Abstract

The introduction of the Job Creation Law by the Indonesian government is a strategic measure that will impact the licensing and investment framework in Indonesia.The law is expected to streamline the licensing process, accelerate investment, and create a more friendly business environment for domestic and foreign investors.One of the main focuses of the Job Creation Act is licensing reform, particularly in relation to investments in Indonesia.These include simplifying the number of permits required to carry out investment activities in Indonesia, simplifying the licensing process, and introducing a risk-based licensing system.These measures taken by the government are expected to improve efficiency and increase investor enthusiasm for investment activities in Indonesia.However, the implementation of the Job Creation Act also generated debate and controversy.Some parties are concerned that lowering labor and environmental standards or changing regulations too quickly could have negative social and environmental impacts.Therefore, the discussion in this journal is about the process of changing these simplifications, the impact of which will affect Indonesia's investment environment, especially at the international market level.Keywords : Omnibus Law, Licensing, Investment

Abstract

Disrupsi digital membawa perubahan dan tantangan yang luar biasa bagi pola perilaku dan pemikiran konsumen dan pelaku usaha. Beragam peraturan yang dimaksudkan untuk memitigasi risiko atas masifnya perkembangan teknologi digital pasalnya tidak serta merta meredakan problematika yang kerap berdatangan di tengah aktivitas konsumen. Dalam hal ini, rendahnya tingkat literasi digital merupakan salah satu faktor pemicu persoalan. Dengan menggunakan metode normatif dan pendekatan kualitatif, penelitian ini berupaya untuk menggambarkan urgensi penguatan literasi digital dalam mengoptimalisasikan perlindungan konsumen. Hasil penelitian menunjukkan bahwa penguatan literasi digital bagi konsumen dan pelaku usaha merupakan faktor terpenting dalam rangka meningkatkan pencegahan dan perlindungan konsumen dan pelaku usaha dari dampak negatif yang ditimbulkan oleh transaksi digital. Upaya penguatan ini merupakan jawaban untuk keamanan konsumen dan pelaku usaha saat bertransaksi digital. Pada puncaknya, penguatan literasi digital adalah bentuk upaya preventif terjadinya konflik di antara konsumen dan pelaku usaha.Keywords: Urgensi, Penguatan, Literasi Digital, Perlindungan Konsumen

Abstract

The presence of Law Number 5 Year 1999 on the Prohibition of Monopolistic Practices and Unfair Business Competition is a real effort for the state to reform the law in the field of economics and business competition law. Against the condition of Indonesia in the vortex of economic globalization that intersects with foreign business actors, there are legal issues that arise are related to the legal position of foreign business actors within the framework of the principle of extraterritoriality jurisdiction and how to anticipate the negative impact of anti-competitive actions committed by foreign business actors based on the principle of extraterritoriality to realize legal certainty. The method used in this research is normative and analytical descriptive research, using secondary data and analyzed qualitatively. The result of the research is the need for improvement and reformulation of the legal position of foreign business actors in the context of extraterritorial jurisdiction in modern competition law. Renewal of business competition law is a necessity considering the needs and dynamics of business competition law that is growing rapidly in the era of global trade. KPPU's institutional strengthening must be carried out continuously and policy innovations must be implemented continuously to adjust to the current needs of competition law. Abstract

Patents are exclusive rights that the state grants to inventors based on the results of inventions carried out by themselves or approves other parties to do it in the field of technology within a certain period of time. The formulation of the problem is whether a simple patent for a simple colored bubble wrap which has become a public domain in the United States has the novelty to be registered in Indonesia and what is the decision of a commercial court judge in a simple patent dispute regarding the public domain in Decision Number 44/Pdt.Sus-Paten/2020/ PN.Niaga.Jkt.Pst based on Law no. 13 of 2016 concerning Patents. This research is a normative legal research type through the use of secondary data, which is supported by primary data. The nature of research is descriptive analysis, with qualitative analysis of the data. Based on the conclusion that patents that have been registered when viewed from Article 132 Law No. 13 of 2016 concerning patents can be canceled or abolished and the decision of the panel of judges at the commercial court is considered to be inappropriate in its considerations regarding the non-fulfillment of the element of novelty because it has not been careful with the existing problems and facts. In this case the judge should have been more observant in considering the provisions formulated by the Patent Law.

Abstract

As one component of intellectual property rights, trade secrets have an important position in business activities in Indonesia. Problem formulation How well do the provisions of Law Number 30 of 2000 concerning Trade Secrets protect trade secret owners? And how reasonable is Law Number 30 of 2000 concerning Trade Secrets in interpreting judges' decisions No. 76/PDT.G/2021/PN.CKR on trade secret disputes the plastics industry? This research is analytical, descriptive, and is normative legal research. Deductive inference is used in qualitative analysis of existing evidence. The results and discussion indicate that Law Number 30 of 2000 on Trade Secrets is not yet adequate and effective in providing legal protection to trade secret holders due to its lack of relevance and many legal gaps. The judge ruled the case using Article 1365 of the Civil Code on Unlawful Acts, which is deemed inappropriate because the applicable law should be Law No. 30 of 2000 on Trade Secret Protection. The conclusion is Law No. 30/2000 on Trade Secrets, which provides legal protection to trade secrets in the plastics industry, is ineffective and inadequate in protecting trade secrets due to the absence of specificity regarding the scope, terms, legal protection, and sanctions of trade secrets

Abstract

Copyright violations have occurred frequently over the years, with one prevalent issue being the unauthorized duplication of copyrighted works. A notable instance of this is the unauthorized use of the song "Aku Mau" in the "Putri Anisa Hijab Perfumed Doll" toy. This case examines the protection of the song "Aku Mau"'s creator in relation to the doll product and the considerations of the Commercial Court judges based on Law No. 28 of 2014 on Copyright. The research methodology used is normative legal research with a descriptive approach, drawing on secondary data to support primary data. Data was gathered through fieldwork and literature review, then analyzed qualitatively with conclusions drawn using deductive reasoning. The results of this research is that the actions by GO TOYS and PT. BINTANG CAHAYA KENCANA involved the unauthorized duplication of the song "Aku Mau" for commercial gain. The conclusion is that the judges’s decision was justified, as the DJKI copyright registration confirmed Inge Christiane as the rightful creator of the song "Aku Mau." Consequently, the Commercial Court judges ruled in favor of awarding partial material damages totaling Rp. 4,000,000,000.

Abstract

(E) Plant Variety Protection Rights are special rights granted by the state to breeders and/or Protection of Plant Varieties rights holders to use their own varieties resulting from their breeding or to give approval to other people or legal entities to use them for a certain time. The main problem in this case is how legal protection is for corn plant breeders who produce the Talenta corn variety according to Law number 29 of 2000 on Protection of Plant Varieties and how the government is trying to prevent violations of breeders' rights. This research uses descriptive normative legal research methods, the type of data uses secondary data and is studied qualitatively, so that way of drawing conclusions uses deductive logic. The results and conclusions are Law number 29 of 2000 on Protection of Plant Varieties is adequate to protect breeders both from its articles and the implementation of law enforcement. Farmers do not yet understand what legal restrictions there are in implementing contracts, so the challenge lies in monitoring and controlling the use of plant varieties. Collaboration between plant breeders, government, related institutions, and the seed industry is key to maintaining the success of PVP systems.

Abstract

Public knowledge about Intellectual Property Rights is currently lacking, especially with regard to the right of Communal Intellectual Property. One type of communal intellectual property that is not widely known by society is the Indication of Origin. The latest case related to Indication of Origin that has become a polemic is the case of the sale of Rendang Babi products at a Padang Restaurant in Jakarta. Rendang Babi doesn't measure up to the values of Minangkabau Society as the original proprietor of Rendang Minang. The issue that the author discussed in this case is whether Rendang Babi is a violation of the communal property values of Indication of Origin Rendang Minang and how to protect Communal Intellectual Property right of Rendang Minang according to the act. Based on analysis by the author that the Rendang Minang has the values embodied in it, namely cultural values, customs, religion (kehalalan), precision, and togetherness. Rendang gives an impression on the cultural identity of the Minangkabau based on Islamic Wisdom. The existence of a Rendang Babi was not thought to match the meanings contained in the Rendang. Thus, Rendang Babi product violates the communal possession value of the Rendang Minang.

Abstract

In Indonesia in urban centers, vagrants and beggars are a concern for the government. This role is the implementation of the 4th paragraph related to social welfare. The government has directly played a role and is directly involved in handling the problem of vagrants and beggars. Various ways have been done including by using Government Regulation Number 31 of 1980, but these efforts have not been able to produce results. The study of what the author describes provides the latest alternative solution as an effort to overcome and provide a feasible solution by the homeless beggars, namely by providing skills, education, and religious teachings in order to be able to bring them to a better direction. After the problem has been resolved, the second is to strengthen the legal substance, namely by regulating clear and more specific rules, After the substance has been regulated, the most appropriate alternative and solution is to record how many homeless people are in the center of the Capital City, after that they are given temporary placement by those who do not have a clear home, and see who is not physically strong to be treated and given skills when they are healthy later, and for those who are still healthy, they are given decent work skills with skills according to the fields they want. The last is to provide residential placement and the budget will be funded by the APBD for this, data is collected and calculated who deserves the placement and sees the eligibility of homeless people and beggars who are entitled to occupy it.

Abstract

Abstract: Every use of space needs to pay attention to the provisions in its Regional Spatial Plan and in order to realize orderly spatial planning, legal awareness is needed in the use of space. The main problem that is the main focus of this study is how the theory of legal awareness influences the Enforcement of Law on Violations of Spatial Utilization. This study uses a descriptive analysis research method, which means that this study is conducted to provide an overview of public awareness as part of the legal culture that influences a rule in force. The results of this study indicate that due to the many developments that are currently being carried out in our country, the mining sector has become a promising industry and public awareness in the use of space needs to be increased in order to create orderly spatial planning without new violations that arise more complex.Keywords: legal awareness, legal culture, spatial planning.
