Abstract

Abstract - The covid-19 pandemic during 2020-2021 drove the economic uncertainty and stock retail investment in Indonesia. However, the stock retail transaction increased significantly during pandemic. The paper investigates the determinant factors of stock retail investor behaviour. Pandemic Covid-19 made people work from home and stay at home. Work from home with long hours at the computer made people interested in investing in the stock market. A high number of investors led by phenomenon referred to as herding by certain individuals or groups that are tempting to joint invest came from influencers or public figures. This study combines Theory Planned Behavior (TPB) and Technology Acceptance Model (TAM) to uncover the decision investment from retail investors. The novelty of the research is herding behavior as an antecedent of the decision. Online survey method is distributed through social media, email, and personal messages. The study is able to collect 116 respondents. The data will be analyzed using PLS – SEM. The research found that planned behavior does not significantly affect the investment behavior, while variables from TAM do significantly affect the investment decision. The study concludes that variables from TAM influenced the investment decision. The limitation is the herding behavior does not influence investor decision in stock market. The implication of the research is that retail investors are still interested in investing in stock. Technology indeed is an enabler for the stock trading process, although it seems investors prefer offline processes. Abstract

Gratitude therapy is a positive psychotherapy approach given to victims of sexual abuse to generate positive thinking by expressing gratitude to the environment, God and other people. This research aims to test gratitude intervention as a religious activity undertaken to reduce negative emotions in victims of sexual abuse. A total of 104 such victims were identified using the snowball sampling method who were divided into an experimental group (N=52) and a control group (N=52). They were diagnosed as having negative emotions based on the child Trauma Questionnaire Shot-Focus (CTQ-SF) and Gratitude Questioner-6 (GQ-6) with triple ANOVA data analysis. The study’s results demonstrate a significant influence of gratitude on negative emotion, with values of F(39,037) = 4.71, p < .01, and ηp2 = 0.113. It can increase feelings of gratitude and reduce negative emotions in victims of sexual abuse. Gratitude therapy helps reduce negative emotions and foster positive emotions amongst such victims. The study could be implemented in people who experience negative emotions related to clinical and non-clinical disorders.

Abstract

This study aims to analyze the juridical aspects of the threshold provisions in the Pilkada by referring to the decision. The research method used is a normative research method with a case approach that focuses on analyzing the Constitutional Court Decision Number 60/PUUXXII/2024. The results of the analysis show that the Constitutional Court's decision provides a new interpretation of the threshold provisions, which has the potential to affect the constitutional rights of political parties and independent candidates in the Pilkada contestation. The implication of this decision is a significant change in the regional head nomination mechanism in Indonesia. The General Elections Commission (KPU) revised KPU Regulation Number 8 of 2024 to KPU Regulation Number 10 of 2024 to adjust the nomination regulations with democratic principles and applicable laws. Thus, this decision ensures the legality of regional head candidacy and increases the value of democracy in the 2024 simultaneous regional elections in Indonesia.

Abstract

Introduction: Indonesia, as a state governed by the rule of law, upholds equality before the law and the protection of human rights as fundamental principles. However, the rapid development of digital technology has created new challenges, particularly the emergence of electronic sexual violence, which has raised significant public concern. Although Law Number: 12 of 2022 regulates such crimes, judicial practice reveals sentencing disparities that undermine legal certainty and victim protection.Purposes of the Research: This study aims to analyze the causes of judicial sentencing disparities in cases of electronic sexual violence and examine their implications for law enforcement in Indonesia. Methods of the Research: The research employs a normative juridical method with a library research approach. Data were collected from primary legal materials such as statutory regulations, secondary legal materials including literature, doctrines, and previous studies, as well as tertiary legal materials such as legal dictionaries and encyclopedias.Findings of the Research: The findings indicate the existence of disparities in three court decisions that applied similar provisions but resulted in significantly different sentences. Factors contributing to these disparities include differences in judicial interpretation, the application of individualized sentencing principles, and non-juridical considerations. Such disparities have serious implications, including diminished legal certainty, reduced deterrence for offenders, weakened victim protection, and declining public trust in the judiciary. Therefore, the establishment of consistent, transparent, and victim-oriented sentencing guidelines is essential to ensure substantive justice in Indonesia’s criminal justice system.
