Abstract

Despite recent legal provisions to protect emergency medical personnel in Indonesia, many still face criminal, civil, or administrative sanctions, revealing gaps in the current law’s effectiveness this study uniquely analyzes and proposes reconstructive reforms based on justice principles. This study employs a descriptive-analytical method within a constructivist paradigm and socio-legal approach, integrating Islamic and Pancasila justice as grand theories, legal systems theory as a middle-range framework, and theories of legal protection and progressive law as applied perspectives to comprehensively analyze emergency medical personnel’s legal protection. The findings reveal several key weaknesses. First, at the substantive level, vague and ambiguous legal norms result in inconsistent court decisions regarding the liability of medical personnel during emergency services. Second, at the structural level, disciplinary and ethical institutions lack assertiveness and clarity in enforcing professional accountability. Third, at the cultural level, crucial values such as patient safety, autonomy, and a culture of apology have not been fully embedded in medical practice. To address these problems, the study proposes a reconstruction of the legal framework by promoting centralized responsibility, expanding immunity protections for emergency actions, extending procedural time limits, and recognizing the role of unified professional organizations. These reforms aim to ensure effective and just legal protection for medical personnel.

Abstract

Oil Palm Plantations significantly contribute to Indonesia’s economy through agricultural production and exports. However, their development has caused environmental damage and social conflicts, leading stakeholders to resist and call for more sustainable management practices to protect both the environment and local communities. This study aims to evaluate the current regulations on Sustainable Palm Oil Plasma management to identify weaknesses that affect ecological justice and sustainability. It seeks to propose improvements based on ecological justice principles to ensure environmental protection and social fairness. The research uses a constructivist approach, collecting and descriptively analyzing data from stakeholders, supported by relevant legal theories. This research reveals three main findings. First, fundamental problems persist in palm oil plasma management, including land conflicts due to community demands for plasma plantations within company concessions and companies’ failure to fulfill legal obligations such as building plasma plantations. Second, perceptions of sustainability standards like RSPO and ISPO differ significantly between certified and uncertified farmers, with many smallholders lacking access, knowledge, and resources to comply, limiting widespread implementation. Third, recent regulatory changes under the Job Creation Law create challenges in land availability for plasma plantations, especially in regions with limited land, impacting both plantation companies and plasma farmers.

Abstract

Penelitian ini memberikan gambaran pencantuman logo halal pada produk makanan terutama pada produk makanan yang telah terkenal mereknya. Presepsi masayarakat mengenai logo halal masih kurang, sehingga kedepannya juga memberikan pencerahan bagi pengusaha yang belum memahami mengenai aturan yang berkaitan pencantuman logo halal ini semakin tahu tujuannya untuk mendaftarkan produknya ke BPJPH. Jenis penelitian yang digunakan adalah yuridis normatif yang melibatkan analisis terhadap peraturan-peraturan hukum dan konseptual. Sifat penelitian yang digunakan adalah Deskriptif yang mana mendeskripsikan aturan hukum yang diikuti dalam logo halal yang dicantumkan pada produk makanan bermerek. Berdasarkan hal tersebut, penelitian ini bermaksud untuk membahas mengenai yaitu Pertama, Di Indonesia karena mayoritas penduduk beragama Islam, maka diperlukan pendaftaran produk yang mau diedarkan ke masyarakat, tetapi produk yang mau didaftarkan memang tidak ada kandungan non halal di dalam produk tersebut maka si pengusaha silahkan mendaftarkan produknya ke BPJPH. Sebaliknya jika produk yang dijual pengusaha mengandung salah satu bahan atau semua bahan non halal, maka tidak perlu mendaftarkan makanannya ke BPJPH, tetapi cantumkan logo non halal di produknya. Kedua, Implikasi strategi pemasaran produk makanan di Indonesia diharapkan agar Prosedur pendaftaran logo halal di Badan Penyelenggara Jaminan Produk Halal (BPJPH) di Indonesia pada tahun 2024 bagi produsen makanan melibatkan dapat memberikan kesadaran bagi para produsen atas kebutuhan konsumen terhadap kehalalan suatu produk yang mayoritas masyarakatnya beragama islam.

Abstract

This research aims to examine juridically and analytically the mechanism of business registration and verification services in Timor-Leste, which is carried out by the Serviço de Registo e Verificação Empresarial, Instituto Público (SERVE, IP) as a public institution responsible for the legalization process of business entities. The focus of the study is directed at the legal basis underlying the operation of SERVE, IP., the procedures of business registration and verification services, as well as the challenges faced in the implementation of government policies in the field of economic licensing. The research method used is normative juridical with a descriptive-analytical approach, through a literature review of regulatory analysis and relevant legislation, as well as official documentation from the Government of Timor-Leste. The approach method employed in the preparation of this thesis is normative juridical research (normative legal research). Normative juridical research is library-based legal research conducted by examining library materials or secondary data only. The results of the study show that the existence of SERVE, IP., has made a significant contribution to government efforts in creating legal certainty, transparency, and efficiency for entrepreneurs in Timor-Leste. The mechanism applied is relatively simple with the concept of a one-stop shop that facilitates the business registration process. However, its implementation still faces considerable challenges, including limited competent human resources, suboptimal utilization of information technology in the service system, and overlapping sectoral regulations with existing economic licensing laws. These factors affect the speed, effectiveness, and quality of services provided to the public and the private sector. To improve the effectiveness of the mechanism, efforts are needed to harmonize sectoral regulations with national economic licensing policies, strengthen the institutional capacity of SERVE, IP., and develop a more integrated digital service system. Thus, the business registration and verification policy implemented is expected to support private sector growth, improve the investment climate, and reinforce sustainable economic development in Timor-Leste.

Abstract

Indonesia regulates digital defamation through the ITE Law; however, the existing framework remains inadequate because it fails to achieve a balanced integration of reputation protection, freedom of expression, legal coherence, institutional coordination, and public awareness. This research aims to analyze regulatory inadequacies on digital defamation, identify weaknesses in the existing framework, and propose a justice-based reconstruction for Indonesia’s legal system. Employing a constructivist paradigm, this study adopts a socio-legal research approach with a descriptive type of analysis. Data were derived from secondary sources, including primary, secondary, and tertiary legal materials, collected through library research and analyzed qualitatively. The research demonstrates that Indonesia’s regulation of digital defamation remains unjust because it fails to adequately protect citizens’ right to express opinions without surveillance, restriction, or silencing. Substantively, lawmakers must critically reconsider Article 45 paragraph (4) of the ITE Law to ensure fair and consistent enforcement. Structurally, law enforcement institutions must strengthen coordination between the police, prosecutors, and judiciary to address weak institutional synergy. Culturally, policymakers and stakeholders must expand public dissemination of the ITE Law to improve legal understanding across society. Based on these findings, the study concludes that reconstructing the regulation of digital defamation requires embedding justice-oriented values into both legal norms and enforcement mechanisms, particularly through reforming Article 27A and Article 45 paragraph (5) of the ITE Law.

Abstract

Kegiatan Sosialisasi Lelang sebagai instrumen jual beli berkarakter khusus dan pencegahan cyber crimed di Desa Cikalahang Kabupaten Cirebon. Kegiatan ini dilatarbelakangi dengan potensi desa dimana perikanan, dan pariwisata yang berkembang sebagai sentral produk olahan ikan dan wisata kuliner ikan bakar air tawar. Pandemi Covid-19 telah berdampak pada ekonomi, menyebabkan penurunan aktivitas bisnis. Fokus pemerintah desa pada tanggung jawab sosial dapat mendorong generasi muda untuk menjadi pemilik bisnis yang bertanggung jawab dan mempromosikan produk lokal. Di era digital, strategi pemasaran dan metode komunikasi harus disesuaikan untuk memastikan pertumbuhan ekonomi dan partisipasi. Metode kegiatan pengabdian ini yakni community development yang dipadukan dengan service learning. Lelang sebagai salah satu instrumen jual beli yang berkarakter khusus yang dapat meningkatkan pendapatan dari penjualan produk dan bahaya kejahatan cyber crime dibalik penggunaan media sosial untuk memasarkan produk. Hasil pengabdian kini adalah tumbuhnya semangat warga masyarakat, pelaku usaha untuk menggunakan lelang sebagai salah satu cara memasarkan dan meningkatkan penjualan produk mereka, serta adanya sikap waspada masyarakat dalam penggunaan media sosial.

Abstract

This study examines the harmonization of International Commercial Law (ICL) with Sharia-based national legal systems in five member states of the Organization of Islamic Cooperation (OIC): Pakistan, Turkey, Indonesia, Malaysia, and Saudi Arabia. These countries were deliberately selected for their diverse legal traditions, varying levels of economic development, and differing degrees of Sharia implementation within their domestic legal orders. Using a qualitative-comparative approach, the research draws on academic literature, national legal documents, and relevant international legal instruments to analyze the interaction between global commercial norms and Islamic legal principles. The analysis identifies thematic trends, methodological approaches, and significant findings from previous scholarship on the intersection of ICL and Sharia. The findings reveal divergent trajectories: Malaysia and Turkey have successfully integrated ICL provisions into their domestic frameworks through institutional reforms and adaptive jurisprudence. In contrast, Pakistan and Saudi Arabia face persistent conceptual and normative challenges, particularly in reconciling modern commercial practices with strict interpretations of Sharia. Indonesia represents a hybrid model, blending secular legal norms with religious values to produce a contextually balanced system. By mapping these comparative experiences, this study contributes to the discourse on legal pluralism and provides insights for policymakers and scholars seeking to develop context-sensitive models for integrating transnational commercial law into modern Islamic legal systems.

Abstract

Introduction to the Problem: Online gambling produces cascading social harms (debt, mental distress, and family conflict) that are surfacing in Indonesian divorce cases. Yet core enforcement gaps persist because gambling platforms, servers, and payment rails are frequently offshore and evidence is digital and volatile. Existing tools in the ITE Law and the Criminal Code lag behind these modalities. Purpose/Study Objectives: To analyze how cross-border features of online gambling undermine Indonesian criminal and family-law responses, and to propose an integrated reform agenda that links criminal accountability with family protection. Design/Methodology/Approach: Normative legal research combining statutory and conceptual analysis with comparative insights (licensed regimes such as Australia/UK; prohibition/ambiguous regimes) and illustrative Indonesian Religious Court decisions referencing gambling-driven marital breakdown. Findings: Indonesia’s response is hampered by three enforcement deficits: (1) Platform/finance dependence: foreign digital platforms and domestic payment intermediaries (banks, e-wallets, telecoms) enable chip-based and crypto-denominated flows that current doctrine barely reaches; (2) Digital-evidence fragility: logs, metadata, and accounts are transient or hosted abroad, while preservation and admissibility standards and forensics capacity remain under-specified; and (3) Limited cross-border reach: narrow MLAT/extradition coverage and dual-criminality barriers where gambling is legal overseas. These deficits help explain a growing footprint of gambling in Indonesian divorce pleadings and judicial reasoning, even when causation is indirect (asset dissipation, coercive financial control, persistent conflict). Comparative practice shows courts can recognize gambling-related “wastage” in property division and maintenance, while regulators can harden payment and advertising controls. Overall, the paper finds that doctrinal silos between criminal/ITE rules and the Marriage Law weaken both enforcement and family protection. Paper Type: Research Article

Abstract

The social media utilize algorithms to increase productive and targeted promotions which regulate the flow of information circulating in the system, and usually record user habits and monitor their personal activities for business profits. This phenomena raise issues amongst academia about the importance of user confidentiality governance in social media. This research is a normative research using conceptual approach and statutory approach, aims to examine whether an algorithms system breach of personal data protection law in European Union, China and Indonesia. The result of this research is the use of algorithm is not explicitly prohibited in European Union States, China and Indonesian Law. Normatively, algorithms utilization do not breach the data protection law in these three countries as long as it uses with user permission, uses for legal reason, provide explanation and protection to the user personal data.

Abstract

This research was aimed to describe the restructurization of existing policies to formulate the legal umbrella for strengthening Pancasila ideology in Indonesia. Strengthening Pancasila has been already formulated by establishing a new institution called Badan Pembinaan Ideologi Pancasila (BPIP). This study analyse the policy structuring in this new policy which was seen as as a reinforcement, and expected to create a better order by using Pancasila as the utmost national philosophy. This study uses a qualitative research approach where qualitative research as a scientific method is often used and carried out by a group of researchers in the field of social sciences. A qualitative research approach is a research and understanding process based on a method that investigates a social phenomenon which in this study focuses on strengthening institutional policies in fostering the ideology of Pancasila. This method is used in research to try to understand and explore their views and experiences to get the information or data needed. In order to provide regulatory strengthening for BPIP institution, it is necessary to reorganize policy directions in the regulatory aspect, which is carried out by strengthening the current legal umbrella of BPIP which is based on a Presidential Regulation whose legal force is increased to become Law. Therefore, the results of the research show that it is necessary to regulate: a). Procedures for Implementing Coordination, Synchronization, and Inter-institutional Relations, and b). Control of Pancasila Ideology Development for Ministries/Agencies and Local Governments. Abstrak Penelitian ini bertujuan untuk mendeskripsikan restrukturisasi kebijakan yang ada untuk merumuskan payung hukum penguatan ideologi Pancasila di Indonesia. Penguatan Pancasila sudah dirumuskan dengan membentuk lembaga baru bernama Badan Pembinaan Ideologi Pancasila (BPIP). Kajian ini menganalisis penataan kebijakan dalam kebijakan baru ini yang dipandang sebagai penguatan, dan diharapkan dapat menciptakan tatanan yang lebih baik dengan menggunakan Pancasila sebagai falsafah bangsa yang paling tinggi. Penelitian ini menggunakan pendekatan penelitian kualitatif dimana penelitian kualitatif sebagai metode ilmiah sering digunakan dan dilakukan oleh sekelompok peneliti di bidang ilmu-ilmu sosial. Pendekatan penelitian kualitatif adalah proses penelitian dan pemahaman yang didasarkan pada metode yang menyelidiki suatu fenomena sosial yang dalam penelitian ini berfokus pada penguatan kebijakan kelembagaan dalam pembinaan ideologi Pancasila. Metode ini digunakan dalam penelitian dengan tujuan mencoba memahami, menggali pandangan dan pengalamannya untuk mendapatkan informasi atau data yang dibutuhkan. Dalam rangka memberikan penguatan regulasi bagi lembaga BPIP, maka perlu penataan kembali arah kebijakan di bidang regulasi yang dilakukan dengan memperkuat payung hukum BPIP saat ini yang didasarkan pada Peraturan Presiden yang kekuatan hukumnya ditingkatkan menjadi UU. Oleh karena itu, hasil penelitian menunjukkan bahwa perlu diatur: a). Tata Cara Pelaksanaan Koordinasi, Sinkronisasi, Hubungan Antar Lembaga, dan b).
