Abstract

Legal education is an important things for law enforcement in Indonesia becauselaw enforcers were born from a legal education. Nowadays in the law enforcementthere are many problems, one of which is the law enforcement that do not providea justice because law enforcer only became the implementer of law. Theseconditions make a law could not fulfill the needs of society. Law tend to be rigidand interpreted as a regulations, whereas according to Satjipto Rahardjo stated thatthe law qualities are determined by the ability to serve the society. Lawenforcement nowadays are inseparable from the legal education, where thestudents are taught with a variety of legal theories, judicial practices in severalcourses and internship. However, this is not able to result the graduates who areable to put a law to serve the society. In addition, the students tend to be begin bythe difference between theories and legal realities. Basically, there are legal aid oncampus that can be used as a means to solve these problems, but the existence oflegal aid cannot be utilized properly. Therefore clinical legal education throughdeveloping of legal aid are needed to solve these various problems. This paperdiscusses two main issues: the first, how are the urgency of clinical legal educationthrough developing of legal aid on campus? The second, how are theimplementation of clinical legal education through developing of legal aid oncampus? The results of this paper are: the first clinical legal education throughdeveloping of legal aid on campus is important to make the students understandthe society problems. Additionally after graduation, the students are expectedbecoming law enforcer who provide justice. Furthermore the graduates of the legaleducation are expected to enforce the law progressively based on the value ofjustice. The second, clinical legal education are implemented through the studentwith given more time to practice in the society so that the students know thevarious problems in society and compare with the legal theories. Furthermoreparadigm of the lecturer is also need to be changed with directed to give practicalcourses so that the students know the case directly in the society. Optimizing theexistence of legal aid on campus also become important things because it can beused to the students to provide services toward the society on campus. These waysare expected to the students who are able to practice in the society and makehumanist law.

Abstract

Undang-Undang Dasar Negara Republik Indonesia Tahun 1945 sebagai konstitusi negara mengamanahkan bumi, air dan kekayaan alam yang terkandung di dalamnya dikuasai oleh negara dan digunakan sebasar-besarnya untuk kemakmuran rakyat, hal tersebut seharrusnya menjadi pedoman bagi pemerintah dalam menyusun kebijakan mengenai pemanfaatan sumber daya alam. Akan tetapi muncul kasus Rosidi yang dinilai mencederai keadilan masyarakat dan membatasi maysraakt dalam mengakses hasil hutan. Hal tersebut menarik jika dihubungkan dengan kesiapan sistem hukum di Indonesia dalam menghadapi masyarakat ekonomi ASEAN.

Abstract

The 1945 Constitution of the Republic of Indonesia as the state constitution mandates the earth, water and natural resources contained in it to be controlled by the state and used as much as possible for the prosperity of the people, this should be a guideline for the government in formulating policies regarding the use of natural resources . However, the Rosidi case was deemed to have injured community justice and restricted access to forest products. This is interesting if related to the readiness of the legal system in Indonesia in dealing with the ASEAN economic community.

Abstract

The rapid development of information technology, especially related to the use of the internet, having a positive and negative impact. The negative impact of the use of technological developments and the spread of negative content encourages a non-criminal criminal policy through techno prevention. The use of various internet programs and applications that have been created by Kemenkominfo become one form of non-criminal policy through efforts to use techno prevention in overcoming the spread of negative content. Techno prevention forms include Internet Sehat dan Aman (INSAN), Internet Cerdas Kreatif dan Produktif (INCAKAP), software Whitelist Nusantara, Family Link application, YouTube Kids, Dinner Time, MamaBear, Bandwidth throttling, and a number of say no to hoax fanpage and discussion groups, Trend Micro Online Guardian, YouDiligence, Avira Social Network Protection and STOPit.  Pesatnya perkembangan teknologi informasi khususnya terkait dengan penggunaan internet selain memberikan dampak positif juga memberi dampak negatif. Dampak negatif dari penggunaan perkembangan teknologi dan adanya penyebaran konten negatif mendorong suatu kebijakan kriminal non penal melalui techno prevention. Penggunaan berbagai program dan aplikasi internet yang telah diciptakan oleh Kemenkominfo menjadi salah satu bentuk kebijakan kriminal non penal melalui upaya penggunaan techno prevention dalam penanggulangan penyebaran konten negatif. Bentuk techno prevention diantaranya, program Internet Sehat dan Aman (INSAN), Internet Cerdas Kreatif dan Produktif (INCAKAP), software Whitelist Nusantara, aplikasi Family Link, YouTube Kids, Dinner Time, MamaBear, Bandwidth throttling, dan sejumlah fanpage dan grup diskusi anti hoax, Trend Micro Online Guardian, YouDiligence, Avira Social Network Protection dan STOPit.

Abstract

Tujuan: menganalisis dan menjabarkan penerapan restorative justice di Indonesia khususnya terkait dalam proses penyelesaian perkara pidana. Penyelesaian perkara pidana melalui ADR berbasis restorative justice diharapkan dapat diatur secara lebih rinci dan tertata dalam KUHAP sebagai sumber hukum dalam beracara pidana di Indonesia. Metodologi: penelitian ini termasuk sebagai penelitian normative legal research dengan menggunakan pendekatan statute approach yang menelaah permasalahan yang akan dibahas menggunakan peraturan hukum berupa data sekunder (bahan hukum primer, sekunder dan tersier). Analisis dilakukan secara kualitatif dan pembahasan atas rumusan masalah menggunakan library research. Temuan: penyelesaian perkara pidana berbasis restorative justice di tingkat penyidikan dan penuntutan dapat mengurangi penumpukan perkara dan lebih mewujudkan keadilan sebagaimana diinginkan oleh para pihak (korban, pelaku dan lingkungan). Pemulihan para pihak yang berperkara ini berdasar pada Perkapolri Nomor 6 Tahun 2019 Tentang Penyidikan Tindak Pidana dan Perja Nomor 5 Tahun 2020 tentang Penghentian Penuntutan Berbasis Restorative Justice.  Kegunaan: Pemerintah perlu membuat payung hukum yang komprehensif untuk mengatur proses penyelesaian perkara pidana melalui Alternative Dispute Resolution (ADR) berbasis restorative justice secara lebih rinci dan tertata dalam KUHAP di Indonesia. Kebaruan/Orisinalitas: Dasar hukum terbaru dalam proses penyelesaian perkara pidana berdasar pada restorative justice yang dikaitkan dengan Perkapolri Nomor 6 Tahun 2019 tentang Penyidikan Tindak Pidana dan Peraturan Kejaksaan RI Nomor 15 Tahun 2020 tentang Penghentian Penuntutan berdasarkan keadilan restorative. Berdasar pada ketentuan tersebut akan dibahas lebih lanjut terkait proses penyelesaian perkara pidana berbasis restorative justice di tingkat penyidikan dan penuntutan.

Abstract

Penelitian ini bertujuan untuk menemukan harmonisasi antara Kitab Undang-Undang Hukum Pidana dan legal culture dalam penegakan pasal zina beserta permasalahannya. Metode yang digunakan adalah pendekatan yuridis normatif dengan jenis penelitian kualitatif. Meskipun sudah ada aturan hukum pidana positif yang mengatur terkait tindak pidana zina, namun belum bisa menampung semua permasalahan yang terjadi di Indonesia tentang zina. Aturan terkait zina yang belum bisa tertampung adalah aturan mengenai zina yang terjadi antara seorang laki-laki dan seorang perempuan yang tidak memiliki ikatan perkawinan dengan siapa pun. Sehingga guna menyelesaikan permasalahan yang ada dalam masyarakat, masyarakat menggunakan hukum adat yang mereka pegang teguh sebagai pedoman dan panduan dalam menjalankan kehidupan bermasyarakat, berbangsa dan bernegara. Dengan demikian, diperlukan suatu pembaharuan dalam hukum pidana guna menampung permasalahan-permasalahan yang terjadi di masyarakat yang tidak dapat terpenuhi oleh Kitab Undang-Undang Hukum Pidana yang berlaku saat ini.

Abstract

Tofu is a food that people are fond of and is recognized as healthy, nutritious and cheap cuisine. The tofu industry has been growing rapidly in Indonesia in the form of household scale businesses or MSME (Micro, Small and Medium Enterprises). On the other hand, tofu industry also has a negative impact to the environment due to its waste. The waste of tofu industry has high level of BOD and COD so that it becomes organic pollutant for groundwater and creates an unpleasant odor. Tofu components that potentially become liquid waste are the organic compounds such as protein (40-60)%, carbohydrates (25-50)%, and 10% fat. The largest component of tofu liquid waste is protein, which is 226.06 mg/L to 434.78 mg/L. This nutrient content allows tofu liquid waste to be processed into liquid organic fertilizer through a simple fermentation process. In this community service project, short training on processing tofu industrial liquid waste into liquid organic fertilizer has been conducted in Sumurrejo are, Semarang. To utilize this organic fertilizer for plant growing, an alley garden was also established in the village.

Abstract

Worthy children and women's Village/Sub-district is a village/sub-district development that brings together the commitment and resources of village/village government that involve the community and business world in the sub-district in order to promote, protect, Fulfilling and respecting the rights of children and women, which are planned consciously and sustainably. Some laws have been established to support the protection of children and women such as the Act of the Republic of Indonesia number 35 year 2014 about the amendment to law Number 23 year 2002 about protection Children and Law Number 23 year 2004 concerning the elimination of violence in households. In order to realize the child and women’s friendly villages, there are several efforts that can be done as the socialization of legal protection and community empowerment. Socialization programs not only provide information or knowledge but also supported by the empowerment of community that provides training and experience in the community. So that socialization tends to only provide information to be easier to understand by the community through the Community Empowerment program and increase public awareness to continue to actively participate in the realization of child and women’s friendly villages.

Abstract

Tingginya angka pernikahan usia anak, menunjukkan bahwa pemberdayaan law enforcement dalam hukum perkawinan masih rendah. Pernikahan dini merupakan permasalahan serius yang harus segera diberikan solusi, dan salah satunya adalah masyarakat harus paham dampak negatif dari pernikahan dini. Pernikahan dini hanya akan hanya akan berdampak negatif. Pernikahan dini rentan terjadap kekerasan dalam rumah tangga (KDRT), dengan perempuan sebagai korbannya.Penyadaran kepada orang tua bahwa pendidikan adalah hal yang sangat penting untuk membangun keluarga yang sehat dan berkualitas. Komitmen dari pemerintahan Desa Munding dan masyarakat khususnya Dusun Cemanggal dibutuhkan untuk mengutamakan pendidikan, seperti yang telah diamanatkan oleh undang-undang sehingga bisa menyiapkan pasangan suami istri yang lebih siap dan layak untuk menikah. Komitmen ini bisa diwujudkan dengan pembentukan peraturan desa mengenai batas minimal usia menikah di Desa Munding. Masalah-masalah yang ditimbulkan oleh pernikahan dini membutuhkan pendampingan melalui pembentukan Kelompok Masyarakat Sadar Hukum (KADARKUM). Pembentukan kadarkum diperlukan, bekerjsama dengan pos bantuan hukum melakukan kegiatan berupa pemberian informasi, sosialisasi aturan hukum, dokumen, konsultasi atau advise hukum maupun berupa pendampingan penanganan perkara.
