencucian uang yang berfokus pada perumusan kebijakan tindak pidana, pertanggungjawaban pidana, dan sanksi pidana. Dengan kata lain, pembaruan hukum pidana mensyaratkan adanya penelitian dan pemikiran tentang masalah sentral dan sangat mendasar dan strategis dalam dirumuskan dalam peraturan perundang-undangan. Kebijakan hukum pidana dalam rangka mengatasi kejahatan pencucian uang dapat dirumuskan sebagai upaya untuk membuat dan membentuk peraturan tentang hukum pidana di masa depan secara efektif dan efisien. Kedua, Kendala dalam menangani kejahatan pencucian uang di samping Kendala Pusat Analisis Transaksi Keuangan (PPATK), kendala Perbankan, Kendala Penyidik Polisi dan kurangnya koordinasi antara petugas penegak hukum lainnya dalam melakukan pencucian uang dan upaya pemerintah untuk mengatasi hambatan. - Hambatan ini. Dalam menjalankan perannya masing-masing diperlukan sinergi antara lembaga-lembaga ini untuk mencegah dan memberantas kejahatan pencucian uang yang berlaku efektif, Saran penulis, pertama, Diharapkan dalam peraturan pencucian uang, pemerintah diharapkan lebih tegas dalam merumuskan tindak pidana , pertanggungjawaban pidana, sanksi atau hukuman sehingga penjahat pencucian uang merasa lebih takut, ini untuk mengurangi kejahatan pencucian uang di masa depan. Kedua, Diharapkan bank akan menerapkan sistem nomor identitas tunggal sehingga bank dapat memperoleh identitas pengguna jasa dan menghindari pengguna identitas palsu untuk digunakan dengan tujuan melakukan pencucian uang. Kata Kunci: Kebijakan Hukum, Pemberantasan, Kejahatan, Pencucian Uang

Abstract

AbstractThe purpose of this writing is to find out the responsibility of parents for traffic violations committed by minors and to know the idea of traffic violations committed by minors. This type of research will examine the subject matter in accordance with environmental space and identify problems through a normative juridical approach. Based on the results of the analysis in this study, it can be concluded: The responsibility of parents for traffic violations committed by minors due to negligence resulting in traffic accidents carried out by children cannot be transferred to their parents for criminal liability. The idea of criminal acts of traffic violations committed by minors should be transferred to the parents of the child on the grounds that the person responsible for the violation of the child is the parent of the child who has been negligent with his decision to make a leeway on the highway while still underage. Parents are stated as an aid to criminal acts committed by their children and are also responsible for victims of criminal acts committed by their children. Besides that, children can also be categorized as victims in the sense of victims from their parents' negligence because as long as their status is still a child, they are still under control parent or guardian. Keywords: Parental Responsibility, Criminal Driving, Children. AbstrakTujuan penulisan ini adalah mengetahui pertanggungjawaban orangtua terhadap tindak pidana pelanggaran berlalu-lintas yang dilakukan anak di bawah umur dan gagasan terhadap tindak pidana pelanggaran berlalu-lintas yang dilakukan anak di bawah umur. Jenis penelitian ini akan mengkaji pokok permasalahan sesuai dengan ruang lingkungan dan diidentifikasi masalah melalui pendekatan yuridis normatif. Pertanggungjawaban orangtua terhadap tindak pidana pelanggaran berlalu-lintas yang dilakukan anak di bawah umur yang karena kelalaiannya mengakibatkan kecelakaan lalu lintas yang dilakukan oleh anak tidak bisa dialihkan pertanggungjawaban pidananya kepada orang tuanya. Gagasan terhadap tindak pidana pelanggaran berlalu-lintas yang dilakukan anak di bawah umur sebaiknya dialihkan kepada orangtua anak dengan alasan yaitu penanggung jawab akibat pelanggaran pada anak adalah orangtua si anak yang telah lalai dengan keputusannya memberikan kelonggaran berkendara di jalan raya padahal masih di bawah umur. Orangtua dinyatakan sebagai perbantuan terhadap tindak pidana yang dilakukan anaknya dan turut bertanggungjawab terhadap korban dari tindak pidana yang dilakukan oleh anaknya, disamping itu anak juga bisa dikategorikan sebagai korban dalam artian korban dari kelalaian orang tuanya karena selama statusnya masih menyandang sebagai anak maka ia masih dibawah penguasaan orangtua atau walinya. Kata Kunci: Pertanggungjawaban Orangtua, Pidana Berkendara, Anak.

The dissolution of social organizations which are the absolute authorityof the Government based on Law Number 16 of 2017 concerning Stipulation ofGovernment Regulations in Lieu of Law Number 2 of 2017 concerningAmendments to Law Number 17 of 2013 concerning Social Organizations intoLaws does not reflect the basic principles of a rule of law and democracy thatrequires the protection of human rights and the distribution of power in orderto prevent the instrumentation process from placing the law as part of power.The dissolution of social organizations should still involve a court process toavoid subjective decisions made by the government. Therefore, the purpose ofthis thesis research is first, to analyze the mechanism for dissolution of socialorganizations based on Law Number 16 of 2017 concerning Stipulation ofGovernment Regulations in Lieu of Law Number 2 of 2017 concerningAmendments to Law Number 17 of 2013 concerning Social Organizations intoLaws which is reviewed from the perspective of the rule of law and democracyin Indonesia. Second, the ideal arrangement for the dissolution of cocialorganizations in IndonesiaThis type of research can be classified into normative juridicalresearch, namely a research that describes clearly and in detail the mechanismfor the dissolution of social organizations based on Law Number 16 of 2017concerning Stipulation of Government Regulations in Lieu of Law Number 2 of2017 concerning Amendments to Law Number 17 of 2013 concerning SocialOrganizations into Laws, which is reviewed from the perspective of a rule oflaw and democracy in Indonesia. This study uses data sources in the form ofprimary data and secondary data, and data collection techniques are carriedout by literature review.From the results of the research problem there are two main things thatcan be concluded. First, the problem of fulfilling human rights in themechanism for dissolving social organizations in Indonesia. Second, the idealarrangement is related to the mechanism for the dissolution of SocialOrganizations in Indonesia. The author's suggestion is that the current Law onSocial Organizations needs to be revised again by incorporating the court'sauthority in deciding disputes over the dissolution of social organizationswhich is supported by the application of fast, simple and low-cost judicialprinciples.Say key: Social Organization-Rule of Law-Democracy
