Abstract

Sengketa tanah yang sering timbul di masyarakat diawali dengan banyaknya kasus atau tanda-tanda hak atas tanah lama yang tidak hilang ketika diubah menjadi sertifikat, sehingga banyak pihak yang memiliki pipil atau sertifikat dari negara yang sama. Sedangkan pipil atau sejenisnya merupakan bukti kepemilikan tanah, sebelum Undang-undang No. 5 Tahun 1960 tentang Agraria, yang menyatakan bahwa sertifikat adalah bukti kepemilikan tanah yang sah. Oleh karena itu, persoalan ini berkaitan dengan bagaimana kekuatan pipil membuktikan hak atas tanah sebelum sertifikat diterbitkan dan sengketa tanah ulayat di desa adat Guwang diselesaikan pada saat sertifikat. Penelitian ini menggunakan jenis penelitian hukum empiris dan pendekatan sosiologis. Hasil dari penelitian ini adalah Pipil merupakan bukti sahnya kepemilikan hak-hak lama sebelum lahirnya Undang-Undang Pokok Agrari (UUPA) dan Sertipikat merupakan bukti sahnya pemilikan tanah menurut UUPA. Untuk sengketa adat Desa Guwang yang hak milik atas tanahnya disebutkan dalam Pasal 19(2)(c) UUPA, sertifikat merupakan alat bukti yang kuat, yaitu keterangan fisik dan hukum yang terdapat dalam surat pernyataan tidak menjadi penentu sengketa adat Desa Guwang.

Abstract

Lembaga Perkreditan Desa (LPD) secara kelembagaan perlu dikuatkan seiring dengan wacana penguatan desa adat dengan mengingat bahwa LPD sampai saat ini berjalan secara alami sehingga rentan untuk terjadi penyalahgunaan keuangannya terutama oleh “pengurusnya”. Upaya yang dilakukan adalah penguatan kelembagaan melalui pelatihan manajemen Sumber Daya Manusia (SDM) dan akuntansi keuangan berbasis aplikasi, Focus Group Discussion (FGD), dan sosialisasi keberadaan “perarem LPD” untuk menjamin adanya kepastian hukum melalui penegasan hak dan kewajiban pengurus, pengawas, prajuru adat dan masyarakat hukum adat yang dikenal dengan “krama desa”. Tiap bidang kegiatan yang memerlukan aturan yang lebih khusus dari awig-awig yang ada agar awig-awig dapat dilaksanakan sesuai dengan asas kepatutan, yaitu: kepastian, keadilan dan kemanfaatan. LPD di tiap desa adat dilahirkan untuk menguatkan sistem perekonomian desa adat dalam upaya memandirikan dan pemberdayaan krama desanya. Kondisi ini menjadi sangat urgen dengan mengingat, bahwa beberapa LPD Desa Adat di masing-masing Kabupaten di Bali sudah kolaps, kondisi ini lebih disebabkan karena perbuatan menyimpang pengurus LPD. Juga upaya adaptasi sistem akuntansi keuangan LPD berbasis aplikasi dan manajemen SDM yang lebih modern. Metode yang digunakan disesuaikan dengan tahapan pelaksanaan kegiatan, yaitu sosialisasi rancangan pemikiran dalam paruman prajuru adat, pelatihan sistem akuntansi keuangan berbasis aplikasi, pelatihan menajemen LPD. Teknik pendekatan yang digunakan berupa pendekatan partisipatif dari pengurus dan karyawan LPD. Untuk sosialisasi awig-awig dan perarem dilakukan melalui paruman prajuru desa.

Abstract

The Village Credit Institution (LPD) owned by Desa Adat in Bali is oriented to strengthen the economy of indigenous peoples (krama adat) through lending (loans) and savings. The main source of capital for LPDs is the commitment and trust of all village manners which are submitted through the Adat Village Management Board (Prajuru) and the LPD Board. The strengthening of LPDs is in its management and accounting system and its supervision, because it is not uncommon for LPDs that are already large due to weak monitoring systems, poor management and accounting systems to misuse LPD funds utilization which causes LPD to no longer be operational or temporarily bankrupt like LPD in Adat Selulung Village, Kintamani Bangli. The bankruptcy of the LPD was also caused by the weakness of the Prajuru Adat in taking quick steps to replace corrupt officials on the one hand, while on the other hand it did not abolish its obligation to return funds that could not be accounted for through the imposition of civil sanctions or those known as pamidanda (sanction) in awig-awig.

Abstract

In the period of kingdom, Pauman land was collectively owned by the community called pauman. After the independence and at the time Land Law had been imposed, even in some villages the land had been proposed to be owned individually and some of the land had been sold, so the problem discussed were; what model was applied for the pauman land ownership and how the management was done when the Land Law had been imposed. The model of the research was a research of normative law with legislation, concept, analytic, and case approach. The sources of the regulation which were used in this research were primary law sources, secondary law sources, and tertiary law sources which were collected by interview (affirmation), note taking and document. And then it was done interpretation technique. The result of the research showed that there was still collective ownership for pauman land in which the members of the owners were permanent and some were dynamic depended upon the development of the genealogical main owners. Meanwhile, in some villages the ownership tended to be secularly individualization through having the legality of the law in context of Land Law so that some pauman lands dismissed, infect the pauman land was the basic of the managing commitment and there was no more unity of community as the result of authority and ownership transference through trading them to other people. That’s why serious efforts are needed to preserve the pauman lands.

Abstract

The formulation of customary law norms for marriage and inheritance needs to be constructed through Awig-Awig (customary law) formulation to ensure legal certainty in strengthening Balinese customary law. The Awig-Awig formulation is a form of codification of Balinese customary law, which regulates traditional village members and their various activities, Parhyangan (temple) as a forum for village members to connect with Ida Sang Hyang Widi Wasa (God Almighty) and at the same time as a means of preserving Balinese culture, Palemahan (land) as a manifestation of the territory and at the same time as an area that becomes the foundation of the source of life and a foothold in living life until death in a harmonious relationship. In the development of the life of village members, which are always in process, it is necessary to confirm the arrangement through Awig-Awig formulation, such as in the field of membership of village members with their rights and obligations, marriage, inheritance with the intention of being enforced consistently and dynamically according to appropriate values ​​in a society that is always developing.

Abstract

As a solution to address the interest of foreign citizens to own houses and land in Indonesia, the Government regulates this in Article 41 and Article 42 of Law No. 5/1960 (UUPA) as well as Government Regulation No. 18/2021 on Management Rights, Land Rights, Flat Units, and Land Registration. However, obtaining such rights requires time, significant costs, and the fulfillment of certain conditions. Often, foreigners are reluctant to engage in complicated and time-consuming processes, preferring the easy, cheap and fast way. In addition, there is a practice of land tenure by foreigners which in reality is considered a form of legal smuggling. Hence, this research aims to identify and analyze the granting of right of use on freehold land to foreign citizens in Badung Regency, as well as to identify and analyze the effectiveness of laws and regulations in granting right of use on freehold land to foreign citizens in Badung Regency. This research is juridical empirical, with primary data obtained through direct interviews with respondents and informants in the field, while secondary data is obtained through library research on primary, secondary, and tertiary legal materials. The research findings revealed that the implementation of the provisions on the granting of the right of use on freehold land for foreign citizens in Badung Regency has been effective, as the data suggest that foreign citizens in Badung Regency have obtained land rights in accordance with the provisions of the law.

Abstract

ABSTRACT This paper aims to find an ideal concept in managing Tanah laba pura to support tourism and provide benefits for the temple itself and for tourism. The problems discussed are how the conversion of Tanah laba pura is used as a means of supporting tourism and how the legal protection of Tanah laba pura is used as a means of supporting tourism in Ubud Village. The type of research used is empirical legal research, with a statute approach, a conceptual approach, and a sociological legal approach. The sources of research data are primary and secondary data sources. Furthermore, it is analyzed using sociological or teleological interpretation analysis techniques. The results of the study show that the benefits of converting Tanah laba pura in Ubud Village are to repair and maintain the temple building, to cover all religious ceremonial activities of the temple such as piodalan, to help the krama desa in the cost of repairing and maintaining the temple building, and to support tourism facilities in improving the quality of tourism in Ubud. Legal protection of temple land used as a means of supporting tourism in Ubud Village is regulated in the Decree of the Minister of Home Affairs No. SK.556/DJA/1986, where temples are declared as state legal entities that can own land with ownership rights

Abstract

This paper examines the legal status and registration of Pauman land in the Karangasem Regency of Bali. The concept of Pauman land is unique to this region and is considered a gift from the King of Karangasem. Recently, there have been disputes over the registration of Pauman land as individual plots through PTSL, leading to questions about its legal status and ownership. The study uses an empirical legal approach, including statute, historical, case, analytical, conceptual, and legal sociology approaches. The research highlights the gap between the predetermined norm and the implementation of Pauman land practices. Pauman cannot be considered a legal entity that can hold land rights under state law, but it can be recognized as a subject of the Temple according to the Decree of the Minister of Home Affairs. The paper recommends issuing a Certificate of Property Rights (SHM) in the name of the Temple to strengthen the position of Pauman land ownership without changing its communal and cultural heritage status. The use of the Temple's subject name is preferable to borrowing the name Klian for registering Pauman land as communal property. The study also predicts potential disputes due to re-recognition by the puri family, which needs to be anticipated by Pauman. Overall, this paper provides insights into the unique legal status and registration of Pauman land in the Karangasem Regency of Bali and offers recommendations to ensure the preservation of its communal and cultural heritage status.

Abstract

Purpose:The purpose of this study is to find a legal protection model for tenants of buildings whose land is used as collateral by the landowner. Therefore, the relevant issues to be discussed are legal protection for tenants of buildings whose land is used as collateral by the landowner and the function of good faith in protecting tenants of buildings whose land is subject to foreclosure.Methodology:The research method used is normative legal research with a legislative approach, conceptual approach, and case study. The analysis of legal materials used is analysis with interpretation and content techniques.Findings:The results of the study indicate that the principle of horizontal separation provides a basis for separating building rights from land rights, thereby ensuring that tenants retain a strong legal position. In addition, the principle of good faith is a key consideration in protecting tenants' rights, as emphasised in SEMA No. 4 of 2014, which stipulates that tenants' rights shall be respected throughout the term of the leaseImplication:This study recommends strengthening regulations, transparency regarding the status of leased properties, and legal education for the public to create legal certainty and fairness in the practice of leasing buildings on land that is used as collateral for mortgage rights.

Abstract

This study focuses on accelerating the development of Arabica coffee production and processing in Kintamani, Bali, to enhance local business and economic growth. Kintamani, renowned for its distinctive Arabica coffee, faces challenges in productivity, post-harvest processing, and global market access. The program employed a combination of face-to-face methods, counseling, training, and hands-on practices to improve cultivation techniques, post-harvest methods, marketing strategies, and collaboration networks. The method involved direct practice guided by experts, with training on sustainable agricultural practices, modern post-harvest processing technologies, and effective marketing strategies. Results show a significant increase in participants' knowledge, with an understanding of marketing strategies improving from 21.05% to 84.21%, and awareness of product certification rising from 10.53% to 84.21%. These outcomes demonstrate the program's effectiveness in empowering local communities and fostering sustainable development. Recommendations include leveraging social media, certification systems, and stakeholder collaborations to enhance market access and ensure business continuity.
