Abstract

Bank sebagai lembaga penyaluran dana kepada masyarakat juga memerlukan jaminan atas dana yang disalurkan tersebut, salah satu jaminan yang dapat diagunkan adalah Sertifikat Hak Atas Tanah, yang kemudian dibebankan Hak Tanggungan agar memiliki Hak Eksekutorial sebagaimana diatur dalam UU No. 4 Tahun 1996 tentang Hak Tanggungan yang mana salah satu cara eksekusi Hak Tanggungan adalah dengan cara proses lelang yang diatur secara khusus dalam PMK No. 27/PMK.06/2016 tentang Petunjuk Pelaksanaan Lelang. Penelitian ini dilakukan dikarenakan pemberlakuan peraturan hak tanggungan masih belum maksimal atau masih menimbulkan permasalahan baik bagi pihak kreditur dan peserta lelang. Tujuan penelitian ini dilakukan adalah untuk menganalisis permasalahan hukum yang timbul dalam pelaksanaan eksekusi hak tanggungan, serta permasalahan yang dihadapi oleh pihak Bank setelah proses pelaksanaan lelang dilakukan, serta untuk menganalisis perlindungan hukum bagi peserta lelang yang telah beritikad baik dalam proses lelang ditinjau dari UU No. 4 Tahun 1996 tentang Hak Tanggungan Atas Tanah dan Peraturan Menteri Keuangan No. 27/PMK.06/2016 tentang Petunjuk Pelaksanaan Lelang. Dengan pendekatan penelitian normative empiris dan spesifikasi deskriptif analisis didapatkan bahwa banyak debitur yang mengajukan perlawanan ketika pihak Bank hendak melakukan eksekusi Hak Tanggungan, sehingga mengakibatkan pihak Bank tidak dapat menggunakan hak eksekutorial, melainkan harus mengajukan Penetapan Pengadilan. Peraturan yang berlaku masih tidak mengatur secara rinci dan khusus terkait perlindungan hukum terhadap kreditur serta peserta lelang yang telah beritikad baik.

Abstract

Pembeli menganggap paket yang mereka beli melalui jasa pengiriman dan sistem pembayaran online terutama sistem Cash on Delivery sangat menguntungkan. Tetapi tidak sedikit juga masalah yang timbul akibat belanja dari e-commerce dan menggunakan sistem pembayaran Cash on Delivery Banyak pembeli yang menolak untuk membayar paket yang mereka beli karena merasa paket tersebut tidak sesuai, bahkan sampai meminta pengembalian dana dari kurir. Sementara itu, kurir tidak bertanggung jawab atas ketidaksesuaian produk yang diterima, kurir hanya berfungsi sebagai perantara antara penjual dan pembeli kemudian mengantarkan paket dan menagih pembayaran dari mereka. Tujuan dari penelitian ini adalah untuk mengetahui bagaimana regulasi tentang perlindungan hukum terhadap kurir dalam sistem pembayaran Cash on Delivery. Penelitian ini menggunakan penelitian yuridis empiris yang dilakukan dengan cara meneliti data primer kemudian didukung dengan data sekunder berupa studi kepustakaan dan perundang-undangan. Hasi dari penelitian ini menemukan bahwa adanya kerugian yang dialami oleh kurir, wajib ada ganti rugi dan pertanggungjawaban penjual apabila terbukti ketidaksesuaian dan kerusakan barang dari awal merupakan akibat dari kesalahan penjual.

Abstract

Emergency laws are often framed as necessary tools to respond quickly during national crises, but they also present significant risks to democratic structures. This paper explores how emergency powers can be used to centralize executive authority in Indonesia, Thailand, and Vietnam. The purpose of this study is to analyze how legal frameworks enable or fail to restrict executive power during emergencies. Using a doctrinal legal research method, the paper examines constitutional texts, relevant statutes, and key political events to assess how emergency powers function in practice. Findings show that while all three countries demonstrate varying degrees of executive flexibility, Indonesia stands out due to its lack of clear legal limits and minimal oversight, while Thailand is riddled with normative inconsistencies and multiple avenues for its executive branch to weaponize the state of emergency. Vietnam, on the other hand, subordinates all branches of state power to the overarching control of the Communist Party, resulting in possible limited legal accountability and significant potential for unchecked executive action. The study emphasizes the need for stronger legal safeguards to prevent emergency powers from becoming a lasting feature of governance.

Abstract

Currently football has become an industry that includes all forms of business activities in it. Including the matter of buying and selling players in football or better known as transfers. This research aims to find out how Islamic law reviews the position of the transfer of football players in Islam. Packaged in the form of articles that are normative legal research using secondary data types, namely data obtained from literature. The law of the transfer of football players in Islam is permissible if it does not violate the existing provisions of Islamic Law. Transfer in football is a lease (ijarah) of services, although it is often referred to as buying and selling. Allah swt justifies buying and selling and haram usury, by buying and selling what is meant is buying and selling that is not against the Islamic law.

Abstract

Online Single Submission (OSS) or electronically integrated business licensing is a business license issued on behalf of the Ministries and also local governments as regulated and listed in Government Regulation Number 24 of 2018. The establishment of the OSS system provides convenience in accelerating, improving investment and also provides convenience in managing the necessary permits, both individual and non-individual. The purpose of this research is to find out the development of the formation of OSS and also the problems that arise from the implementation of OSS which is regulated in PP No. 24 of 2018. This research was carried out using a normative juridical method by studying and reviewing theories in the literature, namely by studying the legal basis in books. books and regulations related to research. The results of the analysis show that there are various problems from the unpreparedness of the creation of this OSS system, causing various kinds of speculation as well as the pros and cons of the government, which is aimed at accelerating and also increasing investment and business which is packaged in the form of electronic business licenses issued by the Ministry. or Institutions as well as local governments must be further developed, due to various revisions that are deemed necessary to improve the quality of this OSS system so that it can support the main goal of the publication of this OSS system.

Abstract

This research discusses the scope of prenuptial agreement enforcement and legal protection for the parties that involved in mixed marriages in the event of a cancellation of the prenuptial agreement. The research method used in this article is normative research with a statutory approach and a case approach, with a case study data collection technique, which produces secondary data made from primary, secondary and tertiary law. As well as using the theory of legal protection by Satjipto Rahardjo. The results article is a prenuptial agreement plays an important role in mixed marriages in protecting the rights of parties of mixed marriages. However, in the preparation of a prenuptial agreement, there are also conditions that must be fullfiled by the parties. If there has been an agreement, but it is not fulfill the requirement, then the prenuptial agreement can be canceled, in which the agreement will be assumed its never existed and the rules that were arranged will be returned to to the provisions before agreement was made

Abstract

Pertumbuhan ekonomi Indonesia terkontraksi 0,7% karena dipengaruhi oleh pandemi Covid-19, penelitian ini mengkaji potensi dan kontribusi perbankan syariah dalam meningkatkan kondisi perekonomian Indonesia pada masa pandemi. Sektor perbankan merupakan salah satu sektor yang sangat mempengaruhi laju pertumbuhan ekonomi suatu negara dan perbankan syariah berpotensi besar untuk berkembang lebih pesat di Indonesia. Penelitian ini menggunakan metode kualitatif dan pendekatan penelitian Hukum Normatif dengan menggunakan objek penelitian berupa objek data sekunder.  Hasil penelitian menunjukkan bahwa perbankan syariah mempunyai peran yang sangat penting dalam mendorong sektor pertumbuhan ekonomi di Indonesia. Secara historis, sistem ekonomi Islam merupakan sistem yang “kuat” dalam menghadapi goncangan ekonomi maupun kesulitan zaman dibandingkan sistem konvensional, kapitalis, atau sosialis. Hal ini dikarenakan Bank Syariah memiliki peran untuk memasyarakatkan praktik bagi hasil dan menghindari praktik riba (bunga). Perbankan syariah merupakan lembaga keuangan yang sehat dan tetap stabil bahkan ketika runtuhnya kurs mata uang. Di sisi lain, dengan disahkannya UUPS maka membuat para investor lebih percaya diri untuk menanamkan modalnya di perbankan syariah sehingga menambah arus investasi di Indonesia. Selain itu, upaya yang akan dilakukan oleh Bank Syariah dalam meningkatkan mutu perekonomian Indonesia adalah dengan mengalokasikan dana dari DPK pada sektor perekonomian dan memberikan dukungan permodalan terhadap sektor UMKM.

Abstract

This study investigates the normative inconsistency vis a vis the political rights of ex-corruption convicts and the principle of electoral integrity within the framework of Sustainable Development Goals (SDGs), particularly SDG 16, in Indonesia. The problem addressed centers on whether allowing individuals convicted of corruption to participate as election candidates aligns with democratic values and sustainable governance. While inclusivity is a key component of both democracy and SDG 16, this research critically examines the extent to which such inclusivity may conflict with the imperative of maintaining public trust and ethical standards in political leadership. Employing a normative legal research method supported by a statutory approach, the study analyzes Indonesian legal instruments. The research identifies a significant legal paradox: integrity is mandated for election officials but not for legislative or presidential candidates. This discrepancy raises critical questions regarding the consistency and credibility of Indonesia’s democratic processes. Findings indicate that allowing ex-corruption convicts to run for office undermines public confidence, hampers political regeneration, and dilutes the ethical foundation of electoral integrity. The analysis also reveals that an uncritical application of SDG 16 as a justification for political inclusivity may inadvertently legitimize impunity and erode democratic accountability. The study calls for urgent legal reforms to align candidacy requirements with broader democratic and developmental objectives. By reinforcing integrity as a universal qualification for public office, Indonesia can uphold the principles of justice, restore electoral legitimacy, and promote sustainable political development.

Abstract

Developments in various matters cannot be separated from the regulations attached to them, one of which is related to euthanasia. Euthanasia in general is a treatment given to a patient to end his life intentionally with the aim of escaping suffering. Euthanasia is divided into two types, namely active euthanasia and passive euthanasia. Until now, the act of euthanasia still has pros and cons, including in Indonesia. However, there are also countries that have legalized this, such as the Netherlands. This article will raise issues related to the positive legal regulation of euthanasia in Indonesia and the Netherlands as countries that have legalized euthanasia in terms of human rights and the Criminal Code. The research method is normative juridical research with a comparative approach. The results show that legal regulations related to euthanasia in Indonesia have not yet been specifically regulated even though the act of euthanasia is absolutely prohibited. From a criminal law perspective, the act of euthanasia is subject to Article 338 and Article 344 of the Criminal Code, the implementation of which still creates uncertainty. For families who submit euthanasia, Article 345 of the Criminal Code applies. Meanwhile, the Netherlands has had a law relating to euthanasia since 2001 which is followed by procedures and conditions for its implementation based on Dutch Penal Code 293 and 294 of Dutch law. The formation of regulations related to euthanasia is necessary in Indonesia if it needs to be hastened considering the progress of the times and the mindset of humans who know information easily and can find out about euthanasia

Abstract

The use of mineral gallons in Indonesia is something that is often found. Mineral water companies are also competing to innovate their products, both in terms of the composition of the existing mineral water and in terms of the product packaging itself. Then, a new innovation emerged, namely the use of GSP. Even though it is considered efficient enough to use, this innovation actually adds to the threat to the environment. That is why this research aims to find out the effectiveness and ineffectiveness of the enactment of environmental pollution legal regulations which discuss the activity of business actors in minimizing environmental pollution in Batam City. The type of research used in this writing is empirical research or what is usually called empirical legal research. Where secondary data is initial data as a data collection technique and primary data is complementary data obtained directly from the field. Environmental pollution caused by microplastics due to the use of single-use gallons does have a bad impact because plastic is waste that cannot simply be decomposed by natural processes, but this comes back to public awareness and firm decision making by legal stakeholders.
