Abstract

Cattle farming in Bombana Regency is mostly practiced through grazing, which causes social problems in the form of livestock sometimes entering people's gardens and damaging crops. This incident is legally considered as an unlawful act by the livestock owner even though it is not done directly by the livestock owner. On this basis, we conducted research related to how the legal norms of unlawful acts of livestock owners, then how the responsibility of livestock owners and how the settlement of cases of crop destruction by livestock between livestock owners and crop owners. From the results of our research in Bombana Regency, Southeast Sulawesi, we found that in addition to the national legal framework of Articles 1365, 1366, and 1368 of the Indonesian Criminal Code, there are also norms in Regional Regulation No. 4/2017 on the Control of Livestock and the core provisions of the Regional Regulation relating to the obligation of compensation are found in Article 28 Paragraph 1 Letter a. In addition, we found that the responsibility of the owner of the livestock for damaging the crops is the responsibility of the owner of the livestock, In addition, we find that the responsibility for the destruction of crops by livestock is a tort, which is a responsibility due to fault so that the tort can strictly apply the norms mentioned above, the process of resolving cases between livestock owners and crop owners is resolved through non-litigation courts, both negotiation and mediation.

Abstract

Life has changed with the development of science and technology. One technology that has a significant impact is the technology of the Internet world, the Internet introduces people to the digital world. Of course, this development also affects the law, especially copyright law. Copyrighted works that were still in a traditional form can now be converted to a digital form or digital copyrighted works can be created. In this case, copyright law, which previously protected traditional forms of copyrighted works, must evolve to include the protection of digital copyrighted works, one of which is through cooperation with technology. This research is a normative study with a focus on how copyright law, which previously protected traditional forms of copyright, must evolve to include protection of digital copyrights, one of which is through cooperation with technology. This research is a normative research with a qualitative approach that is descriptive. As technology allows the conversion of copyrighted works into digital forms, there are advantages such as the easy distribution/notification of copyrighted works, but also the ease of infringement. In view of these developments, the WIPO has issued two international treaties known as the WIPO Internet Treaties. These treaties have been adopted by several countries. Indonesia in its positive copyright law has implemented the protection of digital copyrighted works in its articles. Our copyright law needs to be further enriched to protect digital copyrighted works as suggested by the author in this study

Abstract

Pertambangan di Indonesia dari berbagai riset telah menunjukan dampak positif diantaranya adalah sebagai lokomotif perekonomian yang secara langsung berkontribusi langsung pada peningkatan PDB, selain itu pada aspek ekonomi sektor riil berkontribusi terhadap peningkatan serapan tenaga kerja, peningkatan pendapatan, mempunyai multi efek player dengan meningkatkan usaha mikro masyarakat, namun disatu sisi riset yang lain menunjukan  dampak negatif terutama dampak lingkungan, konflik agraria, alih fungsi lahan dari pertanian menjadi kawasan eksploitasi pertambangan menyebabkan defisit  persediaan pangan. Khusus untuk permasalahan mitra pada pengabdian masyarakat ini karena terdapat protes warga soal kerusakan lingkungan, konflik horizontal antara masyarakat dan perusahaan, aktifitas ilegal memuat nikel tanpa memiliki syarat admininstrasi yang lengkap, untuk  itu kami melakukan pengabdian kepada masyarakat kiranya dengan informasi yang kami transformasikan masalah dapat diselesaikan oleh stake holders yang didaerah Lokasi mitra. Metode yang kami lakukan ialah metode pra pelaksanaan dan pelaksanaan; pra pelaksanaan dengan  memperhatikan base line visi misi fakultas hingga menentukan topik yang sesuai, kemudian melaksanakan observasi berita dan konfirmasi lapangan untuk memastikan urgensi kebutuhan mitra yang sesuai dengan topik, mengiventaris bahan materi lalu merumuskannnya hingga sistematis dan tersaji dengan baik, kemudian pelaksanaan  dilakukan dengan metode  service learning. Hasil dan pembahasan kami mengemukakan sumber hukum dan ketentuan inti pertambangan di Indonesia, tata kelola dan manejem lingkungan, penanganan konflik agraria, norma yang dapat diterapkan apabila perusahan badan hukum atau perorangan memuat nikel keatas kapal yang belum lengkap syarat admininstrasinya, layanan pengaduan masyarakat yang dapat diakomodir pemeritah daerah sesuai dengan norma undang-undang saat ini.

Abstract

The purpose of this research is to determine the role and responsibilities of legal aid institutions in trademark disputes in Indonesia. The method used is qualitative research, specifically normative legal research. The approach used is a legislative and conceptual approach. The data obtained indirectly from primary, secondary, and tertiary legal materials such as the 2016 Law No. 20, books, and legal research journals. The data collection to solve this problem is done through documentary or library research, using snowball sampling technique, by tracing legal regulations sources in the field of trademarks. After collecting the data, it is analyzed qualitatively. This technique involves studying legal materials or literature to provide an understanding of the research topic and help the writer draw accurate conclusions. The research findings conclude that legal aid institutions (LAI) play a strategic role in assisting individuals or groups, including businesses or other organizations, in resolving legal problems they face. LAIs can provide professional assistance in resolving trademark disputes, making the resolution process easier. In trademark disputes, LAIs can provide advocacy and assistance in the resolution process, including litigation or settlement outside the court. Thus, LAIs can ensure that the rights of parties involved in trademark disputes are protected and fulfilled in a professional and lawful manner.

Abstract

The practice of concurrent positions carried out by the Board of Directors in the management of a PT does not yet have a legal basis regulated explicitly in Law Number 40 of 2007 concerning Limited Liability Companies (UUPT). Concurrent positions lead to legal loopholes that can cause potential losses to the company. This research aims to analyze the practice's suitability with the law's provisions and compare it with policies in the United States. This research uses a normative method with conceptual and statutory approaches and secondary data from relevant regulations. The results show that concurrent positions can cause conflicts of interest, weaken management, and undermine corporate governance. Legislation changes are needed in Indonesia to limit the number of positions a director can hold and impose more severe sanctions for violators. In conclusion, a law revision is needed to strengthen the regulation of concurrent positions to promote better corporate governance.

Abstract

Mining in Indonesia is a vital sector that contributes significantly to the economy. However, current regulations still reveals a number of weaknesses that impact environmental sustainability and community welfare. These include weak law enforcement, lack of transparency and public participation at all stages of mining activities, inadequate mechanisms to ensure corporate social responsibility and environmental and post-mining reclamation, provisions that are not responsive to changing social and environmental conditions, further exacerbating the situation. This research uses a normative legal research method with an analytical approach to the provisions of laws and regulations based on facts obtained from secondary sources by paying attention to the credibility of these secondary sources. The main findings of the research reveal that environmental problems arise due to misalignment between mining laws and environmental laws. Environmental laws are not positioned as a command to mitigate the environmental impact of mining, and issues are further compounded by overlapping regulations on mining reclamation. The welfare of the community remains an unfulfilled promise, as environmental economic rights are increasingly eroded by the provisions in Article 162 of Law No. 3 of 2020. The rampant illegal mining activities further harm state finances, exacerbated by the absence of sophisticated infrastructure to monitor mining areas and potential sites in real time using satellite imagery. Additionally, inadequate distribution of corporate social responsibility (CSR) funds has left mining and affected areas without proper support, highlighting the urgent need for CSR regulations in the future be regulated at the legislative level. Furthermore, regulatory efforts to adopt green technology remain insufficient, with a lack of fiscal incentives and investment protection for companies committed to sustainable practices. The situation is further worsened by the lack of transparency in the mining sector, further exacerbates the situation as there is still no clear mechanism to ensure accountability or provide the public with access to crucial mining operation data. Based on the complex mining problems from multi-sectors, the regulatory reform framework must involve authorized government institutions and involve public participation in regulatory reform and the outcomes of the rules formed can accommodate the protection of public participation and protection of public rights in mining, respond to effective law enforcement and provide great contribution to the state, society, and global collaboration.

Abstract

Abstrak: Persamaan Medan Einstein Efektif Energi Rendah pada Model Dunia Brane dengan Medan Skalar Bulk. Penelitian ini adalah studi analitik untuk memperoleh persamaan medan Einstein efektif pada brane. Model yang digunakan dalam studi ini adalah model dunia brane dengan tambahan suku medan skalar pada bulk dan brane berdimensi . Persamaan medan Einstein brane diperoleh melalui pendekatan ekspansi gradient atau pendekatan limit energi rendah. Persamaan medan Einstein yang diperoleh memodifikasi persamaan medan Einstein dalam teori relativitas umum dengan suku tambahan yang diharapkan berprilaku sebagai energi gelap.

Abstract

The implementation of the life of the nation and state is inextricably tied to the divine values encapsulated in Pancasila and the Constitution. However, the current reality of Indonesia's diverse nation poses a challenge to these divine values. The absence of barriers between individuals, as exemplified by their interactions and the formation of families through marriage, has resulted in the dissolution of ethnic, cultural, and religious distinctions. Consequently, some couples entering into marriage no longer consider their ethnic and cultural background as a determining factor in their relationship.The purpose of this paper is twofold: first, it aims to analyse the views of Pancasila and the 1945 Constitution of the Republic of Indonesia on the phenomenon of interfaith marriages in Indonesia; second, it seeks to provide confirmation of the actual legal status of these marriages. In order to achieve this, this paper employs a normative legal research methodology, utilising both a statutory and conceptual approach in its investigation. From a conceptual standpoint, marriage encompasses not only its legal and private aspects, but also its religious aspects. Therefore, the state relinquishes its authority to determine the legitimacy of marriage to religious law, which, by its nature, discourages interfaith marriages. This paper concludes that Pancasila and the 1945 Constitution do not acknowledge the existence of interfaith marriages, as they are deemed incompatible with divine values. Accordingly, the judiciary should refrain from recognizing interfaith unions. To resolve legal disputes surrounding these unions, the Population Administration Act should be amended to repeal Article 35, Paragraph 1.

Abstract

Tujuan dari penelitian ini adalah untuk menilai bagaimana Indonesia menggabungkan prinsip-prinsip hukum digital internasional ke dalam konteks domestiknya, dengan fokus khusus pada e-commerce dan transaksi digital. Peneliti mengadopsi pendekatan normatif dan konseptual, memeriksa peraturan, hukum, kebijakan, literatur akademis, dan sumber hukum sekunder. Metode analisis dengan menggunakan perbandingan antara standar hukum internasional dan implementasinya di Indonesia, dan mempertimbangkan faktor sosial, ekonomi, dan budaya. Temuan menunjukkan komitmen Indonesia untuk mengintegrasikan standar hukum digital global ke dalam kerangka hukum lokal, sejalan dengan perjanjian ASEAN sambil mengakui keunikan nasional. Komitmen ini tercermin dalam pembentukan peraturan yang mendukung pengembangan ekonomi digital yang inklusif dan berkelanjutan. Namun, praktisi hukum dan pemain industri di Indonesia dihadapkan pada tantangan untuk terus beradaptasi dengan teknologi dan regulasi yang terus berkembang. Pendekatan proaktif ini memastikan kepatuhan terhadap standar saat ini dan masa depan, mempersiapkan mereka menghadapi tantangan yang akan datang.
