Abstract

Tradition is one element of the form of culture as the identity of a society. Understanding adat as a form of community culture can accelerate the process of unity and unity of the nation as Indonesia which is composed of various cultures and its tradition.This diversity becomes the strength of the Indonesian nation that must always be knitted, so it must be managed with the spirit of nationality based on Pancasila and 1945 Constitution in the container Bhineka Tunggal Ikadan The Unitary State, because if it is not managed properly and properly it can lead to the disintegration of the nation and threaten the integrity of the Unitary State of the Republic of Indonesia. Differences of custom and culture also apply globally and tested in the era of globalization. Therefore it is necessary to understand the reality of the differences to be managed in creating peace.

Abstract

This research aims is to analyze the validity of the transfer of land rights Pura profit in the perspective of legal certainty and protection of the law in the conservation of land Pura profit in Badung regency. This research is an empirical law study using primary data and secondary data. An Approach used in the form of the approach of legislation analysis, case and custom law. Based on the results of the research can be analyzed that the sale and purchase of land Pura profit executed after the fulfilled special terms and general terms according to the customary law and law of the country. The purpose is for the legal certainty and legal protection for both the buyer and the existence of the temple itself. Therefore, for Pura profit is expected to be innovatively able to manage temple income to be useful to support the activities of temple balance.

Abstract

Penelitian yang dilakukan menggunakan metode penelitian empiris untuk membahas permasalahan yaitu : 1) Bagaimanakah penguasaan hak atas tanah adat di Kecamatan Ubud Kabupaten Gianyar. 2) Faktorfaktor penyebab alih fungsi tanah adat sebagai akomodasi pariwisata.Teori yang digunakan; Teori kepastian hukum, Teori Teori Fiksi, milik kolektif dan Teori kewenangan. Melalui pendekatan perundang-undangan, pendekatan analitik dan pendekatan sosiologi hukum yang dianalisis dengan menggunakan metode analisis interprestasi yang dibantu dengan analisis kualitatif terhadap data yang diperoleh. Berdasarkan hasil analisis didapat simpulan sebagai berikut: Pertama; Penguasaan hak atas tanah adat di Kecamatan Ubud pada umumnya dikuasai oleh Desa, Pura, dan krama desa. Tanah ini peruntukan anaknya sebagai lahan pertanian kemudian berubah menjadi akomodasi pariwisata seperti restorant, vila/hotel Maneychanger dan tempat parkir. Kedua; Faktor yang menjadikan alih fungsi peruntukan tanah adat antara lain (1) Faktor ekonomi seperti tanah adat dijadikan tempat usaha restorant, vila/hotel Maneychanger dan tempat parker.(2) Keterbukaan lahan dalam pengembangan akomodasi pariwisata. Kata kunci, Alih Fungsi, Hak Penguasaan, dan Tanah Adat.

Abstract

Pura memiliki tanah yang disebut dengan tanah Laba Pura atau tanah Pelaba Pura dan antara keduanya merupakan satu kesatuan fungsi yang tidak dapat dipisahkan. Hal ini didasarkan pada konsep pembagian wilayah Pura menurut hukum Hindu yang dikenal dengan konsep Tri Mandala. Berdasarkan konsep tersebut, maka tanah Laba Pura merupakan Kanista Mandala Pura, yaitu: wilayah Pura yang terletak diluar bangunan Pura. Menurut hukum adat tanah Laba Pura adalah tanah-tanah yang hanya dipergunakan untuk kepentingan-kepentingan Pura, misalnya untuk pembiayaan pelaksanaan upacara-upacara maupun pemeliharaan atau perbaikan bangunan Pura. Rumusan masalah dalam penilitian ini yaitu: bagaimana sahnya peralihan hak atas tanah Laba Pura dalam perspektif kepastian hukum. Penelitian ini bertujuan supaya adanya kepastian hukum dan perlindungan hukum baik bagi pembeli maupun eksistensi Pura itu sendiri. Oleh karena itu bagi Pengempon Pura diharapkan secara inovatif dapat mengelola Laba Pura agar bermanfaat menunjang kegiatan keseimbangan Pura. Penelitian ini menggunakan metode penelitian hukum empiris. Masyarakat pada umumnya melihat tanah Laba Pura adalah tanah biasa seperti tanah pertanian lainnya, hal ini menyebabkan masyarakat bebas memindah tangankan tanah Laba Pura. Perlindungan hukum terhadap tanah Laba Pura atau sering di sebut tanah Pelaba Pura adalah terkait dengan upaya-upaya pelestarian terhadap tanah-tanah adat yang dewasa ini perlu memperoleh perhatian dari pengempon Pura dan pemerintah. Sahnya peralihan hak atas tanah Laba Pura dalam perspektif kepastian hukum secara umum adalah sama dengan peralihan tanah hak milik. Namun peralihan tanah Laba Pura dijalankan setelah dipenuhi syarat khusus dan syarat umum hukum adat dan hukum Negara. Selanjutnya berkaitan dengan perlindungan hukum pelestarian terhadap tanah Laba Pura dapat dilakukan dengan pendaftaran dan pensertipikatan tanah Laba Pura melalui pelaksanaan paruman pengempon pura guna memperoleh kata sepakat seluruh pengempon pura. Abstract

Sengketa tanah yang sering timbul di masyarakat diawali dengan banyaknya kasus atau tanda-tanda hak atas tanah lama yang tidak hilang ketika diubah menjadi sertifikat, sehingga banyak pihak yang memiliki pipil atau sertifikat dari negara yang sama. Sedangkan pipil atau sejenisnya merupakan bukti kepemilikan tanah, sebelum Undang-undang No. 5 Tahun 1960 tentang Agraria, yang menyatakan bahwa sertifikat adalah bukti kepemilikan tanah yang sah. Oleh karena itu, persoalan ini berkaitan dengan bagaimana kekuatan pipil membuktikan hak atas tanah sebelum sertifikat diterbitkan dan sengketa tanah ulayat di desa adat Guwang diselesaikan pada saat sertifikat. Penelitian ini menggunakan jenis penelitian hukum empiris dan pendekatan sosiologis. Hasil dari penelitian ini adalah Pipil merupakan bukti sahnya kepemilikan hak-hak lama sebelum lahirnya Undang-Undang Pokok Agrari (UUPA) dan Sertipikat merupakan bukti sahnya pemilikan tanah menurut UUPA. Untuk sengketa adat Desa Guwang yang hak milik atas tanahnya disebutkan dalam Pasal 19(2)(c) UUPA, sertifikat merupakan alat bukti yang kuat, yaitu keterangan fisik dan hukum yang terdapat dalam surat pernyataan tidak menjadi penentu sengketa adat Desa Guwang.

Abstract

Lembaga Perkreditan Desa (LPD) secara kelembagaan perlu dikuatkan seiring dengan wacana penguatan desa adat dengan mengingat bahwa LPD sampai saat ini berjalan secara alami sehingga rentan untuk terjadi penyalahgunaan keuangannya terutama oleh “pengurusnya”. Upaya yang dilakukan adalah penguatan kelembagaan melalui pelatihan manajemen Sumber Daya Manusia (SDM) dan akuntansi keuangan berbasis aplikasi, Focus Group Discussion (FGD), dan sosialisasi keberadaan “perarem LPD” untuk menjamin adanya kepastian hukum melalui penegasan hak dan kewajiban pengurus, pengawas, prajuru adat dan masyarakat hukum adat yang dikenal dengan “krama desa”. Tiap bidang kegiatan yang memerlukan aturan yang lebih khusus dari awig-awig yang ada agar awig-awig dapat dilaksanakan sesuai dengan asas kepatutan, yaitu: kepastian, keadilan dan kemanfaatan. LPD di tiap desa adat dilahirkan untuk menguatkan sistem perekonomian desa adat dalam upaya memandirikan dan pemberdayaan krama desanya. Kondisi ini menjadi sangat urgen dengan mengingat, bahwa beberapa LPD Desa Adat di masing-masing Kabupaten di Bali sudah kolaps, kondisi ini lebih disebabkan karena perbuatan menyimpang pengurus LPD. Juga upaya adaptasi sistem akuntansi keuangan LPD berbasis aplikasi dan manajemen SDM yang lebih modern. Metode yang digunakan disesuaikan dengan tahapan pelaksanaan kegiatan, yaitu sosialisasi rancangan pemikiran dalam paruman prajuru adat, pelatihan sistem akuntansi keuangan berbasis aplikasi, pelatihan menajemen LPD. Teknik pendekatan yang digunakan berupa pendekatan partisipatif dari pengurus dan karyawan LPD. Untuk sosialisasi awig-awig dan perarem dilakukan melalui paruman prajuru desa.

Abstract

ABSTRACT After the Referendum of 1999, ownership of land rights in East Timor is still complicated bringing about problems such as: 1) How is the ownership of land rights for the people of East Timor by the Constitution of the Democratic Republic of Timor-Leste in 2002, 2) How is the Timorese government's efforts to resolve housing land disputes left by the former inhabitants of East Timor in Timor Leste. The type of research is Normative Legal Research by using legislation, concepts, analytical, case, and comparative law approaches. Materials used are in the form of primary legal materials, secondary, tertiary, and then analyzed by interpretation technic. The study found that land rights for the people of East Timor by the Constitution of 2002 was still weak. On the basis of Article 13 and 15 of Law No. 1 of 2003 on assets and immovable possessions the property rights on land owned by the ex-East Timorese people are automatically revoked or missing. Recommendation to the government of Timor Leste is that UUPA ever prevail in Timor-Leste can be adopted for under article 3, paragraph 1 of UNTAET Regulation No. 1 of 1999, land owned by the former inhabitants of East Timor adopted by some natives of East Timor must be reprocessed by the government of Timor Leste in accordance with the applicable law. Abstract

ABSTRACT Legal protection in the registration of indigenous land rights in Denpasar still so unclear in the public and little or not cause problems such as: 1) How does the legal protection in the registration of customary land by BAL, 2) How Implications Conflict in the registration of customary land in Denpasar. This type of research is research of normative law, the approach to legislation, Concepts, Analytical, Case, and Comparative Law, Materials used in the form of primary legal materials, secondary, tertiary, and then analyzed by Technical Interpretation. The study found that the legal protection in the registration of customary land according to the BAL described in Article 3 and Article 4 of the registration of the land on which rang to provide protection and legal certainty, as the enactment of Government Regulation No. 24 of 1997, the order of article 19 of Law land laws. The implications of conflict in the registration of customary land in the city of Denpasar because of their customary land rights of control in an individual or individuals who aims into the land conflicts, which make land registration becomes blocked, land conflicts resolved by the General Court and the Administrative Court. While the land conflict resolution outside the court to do is negotiation, consensus and mediation. Negotiations carried out by way of which the conflicting parties to sit together to find the best way of resolving conflicts with the principle that the settlement was no injured party (win-win), the two sides no one feels aggrieved. Abstract

Land is one of the productive sources that play a very important role for humans because of its function as one of the sources of life. Land has become a vulnerable source of disputes between people, especially of the tenure or ownership over it. This study was carried out to reveal how the conversion of the land function of Tanah Ayu Pura Tanah in Badung Regency is made and to describe how the dispute in making a certificate for the land is carried out. To achieve the objectives of this study, empirical juridical method was applied by making use of the statute approach, conceptual approach, and case approach. Data in the form of primary and secondary data were collected by applying note-taking technique and documentation technique. Data analysis was carried out through the application of descriptive qualitative data analysis methods. From the results of the data analysis, it is found that the conversion of land of Laba Pura tanah ayu in Badung Regency is begun with the issuance of certificate, that is the new Notification of Tax Due (SPPT) for one plot of land and for two certificates of two plots of land that are not at the same location. In fact, the SPPT issued was not for land located in the Laba Pura tanah ayu. There has never been an agreement from the comparator in the issuance of the said land certificate, so that the certificate issued is legally defective. The settlement of the dispute over the issuance of the land certificate of Laba Pura tanah ayu is carried out through deliberation at the Office of the National Land Agency. If the dispute cannot be settled under government assistance, it shall be done through court institution.

Abstract

Traditional Villages in Bali have the task of realizing Traditional Village customs which include tranquility, prosperity, happiness, and peace in life and the future. Bali Province Regional Regulation No. 4 of 2019 in conjunction with Bali Province Regional Regulation No. 4 of 2022 is one answer and solution to this task. It contains the ideology and basic framework for the governance of Traditional Villages in Bali and the economic system of Traditional Villages in Bali. It is also a basic strategy for strengthening the existence and role of Traditional Villages. Based on these conditions, the legal issues raised in this research are to analyze (1) the nature of Traditional Village-Owned Enterprise (referred to as BUPDA) management arrangements in Bali Province; (2) the effectiveness of Bali Province Regional Regulation No. 4 of 2019 in conjunction with Bali Province Regional Regulation No. 4 of 2022 in regulating the management of BUPDA in Bali Province; and (3) a BUPDA management model that can improve the welfare and economic independence of traditional law communities in Bali. The research method used is an empirical legal research method. The results of the research show that (1) The nature of BUPDA plays a role in preserving the continuity, preservation of customs, traditions, arts and culture, and local wisdom in Bali and can improve the welfare and independence of Traditional Villages in Bali; (2) The effectiveness of Bali Province Regional Regulation No. 4 of 2019 in conjunction with Bali Province Regional Regulation No. 4 of 2022 or the small number of BUPDA formations in Traditional Villages is also caused by not all factors such as law enforcement, legal quality, and the suitability of regional regulations to local needs and conditions in each district/city which can influence the effectiveness of implementing regional regulations regarding BUPDA; and (3) The BUPDA management model in Bali by integrating the components of cultural capital, economic capital, social capital, religious capital, and technology/IT capital as a hybrid institutional model. BUPDA governance needs to pay attention to cultural, social, religious, and technological aspects in developing the economy of Traditional Villages sustainably based on local potential and wisdom.
