Abstract

Anturan Village, which is still included in the tourist area of North Bali, has enormous potential to be developed into an adat village-based tourist destination. This village, has a unique culture, religion and customs. The potential of the Anturan traditional village in particular has Kerta Desa a kind of traditional court that can reconcile civil disputes, in the indigenous Anturan community, especially those who are Hindu. This means that prior to the enactment of Indigenous Village Law No. 4 of 2019 concerning Indigenous Villages which obliged to form a Kerta Desa, the Anturan traditional village already had a Kerta Desa. The problem arises that, even though the Kerta Desa has authority in peace in adat villages based on adat law by making decisions in accordance with awig-awig and / perarem. In the Empowerment of Anturan Indigenous Village Empowerment there are problems namely: (1) legal issues related to tourism activities in Anturan Village cannot be comprehensively solved. (2) The form of Kerta Desa's relationship with Bendesa adat and community leaders in resolving tourism cases has not been synergistic so that the law can mean coexistence. (3) There is no Kerta Desa Empowerment model, in the context of state law enforcement and Balinese customary law. (4) The absence of kerta desa in tourism law enforcement is in accordance with the interests of the local community. Solution offered: (1) Existence of Policy Study on Empowerment of Village-based Tourism Village that involves the kerta desa in handling cases of traditional village land and land in the form of investment; (2) Increased knowledge and the existence of legal awareness in the management of traditional village-based Tourism Villages concerning land for investment purposes; (3) Able to develop the implementation of state law and customary law of Bali and tourism law to resolve the case of tourism investment in the traditional village of Anturan; (4) Can have a positive impact on society and can improve human resources, and the Kerta Desa in handling investment cases in tourism can apply the law in coexistence. The method used in the form of empowerment Kerta Desa with the pattern of assistance, FGD and find the real core of the problem. Legal issues are very complex, can find hidden problems in travel cases, and inventory problems and solve problems that arise with village officials, custom officers and indigenous community leaders in Anturan. Target outcomes to be achieved are publication of national journals / or proseding ISBN National publications, mass media publications, videos on broadcast activities. Activities in Empowering Anturan Indigenous Village Empowerment in resolving land issues in tourism investment by providing assistance and counseling to Kerta Desa, Prajuru Desa adat and community leaders who are relevant to Land Cases and investments in Anturan village.

Abstract

Abstrak Desa Plaga kuhusnya desa adat Kiadan secara legal telah didesign untuk menjadi Desa Wisata. Hal ini tidak terlepas dari proses politik dan hukum untuk menjadikan desa Plaga sebagai desa Wisata. Dikeluarkannya Surat keputusan Bupati Badung, nomor 47 tahun 2010 tentang penetapan kawasan desa wisata di kabupaten Badung. Tujuan penetapan desa wisata untuk mencegah kesenjangan ekonomi wilayah Badung Selatan dengan Badung Utara. Dengan adanya Surat Keputusan Bupati tentang Desa Wisata untuk Badung Utara khususnya Desa adat Kiadan diharapkan Desa Adat mampu mengelola fotensi Desa Wisatanya berdasarkan kearifan local yang hidup di masyarakat adat Bali sesuai dengan asas desa mawa cara, negara mawa tata. Hampir 8 (delapan) tahun terbitnya Surat Keputusan Bupati tidak jelas model pengelolaaan Wisata Desa di Kiadan, karena masyarakat belum mengetahui tentang konsep desa Wisata, bagaimana mengelola desa wisata, dan bagaima memanfaatkan potensi sebagai sumber daya budaya untuk mengangkat citra desa wisata untuk kesejahtraan masyarakat adat. Untuk itu, perlu pendampingan aktor pariwisata lokal, penyuratan pengelolaan desa wisata melalui awig-awig desa adat.

Abstract

Abstrak As one of the driving force of the middle economy, the cooperative has been growing rapidly in Indonesia in recent years. Bali Province is one of the best competition for Cooperative in Indonesia. This can be seen from the award given by the Ministry of Cooperatives and Small and Medium Enterprises of the Republic of Indonesia to the cooperatives in Bali. The government is also optimistic to continue to develop cooperatives in Bali well and right so that the future can meet the market both domestically and abroad, as well as the KOPWAN Mertasari, Karangasem District. This cooperative arises from the desire to develop a Dharma Wanita group within the Karangasem Regional Government in order to help the economy of the members even the Karangasem community. However, it is inevitable that various barrier factors are formed along with the establishment of this cooperative, one of which is bad credit. The problem of bad debts is the most common problem we encounter in banking institutions and it is very difficult to avoid. Therefore, in the course of a cooperative, it is necessary to prepare a variety of preparations to anticipate the occurrence of bad loans, one of them through a good credit analysis and the establishment of credit agreements with legal force

Abstract

The rise of the construction of supermarkets in Gianyar Regency causes the competitiveness of business actors to be increasingly fierce and the community as consumers who are not sensitive to their own rights, the position of consumers is getting weaker than business actors. The formulation of this research problem includes: What is the form of legal protection for consumers who make transactions at convenience stores in Gianyar Regency? and What are the legal consequences for convenience store businesses that violate consumer rights? This study is carried out using empirical legal research methodology, which involves investigating how the application of law in society and seeing the law in its practical application. The results of this study explain that consumers receive direct legal protection fromConsumer Protection Act. Consumers who are harmed by the convenience store in the form of damage or goods that have expired are held accountable in the form of direct compensation by the convenience store.

Abstract

The rapid advancement of technology has made the task of booking hotel tickets easier for the public. The problem discussed in this research is the case of losses suffered by consumers due to the cancellation of onl reservations made by business actors. This is stated as a problem of default which is a condition of non-fulfillment of achievements or obligations in an agreement. This research is conducted to find out the validity, and the timing of an online hotel booking transaction agreement, especially hotels in Bali. The research method uses normative legal research that examines the problems of legal regulation or legal norm. The result of the research is that consumers have received compensation due to the cancellation of hotel reservations made by business actors. In the Civil Code, it is formulated that negligence in an agreement can be concluded as a default, which is an unlawful act in various forms of default against every obligation imposed in every provision of the applicable law. For the government, the hotel and consumers must have insight into the requirements that apply in the Law regarding default issues in online hotel bookings.

Abstract

Pembangunan ekonomi nasional tidak terlepas dari peran investasi, termasuk penanaman modal asing yang umumnya dilakukan melalui Perseroan Terbatas Penanaman Modal Asing (PT PMA). Penyetoran modal awal merupakan syarat penting dalam proses pendirian guna menjamin keseriusan pendiri serta memberikan perlindungan bagi pihak ketiga. Namun dalam praktik, penyetoran modal seringkali hanya dibuktikan melalui surat pernyataan tanpa verifikasi yang memadai, sehingga menimbulkan ketidakpastian hukum. Penelitian ini bertujuan untuk menganalisis peran notaris dalam pendirian PT PMA serta mengkaji bentuk perlindungan hukum bagi pihak ketiga terhadap penyetoran modal awal yang tidak sesuai. Metode penelitian yang digunakan adalah hukum normatif dengan pendekatan perundang-undangan dan konseptual. Hasil penelitian menunjukkan bahwa notaris memiliki peran penting sebagai pejabat umum yang memastikan terpenuhinya persyaratan formal pendirian perseroan. Namun, ketidakjelasan norma mengenai bukti penyetoran modal yang sah menyebabkan keterbatasan dalam melakukan verifikasi materiil. Oleh karena itu, diperlukan penguatan pengaturan hukum guna meningkatkan kepastian hukum dan perlindungan bagi pihak ketiga.

Abstract

The role of notaries as public officials authorized to prepare authentic deeds is increasingly challenged by the rising complexity of financial crimes such as money laundering. While Indonesian regulations obligate notaries to implement the Know Your Customer principle (Prinsip Mengenali Pengguna Jasa/PMPJ), a normative gap exists in the Law on Notary Office (UUJN), particularly in Article 38, which does not authorize notaries to actively verify the legal identity or intentions of their clients. This discrepancy between regulatory obligation and statutory limitation creates legal uncertainty and exposes notaries to potential criminal liability. Previous studies have focused on compliance issues and ethical dilemmas faced by notaries but lack a comprehensive legal protection framework. This study aims to analyze the normative position of notaries in implementing PMPJ and to formulate an ideal legal protection model. The research employs a normative juridical method with statutory, conceptual, and case approaches, supported by qualitative-deductive analysis. The findings reveal that without the authority to verify client data beyond formal documents, notaries are vulnerable to misuse in money laundering schemes. The study proposes a legal reform model comprising: (1) revision of the UUJN to authorize controlled verification; (2) limited legal immunity for compliant notaries; and (3) integration of technological tools such as digital identity authentication. This work advances the current state of knowledge by highlighting the urgent need for harmonization between notarial duties and anti-money laundering mandates, thereby ensuring both legal certainty and protection for notaries within Indonesia’s evolving legal system.
