Abstract

Over time, there has been a surge in interfaith marriages between men and women, which has led to a number of social and legal challenges. The Indonesian Conference on Religion and Peace (ICRP) registered 1,655 interfaith weddings from July 19, 2023, and 2005. The year 2023 has drawn significant attention, particularly after the South Jakarta District Court approved interfaith marriages by referring to Article 35, Letter A of Law No. 23 of 2006. Supreme Court Circular Letter No. 2 of 2023, which offers guidance for judges in making decisions pertaining to the registration of marriages between people of various faiths and beliefs, was issued by the Supreme Court in response to this circumstance.

Abstract

Law no. 3 of 2020 is predicted to be able to improve mineral and coal mining by integrating the concept of real participation in the community. In fact, the Minerba Law has sparked polemics on human rights issues. This research aims to find out what are the controversial regulations on the Human Rights of Indigenous Peoples contained in the Minerba Law and the community's efforts to fight for human rights contained in the Minerba Law. This research uses normative juridical methods, namely research starting from statutory regulations, books, scientific journals and websites. The results of the research are that there are several articles that have multiple interpretations regarding the rights of customary law communities which are detrimental to the community. This controversy has certainly drawn a response from the public whose efforts are to carry out a judicial review at the Constitutional Court. Constitutional Court Decision Number 37/PUU-XIX/2022 Revision of Law Number 4 of 2009 concerning Mineral and Coal Mining as partly amended by Law Number 11 of 2020 concerning Job Creation to the Constitution of the Republic of Indonesia seems to provide a wide path to oligarchic profit-seekers rather than paying attention to the welfare of the Indonesian people. Looking at the problems above, the role of regional government is a solution in making regional legal product policies that can provide solutions for empowering, fostering respect and protection of MHA as a subject of development.

Abstract

Perkawinan usia dini merupakan fenomena sosial yang banyak terjadi di berbagai wilayah Indonesia, maraknya perkawinan usia dini di kalangan sejoli millennial meresahkan masyarakat terhadap masih tingginya prevelensi perkawinan usia dini yang berdampak besar bagi anak yang melakukannya, seperti adanya kekerasan dalam rumah tangga, putusnya pendidikan anak, dampak kesehatan bagi anak wanita, dampak kehamilan atau kandungan dan pengaruh psikologi dan biologi anak. Posisi prinsipiil hukum negara mengutuk kebiasaan perkawinan usia dini, namun masih menyisahkan kontradiksi dan ruang untuk bermanuver di dalam hukum itu. Selain itu sistem pluralisme hukum di Indonesia mempengaruhi kebiasaan itu. Terkadang hukum adat dan hukum agama terkait polemik ini bertentangan dan mengesampingkan hukum negara, dalam hukum negara ditegaskan dalam UU Perkawinan, Perkawinan hanya dapat dilaksanakan jika usia perkawinan mencukupi sesuai dengan aturan hukum perkawinan, usia yang belum mencukupi usia perkawinan masih termasuk kategori sebagai anak, dalam UU Perlindungan Anak, Anak ialah yang tidak melebihi usia 18 tahun. Sedangkan akil balig adalah sebuah konsep dalam hukum Islam, yang sering kali dipakai untuk membolehkan perkawinan usia dini. Berbagai peraturan dan kebijakan diatas jelas menghadapi banyak tantangan dalam penegakannya yang menimbulkan banyak kontrakdiksi. Untuk menjawab permasalahan diatas penulis menggunakan jenis penelitian yuridis normatif atau metode penelitian kepustakaan.

Abstract

This article examines the application of substantive justice in court decisions related to social media fraud, focusing on Court Decision Number 63/Pid.Sus/2022/PN Btm. The rapid expansion of digital platforms, such as WhatsApp and Facebook, has led to a substantial rise in technology-based fraud cases, presenting significant new challenges for consumer protection in the digital era. In Indonesia, social media fraud falls under the Consumer Protection Law (UUPK) and the Electronic Information and Transactions Law (UU ITE), which provide general legal grounds but lack specific provisions to address the complexities of fraud on social media platforms. As a result, legal gaps arise, requiring judges to interpret laws in cases where existing regulations are limited or ambiguous. Using a normative juridical approach and case study analysis, this research highlights that applying substantive justice necessitates judicial consideration of both legal aspects and the social and emotional harm experienced by victims. The court ruling analyzed emphasizes the need for sentences that serve not only a punitive purpose but also educational and preventive functions, reinforcing public trust in digital transactions and deterring similar crimes in the future. This study underscores the importance of judicial discretion in interpreting laws to adapt to the unique challenges of social media fraud cases, including the wide-reaching impacts on victims’ lives and society. The findings point to an urgent need for updated regulatory frameworks, stronger enforcement mechanisms, and greater public awareness to protect consumers more effectively within the digital landscape, ensuring that legal protections evolve alongside rapidly advancing technology in society.

Abstract

Terrorism as a universal threat to peace has been a huge problem specifically for Indonesia, threatening the fabrics of Indonesian society in collaboration with radicalism, which can reach even minors. To fight this, efforts to eradicate radicalization as an important factor in the spread of terrorism”™s influence should be supported with by adequate regulations. Using the normative legal research method, this research analyzes the reality of terrorism and its relation to the existing relevant legal framework in Indonesia. This research finds that terrorism has a wide grip on Indonesian society, especially the youth, due to the spread of radicalism and the weak normative structure surrounding the act of radicalization. Findings and analysis of this research argue that there are possibilities of using the restorative justice approach through the process of deradicalization, according to Indonesia”™s ideology, Pancasila.

Abstract

With the development of the times, fintech companies in Indonesia are increasingly popular and are also increasingly sought after by many people. One of the developments in fintech is the emergence of Sharia fintech. This study aims to analyze fintech crimes that occur from the perspective of jinayah law and to analyze relevant dispute resolution for fintech crimes from the perspective of jinayah law. In this study, the author uses a normative legal research method that uses qualitative analysis, namely by explaining the existing data with words or statements not with numbers. Sharia fintech has a difference with conventional fintech, namely sharia fintech is carried out in the contract process between business owners and investors. The emergence of sharia fintech provides convenience for the community to carry out a credit process using sharia principles and principles. But there is also a negative side, namely sharia fintech crimes such as fraud, fraud. Based on the results of the study, it shows that this sharia fintech crime when viewed from the perspective of jinayah law is included in the ta'zir crime, which if there is a violation the law enforcement is in accordance with the existing legislation in the fairest manner and carried out indiscriminately and discipline that actually carries out sanki ta'zir for sharia fintech crimes, which in essence contain benefits for human life both in the world and in the hereafter.

Abstract

Ships as collateral for mortgages in credit agreements are regulated in Articles 1162 to Article 1232 of the Civil Code and Shipping Law Number 17 of 2008. This departs from Indonesia's geographical conditions as a maritime country with important sea transportation, as well as its position in between the continents of Asia and Australia. Ships have two legal statuses, namely as movable and immovable objects. The Shipping Law states that the guarantee of a ship is determined by its region of registration, which is also linked to information about the ship and its owner in the national registration book. The nationality of the ship needs to be considered like other property rights. Banks are often hesitant to accept ship collateral due to the precautionary principle. However, the 2008 Shipping Law provides new hope for shipping entrepreneurs, even though many ships are not yet insured, making it difficult for banks to accept ships as credit collateral.

Abstract

The phenomenon of junk food is growing rapidly at this time. Although most junk food ultimately harms the health of consumers, buying and selling junk food is not illegal. As a general rule, both the seller and the buyer are free to determine the type, content and form of the contract. However, the existence of standard clauses as a means to facilitate sales transactions between producers and consumers has proven to be widely misused by sellers with standard clauses that are detrimental to consumers, such as "for take away food, an additional fee in the form of a takeaway charge is imposed." The application of the standard clause makes the seller has a stronger position and cause losses for the buyer. This type of research is normative legal research. The results show that basically the standard clause is not prohibited, as long as there are no elements that harm other parties. Provisions for the inclusion of standard clauses are regulated in Article 18 of the UU PERLINDUNGAN KONSUMEN. The advantage of using standard clauses in junk food agreements is that it gives consumers the benefits of time efficiency and equal service, but the disadvantage is that consumers do not have the opportunity to negotiate and decide on the contents of the contract, leaving only the choice of accept or leave. As a result, consumers become vulnerable, there is an imbalance of rights and obligations between economic actors and consumers, and consumers are more disadvantaged.

Abstract

Trademarks have played a significant role in safeguarding intellectual property within the fashion industry and have been instrumental in upholding the reputation of various companies, particularly those aspiring to adopt sustainability concepts. This research aims to delineate the legal challenges and potential solutions for protecting intellectual property rights related to trademarks and the integrity of claims for sustainability implementation in Indonesia, employing normative research methods and comparative analysis with Italy's legal framework. The analysis reveals several structural differences between Indonesia and Italy's trademark legal frameworks despite sharing similar objectives. Italy has already been able to foster the integrity of sustainable claims in the fashion industry through regulations from the European Union although no direct connection to trademarks exists. On the other hand, Indonesia has yet to regulate the integrity of sustainable claims in the fashion industry although it possesses a sufficient foundational framework that could be further developed through its connection to the communal intellectual property protection system. Secara tradisional, merek memiliki peran penting dalam melindungi kekayaan intelektual di dalam industri fesyen dan telah menjadi kunci dalam menjaga reputasi berbagai perusahaan, terutama yang berkeinginan menerapkan konsep keberlanjutan. Penelitian ini bertujuan untuk menguraikan tantangan hukum dan solusi potensial dalam melindungi hak kekayaan intelektual yang terkait dengan merek serta menjaga integritas klaim implementasi keberlanjutan di Indonesia, dengan menggunakan metode penelitian normatif dan analisis perbandingan dengan kerangka hukum Italia. Analisis ini mengungkapkan beberapa perbedaan struktural antara kerangka hukum merek di Indonesia dan Italia, meskipun memiliki tujuan yang serupa. Italia telah berhasil menggalang integritas klaim keberlanjutan di industri fesyen melalui regulasi dari Uni Eropa, meskipun tidak ada keterkaitan langsung dengan merek. Di sisi lain, Indonesia masih harus mengatur integritas klaim keberlanjutan di industri fesyen, meskipun memiliki landasan kerangka kerja yang memadai yang bisa lebih dikembangkan melalui keterhubungannya dengan sistem perlindungan kekayaan intelektual komunal.

Abstract

Genetic engineering raises complex ethical and legal challenges, particularly in Indonesia, where intellectual property rights intersect with religious values. This research identifies the regulatory gap within Indonesian patent law, which lacks clear provisions for managing ethical concerns related to genetic engineering, including antitrust measures and scientific scrutiny. The study aims to explore whether the concept of Hisbah within Sharia can offer a normative framework to address these challenges while fostering scientific progress. Utilizing a normative legal research method, this study critically analyzes Law No. 13 of 2016 on Patents alongside Islamic legal doctrines. The findings reveal that, contrary to ultraconservative views, Hisbah encourages scientific advancements such as genetic engineering when aligned with societal welfare and ethical considerations, emphasizing that knowledge should contribute to the public good without enabling monopolistic practices. This research concludes that integrating Hisbah into Indonesia’s patent regulation can guide the ethical development of genetic engineering while respecting both the need for innovation and the values embedded in Indonesian society. It offers a significant perspective for policymakers to harmonize intellectual property law with Islamic principles, ensuring a balanced legal framework that safeguards public interest while promoting scientific progress.
