Abstract

Penolakan ahli waris terhadap harta warisan merupakan isu penting dalam sistem hukum Indonesia karena melibatkan pluralisme hukum antara Kitab Undang-Undang Hukum Perdata (KUHPerdata) dan hukum Islam. Fenomena ini sering menimbulkan sengketa keluarga akibat perbedaan interpretasi mengenai hak dan kewajiban ahli waris dalam proses pembagian harta. Penelitian ini bertujuan menganalisis persamaan dan perbedaan konsep penolakan waris menurut kedua sistem hukum serta implikasinya terhadap kepastian hukum dan keadilan. Pendekatan yang digunakan adalah yuridis normatif dengan analisis komparatif, memanfaatkan data sekunder berupa peraturan perundang-undangan, doktrin, jurnal ilmiah, dan publikasi internasional. Hasil penelitian menunjukkan bahwa dalam KUHPerdata, penolakan waris harus dilakukan melalui prosedur formal di pengadilan dan berdampak pada hilangnya hak atas seluruh bagian harta peninggalan, sedangkan dalam hukum Islam konsep takharuj menekankan musyawarah, kerelaan, dan kesepakatan bersama tanpa prosedur formal yang kaku. Temuan ini menegaskan pentingnya harmonisasi antara kedua sistem hukum untuk mewujudkan mekanisme pembagian harta waris yang lebih adil, inklusif, dan responsif terhadap keberagaman sosial

Abstract

Perkembangan teknologi medis memungkinkan pasangan dengan indikasi medis infertilitas untuk memiliki anak melalui penyewaan rahim wanita lain (surrogate mother). Akan tetapi, prosedur tersebut menimbulkan berbagai problematika seperti eksploitasi wanita dan anak, ketidakpastian hukum, pertentangan norma, hingga pengabaian hak-hak anak. Penelitian ini bertujuan untuk memaparkan perbedaan regulasi terkait surrogate mother di Indonesia dan India juga untuk mengatahui bagaimana kedudukan hukum dan hak waris anak yang dilahirkan melalui proses surogasi. Penelitian ini termasuk dalam penelitian hukum normatif yang  menggunakan pendekatan perundang-undangan, konseptual dan komparatif. Dari penelitian ini dapat disimpulkan bahwa berdasarkan hukum Indonesia, anak hasil surogasi memiliki hubungan hukum sebagai anak kandung surrogate mother,dan memiliki hak waris terhadapnya. Sebaliknya, menurut hukum India anak tersebut menjadi anak kandung dari intending couple, serta hak keperdataan lainnya seperti waris, nafkah, serta kewarganegaraan. Tidak adanya regulasi khusus terkait surrogate mother di Indonesia menyebabkan ketidakpastian hukum terhadap status anak dan merugikan hak keperdataan mereka. Oleh sebab itu, pemerintah diharapkan untuk menyusun regulasi terkait perlindungan hukum anak dari surrogate mother,serta edukasi bagi masyarakat terkait implikasi hukum anak dari surogasi.

Abstract

The professional zakat (income zakat) calculation system in Indonesia is stipulated by two authoritative sources: the Indonesian Ulema Council (Majelis Ulama Indonesia/MUI) Fatwa No. 3 of 2003, which states that professional zakat is calculated based on net income (after basic needs are deducted) annually; and the National Zakat Agency (Badan Amil Zakat Nasional/BAZNAS) Decree No. 1 of 2024, which stipulates that professional zakat is calculated based on gross income monthly and annually. This divergence presents a fundamental problem in the application of professional zakat in Indonesia. Therefore, this research aims to analyze the professional zakat calculation system from the perspective of both MUI and BAZNAS. This study employs an empirical-normative legal research method. Primary data were obtained through interviews, and secondary data were collected from primary, secondary, and tertiary legal materials, all analyzed qualitatively. The results indicate that professional zakat in Indonesia can be calculated from either net income (by deducting essential living expenses such as food, clothing, shelter, dependents’ needs including healthcare and education, and then paying 2.5% zakat if it reaches the nisab equivalent to 85 grams of gold annually), or from gross income (by paying 2.5% zakat at the time of income receipt, provided it meets the monthly nisab of IDR 6,859,349.00 or the annual nisab of IDR 82,312,725.00).

Abstract

Corruption is an extraordinary crime that often leaves unresolved legal consequences when the perpetrator dies before serving their sentence, raising the question of whether heirs are responsible for settling resulting state losses. This study employs normative legal research through literature review to examine the compatibility between Islamic inheritance principles and the civil liability imposed on heirs in such cases. The findings show that Islamic inheritance law recognizes heirs’ obligation to settle the deceased’s debts, including those from unlawful acts, but strictly within the limits of the inherited estate. Thus, while heirs can be held accountable for corruption-related debts, their liability is confined to the value of the assets they receive. This highlights the importance of integrating religious norms and positive law to ensure fair and effective recovery of state losses after the perpetrator’s death.

Abstract

This article describes the elements arranged in the Bojong dalung inscription born in the XVI-XVII centuries. By using the study of legal texts on the Dalung Bojong Inscription and the study of concepts in legal science, a hierarchy of regulatory systems in the form of values, principles, and legal acts was found. Values are the basis for the birth of principles and principles are the basis for the birth of legal acts explicitly contained in eleven articles. The values of divinity, humanity, nationality, democracy, and justice are the basis of values that give birth to the consensualist principle, the principle of equality, the principle of protection, the principle of legal certainty, the principle of territoriality, and the principle of personality. These six principles became the basis for the birth of legal acts in the form of Participation (Article 5), Crimes Against the Body; Quarreling or fighting among people (article 2), Inciting a struggle (article 3), Crimes against property; theft by force/robbery (article 4), theft (article 10) and Crimes of disturbing public safety; Article 6,7 and Article 10 on gambling, drinking intoxicating beverages.

Abstract

This study scrutinizes structural deficiencies in the governance of productive zakat distribution at BAZNAS Lampung Province, specifically focusing on the absence of empowerment-based distribution modules, mentorship practices that lack clear and measurable competency frameworks, and insufficient long-term monitoring mechanisms. Adopting a normative and empirical approach, the research derives data from in-depth interviews with amil and mustahik, complemented by an analysis of regulatory and institutional documents. Findings indicate that distribution remains predominantly administrative, mentorship lacks measurable competency indicators, and evaluation systems fail to capture sustained trajectories of mustahik business development. The novelty of this research lies in the formulation of an integrated module synthesizing legal perspectives, empowerment theory, and empirical practices to fortify zakat governance. The proposed module encompasses initial assessments, competency-based mentorship, and long-term performance evaluation systems. Theoretically, this study enriches the discourse on zakat governance; practically, it offers a replicable operational model to enhance accountability and mustahik self-reliance.

Abstract

Pelaksanaan perkawinan harus dilaksanakan sesuai dengan ketentuan hukum yang berlaku, salah satunya dengan memenuhi asas larangan perkawinan untuk perkawinan. Asas tersebut tidak hanya menjadi bagian dari syarat sahnya perkawinan, tetapi juga menjadi aspek penting dalam pertimbangan hakim ketika memutus perkara dispensasi kawin. Penelitian ini bertujuan untuk mengkaji makna asas larangan perkawinan dalam perspektif hukum Islam serta bagaimana penerapannya oleh hakim dalam kasus dispensasi kawin di Pengadilan Agama Tanjung Karang. Metode penelitian yang digunakan adalah hukum normatif-empiris dengan pendekatan deskriptif. Berdasarkan temuan, asas ini mencakup larangan tetap seperti nasab, radha'ah (persusuan), dan mushāharah (persemendaan). Sedangkan larangan sementara mencakup perkawinan dua saudara sekaligus, wanita dalam iddah, dan perbedaan agama. Dalam praktik, penerapan asas ini dilakukan melalui pemeriksaan identitas, verifikasi saksi, dan koordinasi dengan KUA serta pihak medis. Hakim juga mempertimbangkan kematangan fisik dan psikologis calon mempelai, khususnya dalam perkara dispensasi kawin, sebagai bentuk perluasan interpretasi asas.

Abstract

The polemic regarding interfaith marriage in indonesia reflects the tension between positive law, religious values and the principles of human rights (HAM) the marriage law explains that a marriage is valid if it is carried out in accordance with each religion, making it difficult for interfaith couples to legally marry. If we look at the universal declaration of human rights (DUHAM), it gives everyone the freedom to marry regardless og religion. In indonesia, religious views on interfaith marriage also vary, some religious prohibit it, while others allow it with certain conditions. These diffrences in rule and views cause confusion and legal uncertainty. Therefore, clearer and fairer rules are needed so that everyone’s right to marry can still be respected without ignoring existing religious values.

Abstract

The right to health, as a fundamental part of human rights, demands the commitment of the state to provide quality and equitable health services. Puskesmas, as the frontline, play a crucial role in accessibility and health system strengthening. However, the reality on the ground shows that there are challenges, such as damage to facilities and incomplete laboratories at several Puskesmas in Central Lampung District, including Puskesmas Wates. This problem raises a critical question: How is the relevance of fulfilling health service standards to the realization of strengthening primary health services at Puskesmas Wates Lampung Central. This research uses normative legal methods, with a statutory and analytical approach, examining primary, secondary, and tertiary legal materials. The focus is on reviewing the Decree of the Minister of Health Number HK.01.07/Menkes/1047/2024 on Equipment Standards. The results of the study are expected to identify the significance of the fulfillment of equipment standards in improving the quality of service and capacity of Puskesmas Wates, and provide policy recommendations for optimizing the strengthening of primary health services in the context of fulfilling the right to public health
