Abstract

Penelitian ini bertujuan untuk menganalisis pertanggungjawaban pidana terhadap pelaku malpraktik medik di RSUD Anutapura Palu dan menganalisis pertimbangan hakim dalam memutus perkara malpraktik medik dalam kasus putusan Nomor : 871K/Pid/2018. Metode penelitian yang digunakan adalah penelitian hukum normatif dengan menggunakan data lapangan sebagai fokus penelitian serta menggunakan perundang-undangan sebagai sumber data penelitian. Hasil penelitian menunjukan bahwa pertanggungjawaban pidana terhadap pelaku malpraktik medis di RSUD Anutapura Palu dengan mempertimbangkan aspek hukum dan praktik medis dengan analisis menyeluruh tentang standar perawatan medis, saksi ahli, dan dampak pada praktik medis. Analisis pertimbangan hakim dalam memutus perkara malpraktik medik dalam kasus putusan Nomor 871/Pid/2018 adalah adanya ketidakseimbangan dalam memberikan keadilan di mana hakim memberikan keadilan untuk terdakwa secara penuh dengan putusan bebas dalam perkara ini akan tetapi untuk korban tidak mendapatkan keadilan yang pasti. This study aims to analyze the criminal responsibility of the perpetrators of medical malpractice at Anutapura Regional General Hospital of Palu and analyze the Judge's consideration in deciding the medical malpractice case in the verdict case Number: 871K/Pid/2018. The research method used is normative legal research using field data as the focus of research and using legislation as a source of research data. The results showed that criminal liability for perpetrators of medical malpractice at Anutapura Palu Hospital by considering aspects of law and medical practice, where a thorough analysis of the standard of medical care, expert witnesses, and the impact on medical practice. And the analysis of the judge's consideration in deciding the medical malpractice case in verdict Number 871/Pid/2018 is that there is an imbalance in providing justice, where the judge provides justice for the defendant in full with an acquittal in this case but for the victim does not get certain justice.

Abstract

Penelitian ini bertujuan untuk mengetahui penyelesaian kasus tindak pidana pertambangan dengan restorative justice di wilayah Kepolisian Daerah Sulawesi Barat dan untuk mengetahui penghentian penyidikan perkara tindak pidana pertambangan di Kepolisian Daerah Sulawesi Barat. Metode penelitian yang digunakan adalah penelitian hukum normatif. Hasil penelitian menunjukkan bahwa penyelesaian kasus tindak pidana pertambangan dengan restorative justice di wilayah Kepolisian Daerah Sulawesi Barat yaitu penerapan restorative justice yang melibatkan proses dialog terstruktur antara para pihak yang terlibat, yang dipandu oleh seorang mediator atau fasilitator yang terlatih. Proses ini dirancang untuk memberikan kesempatan bagi korban untuk mengekspresikan rasa sakit dan kekecewaannya, sedangkan pelaku diberi kesempatan untuk mengakui kesalahan mereka dan melakukan tindakan untuk memperbaiki kerusakan yang telah terjadi. Proses restorative justice juga dapat melibatkan keluarga, teman, dan masyarakat yang terkena dampak dari konflik atau kejahatan. Beberapa keuntungan dari pendekatan restorative justice adalah bahwa pendekatan ini dapat menghasilkan solusi yang lebih memuaskan dan bermanfaat bagi semua pihak yang terlibat dalam suatu konflik atau kejahatan. Penghentian penyidikan perkara tindak pidana pertambangan di Kepolisian Daerah Sulawesi Barat oleh penyidik polri sesuai Pasal 30 Perkap Nomor 6 tahun 2019 tentang Manajemen Penyidikan Tindak Pidana diantaranya: 1) penghentian penyidikan dilakukan melalui gelar perkara; 2) penghentian penyidikan dapat dilakukan untuk memenuhi kepastian hukum, rasa keadilan, dan kemanfaatan hukum; dan 3) penghentian penyidikan dilaksanakan sesuai dengan ketentuan peraturan perundang-undangan. This research aims to find out the settlement of mining crime cases with restorative justice in the West Sulawesi Regional Police area and to find out the termination of investigation of mining crime cases in the West Sulawesi Regional Police. The research method used is normative law research. The research results show that the resolution of mining crime cases using restorative justice in the West Sulawesi Regional Police Area is the application of restorative justice which involves a structured dialogue process between the parties involved, guided by a trained mediator or facilitator. This process is designed to provide an opportunity for victims to express their pain and disappointment, while perpetrators are allowed to admit their mistakes and take action to repair the damage that has been done. The restorative justice process can also involve family, friends, and communities affected by conflict or crime. One of the advantages of a restorative justice approach is that this approach can produce a more satisfying and beneficial solution for all parties involved in a conflict or crime. Termination of investigation of mining crime cases in the West Sulawesi Regional Police by police investigators in accordance with Article 30 of Perkap Number 6 of 2019 concerning Criminal Investigation Management including: 1) termination of investigation is carried out through a case title; 2) termination of investigation can be carried out to fulfill legal certainty, a sense of justice, and legal expediency; and 3) termination of investigation is carried out in accordance with the provisions of laws and regulations.

Abstract

Penelitian ini bertujuan untuk mengetahui penerapan keadilan restoratif di Kepolisian Resor Polewali Mandar dalam menyelesaikan tindak pidana penggelapan dalam jabatan dari tahun 2022 hingga tahun 2023 serta faktor penghambatnya. Jenis penelitian ialah penelitian campuran normatif dan empiris. Pengumpulan data dilakukan melalui studi kepustakaan, wawancara, dan studi dokumen. Analisis data yang digunakan yaitu secara kualitatif kemudian disajikan secara deskriptif. Hasil penelitian menunjukkan penerapan keadilan restoratif dalam penyelesaian perkara pidana penggelapan dalam jabatan di Kepolisian Resor Polewali Mandar di tahun 2022 hingga tahun 2023 belum berjalan optimal diakibatkan penanganan kasus tahun 2022 terdapat 7 (tujuh) kasus dengan 6 (enam) kasus yang tidak berhasil diselesaikan dengan keadilan restoratif. Demikian pula pada tahun 2023 dari 4 (empat) kasus terdapat 3 (tiga) kasus yang tidak berhasil diselesaikan dengan keadilan restoratif. Faktor yang menjadi hambatan dalam penerapan keadilan restoratif guna menyelesaikan tindak pidana penggelapan dalam jabatan di Kepolisian Resor Polewali Mandar dari tahun 2022 hingga tahun 2023 dipengaruhi oleh (1) faktor internal berupa sumber daya manusia dan sosialisasi ke masyarakat; dan (2) faktor eksternal yaitu pelapor dan tersangka. This research aims to find out the application of restorative justice in the Polewali Mandar Resort Police in solving the crime of embezzlement in office from 2022 to 2023 and the inhibiting factors. The type of research is mixed normative and empirical research. Data collection is done through literature studies, interviews, and document studies. The data analysis used is qualitatively and then presented descriptively. The results showed that the application of restorative justice in solving criminal cases of embezzlement in positions at the Polman Resort Police from 2022 to 2023 has not run optimally due to the handling of cases in 2022 there were 7 (seven) cases with 6 (six) cases that were not successfully resolved with Restorative Justice. Similarly, in 2023 out of 4 (four) cases, 3 (three) cases cannot be successfully resolved with Restorative Justice. Factors that become obstacles in the application of Restorative Justice to solve embezzlement crimes in positions at the Polewali Mandar Resort Police from 2022 to 2023 are influenced by (1) internal factors in the form of human resources and socialization to the community; and (2) external factors i.e. the whistleblower and the suspect.

Abstract

This study aims to determine the enforcement of environmental criminal law and the legal responsibility of PT. Freeport Indonesia for the disposal of tailings waste in Mimika Regency. This research method is normative-empirical using primary data and secondary data. Primary data was obtained through interviews with related parties, namely the Mimika Resort Police, the Mimika Regency Environmental Service and Environmental Care Organizations. The results of the study indicate that the enforcement of environmental criminal law due to tailings waste pollution by PT. Freeport Indonesia has not been able to be implemented effectively. This is because the process of proving and determining the causal relationship between the act of pollution and the victim requires special experts and laboratories and the enforcement of environmental criminal law still relies on administrative sanctions. The application of criminal sanctions is still the ultimum remedium which is the last resort in its application. The legal responsibility of PT. Freeport Indonesia due to the disposal of tailings waste must be carried out in accordance with the provisions of laws and regulations as stipulated in Law Number 4 of 2009 concerning Minerals and Coal and Law Number 32 of 2009 concerning Environmental Protection and Management, regarding compensation for losses due to tailings waste pollution.

Abstract

Penelitian ini bertujuan untuk menganalisis penerapan justice collaborator dalam kewenangan penyidik di Direktorat Reserse Narkoba Kepolisian Daerah Sulawesi Selatan, serta untuk mengidentifikasi faktor-faktor yang memengaruhi penerapannya. Jenis penelitian yang digunakan adalah penelitian deskriptif dengan pendekatan yuridis-empiris, yang memadukan antara kajian normatif dan empiris. Pendekatan normatif digunakan untuk menelaah ketentuan hukum yang mengatur tentang justice collaborator sebagaimana tertuang dalam peraturan perundang-undangan yang berlaku, sedangkan pendekatan empiris digunakan untuk menggambarkan praktik kewenangan penyidik dalam menentukan dan menerapkan justice collaborator di lapangan. Sifat penelitian ini bersifat deskriptif dan preskriptif, yang bertujuan tidak hanya untuk menjelaskan kondisi faktual, tetapi juga memberikan rekomendasi normatif mengenai pelaksanaan kewenangan tersebut. Hasil penelitian menunjukkan bahwa penerapan justice collaborator oleh penyidik di Direktorat Reserse Narkoba Kepolisian Daerah Sulawesi Selatan memberikan kontribusi positif dalam pengungkapan jaringan peredaran narkotika, terutama dalam memperoleh informasi penting untuk menelusuri pelaku utama. Namun demikian, implementasinya masih menghadapi beberapa kendala, khususnya terkait perlindungan hukum bagi justice collaborator yang dinilai belum optimal. Di samping itu, regulasi yang mengatur mekanisme dan perlindungan bagi justice collaborator masih memerlukan penguatan agar dapat memberikan kepastian hukum yang jelas. Faktor-faktor yang memengaruhi penerapan justice collaborator meliputi faktor hukum, faktor penegak hukum, faktor sarana dan prasarana, faktor masyarakat, dan faktor kebudayaan. Keseluruhan faktor tersebut terbukti memiliki pengaruh yang signifikan terhadap efektivitas pelaksanaan justice collaborator oleh penyidik di Direktorat Reserse Narkoba Kepolisian Daerah Sulawesi Selatan. Berdasarkan temuan tersebut, direkomendasikan agar pengaturan mengenai perlindungan bagi justice collaborator diperkuat melalui revisi atau penambahan ketentuan khusus dalam Undang-Undang Nomor 13 Tahun 2006 tentang Perlindungan Saksi dan Korban, guna memberikan dasar hukum yang lebih jelas dan komprehensif terhadap kedudukan serta hak-hak justice collaborator dalam proses peradilan pidana. This study aims to analyze the application of justice collaborators within the authority of investigators at the Narcotics Investigation Directorate of the South Sulawesi Regional Police, and to identify factors that influence its application. The research design is descriptive, with a juridical-empirical approach that combines normative and empirical studies. The normative approach examines the legal provisions governing justice collaborators as stipulated in applicable laws and regulations, while the empirical approach describes investigators' practice in determining and implementing justice collaborators in the field. The nature of this research is descriptive and prescriptive, aiming not only to explain the factual conditions but also to provide normative recommendations for implementing this authority. The results of the study indicate that the application of justice collaborators by investigators at the Narcotics Investigation Directorate of the South Sulawesi Regional Police has made a positive contribution to uncovering narcotics distribution networks, especially by providing key information to trace the main perpetrators. However, its implementation still faces several obstacles, particularly regarding legal protection for justice collaborators, which is considered suboptimal. Furthermore, regulations governing the mechanisms for protecting justice collaborators still require strengthening to provide clear legal certainty. Factors influencing the implementation of justice collaborators include legal factors, law enforcement factors, facilities and infrastructure factors, community factors, and cultural factors. All of these factors have been shown to significantly influence the effectiveness of the implementation of justice collaborators by investigators at the Narcotics Investigation Directorate of the South Sulawesi Regional Police. Based on these findings, it is recommended that regulations regarding the protection of justice collaborators be strengthened through revisions or the addition of specific provisions in Law Number 13 of 2006 concerning Witness and Victim Protection, to provide a clearer and more comprehensive legal basis for the position and rights of justice collaborators in the criminal justice process.
