Abstract

The purpose of this study is to analyze investor rights protection arrangements in the analysis of margin transaction financing and the implementation of investor rights protection arrangements in the analysis of margin transaction financing by Stock Exchange Companies when a share sale is forced. The research method applied is sociological juridical.The results of this study show The regulation on the protection of investor rights in the analysis of margin transaction financing by a Stock Exchange Company when a share sale is made by force has actually been regulated in a letter of agreement, which is stated in Bapepam-LK Rule Number VD6. The existence of these regulations has fulfilled the legal protection aspects for investors as regulated in the Civil Code, but has not fulfilled the investor legal protection aspects as regulated in the Capital Market Law and the Consumer Protection Law. The implementation of the protection of investors' rights in the analysis of margin transaction financing by the Stock Exchange Company when a forced sale of shares is carried out has been carried out through a contract accompanied by the implementation of an internal control system and the implementation of haircuts by the IDX.Keywords: protection, margin transactions, forced sell.

Abstract

Consumer protection for e-commerce transactions is a crucial thing that needs to be considered, starting from regulations, institutions, to implementation. It cannot be denied that consumer protection in Indonesia is not a priority for the government. This can be seen from outdated regulations, overlapping institutional authority, and ineffective implementation of law enforcement. Therefore, reform is needed by conducting comparative analysis between countries, for example with Singapore and Malaysia. The research method uses normative-comparative juridical research with a macro comparative approach. The research specifications used by the author are analytical descriptive and data sources through literature reviews using primary, secondary and tertiary methods. For data collection techniques, the author uses the library search technique. The research results showed that each regulation in each country has advantages and disadvantages, both in regulation and implementation. In Indonesia itself, regulations and their implementation still have many problems and need to be updated, especially in e-commerce (online) transactions. By updating these regulations, law enforcement can be strengthened and its implementation can be effective. Thus, preventing and reducing things that are detrimental to consumers and business actors.

Abstract

The weaknesses of the legal substance relating to the handling of fraud in the Capital Market practices are fundamentally contained in the substance of Law Number 8 of 1995 on Capital Market ("UUPM"). Law enforcement has actually become one of the focuses of attention from law enforcers, such as in the case of state losses incurred due to fraudulent acts in the capital market committed by Perusahaan Gas Negara (PGN) is included in the criminal act of corruption because it indicates the elements of corruption. Officials at State-Owned Enterprises (SOEs) who commit fraud in accordance with the provisions can be categorized as corruption. Corrupt practices in the financial markets that cost the state large amounts of money have not gone unnoticed. Internationally, there is currently an effort to mainstream the financial sector into the jurisdiction of anti-corruption laws. This study concerns on the weaknesses of substance, structure, and legal culture regarding the handling of fraud in the Capital Market practices which is still lacking to overcome fraud related to the practices of Insider Trading.

Abstract

The purpose of this research is to describe analytically how the implementation Systematic Land Registration Complete in Tebing Tinggi City. Related with that , then This study specifically discusses the regulation of Systematic Land Registration Complete in the regulation legislation , influencing factors _ so that hinder Systematic Land Registration Complete , and the efforts made by the BPN Kota Tebing Tinggi so that the Larasita Program could succeed in increase registration right owned by on land in the City of Tebing Tinggi. With existence implementation Systematic Land Registration Complete , I hope could increase registration right owned by on land in the City of Tebing Tinggi. This study uses an empirical juridical approach, with the research location in Tebing Tinggi City. A juridical approach is used to analyze various laws and regulations, which are related to implementation Systematic Land Registration Complete . An empirical approach is used to analyze the law which is seen as the behavior of citizens people who do registration right owned by on soil through Systematic Land Registration Complete , patterned in people's lives, which always interact and relate in social aspects. Through this research, the researcher found that there are internal factors and external influence _ so that hinder Systematic Land Registration Complete in Tebing Tinggi City.

Abstract

All individuals who have entered a household life certainly want the creation of a happy household, inner and outer prosperity and obtain the salvation of the world and the hereafter. Divorce is part of marriage, because there will be no divorce without first marriage. If in a divorce there is a dispute regarding the distribution of joint property, the resolution of a dispute regarding joint property can be submitted through the Religious Court. Property with husband and wife obtained during marriage, both husband and wife, have the same authority in the utilization of household life as well if there is a divorce between husband and wife either because of the death of one of the husband or wife (widowed) or divorce then the joint property have the same rights in the distribution of joint property.

Abstract

This study examines the civil laws of India and Russia in the context of economic growth, focusing on a comparison between the two countries within the BRICS framework. The methodology employed is a literature review to identify differences and similarities in the development of civil laws in India and Russia. The analysis reveals that while India and Russia may not exhibit remarkable environmental performance compared to other BRICS nations, both prioritize environmental sustainability as a primary focus in their economic development policies. The research underscores the role of environmental laws in achieving sustainable impacts on the environment in both countries. Regarding intellectual property, Russia emerges as the most actively involved nation in intellectual property agreements within BRICS, especially when compared to India. Despite differences in trademark registration procedures, both countries demonstrate compliance with an integrated model. The study notes that Russia's intellectual property laws tend to be more general compared to India, which has more specific regulations. Practically, the research suggests the need for continuous efforts to maintain environmental achievements in both countries, with significant potential for collaboration in renewable energy production. In the realm of intellectual property, the identified patterns offer opportunities for collaboration and knowledge exchange between India and Russia. The findings of this study can guide policymakers and stakeholders in formulating strategies for environmental protection and intellectual property management within the BRICS context. This research makes a significant contribution to a deeper understanding of the differences and similarities in civil laws between India and Russia in the context of the BRICS economy. Abstract

Marriage is an important moment in human life that involves not only individuals, but also society. In the legal context, marriage creates a legal bond, resulting in a number of obligations and rights between husband, wife, and children. Birth certificates of illegitimate children are a crucial issue, especially in the context of legal justice in Indonesia. This study aims to analyze the implementation of regulations related to birth certificates of illegitimate children without a marriage certificate, with a focus on existing weaknesses and how Islamic justice values ​​can be integrated. The research method used is a descriptive analytical approach with primary and secondary data collection, including interviews and observations. The results of the study indicate that there are still many illegitimate children in Semarang City who do not have birth certificates, caused by factors such as inconsistencies in Family Card data, low public awareness, and slow administrative processes. In addition, the social stigma that considers illegitimate children as illegitimate children hinders the protection of their rights. Therefore, it is necessary to increase legal awareness and improve the administrative system by the government to ensure justice and protection for all children, in accordance with the values ​​of Pancasila which emphasize social justice. This study is expected to contribute ideas to the development of civil law in Indonesia.

Abstract

This study analyzes the legal protection for building construction service providers amid corruption in state infrastructure projects. It highlights the significant issue of budget misuse in corruption cases, as reported by Indonesia Corruption Watch (ICW) in 2022. A major obstacle is the inadequacy of Law Number 2 of 2017, which fails to sufficiently protect construction service providers who primarily act as implementers without control over the budget. Additionally, the law removes criminal penalties for failure to complete projects, causing legal uncertainty and violating the principle of justice in the 1945 Constitution. Using a sociological juridical approach, the findings suggest a need to revise regulations to clearly separate the responsibilities of construction providers and budget authorities. For Indonesia to strengthen its legal system based on Pancasila and justice, the research calls for regulatory reforms to protect construction service providers from legal exploitation and ensure a more coherent national legal framework.

Abstract

The purpose of this study is to analyze and find related to pre-trial procedural law regulations that are not yet based on justice values, to analyze and find weaknesses in current pre-trial procedural law regulations, and to find a reconstruction of pre-trial procedural law regulations based on Justice Values. There are 3 (three) theories used, namely the Pancasila justice theory as a grand theory, the legal system theory as a middle theory, and the progressive legal theory as an applied theory. This research method uses a socio-legal approach method that law is both a norm and a behavior that examines social phenomena. The analysis of research data is descriptive qualitative. The location of the research was conducted at the Kuala Kapuas District Court. The data source is from the Judge at the Kuala Kapuas District Court. "Mistakes that are made repeatedly over a long period of time will turn into truth." This expression is appropriate in the practice of handling pre-trial cases. Since the birth of the pre-trial institution in Law No. 8 of 1981 concerning Criminal Procedure Law (KUHAP) 38 years ago, the practice of pre-trial seems to use civil procedural law. Such as summons and notifications are carried out by bailiffs. The stages of the process are similar to civil trial trials. Normatively, the Criminal Procedure Code does not strictly regulate pre-trial procedural law. In the Criminal Procedure Code, there is also no article that mentions pre-trial cases with civil case mechanisms. In addition, from the registration and use of case codes in the Court alone, it is clear that pre-trial is a criminal case. It is reasonable that until now the pre-trial examination mechanism only refers to the customs applied in court practice, because since the Criminal Procedure Code was formed it has been handed over to the regulatory mechanism based on court policy. Judges may not reject cases on the basis that there is no procedural law. With the assumption and approach that pre-trial cases have the same nature and characteristics as civil cases, the Judge uses examination procedures as in civil cases even though pre-trial cases are actually criminal cases as seen from the use of the register and code listed in the case number.

Abstract

This study explores the culture of Abhakalan in Madura in the context of early marriage, analyzing its intersections with customary law, religion, and the state. While aimed at preserving family honor, this practice often prioritizes the principle of ḍarran (harm), leading to gender inequality and injustices toward women. The research seeks to evaluate the implications of this cultural practice on women's rights and gender equality, using an empirical legal method grounded in conflict theory and social change, combined with Islamic concepts of ‘urf (accepted custom), naf'an (benefit), and ḍarran (harm). Findings indicate that Abhakalan culture denies women agency in marriage decisions, perpetuating stereotypes of female inferiority and limiting their opportunities for empowerment and education. This study highlights the need for cultural reform through gender advocacy, mindset shifts, and family economic empowerment. By fostering dialogue among customary law, religion, and state policies, the research underscores pathways to equitable and sustainable gender equality. AbstrakPenelitian ini mengkaji budaya Abhakalan di Madura dalam konteks pernikahan dini dengan menganalisis keterkaitannya dengan hukum adat, agama, dan negara. Meskipun bertujuan menjaga kehormatan keluarga, praktik ini sering mengedepankan prinsip ḍarran (bahaya) yang berujung pada ketidakadilan terhadap perempuan dan ketimpangan gender. Penelitian ini bertujuan untuk mengevaluasi dampak budaya ini terhadap hak-hak perempuan dan kesetaraan gender, menggunakan metode hukum empiris yang berlandaskan teori konflik dan perubahan sosial, serta konsep Islam seperti ‘urf (adat yang diterima), naf’an (manfaat), dan ḍarran (kerugian). Temuan menunjukkan bahwa budaya Abhakalan mengabaikan hak perempuan dalam pengambilan keputusan terkait pernikahan, memperkuat stereotip inferioritas perempuan, serta membatasi peluang pendidikan dan pemberdayaan mereka. Penelitian ini menekankan pentingnya reformasi budaya melalui advokasi gender, perubahan pola pikir, dan pemberdayaan ekonomi keluarga, dan dengan mendorong dialog antara hukum adat, agama, dan kebijakan negara, studi ini menawarkan langkah menuju kesetaraan gender yang adil dan berkelanjutan
