Abstract

Terrorism as a universal threat to peace has been a huge problem specifically for Indonesia, threatening the fabrics of Indonesian society in collaboration with radicalism, which can reach even minors. To fight this, efforts to eradicate radicalization as an important factor in the spread of terrorism”™s influence should be supported with by adequate regulations. Using the normative legal research method, this research analyzes the reality of terrorism and its relation to the existing relevant legal framework in Indonesia. This research finds that terrorism has a wide grip on Indonesian society, especially the youth, due to the spread of radicalism and the weak normative structure surrounding the act of radicalization. Findings and analysis of this research argue that there are possibilities of using the restorative justice approach through the process of deradicalization, according to Indonesia”™s ideology, Pancasila.

Abstract

With the development of the times, fintech companies in Indonesia are increasingly popular and are also increasingly sought after by many people. One of the developments in fintech is the emergence of Sharia fintech. This study aims to analyze fintech crimes that occur from the perspective of jinayah law and to analyze relevant dispute resolution for fintech crimes from the perspective of jinayah law. In this study, the author uses a normative legal research method that uses qualitative analysis, namely by explaining the existing data with words or statements not with numbers. Sharia fintech has a difference with conventional fintech, namely sharia fintech is carried out in the contract process between business owners and investors. The emergence of sharia fintech provides convenience for the community to carry out a credit process using sharia principles and principles. But there is also a negative side, namely sharia fintech crimes such as fraud, fraud. Based on the results of the study, it shows that this sharia fintech crime when viewed from the perspective of jinayah law is included in the ta'zir crime, which if there is a violation the law enforcement is in accordance with the existing legislation in the fairest manner and carried out indiscriminately and discipline that actually carries out sanki ta'zir for sharia fintech crimes, which in essence contain benefits for human life both in the world and in the hereafter.

Abstract

Ships as collateral for mortgages in credit agreements are regulated in Articles 1162 to Article 1232 of the Civil Code and Shipping Law Number 17 of 2008. This departs from Indonesia's geographical conditions as a maritime country with important sea transportation, as well as its position in between the continents of Asia and Australia. Ships have two legal statuses, namely as movable and immovable objects. The Shipping Law states that the guarantee of a ship is determined by its region of registration, which is also linked to information about the ship and its owner in the national registration book. The nationality of the ship needs to be considered like other property rights. Banks are often hesitant to accept ship collateral due to the precautionary principle. However, the 2008 Shipping Law provides new hope for shipping entrepreneurs, even though many ships are not yet insured, making it difficult for banks to accept ships as credit collateral.

Abstract

The phenomenon of junk food is growing rapidly at this time. Although most junk food ultimately harms the health of consumers, buying and selling junk food is not illegal. As a general rule, both the seller and the buyer are free to determine the type, content and form of the contract. However, the existence of standard clauses as a means to facilitate sales transactions between producers and consumers has proven to be widely misused by sellers with standard clauses that are detrimental to consumers, such as "for take away food, an additional fee in the form of a takeaway charge is imposed." The application of the standard clause makes the seller has a stronger position and cause losses for the buyer. This type of research is normative legal research. The results show that basically the standard clause is not prohibited, as long as there are no elements that harm other parties. Provisions for the inclusion of standard clauses are regulated in Article 18 of the UU PERLINDUNGAN KONSUMEN. The advantage of using standard clauses in junk food agreements is that it gives consumers the benefits of time efficiency and equal service, but the disadvantage is that consumers do not have the opportunity to negotiate and decide on the contents of the contract, leaving only the choice of accept or leave. As a result, consumers become vulnerable, there is an imbalance of rights and obligations between economic actors and consumers, and consumers are more disadvantaged.

Abstract

Trademarks have played a significant role in safeguarding intellectual property within the fashion industry and have been instrumental in upholding the reputation of various companies, particularly those aspiring to adopt sustainability concepts. This research aims to delineate the legal challenges and potential solutions for protecting intellectual property rights related to trademarks and the integrity of claims for sustainability implementation in Indonesia, employing normative research methods and comparative analysis with Italy's legal framework. The analysis reveals several structural differences between Indonesia and Italy's trademark legal frameworks despite sharing similar objectives. Italy has already been able to foster the integrity of sustainable claims in the fashion industry through regulations from the European Union although no direct connection to trademarks exists. On the other hand, Indonesia has yet to regulate the integrity of sustainable claims in the fashion industry although it possesses a sufficient foundational framework that could be further developed through its connection to the communal intellectual property protection system. Secara tradisional, merek memiliki peran penting dalam melindungi kekayaan intelektual di dalam industri fesyen dan telah menjadi kunci dalam menjaga reputasi berbagai perusahaan, terutama yang berkeinginan menerapkan konsep keberlanjutan. Penelitian ini bertujuan untuk menguraikan tantangan hukum dan solusi potensial dalam melindungi hak kekayaan intelektual yang terkait dengan merek serta menjaga integritas klaim implementasi keberlanjutan di Indonesia, dengan menggunakan metode penelitian normatif dan analisis perbandingan dengan kerangka hukum Italia. Analisis ini mengungkapkan beberapa perbedaan struktural antara kerangka hukum merek di Indonesia dan Italia, meskipun memiliki tujuan yang serupa. Italia telah berhasil menggalang integritas klaim keberlanjutan di industri fesyen melalui regulasi dari Uni Eropa, meskipun tidak ada keterkaitan langsung dengan merek. Di sisi lain, Indonesia masih harus mengatur integritas klaim keberlanjutan di industri fesyen, meskipun memiliki landasan kerangka kerja yang memadai yang bisa lebih dikembangkan melalui keterhubungannya dengan sistem perlindungan kekayaan intelektual komunal.

Abstract

In the context of interfaith marriage, this study aims to investigate the differences in inheritance law regulations between Indonesian civil law and Islamic law. This study uses a normative juridical approach that combines conceptual, legislative, and comparative methodologies. The Civil Code, the Compilation of Islamic Law (KHI), and Supreme Court decisions are examples of primary legal materials; secondary legal elements are derived from literature and legal journals that are evaluated qualitatively. The findings show that, as long as it does not conflict with Article 838 of the Civil Code and allows for the use of wills, civil inheritance law does not view religious differences as an obstacle to inheritance. Islamic inheritance law, on the other hand, prohibits inheritance between people of different religions as stated in the KHI and hadith, but provides for a mandatory will as a substitute, with a maximum of one-third of the inheritance. To achieve legal certainty in Indonesia, this study finds that the wajibah will serves as a legal bridge to connect the principles of justice in Islamic law with the freedom to determine wills in civil law.

Abstract

This study examines the legal issues surrounding the falsification of BPOM (Food and Drug Authority) registration numbers on processed food products through a comparative study between Indonesia and Malaysia. The main problems analyzed concern the differences in regulatory approaches between the two countries and the need for legal lessons that Indonesia can adopt to strengthen its consumer protection system. The research employs a normative juridical method using a statutory and comparative approach, based on the analysis of legislation, academic literature, and relevant research findings. The results show that legal protection in Indonesia remains indirect, fragmented across various regulations, and primarily focuses on repressive rather than preventive measures. In contrast, Malaysia has implemented a digital supervision system, adopted the principle of strict liability, and established stronger law enforcement through the National Pharmaceutical Regulatory Agency (NPRA). Normatively, this study concludes that Indonesia needs to establish specific provisions regarding the falsification of distribution permits in BPOM regulations or the Food Law, strengthen BPOM’s authority as the sole supervisory institution, and adopt a digital monitoring system to achieve effective, preventive, and technology-adaptive consumer legal protection.

Abstract

The rapid growth of the skincare industry, particularly through the use of digital marketing, has contributed to the increasing prevalence of overclaim practices that have the potential to mislead consumers. This study aims to examine the forms of legal protection for consumers against overclaim practices in the skincare industry in Indonesia and the United States, as well as to analyze legal principles and mechanisms that can be adopted by Indonesia to strengthen its consumer protection system. This research employs a normative legal research method using statutory, conceptual, and comparative approaches, drawing on primary and secondary legal materials, including the Consumer Protection Law, BPOM regulations, as well as the Federal Food, Drug, and Cosmetic Act and the Modernization of Cosmetics Regulation Act (MoCRA) 2022 in the United States. The findings indicate that Indonesia’s consumer protection system remains largely reactive and administrative, as supervision and law enforcement are generally conducted after products have entered the market and violations have been identified. In contrast, the United States applies a preventive and evidence-based consumer protection framework through mandatory pre-market verification, the application of the principle of scientific accountability, and the support of transparency mechanisms and class action procedures, thereby providing more effective consumer protection. These findings are consistent with Philipus M. Hadjon’s Theory of Legal Protection, which emphasizes the importance of preventive legal protection to prevent consumer harm.

Abstract

Genetic engineering raises complex ethical and legal challenges, particularly in Indonesia, where intellectual property rights intersect with religious values. This research identifies the regulatory gap within Indonesian patent law, which lacks clear provisions for managing ethical concerns related to genetic engineering, including antitrust measures and scientific scrutiny. The study aims to explore whether the concept of Hisbah within Sharia can offer a normative framework to address these challenges while fostering scientific progress. Utilizing a normative legal research method, this study critically analyzes Law No. 13 of 2016 on Patents alongside Islamic legal doctrines. The findings reveal that, contrary to ultraconservative views, Hisbah encourages scientific advancements such as genetic engineering when aligned with societal welfare and ethical considerations, emphasizing that knowledge should contribute to the public good without enabling monopolistic practices. This research concludes that integrating Hisbah into Indonesia’s patent regulation can guide the ethical development of genetic engineering while respecting both the need for innovation and the values embedded in Indonesian society. It offers a significant perspective for policymakers to harmonize intellectual property law with Islamic principles, ensuring a balanced legal framework that safeguards public interest while promoting scientific progress.

Abstract

The development of digital technology has given rise to a new form of violence in the form of digital sexual violence, including deepfake pornoghraphy which has not been fully accommodated in the Indonesian legal system. This study aims to compare legal protection for victims of digital sexual violence in Indonesia and South Korea and to formulate strategies for strengthening regulations in Indonesia. The method used normative legal research, with a legislative, conceptual, case, and comparative approach, analyzing regulations and legal practices in both countries. The results show that Indonesia already has a legal basis through the TPKS Law, the ITE Law, and the Criminal Code, but does not yet specifically regulate forms of AI-Based DBV such as deepfake pornography. Implementation challenges include digital evidence, inter-agency coordination, and mechanisms for content removal. In contrast, South Korea has more responsive regulations, supported by specialized agencies focused on victim protection and recovery. The novelty of this research lies in its comparative analysis that focuses on institutional strengthening and technical mechanisms for handling digital sexual violence as concrete recommendations for legal reform in Indonesia.
