Abstract

Free, prior and informed consent (FPIC) is one of the principles that emerged from international declarations and conventions. Indonesia is a country that is active in several conventions and declarations. However, there is no recognition in national regulations that explicitly incorporates FPIC elements in their entirety. On the other hand, there is a prolonged conflict between indigenous communities and project initiators resulting from various kinds of problems. This article aims to conduct an analysis related to FPIC in regulations in Indonesia both at the national and regional levels. This research uses normative juridical methods using library materials as the main source. The results of this research are: First, FPIC has basically begun to be recognized in regulations at the central level. However, this recognition is still partial and implicit. Second, in regulations at the regional level such as Minahasa Regency, Bengkayang Regency and Central Sulawesi Province, several elements of FPIC have also begun to be absorbed and explicitly recognized. This is marked by the preparation of general guidelines for implementing FPIC in the form of a Regulation of the Governor of Central Sulawesi Province.

Abstract

Pendidikan Dasar sebagai Perintis terdepan dalam Penguatan Karakter Muslim memiliki keterkaitan dengan Pendidikan karakter. Penyelenggaraan Penguatan Pendidikan Karakter dilaksanakan dengan prinsip manajemen berbasis sekolah yang merupakan tanggung jawab kepala sekolah dan guru, sebagai pemenuhan beban kerja guru dan kepala sekolah (Pasal 6 ayat 3,4,5 PP 87/2017). Sesuai arahan presiden Joko Widodo bahwa pendidikan karakter pada jenjang pendidikan dasar mendapatkan porsi yang lebih besar dibandingkan pendidikan yang mengajarkan pengetahuan, untuk Sekolah Dasar sebesar 70 persen sedangkan untuk Sekolah Menengah Pertama sebesar 60 persen. Ketertarikan peneliti untuk mengkaji pendidikan karakter muslim didasari oleh adanya penurunan karakter siswa kelas tinggi dibanding karakter siswa kelas rendah. Fokus kajian utama penelitian ini adalah manajemen penguatan pendidikan karakter muslim di Sekolah Dasar yang meliputi  perencanaan, pelaksanaan dan evaluasi. Metode penelitian dengan menggunakan metode deskriptif kualitatif melalui kegiatan observasi, dokumentasi dan wawancara studi kasus di SDI Daarul Huda. Hasil penelitian ini diperoleh gambaran bahwa pertama, perencanaan penguatan pendidikan karakter siswa telah dilaksanakan dengan baik melalui penyusunan tujuan, strategi dan pemetaan kebijakan serta pemetaan  prosedur dan penyempurnaan program menggunakan rancangan RPP dan silabus; kedua, pelaksanaan  pendidikan karakter berjalan dengan baik melalui kegiatan kegiatan bersifat religius, penanaman nasionalisme,  peduli sosial dan kepedulian terhadap lingkungan; ketiga, evaluasi manajemen penguatan pendidikan karakter siswa melalui kegiatan pengawasan terhadap pelaksanaan kegiatan dengan melaksanakan refleksi, analisis dan rencana tindak lanjut.

Abstract

This research is related to the reform of criminal law in Indonesia through community service order as an alternative to imprisonment. The type of research used in this study is normative legal research. The specifications used in this legal research are descriptive analytical, with a statute approach and a conceptual approach. The types of legal materials used in this research are primary and secondary legal materials. The method of collecting legal materials used by the author in this research is literature study. The method of legal material analysis conducted in this research uses qualitative analysis. The results of this research show that based on Law Number 1 of 2023 concerning the Criminal Code (KUHP), community service order is one of the main types of penalties that also serves as an alternative to short-term imprisonment, specifically for criminal offenses with a potential penalty of less than five years and where the judge imposes a maximum prison sentence of 6 (six) months. It also serves as a substitute for fines that do not exceed category II. This is an implementation of community service order to achieve the objectives of punishment and with the perspectives of justice and legal expediency.

Abstract

Justice Collaborator, which refers to the cooperation between a non-primary perpetrator and law enforcement in uncovering organized crimes, is often used to expose cases of extraordinary crimes. The concept of a Justice Collaborator has become a topic of public discussion following the case involving the murder ordered by Ferdy Sambo, where Ferdy Sambo instructed Richard Eliezer to kill Jhosua Hutabarat. Richard Eliezer was found guilty by the court and was designated as a Justice Collaborator.

Abstract

Tujuan dalam penelitian ini adalah untuk mengetahui Hubungan Antara Kepercayaan Diri Dengan Kemampuan Interaksi Sosial Pada Siswa Kelas VIII di SMP Negeri 14 Semarang. Dalam penelitian ini peneliti menggunakan pendekatan berupa kuantitatif dengan jenis penelitian korelasional. Populasi dalam penelitian ini adalah siswa kelas VIII SMP Negeri 14 Semarang, yang berjumlah 298 siswa. Pengambilan Sampel dalam penelitian ini adalah menggunakan table isac dan miracle. Sehingga sampel yang digunakan dari populasi 298 siswa dengan tara kesalahan 5% yaitu 161.Hasil penelitian ini dapat disimpulkan bahwa kepercayaan diri dengan interaksi sosial memiliki hubungan yang sangat kuat. Hubungan kepercayaan diri dengan interaksi sosial memiliki hubungan yang positif. Artinya semakin tinggi kepercayaan diri maka semakin tinggi juga interaksi sosial dan sebaliknya semakin rendah kepercayaan diri maka semakin rendah perilaku interaksi sosial.

Abstract

Forest and land fires (Karhutla) pose a significant environmental threat in Indonesia, particularly in Palembang. Law No. 32 of 2009 on Environmental Protection and Management provides a framework for fire prevention and mitigation. This study evaluated the law's implementation effectiveness in addressing Karhutla in Palembang. A socio-legal approach was employed, utilizing primary data from interviews with key informants (government officials, law enforcement, community leaders, and residents affected by fires) and secondary data from legal documents, reports, and academic literature. Qualitative data analysis techniques were used to identify themes and patterns. The study revealed that Law No. 32 of 2009 has not been effectively implemented in Palembang. Weaknesses were identified in law enforcement, inter-agency coordination, resource allocation, and community engagement. While a clear legal framework and stakeholder support exist, implementation is hindered by limited resources, inadequate sanctions, and low public awareness. In conclusion, to improve Karhutla management, strengthening law enforcement, enhancing inter-agency coordination, increasing public legal awareness, and ensuring adequate resource allocation are crucial.

Abstract

Latar belakang: Hipertensi merupakan penyakit tidak menular yang masih sering ditemukan di pelayanan kesehatan dengan risiko morbiditas dan mortalitas. Hipertensi merupakan tekanan darah didalam arteri dengan angka normal berkisar antara 90 mmHg sampai 140 mmHg. Hipertensi dapat menyebabkan peningkatan risiko terhadap stroke, gagal jantung, dan kerusakan ginjal. Tujuan: untuk mengetahui tekanan darah dan mengajak masyarakat untuk melakukan upaya pencegahan dengan berolahraga senam. Metode: dilakukan pemeriksaan tekanan darah untuk mengetahui kategori hipertensi masyarakat. Setelah mengetahui kategori hipertensi masyarakat dilakukan senam bersama. Hasil: hasil pemeriksaan tekanan darah pada masyarakat termasuk dalam kategori hipertensi tingkat 1 dan hipertensi tingkat 2 sebanyak masing-masing 50% yang artinya perlu mendapatkan upaya pencegahan hipertensi. Kesimpulan: senam merupakan salah satu upaya pencegahan penyakit hipertensi. Kata kunci: hipertensi, senam, tekanan darah __________________________________________________________________________________ Abstract Background: Hypertension is a non-communicable disease that is still often found in health services with a risk of morbidity and mortality. Hypertension is blood pressure in the arteries with normal numbers ranging from 90 mmHg to 140 mmHg. Hypertension can lead to an increased risk of stroke, heart failure and kidney damage. Objective: To determine blood pressure and invite people to take preventive measures by exercising. Method: Blood pressure checks were carried out to determine the category of community hypertension. After knowing the category of hypertension, the community did gymnastics together. Result: The results of blood pressure checks-in the community are included in the category of level 1 hypertension and level 2 hypertension of 50% each, which means that it is necessary to get hypertension prevention efforts. Conclusion: Gymnastics is an effort to prevent hypertension. Keywords: hypertension, counseling, blood pressure

Abstract

Law enforcement is one of the many facets of society that have seen substantial changes as a result of the quick growth of digital technology, especially artificial intelligence (AI). The purpose of this study is to assess how electronic evidence is used in Indonesia's criminal justice system, pinpoint the difficulties encountered, and offer suggestions for enhancing the efficiency and equity of electronic evidence in the age of artificial intelligence. In line with the technological elements included in digital and criminal investigation research methodologies, this qualitative study aids in the creation of a theoretical framework for the use of electronic evidence in the setting of artificial intelligence. The results show that Indonesian law is now able to meet the needs of the digital age with its adaptation to technological advancements. Finding material truth in court proceedings is made possible by electronic evidence, which is legally acknowledged as a legitimate tool in criminal justice. To successfully address these issues and optimize the use of AI in the legal system, it is imperative to develop a strong ethical framework, improve law enforcement capacities, and update rules on a regular basis.

Abstract

Abstract The study seeks to examine the effect of Customer Experience, Personalization, Customer Engagement, and Online Customer Review on customer loyalty of Wardah cosmetics in Malang City. The study method use quantitative approach purposive sampling, resulting in 100 respondents who are TikTok users. The data collected were analyzed through linear regression, and hypothesis test performed through F and t test. The findings indicate that, simultaneously, Customer Experience, Personalization, Customer Engagement, and Online Customer Review significantly influence customer loyalty. Partially, each of these independent variables also has a significant impact on customer loyalty to Wardah cosmetics. These results suggest that a positive customer experience, personalized services, strong customer engagement, and favorable online customer reviews can enhance customer loyalty.. Keywords: Customer Experience, Personalization, Customer Engagement, Online Customer Review, Customer Loyalty.

Abstract

Difficulties in Learning English in EFL context are always interesting. Analysing it from the view of external and internal factors is the major interest of this case study. Describing the findings qualitatively is the purpose of this study. The subject in this research was the eleventh graders at SMAN 2 Sengah Temila in Landak Regency. There were 76 students participated in this study. The sources of the data were gathered from the classroom teacher, the students, and the portfolios. Data collection techniques in this research were: open-ended questionnaire, in-depth interview, and observation. Meanwhile, data analysis techniques used interactive analysis.This study finds the internal and the external factors affect the learning difficulties. The indicators on internal factors show (a) health conditions has no significant effect on learning difficulty, (b) the students interest and motivation affect the learning difficulty because no variation on the teaching method bored the students, (c) bad habits in studying evoke the learning difficulties. The indicators on external factors find (a) the teacher has a significant role to expand learning difficulties especially on the use of teaching method and media, (b) the classroom environment has no significant effect in learning difficulties since it is a conservative one.
