Abstract

The Kepulauan Bangka Belitung Province, Indonesia, is renowned for its extensive history of tin mining, a pivotal component of the local economy. Notably, this mining encompasses operations conducted by both corporate entities and individual community members, shaping the region's socio-economic landscape. This research seeks to investigate the multifaceted implications of community-led tin mining activities in Bangka Belitung. Employing a qualitative and socio-legal approach, the study underscores its significance in the acquisition of high-quality data derived from site visits, comprehensive surveys, and interviews with the diverse local community, encompassing various subsistence groups and socio-economic backgrounds. Our findings indicate that individual community mining activities have indeed contributed positively to the economic growth of the Kepulauan Bangka Belitung Province, particularly in the Bangka Regency. However, they also manifest negative repercussions in terms of illegal mining, which adversely affects state revenue due to unregistered taxpayers. Furthermore, these activities hinder human resource development and highlight a deficiency in the supervision of reclamation efforts undertaken by artisanal mining operators. Therefore, the study emphasizes the imperative for government intervention, focusing on community mining permits to enforce reclamation regulations and ensure sustainable, responsible mining practices.

Abstract

Internet or mobile banking is an application or service that connects a device to a banking system. Internet and mobile banking services have many benefits, especially facilitating transactions that only use electronic devices that have internet access. However, with such facilities there are also risks and threats to the users of the tenology services. In some cases, banks may experience digital service disruption caused by hacker attacks. Hacker attacks include cybercrime and violations of the law. Criminological theory can be used to enforce criminal law because it provides answers to the questions of how or why a person and certain behavior are considered evil by society. This study tries to explore criminological theories that can be used in cybercrime in cases of customer data leakage. With the method of juris-empirical research, the author hopes to study the criminological theory in cybercrime, so that the theory can be used to counter its crime in the case of customer data leakage. The conclusion of this study is that there are four criminological theories that can be used to analyze cybercrimes in hacker cases involving customer data leaks, namely: anomie theory, differential association, social control, and neutralization. This criminological theory can be used as a government strategy to take penal and non-penal policy steps against cybercrime in Indonesian banking.

Abstract

Keadilan retributif lebih cenderung menerapkan penderitaan penjeraan dan pencegahan, sedangkan keadilan restoratif menerapkan restitusi. Tujuan dilakukannya penelitian ini adalah untuk mengetahui bagaimana perspektif Utilitarianisme dalam memandang pengaturan restitusi terkait Tindak Pidana Kekerasan Seksual Di Indonesia. Metode penelitian yang digunakan adalah studi kepustakaan. Hasil yang didapat, bahwa Pengaturan restitusi dalam UU No 12 Tahun 2022 tentang Tindak Pidana Kekerasan Seksual merupakan suatu bentuk peralihan dari tujuan pemidanaan dari yang sebelumnya bersifat pembalasan (retributif) menjadi memulihkan ke keadaan semula (restoratif). Hal tersebut dipengaruhi oleh ajaran Bentham terkait the great happiness of the greatest number utamanya dalam kemungkinan adanya restitusi ketika pelaku dan korban tindak pidana kekerasan seksual berdamai. Hasil Penelitian menemukan bahwa seringkali ada ketimpangan relasi kuasa antara korban dan pelaku yang dapat mengakibatkan korban terpaksa berdamai. Sehingga ajaran Bentham terkait the great happiness of the greatest number yang harusnya aturan hukum memberikan rasa kebahagian yang besar pada masyarakat belum terpenuhi dalam UU No 12 Tahun 2022 tentang Tindak Pidana Kekerasan Seksual.

Abstract

Hukum acara pidana di Indonesia tidak mengatur korban untuk berperan aktif dalam proses peradilan pidana dan kedudukan korban diwakili oleh jaksa. Peran aktif korban dalam proses peradilan pidana bertujuan untuk menjamin korban dapat melindungi haknya. Pengabaian peran aktif korban dapat menyebabkan putusan hakim yang jauh dari keadilan. Tujuan tulisan ini adalah untuk mengetahui bagaimana pengaturan ideal dalam hukum acara pidana terkait dengan keikutsertaan korban dalam proses peradilan pidana. Jenis penelitian yang digunakan adalah penelitian doktrinal. Pendekatan yang digunakan adalah pendekatan perbandingan. Data dikumpulkan melalui studi pustaka, kemudian dianalisis secara kualitatif. Hasil penelitian menunjukkan bahwa hukum acara pidana di Rusia mengatur peran aktif korban dalam proses peradilan pidana. Korban dapat secara aktif terlibat dalam tindakan investigasi, mengusulkan penuntutan pribadi dan mendukung penuntutan, berpartisipasi dalam proses peradilan, dan mengajukan keberatan atas anggota hakim yang ditunjuk dalam persidangan. Korban, dalam hukum acara pidana Indonesia, hanya dijadikan sebagai saksi. Oleh karena itu, hukum acara pidana di Indonesia harus mengatur bagaimana korban dapat berperan aktif dalam proses peradilan pidana.

Abstract

The development of an area usually begins with improving public health. With healthy conditions, people will be able to carry out all activities well. The aim of this activity is to improve environmental sanitation and health in the Simpang Petai village community. With better sanitation and environmental health conditions, it is hoped that the community development program will be achieved. To find out the efforts of the government and local communities in dealing with sanitation problems in their environment. Community empowerment through environmental sanitation programs can involve education, active participation in waste management, and the construction of environmentally friendly sanitation facilities.

Abstract

Free, prior and informed consent (FPIC) is one of the principles that emerged from international declarations and conventions. Indonesia is a country that is active in several conventions and declarations. However, there is no recognition in national regulations that explicitly incorporates FPIC elements in their entirety. On the other hand, there is a prolonged conflict between indigenous communities and project initiators resulting from various kinds of problems. This article aims to conduct an analysis related to FPIC in regulations in Indonesia both at the national and regional levels. This research uses normative juridical methods using library materials as the main source. The results of this research are: First, FPIC has basically begun to be recognized in regulations at the central level. However, this recognition is still partial and implicit. Second, in regulations at the regional level such as Minahasa Regency, Bengkayang Regency and Central Sulawesi Province, several elements of FPIC have also begun to be absorbed and explicitly recognized. This is marked by the preparation of general guidelines for implementing FPIC in the form of a Regulation of the Governor of Central Sulawesi Province.

Abstract

Pendidikan Dasar sebagai Perintis terdepan dalam Penguatan Karakter Muslim memiliki keterkaitan dengan Pendidikan karakter. Penyelenggaraan Penguatan Pendidikan Karakter dilaksanakan dengan prinsip manajemen berbasis sekolah yang merupakan tanggung jawab kepala sekolah dan guru, sebagai pemenuhan beban kerja guru dan kepala sekolah (Pasal 6 ayat 3,4,5 PP 87/2017). Sesuai arahan presiden Joko Widodo bahwa pendidikan karakter pada jenjang pendidikan dasar mendapatkan porsi yang lebih besar dibandingkan pendidikan yang mengajarkan pengetahuan, untuk Sekolah Dasar sebesar 70 persen sedangkan untuk Sekolah Menengah Pertama sebesar 60 persen. Ketertarikan peneliti untuk mengkaji pendidikan karakter muslim didasari oleh adanya penurunan karakter siswa kelas tinggi dibanding karakter siswa kelas rendah. Fokus kajian utama penelitian ini adalah manajemen penguatan pendidikan karakter muslim di Sekolah Dasar yang meliputi  perencanaan, pelaksanaan dan evaluasi. Metode penelitian dengan menggunakan metode deskriptif kualitatif melalui kegiatan observasi, dokumentasi dan wawancara studi kasus di SDI Daarul Huda. Hasil penelitian ini diperoleh gambaran bahwa pertama, perencanaan penguatan pendidikan karakter siswa telah dilaksanakan dengan baik melalui penyusunan tujuan, strategi dan pemetaan kebijakan serta pemetaan  prosedur dan penyempurnaan program menggunakan rancangan RPP dan silabus; kedua, pelaksanaan  pendidikan karakter berjalan dengan baik melalui kegiatan kegiatan bersifat religius, penanaman nasionalisme,  peduli sosial dan kepedulian terhadap lingkungan; ketiga, evaluasi manajemen penguatan pendidikan karakter siswa melalui kegiatan pengawasan terhadap pelaksanaan kegiatan dengan melaksanakan refleksi, analisis dan rencana tindak lanjut.

Abstract

The realization of justice in a criminal process cannot be separated from the position of the victim in the criminal justice system. Victims as parties directly dealing with criminal acts certainly expect their rights and interests to be properly accommodated. This article is written based on a method of normative juridical research with a comparative approach in victim protection regulation in Russia and Indonesia. In the process of resolving criminal cases through the criminal justice system in Indonesia, the victim's interests are represented by the Public Prosecutor so that they do not have access to have their wishes heard further. Even though in Law Number 1 of 2023 concerning the Criminal Code, sentencing guidelines and purposes of sentencing have been regulated, which in this case requires the role of the victim and/or their family, and further regulation is needed in practice. This is of course very different from the position of the victim in the Criminal Procedural Code in Russia, which places the victim actively in the process of the criminal justice system. The presence of the prosecutor in court does not diminish the victim's right to fight for their rights, including by conducting private prosecution of the perpetrator in the form of material or immaterial compensation. To be able to realize the values contained in Pancasila which are not only as Grundnorm but also as Grundwerten, it is necessary to place this victim in the process of resolving criminal cases at every level in the criminal justice system

Abstract

This research is related to the reform of criminal law in Indonesia through community service order as an alternative to imprisonment. The type of research used in this study is normative legal research. The specifications used in this legal research are descriptive analytical, with a statute approach and a conceptual approach. The types of legal materials used in this research are primary and secondary legal materials. The method of collecting legal materials used by the author in this research is literature study. The method of legal material analysis conducted in this research uses qualitative analysis. The results of this research show that based on Law Number 1 of 2023 concerning the Criminal Code (KUHP), community service order is one of the main types of penalties that also serves as an alternative to short-term imprisonment, specifically for criminal offenses with a potential penalty of less than five years and where the judge imposes a maximum prison sentence of 6 (six) months. It also serves as a substitute for fines that do not exceed category II. This is an implementation of community service order to achieve the objectives of punishment and with the perspectives of justice and legal expediency.

Abstract

Masyarakat Suku Samin merupakan masyarakat adat yang mempunyai perilaku menyimpang dari tradisi masyarakat lain di Indonesia, seperti membangkang dan tidak patuh terhadap pemerintah. Keyakinan orang Samin dalam menjalani kehidupannya yang masih berpegang teguh terhadap nilai dan budaya mengakibatkan Suku Samin mempunyai karateristik yang berbeda dengan yang lain, termasuk dalam tata cara penyelesaian tindak pidana yang tidak menggunakan jalur pengadilan. Penelitian ini bertujuan: Pertama, menggambarkan mediasi penal yang selama ini dijalankan oleh masyarakat Suku Samin. Kedua, mendeskripsikan relevansi yuridis mediasi penal yang dilakukan oleh masyarakat Suku Samin. Metode yang digunakan dalam penelitian ini adalah yuridis sosiologis dengan pendekatan kualitatif serta sumber data primer dan sekunder. Sedangkan dalam menganalisis data penulis menggunakan teknik triangulasi yang digunakan untuk membandingkan hasil wawancara dengan isi suatu dokumen yang berkaitan dengan penelitian.  Hasil penelitian pertama, mediasi penal selama ini dijalankan oleh masyarakat Desa Klopoduwur terhadap semua jenis tindak pidana, baik tindak pidana yang terjadi di intern Suku Samin, maupun tindak pidana yang dilakukan oleh masyarakat pada umumnya dengan tata cara yang berbeda. Kedua, berdasar Pasal 42 ayat (2) dan ayat (3) RKUHAP (Rancangan Kitab Undang-Undang Hukum Acara Pidana) mediasi penal yang dilakukan dapat diakui akan tetapi hanya untuk beberapa tindak pidana seperti tercantum dalam Pasal 42 ayat (3) RKUHAP. Dalam RKUHP (Rancangan Kitab Undang-Undang Hukum Pidana) mediasi penal yang dilakukan di Desa Klopoduwur dapat dikualifikasikan dalam Pasal 145 jo Pasal 146 RKUHP. Tribal community of Samin are an indigenous community who have deviant behavior of the tradition from the other communities in Indonesia, such as insubordination and disobeying toward the government. Samin belief in living life that still cling to the values and culture resulted in Samin tribe has different characteristics with the others, including the procedures for the settlement of criminal offenses that do not use the courts procedures. This research aims to: The first, to describe the penal mediation used in Samin tribe. The second, to describe the relevance of the juridical-penal mediation conducted by Samin tribe. The method used in this research is juridical sociological with a qualitative approach as well as primary and secondary data sources. Meanwhile the authors analyzed data using triangulation techniques which used to compare the results of interviews with the contents of a document relating to this research. The results from this reseach are: the first penal mediation has been used by the community of Klopoduwur for all types of crime, both offenses occurred in internal Samin tribe, as well as criminal acts committed by the society in a manner that is different. The second, under article 42 paragraph (2) and (3) RKUHAP (Draft of Criminal Court Procedure) penal mediation conducted can be recognized but only to some of criminal offenses as listed in article 42 paragraph (3) RKUHAP. In RKUHP (Draft of Criminal Code) penal mediation conducted can be qualified at article 145 in conjunction with article 146 RKUHP.
