Abstract

In today's rapidly advancing technological era, safeguarding personal data is paramount in ensuring the privacy and security of individuals while preventing misuse or unauthorized access to their private information. As information technology and the internet continue to evolve, personal data has become a highly valuable asset for many companies and organizations. Threats to the security of personal data, such as irresponsible data dissemination in online lending operations, have the potential to lead to a host of serious issues, including identity theft, financial fraud, privacy breaches, and identity theft. The research method employed here is the normative legal research method. In Indonesia, the protection of personal data is governed by Law Number 27 of 2022 concerning Personal Data Protection. This law provides a crucial legal framework for safeguarding the privacy and security of citizens' personal information, with clear definitions and broad scope. Its aim is to protect individuals' rights related to the collection, use, processing, storage, and deletion of personal data by involved parties. The foundation of personal data protection regulation in Indonesia also rests on the principle that personal data protection is a fundamental human right that is inviolable, as recognized and respected by the 1945 Constitution of the Republic of Indonesia. The Personal Data Protection Law has established criminal sanctions for offenders, such as those involved in personal data theft or unauthorized data dissemination, with the hope of deterring such actions and upholding the privacy and security of individuals' personal data.

Abstract

Child marriage is a significant human rights issue as it deprives children around the world of their childhood, education, and safety. Its unfortunately a practice that still has prevalence in Indonesian society. This research is done for the purpose of analyzing the threat of child marriage and the urgency for a dedicated effort to tackle this issue normatively. Through the normative legal research method and supported by comparative analysis, this research analyzes how the Indonesian legal framework fare up to international human rights standards and best practices around the world, in tackling the practice of child marriage. Findings of this research suggest that child marriage can still be considered a neglected human rights abuse, due the minimum number of legal developments throughout the years. The findings expose the legal loophole and the lack of criminalization which can contribute to the prevalence of this dangerous phenomenon. This research serves the purpose of the betterment of human rights protection in Indonesia, specifically on vulnerable underage girls, by providing insights and recommendations that the government may consider for future legal development.

Abstract

The issue of abortion is currently still an actual discussion, both done in accordance with applicable regulations and done illegally, for example, women who are victims of rape.  The purpose of this study is to explain the discussion of Abortus Provocatus as a result of acts of rape based on human rights. Based on Law Number 17 of 2003 concerning Health and Law Number 39 of 1999 concerning Human Rights and the writing of this research article using normative research methods, using library materials as data to analyse the problems discussed in the preparation of this research article. Exceptions to abortion Article 60 paragraph (2) point c which provides relief for abortion for women who are victims of rape. This is also in line with Law No. 39/1999 on Human Rights abortion is only done to protect the life of the mother and child. The existence of regulations that legalise abortion is solely to fulfil the rights and freedom of the mother from psychological and social burdens and freedom in her life as a living being that has human rights

Abstract

A lot of major equity markets abroad have allowed the listing of the Dual-Class Share Structure (DCSS) corporations. DCSS is an agreement in which two types of shares are issued by the very same firm, with one type of share conferring greater power compared to the other. The Indonesian Stock Exchange only allows for limited access for DCSS technology-related corporations to list on its Mainboard. To remain attractive as Southeast Asia's top financial centre, Indonesia needs to alter its securities regulations while making its listing market adaptable to meet the needs of various enterprises. This research aims to analyse and elaborate on permitting DCSS corporations to go public and devise suitable governance safeguards to guarantee the highest possible standards of corporate governance are upheld. This research explores the legal certainty and applicability of DCSS in the Indonesian equity market and abroad, using a qualitative approach and thematic analysis of secondary data. The major finding of this research is the acceptance of DCSS adds to issues with abuse of power by the controlling shareholders, which was outweighed by their cash flow rights. While those in favour of DCSS argue that the existing shareholders' main reason for choosing a DCSS arrangement is to preserve company control. Most major exchanges in the world have taken action to accommodate DCSS going public, like those in the USA, Hong Kong, Singapore, and China. Considering the magnitude of the Asian market, Indonesia can emulate the accomplishments of other exchanges too. A series of recommendations are provided to guarantee the highest standards of corporate governance can be upheld, such as: permitting DCSS for new entrants and innovative businesses, regulating the ownership of enhanced voting shares, and setting out sunset provisions for DCSS arrangement.Keywords: Company Law, DCSS, Dual-Class Shares, Equity Market.

Abstract

Introduction: Religious diversity in Indonesia has led to the practice of interfaith marriages, resulting in legal uncertainty. On July 17, 2023, the Supreme Court issued Circular Letter No. 2 of 2023 (SEMA 2/2023) to provide guidance to judges on adjudicating requests for the registration of interfaith marriages.Purposes of the Research: This study aims to analyze the implementation of SEMA No. 2 of 2023 concerning the registration of interfaith marriages within the framework of Bhinneka Tunggal Ika in Indonesia.Methods of the Research: The legal research method used is normative/doctrinal, with a qualitative research approach that includes legislative analysis of relevant regulations and conceptual analysis using legal theories related to the study.Results of the Research: The study reveals that SEMA 2/2023 provides legal certainty consistent with Indonesia's religious diversity and the Bhinneka Tunggal Ika motto. However, some judges continue to approve requests for the registration of interfaith marriages even after the issuance of SEMA, as evidenced by Decision No. 423/Pdt.P/2023/PN Jkt.Utr dated August 8, 2023. Thus, SEMA 2/2023 is insufficient to address the legal uncertainty surrounding interfaith marriages in Indonesia, despite its alignment with the spirit of Bhinneka Tunggal Ika. Legal harmonization across various regulations is needed to achieve the desired legal certainty.

Teknik eksplorasi ini menggunakan strategi pemeriksaan yang teratur dan sah dengan strategi yang jelas. Pengaturan pemeriksaan halal adalah penelitian yang dilakukan dengan menganalisis perpustakaan (informasi tambahan) atau eksplorasi perpustakaan yang sah. Konsekuensi dari pemeriksaan ini menunjukkan bahwa pengungkapan data dalam kasus-kasus umum dapat dilakukan dengan mengaburkan informasi kepribadian individu. Pentingnya kamuflase atau penggelapan informasi individu sebagaimana diatur dalam “Peraturan Nomor 27 Tahun 2022” bertujuan untuk menjamin data informasi individu tidak mudah diakses oleh masyarakat luas. Dalam tinjauan para ilmuwan, tindakan eksekusi di pengadilan tingkat dasar tidak cukup mempertimbangkan pengaturan dalam “(Pilihan Pengadilan Tinggi) KMA Nomor 1-144/KMA/SK/I/2011.” Hal ini harus terlihat dalam salah satu kasus demonstrasi kriminal yang berkualitas etis, baik nama pelaku maupun korbannya masih diungkapkan secara gamblang dan tidak dikaburkan atau digelapkan dalam kerangka berpikir pilihan tersebut. Benturan standar terjadi dalam penggunaan “Pasal 15 ayat (1) huruf a Perpres No. 27 Tahun 2022”, lebih spesifiknya terdapat intrik-intrik negara yang berebut kepentingan perseorangan sehingga bisa dikatakan di dalam aturan tersebut terdapat potensi pemutusan hubungan kerja yang sah. poin, hak istimewa yang ditetapkan tidak bersifat langsung.

Abstract

Pariwisata berkelanjutan tidak hanya merupakan perubahan yang diperlukan di sektor pariwisata, namun juga merupakan tren yang dapat merevitalisasi sektor pariwisata yang terbelenggu pandemi dan permasalahan sosio-ekonomi dan lingkungan. Kekayaan intelektual berperan penting, khususnya dalam mendukung industri kreatif sebagai bagian tak terpisahkan dari sektor pariwisata. Penelitian ini dibuat untuk memetakan peran kekayaan intelektual terhadap kemajuan industri kreatif di tengah pengembangan pariwisata berkelanjutan. Dengan metode penelitian hukum normatif dan pendekatan komparatif, penelitian ini membandingkan kerangka hukum Indonesia dengan Filipina, serta kecakapan masing-masing sistem hukum untuk mendukung industri kreatif dalam pariwisata berkelanjutan. Analisis menemukan bahwa Filipina memiliki kerangka hukum pariwisata yang lebih baik, yang sudah sekaligus mengatur secara detail penerapan konsep keberlanjutan, serta dukungan terhadap industri kreatif. Namun, Indonesia memiliki kerangka hukum kekayaan intelektual yang lebih baik, khususnya mengenai kekayaan intelektual komunal, yang secara definitif diatur dan sesuai dengan norma-norma mendasar dari kerangka hukum pariwisata.

Abstract

Banking Credit is an agreement between a bank (creditor) and a borrower (debtor) that regulates the provision of loans by banks to customers. This agreement includes various terms and conditions that must be met by both parties, including the loan amount, interest rate, payment period, installment payment obligations, and the rights and obligations of each party. Examples of provisions often found in this agreement are the debtor's obligation to pay installments on time, provisions regarding late fees, and conditions governing the use of collateral in the form of assets that can be auctioned if the debtor fails to pay the debt. This research aims to discuss the rules related to banking credit agreements and the implementation of banking credit agreements, especially by banks, so that these agreements can be obeyed by debtors and run effectively. The method used in this research is the Empirical research method which uses data collection techniques through interviews. credit agreements use standard contracts that contain the rights and obligations of both parties. To mitigate the risk of default, collateral is required and can be sold if the debtor fails to pay. The principle of prudence is applied so that banks remain healthy and maintain public trust. An effective credit agreement involves analyzing the prospective debtor's eligibility, drafting a clear agreement, and monitoring the debtor's performance on an ongoing basis.Banking Credit Agreement is an agreement between a bank (creditor) and a borrower (debtor) that regulates the provision of loans by banks to customers. Abstract

Introduction: Legal protection of consumer in online buying and selling transactions is an urgency in today’s developments. Statistical data from National Consumer Protection Agency shows that from the beginning of 2024 until now receiving complaints from consumers is dominant of e-commerce field.Purposes of the Research: The purpose of this article is to examine the differences in consumer protection laws in online buying and selling transactions in Indonesia and Malaysia which are expected to be applied in Indonesia.Methods of the Research: The research method used in this research is normative legal research with a statutory approach and comparative approach with literature study.Results Originality of the Research: The results show that both Indonesia and Malaysia protect online buying and selling transactions. In dispute resolution, Malaysia’s TTPM and Indonesia’s BPSK provide final and binding decisions with an appeal mechanism to the courts. However, Indonesia lacks specific regulations for e-commerce, while Malaysia has comprehensive regulations and strong law enforcement. In Indonesia, the existing regulations and their enforcement face challenges, particularly in the context of e-commerce. The current UUPK is seen as ineffective, and it is hoped that the Indonesia government will amend it soon to strengthen the law enforcement and improve its effectiveness.

Abstract

Indonesia’s Anti-Money Laundering (AML) laws were originally designed to combat traditional financial crimes; however, the rise of virtual items in online gaming economies presents new challenges. This study aims to assess whether the current legal framework is equipped to address the use of virtual items in money laundering activities. Utilizing a normative legal research method and a statutory approach, the research draws on secondary data from Law No. 8 of 2010 on the Prevention and Eradication of Money Laundering, sourced from Indonesian legal databases. The data are analyzed descriptively to evaluate their relevance to digital economies. The findings reveal that while the AML Law provides a basic framework, it requires further development to specifically address the role of virtual assets and gaming platforms in money laundering. This study proposes legal reforms, including clearer definitions of virtual assets and amendments to impose liability on gaming developers, with the aim of enhancing Indonesia's regulatory framework to address emerging threats.
